The Meridian Public Works Dept. recoAm,ends that the City of Meridian accept the water system with the following stipulations. There are (2) two extra water services that are not used at this time, which may or maynot be used for du-plexs, if not these shall have to be shut off at the corp stop and disconnected, the meter tile, yoke and lid removed at the Developers expense. The lots in question are Lots 13-14-15-16-17 Block 3 Lots 41-42-43- 44-45 Block 3. In accordance with City policy the developer shall guarantee any repairs to the water system for a period of one (1) year from the above date. If you have any questions please call me, Thank you. HINRICHS Chairman Zoning 8 Planning The sanitary sewer system and domestic water system for the subject subdivision have been inspected by the City water and wastewater superintendents and found to be acceptable . With one stipulation, the City can accept these systems for ownership and maintenance. The stipulation concerns the water system and is as follows: There are two (2) extra water services, one each, for Lots 13, 14, 15, 16, 17, Block 3 and Lots 41, 42, 43, 44, 45, Block 3 which may or may not be for duplexes, but are not being used at this time. If these services are not to be used, they shall be turned off at the Corp stop and discon- nected including removal of the meter tile, yoke and lid at the developers expense. Also, in accordance with City of Meridian policy, the developer shall warrant the materials and installation of these systems for a period of one year from the date of this letter. Glaisyer City of Meridian 728 Meridian Street Meridian, Idaho 83642 RE: Settlers Village Subdivision Dear Mayor Glaisyer, It has only recently come to my attention that the plat of Settlers Village Subdivision was vacated by the Meridian City Council. This is indicated by City Council minutes of November 17, 1980. Additionally, City Council minutes of September 15, 1980 indicate that a portion of the project was rezoned and that new covenants were approved. Other minutes indicate the City's approval of a new preliminary and final subdivision map to replace the old one. This letter is to inform the City that I and three other '., individuals own lots 1,2 & 3, Block 1 of Settlers Village :;-~ Subdivision. Our ownership is fee simple and is represented _~ by a deed which was recorded at the Ada County Recorders office on December 1, 1978. We h~;ve been the deeded owners ;>{ with title insurance since that date. Until recently, we have had no contact with the Boise PAC group regarding their work. In fact, we were not even aware they were making these changes until recently. Add- itionally, we have sever received any notices from the City regarding public hearings regarding the vacation, rezoning or approval of the new subdivision map and covenants. '1'he Boise PAC group is now, after the the fact, working with us to assure that our lots including the zoning, covenants and easements are not changed from the orginal plat. It is hoped that this can be worked out as the new plat and covenants requires our signature before they can be recorded. It seems incredulous to myself and my partners that this whole process could have occurred withour our concurrence or knowledge. Nevertheless, it has. This fact casts con- siderable doubt on the legality of everything that has taken place. However, if the Boise PAC group can satify our request that our lots including the zoning, covenants and easements Mayor Joseph L. Frank Capshaw explained that this proposal also proposed a by-pass road from Eldorado around by the Grizzly Bear that would come out at Waverly. Discussion held with Jack Farley explaining the by-pass road that has been proposed if a re-zone can be effected for their property. Much discussion held as to how the by-pass would work. Staff to work with the merchants to see what can be worked out. The Buttreys representative to provide a name to Frank Capshaw for working out the problems. Commissioner Jeppesen moved to take this matter under advisement. Commissioner Winder seconded. Motion carried unanimously. ACTION: TRAFFIC ENGINEERING SUBDIVISIONS - FINAL PLATS Settlers Village - a street name sign the new sign is up. Commissioner Winde the Chairman of the Jeppesen seconded. Keith Jacobs explained that the only thing that has not been done has to be changed and that the plat will not be signed until He recommended that the Commission approve the plat as presented r moved to approve the plat for Settlers Village and to authorize Commission to sign the plat after the sign is up. Commissioner Motion carried unanimously. Westpark Industrial Park No. 5 - Keith Jacobs explained that `the three asterisked conditions have been met but Mr. Allen Noble has not signed the plat as yet. I have reviewed these drawings- and have also received comments from the Meridian Waste Water Superintendent and Water Works Superintendent_ Our comments are shown on this set of drawings in red pencil. I feel it necessary, to avoid possible future confusion in plat names, that a note be added to the title of the plat stating that "This is a Replat of the Original Settlers Village Plat." I notice that Blocks 1 and 6 and Blocks 2 and 3 exist without any physical separation_ It has been my understanding that "Blocks" are defined by physical separations such as roadways and/or property boundaries. Also, a requirement of the Idaho State Code states that all lots within a black shall be numbered continuously. The following comments relate to the sanitary sewer service construction. 1. Mr. Earl Ward, Wastewater Superintendent, requests that one inspection be made for all services from each townhouse complex. The City of Meridian inspection charges however, will be assessed on a per lot basis. 2. The connections shall be constructed only as shown on the approved development drawings. 