"~'1Prk CA~cc Applications: CUP for a residential care (assisted living) facility in an L-O district Summary of Proposed Development: The applicant is proposing a 30,106 square foot, two story, 54- bed, assisted living facility to be constructed in two phases. Existing Land Use(s): The site is currently vacant. Adjacent Land Uses: 1. North: Overland Road and Maverik c-store/fuel station, zoned C-G 2. East: Locust Grove Road; Vacant land, zoned C-G 3. South: Sportsman Pointe Subdivision, zoned R-4 4. West: Sportsman Pointe Subdivision, zoned R-4 History of Previous Actions: - The site was annexed in 2007 with an L-O zoning district. A Development Agreement was approved with the annexation restricting the site to office uses. Alternative Compliance was approved for construction of a concrete landing, retaining walls, and two stairways within the required street landscape buffers. Design Review approval was also obtained for the site and building at that time. - A Development Agreement Modification was approved by City Council on 1/13/09, which allowed for the operation of an assisted living facility on the site with CUP approval. A new site plan and building elevations were also included . in the DA for the proposed assisted living facility. Comprehensive Plan Designations: Office Compliance with Comprehensive Plan: Yes. See analysis in the staff ~epoNt. Compliance with UDC: Yes. See analysis in the staff report. Access: One access point to/from the site is proposed to/from Locust Grove Road at the south end of the site; no access is proposed or approved to/from Overland Road. Outstanding Issues for Commission: Neighbors would like to see denser landscaping (additional evergreen trees) planted along the top of the berm & an increase in the height of the berm along the west boundary to shield their properties from headlights. Written testimony: Letters of testimony were received from Mike Ball, Sportsman's Pointe HOA President; Mike Bussert; and the applicant in agreement with the staff report Staff Recommendation: Approval Notes: .2/5/2009
