I would like it to be zoned R-4. It is presently in Ada county and zoned agricultural. However it was part of an illegally devided subdivision and canot be used for anything. I propose to use it for a single family residence. I would like also to request that I be allowed to drill a well and put in a septic system until those city services become avalible. This proposed use fits in well with the Meridian Comprehensive plan. I am applying separately rather than with the Stonehouse and LDS church groups, because when it got down to applying neither seemed prepared to make the commitment right now. I will'ibe happy to pay the fees necessary to annex the property. It may be well to note that the property is isolated by irrigation ditches on two of the three sides and that it has never been farmed nor can it be. The only thing that it can be used for is a single family residence. Mayor Kingsford opened the meeting for Public Hearing. There was no response, hearing closed. Mayor Kingsford, any questions of the Council? Councilman Giesler, any problems with the comments? Councilman Giesler was advised Mr. Harrison had no problems with the comments or recommendations. The Motion was made by Tolsma and seconded by Brewer to approve the Findings of Fact and Conclusions as prepared for the Planning & Zoning Commission. Motion Carried: All Yea. The Motion was made by Tolsma and seconded by Brewer to approve the Annexation and Zoning request of Rex Harrison and that Water and Sewer Hookup fees be paid in advance. Motion Carried: All Yea. Item #4: Public Hearing, Variance, Preliminary and Final Plat of. Sunnybrook Farms #4. Mr. Wayne Gibbs, JUB Engineers was present to represent this request. Mayor Kingsford opened the meeting for Public Hearing. There was no testimony, hearing closed. Mayor Kingsford, Mr. Gibbs are all the residents in Sunnybrook aware of the Park, Lot#l, Block 14, and the assessments that will be required for upkeep? Mr. Gibbs, Sunnybrook #1 will not be assessed, but in Sunnybrook #2 and #3 this was part of the recorded covenants on these phases the same as it will be in Sunnybrook #4. _ The Motion -was ;Wade by Brewer and seconded by Giesler to -approve the --- Variance as requested. Motion Carried: All Yea. The Motion was made by Brewer and seconded by Tolsma to approve the Preliminary and Final Plat of Sunnybrook #4. Motion Carried; All Yea. Mr. Max Boesiger asked the Mayor and Council about the possibility of having water meter's and building permits before Street is paved and not having square footage designated on plat. This is to be researched and answer to be given later. Motion Carried: All Yea. Item #10: Ordinance# 442. Mayor Kingsford read, Upland Industries -Johnson Annexation, an Ordinance annexing and zoning certain real property which is described as the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 9, -Township 3 North, Range 1 East, Boise -Meridian, is there anyone in the audience who wishes Ord- inance #442 read in its entirety? There was no response. - The Motion was made by Myers and seconded by Tolsma that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance. Number 442 as read be passed and approved. Motion Carried: All Yea. The Motion was made by Tolsma and seconded by Giesler that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 443 as read be passed and approved. Motion Carried: All Yea. Department Reports: Mayor Kingsford brought up the matter of the persons going through the City at the present time passing out flyers for the service of painting house numbers -on -curbs. He advised that this was in no way endorsed by the City. He also stated -he was not in favor of the passing of flyers in the residential areas and would like to investigate the possibility of a Ordinance against door -drops. The Motion was made by Brewer and seconded by Giesler to have the City Attorney check into an Ordinance against door -drops. Motion Carried: All Yea. Gary Smith, City Engineer: You have received the revised Rate Study and would the Mayor and Council want to have a workshop to go over this as well as the Policy Statement which was submitted prior. The motion was made by Shearer and seconded by Johnson that the Meridian Planning and Zoning Commission hereby adopt and approves the Findings of Fact and Conclusions. That notice of a public hearing on the annex- ation was published for two (2) consecutiv'eIweeks prior to the said public hearing scheduled September 19, 1984, the first publication of which was 15 days prior to said hearing; that the matter was duly considered at September 10 hearing and that the public was given full opportunity to express comments; that copies of all notices were made available to newspaper and radio and television stations. 2. That the property included in the annexation is within the Area of Impact of the City of Meridain as ad- opted by Ordinance No. 319, but which Area of Impact has not been adopted by Ada County. 7. That the entire parcel of ground is included with- in the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the 1978 Comprehensive Plan but would not be in the Urban Service Planning Area as presently proposed by the Citizen's Committee which has recommended changes to the Area of Impact and to the Urban Service Planning Area unless annexed. 8. That the application for annexation requests that the parcel be annexed and zoned 11R-4", Residential, that the present use of the property is vacant ground and is zoned by the county as agricultural. 9. That the land in this annexation is contained in the "Neighborhood" known as Warrior as designated in the Meridian Comprehensive Plan as.:amended April 2, 1984. 10. That the proposed use of the property.would be to construct a single family residence. 11. That the Ada County Highway District recommeneded that the applicant provide by dedication forty feet (401) of right-of-way from the centerline of Ten Mile Road abutting the parcel proposed to be annexed, maintain the drainage through the borrow ditch which may require a culvert, and that any work in the right-of-way would require a permit. 12. That the closest city domestic water is located in Cherry Lane approximately 970 feet north of the north- erly most corner of the parcel to be annexed; that the closest city sanitary sewer is 2,640 feet to the east at the interceptor sewer line along Nine Pile Creek; that even though the water and sewer service is not available at present, the applicant agreed to pay the sewer and water connection fees at this time and Ohen sewer and water come to within 300 feet of his property he would extend them to his property at his own cost; that ex- tension of water and sewer could require that the lines be sized larger than necessary to service this property alone. 13. That the Central District Health Department com- mented that it has no objection to the annexation but could not approve a septic system until the high seasonal ground water could be determined. C O N C L U S I O N S -1. That the City has authority to annex land pur- suant to 50-222; Idaho Code; that exercise of the City's annexation authority Is a Legislative function. MOROSE, 2.
