Text Modification Wording Dear Staff; At your request, please accept the following proposed changes to the text for Section 5.1.8 of the Knight Sky Estates Development Agreement modification that is scheduled for the public hearing agenda for February 10, 2009. As stated in my original letter of intent, in light of the recent development applications and decisions being made by the City of Eagle and Idaho Transportation Department with regard to access for other land uses in the vicinity of the intersection of Linder and Chinden, the applicant feels that access for the Knight Sky properly should be re-addressed. Because the development agreement is being brought forward for modification because of the time extension, this appears to be an appropriate time for discussion of access. The proposed changes to Section 5.1.8 are as follows: 5.1.8 That onl one ublic acces to Chinden Boulevard will be allowed on this site. and _ _ _. Y P ~- - ---------------------------------------- -------------- no direct lot access will be allowed without prior approval from ITD and variance approval from the City ;that the Chinden Boulevard up blic access be constructed as a public street that aligns with the existing public street on the south side of Chinden Boulevard (Long Lake Way); and that a11,Femaining_accesses to Chinden Boulevard will - ----- ---------------------------------------- be abandoned. Thank you for your consideration and we look forward to discussing this with the Council next week. Sincerely, . - Deleted: , and no direct lot access, --~ Deleted: existing Shawn L.
