CITY OFC,-WE CITY CLERKS OFFICE Landowner has demonstrated an attitude of disregard for zoning and land use by entering into a lease agreement for heavy industrial use in a RUT (rural urban transitional) zone. Furthermore landowner has disrespected neighbors by failing to properly notify prior to entering into said lease agreement and by allowing contractors currently leasing this property to operate all night in violation of Ada County noise & nuisance ordinances. Zoning and noise ordinances are enacted for the good of all citizens and those impacted the most by violations should not have to suffer for the convenience of a few others. CITY CLERKS OFFICE Sleep deprivation is rampant but more importantly often not understood. It is proven there is a definite connection between mind and body. Sleep is needed to rejuvenate certain parts of the body, especially the brain, so that it may continue to function optimally. After periods of extended wakefulness brain neurons may begin to malfunction, visibly effecting a person's behavior. Consequences of sleep deprivation: • Decreased productivity • Depression • Motor vehicle accidents and work related accidents Stressful circumstances interrupting life's daily routines can easily lead to sleep deprivation. Loss of sleep plays a significant role in employment attendance and performance. It also affects interpersonal and business relationships through distorted perceptions. Sleep loss frequently leads to hazardous driving as well as creating a decline in ones over all well being; both physically and emotionally. Unnecessary stress can be the cause of increased blood pressure, cholesterol, and cancer to name a few of many stress related illnesses. Emotional stress is often the cause of depression. Sleep deprivation can also cause psychoses which frequently lead to suicidal thoughts and occasionally, if untreated, ultimately suicide. Individuals experiencing severe depression related issues can end up being hospitalized and often face a lengthy recovery and occasionally suffering for the remainder of their lifespan. Had the annexation applicant done the right thing by following standard procedures for land use zoning it is most likely some of the damages the neighborhood has incurred could have been prevented. This omission alone demonstrates a lack of regard for society and their best interest. This misuse of land has created a situation the neighbors have to live with on a 24/7 basis, thus creating excess stress. Violation of Noise/Nuisance Code is an extremely serious issue which deserves serious consequences. The applicant's request for a Hearing Continuance is one more added stress factor to each affected resident in the neighborhood. Thank you for seriously considering my testimony. Nearly a year ago Knife River Construction and landowner James Jewett were told Ada County would not allow them to locate and operate a concrete batch plant on this parcel you are considering tonight. Without permits they went ahead and did exactly that as well as using this property as a staging area for stockpiling of materials. Ada County has miserably failed to enforce their own zoning ordinances as well as noise and nuisance ordinances. Quite a number of neighbors have been adversely affected by these operations at all hours of the day and night. Some of these neighbors declined to offer testimony in this hearing for fear of retaliation. On Mr. Jewett's annexation application he correctly lists the current zoning as "RUT". He also lists current land use as "vacant". While it is true that nobody lives on the property it is clearly not vacant. This is the hub of the I84 widening project. Why would the City of Meridian even consider accommodating a developer who flagrantly disregards zoning ordinances? Is the City prepared to enforce their ordinances or do they look the other way like Ada County does? If Mr. Jewett was prepared when he filed for annexation on Dec. 30 why did he have to request a continuance? I submit to you that this annexation process is a means of buying time while the unauthorized activities continue. It may be inevitable that this property will eventually become part of the City but I urge you to do the right thing now and deny this request so that Ada County Development Services can enforce their own Zoning ordinances.
