To annex and rezone approximately 35 acres from existing R-4 and D-2 to C -G (District*General Retail and Service Commercial) located on the west side of Meridian Street north and south of Waltman Lane. 2. Meridian Street, north of Waltman Lane, has a 50' right-of-way except at the intersection of Highway 69 which has between 60' and 110' of right-of-way. The street is improved with 23' of paving only. 3. Meridian Street, south of Waltman Lane, has a 40' right-of-way and is improved with 22' of paving only. 4. Waltman Lane has a 50' right-of-way and 23' of paving only. Waltman Lane is on a mid-section line and is a collector. 5. Highway 69 is a State Highway and under the jurisdiction of ITD, District III. 6. Inadequate information is presented to permit evaluation of traffic impacts on the public streets. Unknown is the size and types of commercial developments to determine traffic generated by the 35 acre parcel. The intersection of Meridian Street and Highway 69 would be a particular concern to the County and State Highway Districts. RECOMMENDATIONS: The Ada County Highway District does not recommend approval or disapproval of the annexation. If the annexation is approved by the City of Meridian and parcel development is intended, then the following recommendations apply: 1. A traffic impact study may be required. The study to be performed by an engineering firm with expertise in this field. 2. Additional right-of-way for the collector street, Waltman Lane, will be required and the street will require improvement. 3. Additional right-of-way and improvements to Meridian Street will be required. 4. Access from the parcel to Waltman Lane and Meridian Street to be submitted to the Ada County Highway District for approval. 5. Any access to Highway 69 to be submitted to ITD District III for approval. 6. That the evidence submitted by the Petitioner shows that it intends to develop the property as 100 room motel and a rest- aurant with a lounge for the serving of liquor by the drink and as including a facility for the overnight housing of livestock; that the Planning and Zoning Commission has processed this application on the basis of the Petitioners representations. 9. That the general area within which the land is contained is ;largely residential and agrarian; that the subject property is, however, zoned C -G and cpable of being developed as requested; the property to the east across Highway 69 is zoned commercial and des- ignted as a regional shopping center site- the property to the north and west is largely residential and agrarian oriented; the property to the south is residential and vacant land of an agrarian nature and a part of Interstate.I-84 is adjacent thereto; the por- tion of the subject property south of Waltman Lane is designated in the Meridian Comprehensive Plan as a Mixed Use Review Area which is capable of being developed in the fashion presented in the Peti- tioner's application or industrially or commercially;;that the sub- ject property is contained in an Interstate Interchange Area which by the Meridian Comprehensive Plan is encouraged to be developed commercially or industrially. 10. That the proposed development of the property is a com- mercial use. The owner would be required under the City Ordinances to commercial rates for water, sewer and trach and to pay pay for - the requisite number of hookup fees required by the Petitioner's us0s. Page 3. 11. That the water and sewer lines are not presently within 300 feet of the proposed development. 12. That the City of Meridian presently has five liquor li= censes which are -being operated in the City limits; that State law provides that there can only be one liquor license for every 1,500 people except for the first two licenses; that a new liquor license will not be available in the City of Meridian until the population reaches 7,500; that in order for this Petitioner and development to include a lounge for the sale of liquor by the drinlr it would have to buy an existing license or vait until it could obtain a li- cense when the population reached 7,500, if it even were in line to receive one at that time; that this petition and development re- quest do not involve the issuance of a liquor license but- only 'the right to operate an alcoholic establishement on the subject prop- erty; the issuance of a liquor license would be a separate matter. 13. That the Commission heard oral testimony and received written testimony; that there were petitions submitted in opposi- tion to the sale and service of liquor on the premises; one person testified that she was against not only the sale of liquor but also the project; other persons testified in support of liquor and the entire project; that no objections were received from the public regarding the plating of the property, which does not require findings of fact or conclusions upon a decesion; that governmenta-1 agencies involved in the development submitted comments and their`_ AMBROSE, II requirements regarding the development which agencies included FITZGERALD RCROOKSTON Attorneys and Counselors P.O. That since the land which is the subject of this Petition is contained within a Mixed Use Review Area, the development must be processed as a planned unit development under the conditional use procedures even though the property is zoned for the uses re- quested in the petition; that the use of the property for an alcoh- lic establishment gust be processed and approved as a conditional use permit. 2. That the City of Meridian has authority to grant Condi- tional Use Permits pursuant to Title 67, Chapter 65, Idaho Code, and pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That upon the issuance of a Conditional Use Permit, the City of Meridian has authority to place conditions upon the Permit and the use of the property. 