CITY CLERbCS OFFICE I IAN- I. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST The applicant, T. T. S. Development, LLC, has applied for a modification to the existing Development Agreement (NIDA) for Woodbridge. See Section 10 of the staff report for more information. II. SUMMARY RECOMMENDATION Staff is recommending approval of the DA modification as shown in Exhibit B.2. III. PROPOSED MOTION Approval After considering all staff, applicant and public testimony, I move to approve File Number MDA-09- 002, as presented in the staff report for the hearing date of March 3, 2009 with the following modifications: (Add any proposed modifications.) IV. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located at 385 S. Locust Grove Road, on the west side of Locust Grove Road, approximately '/a mile south of E. Franklin Road. The site is situated in the Northeast'/a of Section 18, Township 3 North, Range 1 East. B. Owner(s): T. T. S. Developments, LLC 745 N. Ralstin Meridian, ID 83642 C. Applicant: Same as owner D. Applicant's Statement/Justification: Please see applicant's narrative for this information. V. PROCESS FACTS A. The subject application is for a modification to the existing Development Agreement for this site. A public hearing is required before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5. B. Newspaper notifications published on: February 9, and 23, 2009 C. Radius notices mailed to properties within 300 feet on: February 6, 2009 D. Applicant posted notice on site by: February 19, 2009 VI. LAND USE A. Existing Land Use(s) and Zoning: There is an existing structure on this site that has been converted from a residence to an office. The site is zoned L-O. B. Character of Surrounding Area and Adjacent Land Use and Zoning: This site is currently surrounded by commercial, industrial, and existing & future residential uses. 1. North: Residential, zoned Rl (Ada County) 2. East: Residential, zoned Rl (Ada County) and R-15 3. South: Commercial uses, zoned C-G 4. West: Industrial uses, zoned I-L C. History of Previous Actions: • In 2000, the subject property was annexed (AZ-99-020) with an L-O zoning district as a pathway for annexation for the Woodbridge Subdivision located on the east side of N. Locust Grove Road. A Development Agreement was recorded (Instrument #100006603) for this site as part of the annexation that required conditional use permit approval of all future uses on the site. • In 2001, O'Neill Homes, LLC obtained conditional use permit (CUP-01-001) approval for conversion of an existing residence into an office. As conditions of approval of the CUP, the applicant was required to complete the following: 1) extend sanitary sewer and water to and through the site with any future development on the parcel, or after a period of 6 years, whichever came first; 2) construct a 25-foot wide buffer along Locust Grove beyond right-of- way; 3) construct a 20-foot wide buffer screen (60% solid) adjacent to the residential lot north of the subject property. (The double row of trees provided along the north side of the parking lot meets this requirement.); 4) construct a 5-foot wide perimeter buffer adjacent to the driveway and parking areas, with one tree per 351ineal feet; 5) construct a trash enclosure; and other items as described in the Findings of Fact and Conclusions of Law. Note: After the CUP was approved for an office, a Certificate of Zoning Compliance (CZC) was required to be submitted for the change in use of the site but one was never submitted. All required improvements were to be complete prior to obtaining a Cert~cate of Occupancy. Because the CUP was not commenced (sewer & water lines were not installed, occupancy was never granted, and the conditions of approval were not met) within the allowed 18 month time Woodbridge MDA-09-002 PAGE 2 period, and a time extension was not approved by Council, the CUP expired. Since the CUP was approved, the applicant states the developer of Woodbridge used the property as headquarters for the Woodbridge development, and then sold the property to a law firm who used the property as a law office. A CZC, nor Certificate of Occupancy, were obtained for these uses. Therefore, these uses operated illegally. The current owner (applicant) was made aware of the requirements when applying for a CZC. Staff and the applicant agreed that the DA modification was appropriate with regard to the CU requirement and that a compliance schedule should be included in any modified DA. D. Utilities: 1. Public Works: a. Location of sewer: Sewer service is stubbed to the property from Locust Grove Road. b. Location of water: Water service is stubbed to the property from Locust Grove Road. c. Issues or concerns: Timing of connection to City services. E. Physical Features: 1. Canals/Ditches Irrigation: NA 2. Hazards: Staff is not aware of any hazards that exist on this property. 3. Flood Plain: 'This site is not located within the floodplain or floodway. F. Access: One driveway access exists to/from the site to/from Locust Grove Road. No new access points are proposed or approved with this application. VII.. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the MDA file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS A. Analysis of Facts Leading to Staff Recommendation: The current DA is rather ambiguous in its intent. The more restrictive interpretation requires all uses to obtain CUP approval regardless of whether or not the use is a principal permitted use in the district. The least restrictive interpretation requires CUP approval only when required by ordinance. The applicant has requested extensive changes to the existing DA including a request to remove the requirement for CUP approval of future uses on the site. Staff is of the opinion that CUP approval should not be required for uses that are principal permitted uses in the L-O district and therefore supports this portion of the applicant's request. Further, Staff believes that the site should be required to be brought into compliance with current development standards and City utility polices. The City did not receive nor issue a Certificate of Zoning Compliance for any of the previous commercial uses on this site; the previous businesses and owners operated without obtaining Certificate of Occupancy for the structure from the City. Staff has included the applicant's proposed amended DA in Exhibit B.1 and Staff's recommended changes to the existing DA in Exhibit B.2 of this report. Staff is of the opinion that most of the changes proposed by the applicant are unnecessary and agrees in principal with the applicant's proposal for Section 4.1, however, Staff does not feel is necessary to specify uses as these are Woodbridge MDA-09-002 PAGE 3 governed by the UDC. Additionally, Staff has recommended other revisions to the existing DA provisions to ensure the site is brought up to current development standards. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY: 6.1 "Owner" shall develop the "Property" in accordance with the following special conditions: 6.1.1 In accordance with the provisions of Section 4 of this Agreement, which are adopted herein at reference as if set forth at length. 6.1.2 Sanitary sewer and water service shall be extended to and through this parcel within twelve months of the approval of the Development Agreement modification by City Council. The applicant shall submit a surety (letter of credit or cash). along with a bid. for 110% of the cost of installation of these improvements prior to issuance of the Certificate of Zoning Compliance. The Applicant shall coordinate routing and placement of lines with the Public Works Department. 6.2.3 The undeveloped portion of the property shall be mowed and kept free of weeds greater than 8" tall. 6.2.4 A Certificate of Zoning Compliance application shall be submitted to the Planning Department for the establishment of the proposed use. 6.2.5 Landscaping (i.e. street buffers, buffers to residential uses, parking lot landscaping, etc.) shall be installed on the site in accordance with the standards Woodbridge MDA-09-002 PAGE ] 6 listed in UDC 11-3B. Landscaping may be installed in phases over a period of eighteen months from the date of approval of the Development Agreement modification by City Council. A landscape plan, in compliance with current UDC standards, shall be submitted for review and approval with the Certificate of Zoning Compliance application.
