Preliminary Plat Approval of Devon Park Subdivision, Consisting of
Seventeen (17) Commercial Building Lots, and Two (2) "Other" Lots on
10.17 Acres in the R-40 and C-N Zones, by Fairview Lakes LLC. (File No.
PP-03-006).
We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered io full, unless eapreasly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, Fairview Lakes LLC, has applied for preliminary plat approval of a seventeen
(17) lot commercial subdivision on 10.17 acres of land, located on the north side of Fairview
Avenue, approximately'h smile west of Locust Grove.
This project was originally referred to as "Fairview Lakes" when it was approved as Planned
Development (File No. CUP-02-014). The conditional use permit for the Planned Development
has recently been revised by the City, upon the applicant's request, to reduce the number of
apartment units from 196 units to 92 units and to add up to 25 small office buildings in the place
of the eliminated apartmem buildings (File No. CUP-03-014).
The proposed Devon Park No. 2 preliminary plat encompasses approximately half of the small
office buildings that were added to the Fairview Lakes Planned Development and the apartment
complex.
LOCATION
The property is located on the north side of Fairview approximately a '/2 mile west of Locust
Grove Road.

SURROUNDING PROPERTIES
North: The Willows Subdivision, zoned R-8.
South: Commercial property, zoned C-G and R-8 (a car lot).
East: Settlers Village and a car wash, zoned CG and R 8.
West: A mobile home park and commercial property, zoned R-8 and C-G
PRELIMINARY PLAT FINDINGS AND REQUIREMENTS
Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed
subdivision, the Commission/Council shall consider the objectives of this title and at least the
following:
a. The conformance of the subdivision with the Comprehensive Development Plan;
Staff finds the subdivision to be in conformance with the City's adopted Comprehensive
Plan. The Future Land Use Map depicts the property as "Mixed Use Community" which
allows for the commercial and residential mix of uses previously approved within the
proposed subdivision.
The Comprehensive Plan encourages offices and high density housing (up to 40d.u./per
acre) to locate in the Mixed Use Community designation (pg. 98).
b. The availability of public services to accommodate the proposed development;
Staff finds that public services, including water, sewer, police, and fire, are available to
accommodate the proposed development.
c. The continuity of the proposed development with the capital improvement
program;
Staff finds that the subdivision will not require the expenditure of capital improvement
funds.
d. The public financial capability of supporting services for the proposed
development;
Staff finds that the development will not require major expenditure of public funds for
providing supporting services. The project is an infill project and services are already
available to this site
e. The other health, safety or environmental problems that may be brought to the
Commission's attention.

Staff finds that there should not be any other hea@h, safety or environmental problems
associated with this subdivision that may be brought to the Council or Commission's
attention that have not been addressed previously.
STTE SPECIFIC COMMENTS /PRELIMINARY PLAT
1. Sanitary sewer and water service to this site shall be via main line extension from the
existing mains adjacern to the property. Subdivision designer to coordinate main sizing
and routing with the Public Works Department.
2. The applicant has not indicated who will own and maintain the pressurized irrigation
system within this development. Please revise the plat to show how the system is going
to be served (ie connection to the existing Settlers Park Subdivision's system, or
independern pumping facilities) Underground year-round pressurized irrigation must be
provided to all lots within this development. The City of Meridian requires that
pressurized imgation systems be supplied by a year-round source of water. Applicant
shall be required to utilize any existing surface or well water for the primary source. If a
surface or well source is not available, asingle-poirn connection to the culinary water
system shall be required. If a single-point connection is utilized, the developer shall be
responsible for the payment of assessments for the common areas prior to signature on
the final plat by the Meridian Ciry Engineer.
3. Add or revise the following preliminary plat notes:
(10) Arty re-subdivision of this plat shall be in compliance with the most recently
droved subdivision standards of the Cit~ofMeridian.
(11 L The common lots within the subdivision shall be maintained by the Business
Owners Association.
(12.) All development within this subdivision shall be in accordance with Conditional
use Permit File No. CUP-03-014
(13.) Underground~ressurized irrigation within this development shall be provided
through a system to be owned and maintained bv ---------
4. Please submit all updated goundwater/soils monitoring data to the Public Works
Departrnent for review. The original study report indicates that shallow groundwater
may be a factor. All drainage areas (detention/retention basins) must be designed to
ensure that water is retained only during 100-year storm events, and for a period of time
not to exceed 24 hours. Side slopes within drainage areas shall not exceed 3:1. The
project engineer should pay close attention to the results of field studies determining the
groundwater, soil type & and characteristics during the design and construction phases.
The engineer shall be required to certify that the street centerline elevations are set a
minimum of 3-feet above the highest established normal groundwater elevation. This is

