BERT MYERS ROBERT GIESLER BOBSPENCER Chairman Zoning & Planning Upon your request I have, this day, observed the ponding of surface water at and near the intersections of N.W. Eighth and Willowbrook Drive and Willow- brook Drive and Kenmere Drive. The drainage ponding on Kenmere Drive, North of Willowbrook is caused by the absence of the small drain ditches that were to be constructed to convey this street drainage northward until the No. 4 Subdivision was constructed. The ponding of water between N.W. Eighth and the West boundary of the No. 3 Subdivision is caused by a combination of the existing low ground eleva- tion, the built-up ground elevation of the adjacent subdivision lots and the soil stockpile created by the developers. If the strip of land adjacent to N.W. Eighth was developed into lots, as is shown on the tentative plat of No. 4 Subdivision, the drainage problem would be relieved. As a temporary measure, until No. 4 Subdivision develops, it appears an open drainage ditch can be constructed, with pipe under the temporary extension of Willowbrook Drive, to the North to drain into the temporary drain ditch constructed from the end of Kenmere Drive. I have attached a sketch showing my proposed solu- tion. Elevation readings should be taken in the open area adjacent to N.W. Eighth, however, it appears necessary to place some fill to make the drainage flow to the North. The City has received several complaints from the residents as well as the Meridian Fire and Police Departments reg- arding this exit. I --..! �'-i I � D [ Commission Meeting - May 1 1979 Page 3 I Mr. Wayne Forrey of J.U.B. Engineers presented a plat for Meridian Manor, on Meridian Road north of Cherry Lane and asked what the Commission would want for access to this development. Commissioner Silva said he would like to grant the requested accesses but that it must be understood that if it causes a problem in the future the accesses can be revoked. Discussion held concerning the redesign of the project if the City of Meridian uses the area proposed to be a park, for training of students in sewage treatment. Discussion held concerning future development and what might be happening on the 4 mile section line as far as roads go, and the possibility of building a bike path in the development. Commissioner Jeppesen said that we could allow some access as long as it is understood that when other access is available the access can be revoked. John Joines to prepare a letter setting out the wishes of the Commission. tARY LANE STORM DRAINAGE - John Joines explained the drainage problems on Gary Lane and said that a eve oper is proposing that they be allowed to use the existing drain on an interim basis and to make a contribution into the Trust Fund for an eventual larger storm drain. John Joines explained that there would have to be some design work done, and the line that is there now is not totally adequate but the developer could not put anything in right now anyway because of the installation of the sewer. After further discussion, Commissioner Silva moved that the Highway District establish as policy for now, that developers who will be using the drainage on Gary Lane be required to contribute to a Trust Fund for future development of a larger storm drain. Commissioner Fairbanks seconded. Motion carried unanimously. Commissioner Silva asked that the attached letter from Overland Park -be entered into the minutes. STREETSCAPE PROJECT - John Joines explained that i.f alT of the parties concerned with the development on Main Street, Idaho, and_6th Streets will cooperate, Idaho Street and Main Street can be completely rebuilt with just a small amount more than to just patch the streets. It would require a change order. After discussion Commissioner Fairbanks moved to authorize the staff to proceed with the change order as discussed. Commissioners to approve the change order after it is completed. Commissioner Jeppesen seconded. Motion=.carried unanimously. Commissioner Silva excused himself at this point and left the meeting. STATE LAND SALE - Chuck Smith explained that the State is asking $3,000 per acre for the land -a-r—ou-n-cT Hubbard Reservoir, and that he feels the amount is too high. Commissioner Jeppesen moved to authorize Chuck Smith to negotiate with tht State to get the best deal possible on the land up to $3,000 per acre. Commissioner Fairbanks seconded. Motion carried. Further discussion followed concerning prescriptive rights. AUTHORITY TO INVEST - Mike Brokaw asked for authority to invest as per attached. Commissioner Fairbanks moved to approve the authority to invest as requested. Commissione Jeppesen seconded. Motion carried unanimously. VANPOOL PROGRAM - Paul Joos explained that one of the new vans authorized by the Commission has arrived and will be going into service as soon as possible. The Mountain Home agreement has not been signed as yet, but he feels it will be soon. Mr. Joos asked for Commission approval to order a third van when and if the agreement is signed. The Commissioners felt it would be agreeable to order the third van after the agreement is signed. Mr. Joos further stated that the used van that he has been looking at has dropped in price and he asked to be authorized to purchase the 1977 Dodge van for $3,800, funds to be taken from the current vanpool budget. DRAINAGE 1. There will be no acceptance of any increased flow in storm run-off, drainage, or any contaminated waters for which the District might be made liable by the Federal Clean Water Laws. 2. Existing or replacement of on-site drainage or run- off facilities or modification thereto must be per- petually maintained by the site owner or owners. 3. Drainage plans prepared by a registered engineer may be required where deemed necessary by the District even though on-site modifications affecting drainage into the District are not required in the development plans. 4. If a drainage lateral owned and maintained by the District courses the site, no alterations of the lateral nor encroachment of its right of way shall be permitted without a license agreement. No access to such drain shall be denied to the District. B. IRRIGATION 1. Any irrigation supply lateral or canal which is owned and operated by the District and which may course the site, must not be obstructed nor encroachment made on its right of way. Page 2 of 7 Pages 2. No alteration or enclosure of an irrigation canal or lateral shall be permitted without a license agree- ment. No access to such canals or laterals shall be denied to the District. 3. No destruction, interference nor limitation upon water flows which are appurtenant to the property rights of others, shall be permitted. 4. The District cannot provide permission for altera- tion of waterways belonging to and being a part of the property rights of individual land owners and to which waters flow from the system of the District. Permission must be granted from each of the property owners having ditch and water rights in the waterway. C. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Three copies of the proposed site development plan shall be submitted with the application. 2. The District shall determine whether or not modifi- cations to irrigation and/or drainage facilities require preparation of plans. If deemed necessary, drainage or irrigation modification plans and specifications, prepared by a registered engineer, shall be submitted to the Secretary of the District. Three copies of such plans, one of which shall be reduced to a maximum size of 11" x 17", shall be submitted. 3. If these plans conform to specifications of the Dis- trict and/or the recommendations of its engineers, the Secretary of the District will then make arrangements Page 3 of 7 Pages for an appropriate license agreement for which the licensee shall be liable for payment of attorney fees. 4. Fees must be submitted with the application in con- formance with the following schedule: For a site comprising one acre or less ... $175.00 For all other sites ... $175.00 plus $30 for each acre or portion of an acre which exceeds one acre. 5. Attorney fees will be required only where a license agreement is required and these will be payable directly to the law firm of the attorney.
