1. Gary Smith, City Engineer: 1. Water': 8" dia. line presently exists in the
Right of way of 2 1/2 St..and.in right of way of 4th St. The 4th St. line
ends at the S.E. corner of this property. Developer needs to extend this
8" line across the East boundary of Lot. 2 2. San.Sewer: An 8" dia.
line exists about 130' East of 2 1/2 St. and flows North. A 10" dia. line
exists in 4th St. and extends along the East boundary of Lot 2.
3. Streets: 3rd St. provides access to Lot 2. Consideration must be made
to extend 4th St. along the East boundary for access. Possibly only a 1/2
wide street would be necessary for this developers requirement. ACHD
comments would resolve this item.
2. Richard Williams, Councilman: (1) This has already been subdivided once it
appears (2) Does not seem to be the proper way to starting splitting off
property (3) Lot 2 would probably be replatted in another Subdivision
(4) Obviously no intention of Final platting this. (5) This seems to
be an excuse for the convenience of an individual and at the expense of
the City. (6) Recommend they try another way to do this.
3. Earl Ward, Wastewater Supt: Sewer Easement located behind 1304, 1312,
7316 2 1/2 Street.
4. U.S. Post Office, F.E.Frost: No comment at this time. Type of delivery will
be indicated when type of res. development is known.
5. Rick Orton, Councilman: (1) Are the sewer easements adequate? (2) How are
the differences b etween fences and surveyed lines to be settled?
6. Fire Chief Roger Welker: Fre Department does not approve of proposal
because of limited access and no finished roads are shown -All against
Fire Department policies.
______) 4.13.81 Planning & Zoning: The Motion was made by Sharp and seconded by
Mitchell that the Commission recommend to the City Council that they
approve the Preliminary Plat of Milton Subdivision subject to a property
line agreement made between Jack Hawkins and Dale Milton and that no
development of any kind, or building of any kind, take place on Lot 2
until brought back to the Planning and Zoning Commission and the
City Council." Motion Carried
7. Central District Health Dept.: Approve for Central sewage and Central water.
Plans for Community sewage and Central water must be submitted. Street
runoff is not to create a mosquito breeding problem.

1. Locate East 3rd Streets intersection with North boundary of Plat
2. Add East to 2 1/2 Street call out.
3. Southeast corner of Subdivision has an added area of 230' x 25'
that did not appear on the prelim. plat. Why the change?
4. Tie distance from Center of Section to N.E. corner of Subd. changed
36.42' from prelim. .plat. Engineer said property lines would matvh
existing fence lines, however, the existing fence line was only
14.7' from the deed line. Why the difference?
5. Add "Sanitary Sewer and..." to the utility easement call out in the
legend.
NOTE: Questions and answers to above in minutes of August 17th, 1981

with the condition same as Preliminary Plat approval; no
development of any kind, or building of any kind, take place on
Lot 2 until brought back to the Planning and Zoning Commission
and the City Council; and with the stipulation that the ten (10)
foot utility be changed to sixteen (16)feet; and that the City
Engineer proves cincurrence settling the property dispute."

Accordance with resolution you have received.
8. ACRD: (Carol Kirby): The final plat of Milton Sub complies
with all of the recommended requirements made by ACHD
Commissioners. The District's Commissioners recommend it's
approval and they will certify the final plat on submittal
of the plat mylars.

Ode are submitting the attached y subdivision plat at the request of
Dale Milton who is the representitive of the estate of Charley T. Stoner.
Since all ~~~~the property is in an estate, it was felt, by the Heirs, that the
.~ ,property would sell faster if it were split into the following three lots:
L'~ Lot 1, An existing duplex is on this lot and is to remain.

