Simplot Co.) RE: CPA-08-013, Mixed Use -Non Residential Text Agenda Item for February 19, 2009 P & Z Commission Staff is requesting a change to the recommendation given in the staff report for CPA-08- 014, Mixed Use -Non Residential Text. After reviewing the letter dated February 12, 2009 from Vic Conrad, J.R. Simplot Company and meeting with Vic, staff believes we have improved comprehensive plan language that will work better for guiding development in this area. The current language for the Mixed Use-Waste Water Treatment Plant (MU- WWTP) in the comprehensive plan lists the following standards for this category: Light, professional office uses, Flex spaces uses, including light warehousing, No new residential uses will be permitted (existing residential will be allowed to remain and expand accessory structures), Limited, small-scale retail uses, Mini-storage uses, unless otherwise permitted by City-adopted incentives, all developments within this designated area will require approval through the Conditional Use Permit process. Rather than simply changing the name from Mixed Use -Waste Water Treatment to Mixed Use -Non Residential as currently proposed in the staff report, Staff is now recommending that the text for the proposed Mixed Use -Non Residential (MU-NR) designation incorporate some of the existing comprehensive plan language from the Mixed Use - Regional, the Mixed Use -Waste Water Treatment Plant (proposed to be called Mixed Use -Non Residential), and text from the Simplot letter as shown below: Chapter 7, page 103 -Mixed Us° "~ n--.r:,~ Non Residential. The purpose of this cate~ory is to desiffiate areas where new residential dwelling units will not be permitted, as residential uses are not compatible with the planned uses for this area. A wide variety of non-residential land uses may occur in this cate~ory. Employment opportunities, professional offices. warehousing, flex buildings, and storage uses as well as retail uses are envisioned. Staff believes the changes listed in this memo better represent the intent of the proposed Mixed Use -Non Residential (MU-NR) designation; the changes allow greater flexibility for future development than the previous language, while still prohibiting new residential dwellings in areas with the MU-NR designation. The changes requested also state the purpose for this designation and by removing the requirement for a Conditional Use Permit for all uses, it is clear that one is not required unless required by city code. Staff requests that when the Commission makes a motion to approve CPA-08-013, the motion includes acceptance of the modifications noted in this memo which will delete the current standards (text) for the Mixed Use-WWTP, listed in Chapter 7, page 103, of the comprehensive plan and replace it with the proposed standards for Mixed Use -Non Residential listed herein.