to ensure that the bottom elevation of the crawl spaces of homes is at least 1-foot above
groundwater.
5. Water held within the ponds shall be continuously circulated or shall be treated in another
manner to prevent the ponds from becoming stagnarn.
6. Applicarn shall revise the plat to correct the placement of the arrows depicting the 35'
wide landscape buffer so that they do not include 45' (the extra ten feet is aright-of--way
dedication).
7. A drainage plan designed by a State of Idaho licensed architect or engineer is required
and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking
areas. Storm water treatmem and disposal must be designed in accordance with
Departmern of Environmental Quality 1997 publication Catalog of Storm Water Best
Management Practices for Idaho Cities and Cournies and City of Meridian standazds and
policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which
has authority over the receiving stream provides written authorization prior to
development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.
8. Please submit a copy of the Ada County Street Name Committee's approval letter for the
subdivision name, and the lot and block numbering. Make any corrections necessary to
conform.
9. Coordinate fire hydrant placement with the City of Meridian Public Works Department
and the City of Meridian Fire Department.
10. 250-watt and 100-watt, high-pressure sodium streetlights will be required at locations
designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations aze at street intersections and/or fire hydrants.
Final design locations and quantity aze determined after power designs aze completed by
Idaho Power Company. The street light contractor shall obtain design and permit from
the Public Works Department prior commencing installations.
RECOMMENDATION
Staff recommends approval of the proposed preliminary plat and finds that it is in conformance
the revised Planned Developmern (File No. CUP-03-014) and the City's Subdivision Ordinance.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
Commercial occupancies will require afire-flow consistem with the Uniform Fire
Code to service the proposed project. Fire hydrants shall be placed an average of
400' apart. 1997 UFC Appendix III-A
2. The fire department requests that any future signalization installed as the resuh of
the developmem of this project be equipped with Opticom Sensors to ensure a safe
and efficient response by fire and emergency medical service vehicles. This cost of
this installation is to be borne by the developer.
3. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
4. Final Approval of the fire hydrarrt locations shall be by the Meridian Fire
Department. The proposed fire hydrant locations will be submitted to the Public
Works for plan review.
5. All roads and fire lanes shall have a turning radius of 28' inside and 48' outside.
6. Insure that all yet undeveloped pazcels are maintained free of combustible vegetation
per section 1103.2.4 of the Uniform Fire Code.
7. All access roads within the project shall have a clear driving surface with a minimum
width of 20' available at all times. The typical street width of 33' will be allowed to
have parking on both sides. The typical street with a minimum width of 29' will be
required to have restricted parking to only one side. UFC 902.2.2.1
8. Operational fire hydrants and temporary or permanent street signs are required before
combustible construction begins. UFC 901.4.2 & 901.3
9. The phasing plan may require that any roadway greater than 150' in length that is
not provided with an outlet shall be required to have a tum around.
10. The proposed 17-lot subdivision will have an unknown transient population and will
have an unknown impact on Meridian Fire Department call volume.

Dear Mr. Anderson:
Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
If you have any questions concerning this matter, please feel free to call on me at the District's
office, or John P. Anderson, at the District's shop.

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated prior to discharge to the
subsurface to prevent impact to ground water and surface water quality. The
engineers and architects involved with the design of this project should obtain
current best management practices for storm water disposal and design a
storm water management system that is preventing groundwater and surface
water degradation. Manuals that could be used for guidance are:

Idaho Cities and Counties.