3. Please provide a method acceptable to the Meridian City Attorney for separating the areas of responsibility for service line maintenance between the City of Meridian and the property owner. We feel that a revision to the arrangements of these service line laterals to the existing service lines is necessary so that responsibility for clearing a plugged lateral connection line can be related to a specific townhouse unit. We suggest that the service line laterals be installed as we have shown on Sheet 3 of 3 of the development drawings. With this type of arrangement, you may want to realign your service line laterals shown on Sheet 2 of 3 so as to reduce the length of some of the lateral service lines. Note the requirement for a beveled edge on the concrete slab around the meter the as shown on Sheet 3 of 3. Agenda 1 Hearing - Conditional Use for office - Joe Osier - 1332 Darrah Dr, Meridian Park. Joe Osier was present to request a conditional use for a sales office in residential zoning. Osier: "We have a subdivision that`s currently partially completed, 59 lots (displaying map) there is actually 88 lots shown, but 59 completed and you follow the loop around. These three lots are improved with three model homes on them. This house (indicating 1332 Darrah Dr.) is being used as a sales office out of the garage and this is what I need, a conditional use permit for -- to be used as a sales office to market 145 lots that will subsequently be in the subdivision." Hinrichs: "This is to be used as a sales office only until the subdivision is completed?" Osier: "Yes." Sharp: "In this subdivision you are conforming with all of the items you agreed to in the preliminary - final plat process?" Osier indicates yes with a nod, and displayed brochures of homes that are being sold. He stated the minimum home is 1,350 sq. ft., ranging 1,353 to 1,376 sq. ft., all two car garage, different floor plans. All custom built would have to conform to covenant speci- fications. • Hinrichs called for public comment. There was none. The Motion was made by Lee Mitchell and seconded by Don Sharp that the Commission recom- mend to the City Council approval of a conditional use permit to Joe Osier, 1332 Darrah Dr fora sales office, for a three year period. Motion Carried: All yea. Agenda 2 Settlers Village Final Plat Bill Blankinship and Norm Noonan were present with the final plat for Settlers Village. Blankinship, displaying maps: "There are a few differences that we have made on our final plat. We were having some boundary disputes, but we have resolved these disputes and resolved these different parcels of land -- we have an agreement to resolve with the City of Meridian on the well lot. What we have done, these lots were 102 feet deep, now about 93, as we gave•Bill Curtis (to the west) about 7 feet right along his old fence line. These dimensions will be slightly different than preliminary. We had to a~iden lots up to keep our square footage. On that side (east side) we added about 7 feet, all along the east side to the beginning of commercial. The Michels own the three lots fronting Fairviev- and they decided to keep the previous boundary. We have drafted legal agreements to all the people. On the north side, we retained the very same as pre liminary -- Earl Harmon owns part and the City owns part of north boundary. 41e have to draw up an agreement for the City of Meridian, wherein we wi11 agree that the plat of record is the actual boundary instead of fence line." There was discussion concerning survey. Don Hubble was present to explain problem of previous surveying. Blankinship: "There's a section line right out there in the center of Locust Grove and Fairview. There were five. surveys, recorded from 1900 on -- none of which agree." J heridian Planning and Zonin cember 8, 1980 Noonan: "What happened, the legal description was described so far away from that sec- tion corner, but the fence wasn't on that legal description. The legal description was actually over. seven more feet -- the fence has been there for 50 or 80 ,years inside that property boundary, so the fence is there, nobody makes a change within 3 years, a fence becomes a legal boundary. We had to change the legal boundary to meet the fence line.. The same thing happened over here -- the fence was not on the propertyy boundary so we moved this boundary over to match the fence." Sharp: "How do we avoid this happening in the future?" Noonan: "Well, that boundary would be the legal property description, unless someone s 'my fence is there' and takes it to court. Blankinship: "Adverse possession is 3 years in the state of Idaho, and what it assumes is that ,you have paid taxes within.. your fence lies and so you possess this land, paid taxes on it, regardless of whether the fence is in the proper place or not." "Anytime you survey and find old fence lines you should take these into consideration. Title Companys when inspecting will question fence lines." There were at least four different survey pins on one corner within a six foot range. Everyone offically signs and agrees to the correct boundary and then leaves the correct boundary pin. Blankinship states there was a meetina at that one corner with the other surveyors and an agreement made at that time. The accuracy of Dan Rubbles survey was also contributed to a laser type instrument which very few surveyors have acquired. Hinrichs: "Did you clear things up with the ACRD?" Blankinship: "Yes, we've even got the bond." Spencer: "Are there any boundary disputes?" Blankinship: "No, to the best of our knowledge we're straight." The motion was made by Sharp and seconded by Spencer that the Commission recommend approval to the City Council of Settler Village Final Plat be approved as amended provided that the agreements are furnished to the City that proves that the boundaries are legal. I think if we do go ahead and Clive you a deed, which sounds