~~°~~ Lot 2, Is an open 1.75 acre field..This lot if sold separately from the

others can be developed into a nice planned unit development or a recreation center
witYtout further dedication other than what we-are dedicating on this subdivision.
The Heirs of this property do not intend to develope the property but to sell it.
Lot. 3, This lot has a single family resident on it and it will remain.
Vie feel that this division will help settle the estate of Charles T. Stoner and
we therefore request your approval of the preliminary plat as soon as t~ossi.ble and
any help you can 3ive would be welcome.

PRELIMINARY PLAT
Section 7; T3N, R1E, B.M.,
Ada County, Idaho
On April 2, 1981, the Commissioners of the Ada County Highway District
(hereafter) called "District") approved the Preliminary Plat subject to
the following conditions:
1. By plat, dedicate 30' of right-of--way from centerline of
2 1/2 St. to the parcel.
2. By plat, dedicated~30' of right of~aay from centerline of
4th Street to the parcel.
3. Improvements too 2 1/2 Street to be accomplished in the future
under L.I.D.
4. Prior to the develo~xYlent of Lot ~2, the ,Ada County Highway
District shall review and approve the lot access and develop-
ment plan. This restriction to be delineated on the plat.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable standard
conditions to be satisfied prior to District certification and endorsement:
1. Drainage plans shall be suksnitted and subject to review
and approval by the District.
2. If Public Street I~rovements are Required: Prior to any
construction withs.n t existing or proposed public right-
of-way, the following shall be submitted and subject to review
and approval by the District:
a) One complete set of detailed street construction drawings
prepared by an Idaho Registered Professional Engineer
together with payment of plan review fee.
b) Execute an inspection agreement between the Developer
and the District together with intitial payment deposit'
for inspection/testing services.

c) Ccsnplete all street improvements to the satisfaction
of the District, OR execute surety agreement between
the Developer and the District to guarantee the completion
of construction of all street improvements.
3. Furnish copy of final plat showing street names as approved
by the Local Government Agency having such authority ether
with payment of fee charged for the manufacturing and installation
of all street signs as required.
4. If Public Road Trust Fund deposit is required, make deposit
to the District in the form of cash or cashier's check for
the amount specified by the District.
5. Furnish easements, agreements and all other datum or documents
as required by the District.
6. Furnish Final Plat drawings for District acceptance certification
and endorsement. The final plat must contain the signed
endorsement of the Owner's and Land Surveyor's certification.

Minutes of the regular meeting held August 20, 1981, at 12:00 noon, in the offices
of the Ada County Highway District, 318 East 37th Street, Boise, Idaho.
Commissioners Winder and Jeppesen present.
Three citizens present.
Ada County Highway District staff present: Gary Funkhouser, Frank Capshaw,
Ray Putman, Bob Sorcic, Ron Cotterman and Alice Sinsel.
PUBLIC HEARING - RIGHT-OF-WAY EXCHANGE - ALLEY OFF 17TH STREET - Ray Putman
explained that this is the time and place as advertised for the public hearing
to consider the right-of-way exchange of the sixteen foot alley between Front
and Grove in Block 2, Mrs. McCarty's Subdivision, in exchange for a small portion
of the northeast corner of Block 2, Mrs. McCarty's Subdivision. A representative
of Billy Ray Strite's office was present and had no objections to the right-of-way
exchange as presented. No comments or objections were received from the audience.
Commissioner Winder explained that he has a conflict of interest in this particular
piece of property and will be abstainir:g from the vote. Commissioner Jeppesen
moved to approve the right-of-way exchange as presented. Commissioner Winder
abstained. Since Commissioner Jackson was not at the meeting, the Commission
had to poll him by telephone. Commissioner Jackson was contacted by telephone
this date and seconded the motion. Motion carried.
SUBDIVISIONS - PRELIMINARY PLATS
Heidi Subdivision (A re-plat of aJDOrtion) - Bob Sorcic presented the plat and
exp~iained the staff recommendation as presented on August 19, 1981 Technical
Review Committee Agenda. Commissioner Jeppesen moved to approve the replat of
Heidi Subdivision and to authorize the Chairman of the Commission to sign the
plat. Commissioner Winder seconded. Motion .carried unanimously.
Anderson Street Condominiums - The Commission agreed with staff Comments/
Recommendations as outlined on the August 19, 1981 Technical Review Committee
Agenda.
Sunflower Estates - The Commission agreed with staff Comments/Recommendations
as outlined on the August 19, 1987 Technical Review Committee Agenda.
SUBDIVISIONS - FINAL PLATS

