The following statements respond to specific items on the Conditional Use Application
Checklist:
13. A written description of the characteristics of the subject property that make a conditional.
use desirable.
The proposed development is located within [he northern region of the Neighborhood
.Center along N. Locust Grove Road. The subdivision is proposed with townhouses
within an R15 Zone adjacent to N. Locust Grove Road and single-family homes within
an R8 Zone for the balance of the property to the west. This is consistent with the
desirability for a variety a housing choices and housing arranged in a radiating pattern of
lessening densities as shown in the Neighborhood Center Concept shown in the current
Comprehensive Plan; namely, residential densities in excess of eight (8) dwelling units
per acre within the Neighbor Center Residential azea and medium density within a'/2 mile
of the Neighbor Center.
At approximately 11.3 acres, the property is lazge enough to accommodate the proposed
development, including lot size, open space, parking and landscaping. The proposed
development is also based on, and therefore harmonious with, the current Comprehensive
Plan as it relates to development in and around a Neighborhood Center. As the subject
property is bounded on two sides by the Havasu Creek residential subdivision, it is
compatible with the surrounding land use.
The proposed development will extend city services constructed for the Havasu Creek
Subdivision. The water system will be constructed to provide additional looping for the
surrounding system. At present, the applicant is proposing utilizing the "regional"
pressure irrigation system that we understand is proposed for the Havasu Creek
Subdivision. The roadway system within the proposed development extends stub streets

proposed with the Havasu Creek Subdivision. To facilitate future development, the
applicant is proposing extending North Heritage Woods Ave through the development
and stubbing the roadway to the smaller parcel to the south. This will help to improve
vehicular and pedestrian circulation through neighborhood connectivity and promote a
sense of community. Curb, gutter and sidewalks are proposed throughout the single-
family development. During the conceptual phase of the project, the applicant met with
ACRD Development Services staff. The roadway network is in conformance with the
comments provided by ACHD staff.
The proposed subdivision provides for two main housing types, single family detached
dwellings and townhouses. The townhouses will provide an opportunity for both entry-
level home ownership and rental units. Thus, the development will help to ensure a range
of affordable housing opportunities within the City.
Within the townhouse community, the applicant is proposing an open space area of 0.52
acres (1.1.44~n), which will serve, in part, as a drainage facility and additional buffer to N.
Locust Grove Road. The applicant is proposing to build a gazebo in this area and also
provide picnic tables as an amenity.
The common lot adjacent to N. Heritage Green Way will serve as a drainage facility and
a sand volleyball lot. The location is in response to staff comments received early in the
concept phase of the project to locate our storm water detention facility adjacent to the
one provided for Havasu Creek Subdivision, if possible. The applicant envisions the
CC&R's requiring either a 4' fence height or a non-view obstructing fence along the rear
lot lines. Property owners would be allowed a gate directly to the area for ease of access
to the sand volleyball amenity. The sand will help to ensure the bottom of the facility
drains well and the area is usable shortly after a rain event
In the townhouse community, five additional visitor parking spaces are provided above
the two parking spaces per unit.

Additional Considerations:
The engineer has met with Bill Gregory at SSC and Joe Silva. at the Fire Department on
Apri14, 2003. Comments received have been incorporated into the Preliminary Plat.
Individual trash receptacles in the townhouse community is preferable to SSC versus a
dumpster, which would require a commercial front-end-loading garbage truck. A 2S
drive aisle in the townhouse community is acceptable to the Fire Department with no
parking in the drive aisles. We wIll provide two signs in the community indicating "No
Pazking" per the standazd received from the Fire Department.