to be a good idea,I would like you to detail in there what would be available for the park. As Parks Commissioner, if we do proceed with the park down there, we will make the best use out of your resources." Williams: (Addressing Ken Montee and Roger Allen, Meadow View ,#2) "In that area where the old sewage facilities, the idea is to make the land, make that into a Park, remove the sludge beds - cutting one of those trickling filters in half and moving the chain link fence to enclose the treatment facility with a new building being put right on the corner of NW 8th and make the rest of it into a neighborhood park. If we did that we would ask you if we could have an access, a walkway, along one of those lots perhaps to that park. This would make it available to the whole neighborhood." Montee: "What kind of odor would there be?" Williams: "They would just process water - there would be no actual processing, instead of sewage they would use vrater in training." Williams: "They would landscape that to provide an esthetic effect and they do have a vo-tech program as landscaping for the design of the park and of the plant." Crookston: "Where does the water come from?" Felton: "There is a well on the NE corner." Orton: "And that would become their well and they would hookup, pay the power, and if they hookup to domestic water they would pay their water and sewer bill?" Williams: "Yes. ~iJe would nave the same policy as with h1eridian School District." Mayor: "What action do you recommend Dick?" Williams: "I would recommend that we have Council approval of this action, so we could start the legal mechanism in order to provide this deed. The rehabilitation of the plant and the design of the park would all be subject to Council review." Kingsford: "I think we should recommend that the Legal Council draw up an agreement and not approve until we see the finished agreement." Felton: "We still have to, even if you offer us the property and agreement, etc., go through our administration and possibly to the State Board of Education because we already now have an approved site. I feel we have to take the agreement, the Council's backing, to our administration Dr. Kiser, Dr. Nelas and in turn if we have to go to the .State Board Meeting would be in February." The Plotion was made by Williams and seconded by Brewer to approve the concept of BSU Wastewater Training School obtaining the old seaaer plant facility located on PdW 8th St. and to instruct the City Attorney to draw up agreements. Bill Blankinship and Dan Hubble were present to request approval of Final Plat, Settlers Village, Norus Annexation. Final Plat was approved by Planning & Zoning on December 8, 1980. P4aps were displayed. Blankinship: "This is the same as Preliminary Plat, except we have boundary changes, we had some land we gave to Curtis, (West Boundary) and Doris Subdivision boundaries re- solved to the east, and Harmon to the north. This does reflect new boundaries slightly, like 6 or 7 feet. Streets are in, so remained the same. It aave us a little different width in our lots - the lots are the only significant change, 4ve had to broaden lots out to give us the square footage. The plat at this time is ready for record." htayor: "Bill, have you got the correct legal boundaries?" Blankinship: "Yes sir, we have the correct. It has been done, yes, it has been agreed to. We are putting up a new fence." There was discussion concerning the street cut to satisfy Curtis. Curtis wants the 6. feet of street removed from his property. Blankinship: "We will bring that to you Bruce, its just exactly as what we agreed upon. On the water and sewer, our contention was not to reconstruct the sub, but to utilize what's there. We are going to have to add a number of water meters, water lines at directly out at the end of line, or the City's responsibility, and branch out from there water meters to individual users and we actually have it ready." Engineer Smith: "I need to look at the development drawings for sewer and water, get Bruce and Earl's comments, and back to Don to get squared away." Fire Chief Welker: "I can't get the water pressure problem ironed out unless something is done so we won't have to use that well, in case there is a fire in there and we have a break in their line. If we have a fire out there, the mains won't hold the oressure:' Orton: "That situation is normally unlikely. Gary, I'll ask ,you to do this tomorrow - all back to Bruce and Roger - check the shut off head in those pumps and see if they would cause any problems in those lines. Agenda 4 Cope Auto Repair - Locust Grove Industrial Park Mayor: "Wayne, do you have any comments?" Attorney Crookston: "There now appears to be some problem with whether or not that annexation was adjacent to the City of Meridian. I have not talked to Mr. Cope's attorney about that particular problem. Nis attorney was going to get back to me to find out what Cope wanted to do - he hasn't done that. So there is still doubt in my mind as to whether we have a valid annexation. Adjacency problem, I think the City could legally adopt, or legally go ahead and annex that property because its been broken in five acre parcels or less. Now the problem is whether or not it'.s even adjacent." Mayor: "t~de know that it's not contiguous right now - there's a strip starting about 50 feet and narrowing down." Williams: "If that':s the case, they have to sign the annexation reauest." Crookston: "A railroad right-of-way can be annexed without the railroad's concent. That`s specific in the statute. We have to go through a re-annexation." Williams: "Which means all the new property owners have to agree to the annexation." Kingsford: "What about the fact he, (Cope), hadn't approached annexation originally?" Crookston: "Mr. Cope may not have been the owner of record at that time of application." Williams: "What about the school district?"