Little Lane Estates - Bob Sorcic explained that the Commissioners saw this plat
last week and said that there is an existing roadway that was dedicated by the
original plat, and with the re-platting it is necessary that the Highway District
sign the ownership signifying that the right-of-way is Ada County Highway District
right-of-way. Discussion of the requirement for two signatures followed.

HEARING - Milton Subdivision Preliminary Plat
Mayor Glaisyer: "The Engineer for Milton Subdivision called and requested that
Milton Subdivision Preliminary Plat be tabled until the next meeting.
Is there anyone in the audience that alishes to make a public comment on Milton
Subdivision, would you please address the Council at this time?" There was no
response.

Linder Park Industrial
Walt Morrow was present to represent the individual landowners in Linder Industrial
Park. Bill Knickrahm was present to fill in for Ron VanAuker who was out of State.
Linder Industrial Park conists of approximately 135 acres as is located West of
Linder, North of l~l. Franklin and South of the Railroad Tracks.
Morrow: "The last time we met the main concern was with the wet line of the sewer
system and the service that can be had by that. We have researched that and have
found that approximately the eastern 40% of the Park can be serviced by wet line
sewers. This area conists of 35 acres that is currently zoned M-1 Industrial
in Ada County, the remaining portion belongs to Boyd Baxter Farm. The remainder of
the Park cannot be serviced by gravity flow sewer lines to Linder Road. Therefore
we are proposing a three part solution. First, that all phases be required as a
Conditional Zoning to have wet line sewering. Secondly, any developer, or a developer
with any phase, shall in accordance with the current Meridian Sewer Plant install
the standard lines, the lift station and the pressurized lines that are necessary
to service that area. Third, as a interim measure, we would like permission to have
these phases that can 6e serviced by wetline sewer proceed with the active recruiting
of Industrial Users for .that area. This does a couple of things - one it gives the
smaller parcels which range in size from 1 to 14 acres the right to pursue smaller
users - second, the remaining portion of the park, with the zoning, can take that
zoning and the figures for the sewer line and present them to large Industrial Users
so that they can begin to make their financial plan and either gives a yea or nay
when we begin actual recruitment for those people. The third item would. be-at the
present time the sewer line comes from here to there which would have to be put in.
There was also, when this is ready for development it is entirely conceivable that
other .phases along in here will be developed and the sewer line would be smaller in
size."
Bill Knickrahm: "What you are seeing here depicted is nothing more than a compilation
of your existing proposed Meridian Sewer System. This is not an interim lift station
that we are generating, it's not a proposal that in fact tivas of our design, but rather
reflects designs prepared by J-U~-B Engineers under Federal Grant. We are not talking
about any alteration of the now proposed Meridian Sewer System. Second I want to point
out, when you talk .about utilizing the ground - the portion that can be wet line sewered-
none of that is property owned by people you see before you. However, we think in a
doctrine of fairness it seems imperative to us that the City design and implement
policies to govern it's growth. But within those policies it also seems as an element
of fairness that the City give every opportunity for potential residents, or members
of the City, work within the governs or confines that are create. What I am suggesting
here is really nothing more than doctrine competition. l~lhat you have here is within
the confines of-would I think I perceive as your design for the City of Meridian,
how you focus,, Industrial ground in your overall Comprehensive Plan to implement that

