RE: Ada County Code Violation - Assessor's Parcel S1214336330, addressed as 1520 S. Ten
Mile Rd., Meridian & Assessor's Parcel S1214336320, unaddressed - Concrete Batch
Plant/Construction Staging/Contractor's Yard in RUT District
Dear Sirs,
Ada County has received and investigated complaints from the public concerning the
operation of a concrete batch plant and construction staging/contractor's yard at the referenced
address. Table 8-2B-1 in Section 8-2B-3, Ada County Code prohibits these land uses within
residential districts. The RUT district is a residential district. The County has the responsibility
to enforce this code.
By way of history, Concrete Placing Company, Inc., a sub -contractor to Knife River
Corporation on the I-84 widening/reconstruction project between the Garrity and Meridian
interchanges, attended a pre -application conference with County staff on May 27, 2008 to
that this
discuss potential locations for their batch plant They were advised at the meeting use
was not an allowed use on parcels residing in the RUT district. Further, they were given some
options; approach the City of Meridian for annexation and rezone, to look for a property with
an industrial zoning designation elsewhere in the County or within the Meridian city limits,
contact a gravel pit owner as a batch plant could be considered accessory to an approved
conditional use, or to propose a zoning ordinance amendment to allow the use within
residential districts. This was the last contact the County had with Concrete Placing Company,
Inc. prior to December 10, 2008.
The County has been made aware that a contract was entered into between the land owner,
James L. Jewett (and subsequently, ECK Family Limited Partnership) and Knife River
Corporation for use of the land in question. Further, the contract stipulates that an application
for annexation to the City of Meridian was required. To date, an application for annexation has
not been submitted to the City. Kzufe River Corporation has been advised of their options;
secure annexation to the City of Meridian and comply with the City's standards regulating the
uses or relocate to an appropriate site.
At this time, Ada County is prepared to move forward with Code Enforcement actions. As
such, Knife River Corporation must provide to the County evidence of an application for
annexation to the City of Meridian prior to December 31, 2008. Should evidence not be
provided, Knife River Corporation will cease all operations on the referenced properties until
such time as an application is submitted. Further, should the City of Meridian elect to deny an
application for annexation, Knife River Corporation will cease all operations on the referenced
properties.
