This is to advise you of the action taken by the AdaiBounty Planning
and Zoning Commission at their meeting on May 25, 1472, regarding
the preliminary plat of Timothy Subdivision located on the north
side of Overland Road. west of Locust Grove Road, south side of
I -80-N. 1 `
The Commission approved the preliminary plat subject to the following
conditions:
1. 'Compliance with the requirements of the Central
District Health Department.
2. Submit an irrigation and drainage plan.
3. That the covenants state if lots are to receive
Irrigation water.
4. Slimination of any overlap of the future urban
sized lots across the flee acre lot lines.
S. Approval by Meridian City.

division.
We can approve modified individual sewage systems sonsisting of septic tank
and field drains at the rate of 85 square feet per bedroom. The system shall be
100 feet from Aline Mile Creek. The field line shall not be deeper than 18 inches.
We can not approve individual sewage system for anything less than 5 acre lots,
unless a drainage system is installed to lower the water table.

STAFF ANALYSIS:
The applicant is requesting the D-1 zone in order to place mobile homes
on each five acres in his five -acre subdivision. Mobile home is a
permitted use in the D-1 zone on the five acre while it is not a permitted
use in the D-2 zone. While this is a somewhat unorthodox request, staff
has no objection to the requested zone change.
STAFF RECOMMENDATIONS:
Staff recommends approval of the zone change from Suburban District
Zone (D-2) to Rural District Zone (D-1).

Review
It is the policy of the City to present the findings and recommendtion from the
Meridian Planning & Zoining tp the City Council Meetings at the earliest possible
time.
These minutes are filed with the City Minutes. When the City hears or.approves
the actions of the Planning & zoining, all the imput from the planning & zoining
commission then becomes a part of the Cities action.
Conclusion by Sec. of the Commission & also the City Clerk.
Since the beginning of this matter a Eimothy Subdivision it has been the
thinking of the Majority of those involved, that either no development or a maximum of
only l upit per S Acres be allowed.
A drain comes through this subdivision and; through the City Park & if it
became contaminated, it could cause far reaching problems.
The matter of Overlay was not intended to be used until such time that City
Mater & Sewer was available for the whole Timathy Subdivision.
The City does not desire for the City Clerk and Consulting Engineer to sign the
the Short Platt of Mr. Teare, because this would *•,Kean or infer that the City
accepted this.change. The fact that someone went `ahead and took steps on his to
kverturn their orginal intention, is not a desirable position

R-4 (Suburban Residential) to establish

EXISTING LAND USE

zone from D-2 (Suburban District) to
a residential subdivision. The property
of Timothy Street and overland Road.
Currently the subject property is being used for agricultural and a single family
residence. The general land use in this area is predominately agricultural. The
soils are classified II's,and have few limitations.
Residential development on this property is restricted to one house in the
southwest corner and received occupancy approval in 1974. However, to the west
across Timothy Street, approximately 5 acres, are zoned R-4 (Suburban Residential).
The area south of Overland Road is zoned D-2 (Rural District) and is being used for
agricultural pursuits. The surrounding area is sparsely settled and consists of
open space with a few residential structures. The property lies just south of the
South City Limits of Meridian.
UTILITIES

The subject property is not served by either public water or sewer. However, they
area lies within the proposed 1992 planning limits of the Meridian District for
both sewer and water."We could approve this rezone only after verification of the high seas
water."
IRRIGATION
The property is in the Nampa -Meridian Irrigation District. The Nampa -Meridian
Irrigation District submitted the following:
"If the change is approved, please insist that irrigation be served to each lot
with a plan approved by the district. Drainage will be a problem. We must know
what the developer intends here."
FIRE DISTRICT
The property is located within the Meridian Fire District. The closest fire
station is in the City of Meridian.
SCHOOLS
The property is within the Meridian School District. The Commission is well
aware of the School Districts Policy on expansion of residential development. The
Commission is also aware of the opinion from the Ada County Prosecuting Attorney,
as to the denial of a zone change request based on overcrowding of schools, to
the effect change of zones can be denied based on overcrowding of the schools.

