I note with interest that the motion for vacation did not vacate the lot but merely recommended vacation . I also noted your request for clarification as to whether the City of Meridian actually vacates the property or whether the City of Meridian would make recom- mendation to the Boated of County Commissioners . Let me start initially by stating that this office in no way wishes to presume to be your legal advisor . I am assuming that Mr . Fitzgerald is providing you with legal opinions that you ultimately rely upon . In answering your question, it is the opinion of this office that Idaho Code Section 50-1306 controls the question of who vacates plats or lots found in a plat. Idaho Code 50-1306 provides for an individual city to vacate a plat if it is within one mile of the city limits. The county must vacate plats or portions of plats if they lie beyond one mile of the city limits . Pat Joy January 16, 1979 Page - 2- If the Primrose Subdivision is within one mile of your city limits (as I am told it is) then the City of Meridian has the jurisdiction to vacate the lot sought to be vacated . Once that vacation decision is made I feel that a second decision must also be made before the vacation procedure is completed . The city should vacate the property and vest the title in favor of a property owner pursuant to Idaho Code 50-1320. Idaho Code Section 50-1320 states in part: "the parts so vacated , if it be a lot or tract , shall vest in the rightful owner , who shall have title thereof according to the law; or if a public square or common, the property may vest in the proper county, or if in the city,-the property shall vest in the council for the use of such city..." . Public squares or commons are not defined by the Idaho Code. I feel that the ordinary definition of public square or common includes open land held by and for the public . I feel that it can include this parcel of property which was dedicated by the subdivider for public use . If this parcel of property is a public square, or common, then the City of Meridian when vacating the property has the option of vesting title in the County . If the plat were in the city limits the city could vest title to itself . The City of Meridian might want to delay a decision on this vacation until such time as Ada County Board of County Commissioners were given the opportunity to state their opinion as to what Ada County might desire .