4. The uses will be designed, constructed, operated, and maintained to be harmonious in appearance with the in- tended character of the general vicinity such being des- ignated for commercial or industrial development in a Mixed Use Review Area. That the uses will not be hazardous or disturbing to ex- isting of future neighboring uses. The Petitioner is responsible for the extension of the sewer and water lines and it should be able to provide adequately those services. The uses will not create excessive additional requiremen at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. The uses will not involve uses, activities, processes, materials, equipment and conditions of operation that wil be detrimental to any person, property or the general wel fare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. The uses and development will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding pub- lic streets. - The development and uses will not result in the destruc- tion, loss or damage of a natural or scenic feature of major importance. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code and the Ordinances .of the City of Meridian have been complied with. That the State of Idaho Department of Transportation did not submit any comments but since a State Highway is involved in this development any requirements of that Department must be com- lied with. 11. That objections to the sale and serving of liquor as a part of the development are of concern to the Commission; the ob- jections to the point that another liquor establishment is not needed nor desireable in the City of Meridian are muted to a large extent by the fact that if the population does not increase to 7,500, the project would not mean an additional license but a transfer of location of an existing licese already being operated within the City. The comments of one witness to the effect that it is not alcohol itself that creates a problem but the people that abuse its use are also well taken; that the benefits of this project and development to the City of Meridian outweigh the pos sible detriments of transfering a liquor license to this location. The 35 -acre parcel is located on the west side of Meridian Street and straddles Waltman Lane. ' 2. The parcel was annexed to the City of Meridian on August 6, 1984, and with consideration of the Ada County Highway District's comments submitted July 12, 1984. 3. The conditional use permit is for the development of a motel with approximately 100 sleeping rooms and additional meeting room facilities, a free standing restaurant with a lounge, and a free standing enclosed overnight livestock facility. 4. The development abuts Meridian Street which is classified a minor arterial. Meridian Street has inadequate right-of-way and is improved with two paved traffic lanes. 5. Waltman Lane, which bisects the parcel, is classified as a collector street, has inadequate right-of-way and is improved with two paved traffic lanes. 6. Meridian Street extends south of Waltman Lane and provides access to land parcels not included in the proposed development. 7. Traffic from the development would access to State Highway #55. 8. A two lot/block preliminary plat is being submitted concurrent with the conditional use. The requirements recommended below apply to both applications. RECOMMENDATIONS: 1. Provide for a suitable right-of-way exchange if Waltman/Meridian Avenue are to be realigned. 2. Provide by dedication 33' of right-of-way from centerline for Meridian Road where abutting, except that portion of Meridian Road south of Waltman Lane, which shall be 50' right-of-way total. 3. Provide full improvement to the west side of Meridian abutting plus 12' of paving beyond centerline. C O N C L U S I O -N S 1. That the City has authority to annex land pursuant to 50-222, Idaho Code; that exercise of the City's annexation authority is a Legislative function. 2. That the Planning and Zoning Commission has judged the annexation application by the guidelines, standards, criteria, and policies contained in Section 50-222, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, and the 1978 Meridian Comprehensive Plan as amended April 2, 1984. 3. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 4. That the City may take judicial notice of governmental statutes, ordinances, and policies, and of actual conditions existing within the City and State. 5. That all land within the proposed annexation is contigu- ous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 6. That the annexation application has been initiated by High Country Inc. of Idaho and is not at the request or initiation of the City of Meridian. 7. That on page 1, Nature of the Comprehensive Plan, of the Comprehensive Plan" --it indicates that the "plan summarizes policies and proposals and does not develop detailed site plans." B. That on page 6 of the Comprehensive Plan it states: "The Policy Diagram is to be used as a general guide for land use decisionmaking--not as a legalistic, literal and definitive map. As applications and proposals of land uses are submitted, the Policy Diagram is not intended to be used as the sole, authoritative means for decision- making. Rather, it is but one of the many tools which are available for public officials as they exercise their responsibility regarding the health, safety and welfare of the general public." 9. That the Comprehensive Plan, at page 15, under Economic Development encourages commercial development at interchange accesses, one of which is Meridian Road and I-=84. 10. That since the land included in the annexation north of Waltman Lane is on the very edge of the Linder Acres neighborhood, that since it is adjacent to the Mixed Use Area south of Waltman Lane, and that since it is across from the regional shopping center site and part of an interchange development area, and the r s Comprehensive Plan Policy Diagram is not a detailed site plan and is to be used as a general guide for land use decisions, the annexation is concluded to be in compliance with the Comprehensive Plan as amended April 2, 1984, and the annexation land should be treated entirely as being Mixed Use. 11.