NOTICE IS HEREBY GIVEN that on the 15th day of June, 1981
at 7:30 P.M., there will be a public hearing before the
Meridian City Council at City Hall, Meridian, Idaho to
consider a petition for vacation of Lot 2 of Timothy
Subdivision, according to the official plat thereof filed
in Book 31 of Plats at page 1923, records of Ada County,
Idaho; amended by an Affidavit recorded January 28, 1977,
as Instrument No. 7704108, records of Ada County, Idaho.
This vacation of subdivision lot is made pursuant to the
petition of the lot owner, Treasure Valley Baptist Church,
Inc..and pursuant to the requirements of Section 50-1306A
of the Idaho Code.
Any and all parties interested shall be heard at the above
scheduled hearing.

Dear Mr. Hyer:
This letter concerns your review of Timothy Subdivision for approval
of individual septic tanks. I am enclosing a copy of the preliminary layout
showing the location of four tests holes on the site. The subdivision
is a five acre development and contains six lots on approximately thirty
acres. The soil log of the test holes are as follows:

In addition to the above information, I am enclosing the minutes from
the November 20, 1972 meeting of the Meridian Planning and Zoning Committee
considering the denial of the Timothy Subdivision. Please note that one of
the main considerations in offering the denial is that the sewage systems
would contaminate nine mile drain if development were alowede I am in hopes
that if you do not agree with this assumption, that you would direct your
response to these minutes.
It was of particular interest that the ground water in all test holes
were four to six feet higher than the water located in nine mile drain.

This would indicate that nine mile drain has a sealed channel and is
not allowing drainage for this ground water. A proposed solution
would be to construct perforated pipes along nine mile creek and
discharge into the open channel, thus lowering the ground water.
If you need any further information concerning the approval
of individual septic tanks in this area, please let me know, I would
appreciate hearing your consideration of this matter prior to December
4, 1972 as this is the date that we are appealing the Planning and
Zoning Commission's denials

As you know, this firm represents Treasure Valley Baptist
Church in the above matter. This will confirm our recent tele-
phone conversation in which I advised you that Treasure Valley
Baptist Church will agree to indemnify the City of Meridian for
any loss it may sustain as a result of the City's approval
of the vacation of Lot 2 from Timothy Subdivision, Ada County,
Idaho.
As you may be aware, Treasure Valley Baptist Church has
already obtained approval from Ada County Highway District con --.,a
cerning the vacation of future streets lying entirely within
Lot 2, Timothy Subdivision. Additionally, the Ada County Zoning
Commission has approved the issuance, with some conditions, of
a conditional use permit to construct the church building on
that lot.
It is the position of Treasure Valley Baptist Church that
the City of Meridian will have no liability for its approval of
this application. We have made the above offer to indemnify the
City because of that belief. It is our hope that you would agree
with .that assessment and will so advise the council.

Gentlemen:
I represent and write for Mr. and Mrs. Hoyt C. Dobson.
Mr. and Mrs. Dobson are opposed to the proposed vacation
of said Lot 2 for the reason that said property is not
conducive to the proposed use until such time as a public
sewer is available to the property. Due to the high water
table in the area, septic tanks are not feasible for this
proposed use.
Mr. and Mrs. Dobson are also opposed to the petition to
vacate said Lot 2 for the reason that said vacation would
be in violation of the restrictive covenants for the sub-
division. The restrictive covenants for said subdivision
dated January 30, 1973, and recorded November 9, 1973, as
Instrument No. 866030, records of Ada County, Idaho, pro-
vides in Section 2(a) that the use of said lot 'shall be
limited solely to residential purposes. Section 3 of the
covenants provides that the covenants and restrictions are
to run with the land and shall be binding on all parties
and all persons claiming under them for a period of fifteen
(15) years from the date these covenants are recorded, after
which time said covenants shall be automatically extended
for successive periods of ten (10) years unless an instru-
ment signed by a majority of the then owners of the lots has
been recorded, agreeing to change said covenants in whole
or in part.
Mr. and Mrs. Dobson are the owners of Lots 4, 5 and 6 in
said subdivision and have vested property rights in said