Milton Subdivision Preliminary Plat - 1304, 1312 and 1316 2 1/2 Street
Dick Fischer: "I am with Potter and Associates and Mr. Milton was unable to attend.
The reason for this Preliminary Plat is that this property is in an Estate,
they tried to sell the property as a whole and it didn't sell.°°They would like to
make a lot around the single family residence, Lot 3-- Lot 1. around where the duplex
is and Lot 2 the vacant lot in the back which is undeveloped. Owners of this
property are not going to develop this in any way - just want to split it and sell it.
The comments that were put forth by Councilmen on this - the sewer line is in the
back 1'30 feet, we've shown an easement back. there, a 10 foot easement and this could
be whatever the Council would desire - if they would like it wider. The one question
that was brought up about the fences by IKr. Orton - that has been taken care of and
the existing fence lines are going to be used and quick claims are going to be granted
from everyone involved. There has been a lot of problems out in that area and we
uncovered an awful lot. As far as doing any roadwork on 2 1/2 Street or on 4th Street
- 2 1/2 Street would be done under a LID at a later date according to ACRD and they
have a statement in there that"prior to development of Lot 2 ACHD shall review and
approve the Lot access and development plan and this restriction will be delineated
on the plat". As far as what Mr. Williams said about the property already being
subdivided once - the whole block has been subdivided, this is no different than the
Subdivision to the North of it. It's basically like Olive-Dale Subdivision - this
was part of this block to begin with. I feel we have gone all courses that we
possibly can on it. As far as the water line on 4th Street that Gary Smith
brought up, we feel that that should be extended when a developer goes in and does
the development on the street. Planning & Zoning has put a restriction upon this
property saying that there will be no structures or building without going back
through them and back through you people, so it's covered in that area."
Orton: "If you do some development in the future, you have a choice of either not
platting that large lot or platting again, is that correct?"
Fischer: °'Anything that will be done to that lot is to go through the Planning and
Zoning again. Anew plat would obviously have to be filed. This is a.Preliminary
Plat and there is a Final Plat definitely being filed -'I didn't draw anything up
on a Final Plat until we got approval of the Preliminary Plat. But there is every
intention of Filing a Final Plat on this property,"
Kingsford: "What advantage in having Lot 2 involved. in the platting process -
I think I would rather see it be unplatted, and plat Lots 1 and 3."
Fischer: "If you plat Lots 1 and 3 you are creating Lot 2. He owns the whole
parcel, we are replatting to make three lots.11
FiscYier: "As to the concern of the Fire Department, we are not changing anything
that is already in existence out there. When Lot 2 ever does get replatted then
there would have to be new configuration for the streets, access, etc."
Kingsford: "Is a t0 foot easement enough for the sewer?"
Earl Ward: "Too small - this is not a goad location and would have to have a
16 foot easement."
Fire Chief Welker: "We have done this before without proper easements, street
dedication - all we are doing is compounding the problems existing there without
having that back lit platted, Everything needs to be handled in one basket."
Kingsford: "Ts that what ACIID asked for?"
Fischer: "Yes"
Fischer: "We are dedicating 30 feet on Third Street and we are dedicating 30 feet
on 2 1/2 Street."
There was much discussion concerning future development.
Vern Schoen, Bldg. Inspector; "One split doesn't have to be platted and if has
street frontage can get a building permit legally. This one does not have street
frontage - it has access but no frontage"
Kingsford: "I appreciate Dick's (Williams) concern that we don't have the personnel
to research everything that this body, or Planning and Zoning, has done before

Senior Citizens Housing Project Input - John Trowbridge
Trowbridge was present representing Halbeth Management & Consulting Sezyices
and stated that Hal Hogan had been approved as a HUD Coordinator. HUp has approved
a project in Ada County and they felt Meridian has~the ~aci7,ties to a~,low a
Senior Citizens project. Trowbridge stated that they had ,lgoked at three ~ropertie~
John Tromburg (East of 2 1/2 Street); Lembke property (King & 2~eridan $t) and
Art Moore, (East Pine). This project would need high density zoning. There is
$914,000 allocated for a project in Ada County.
Tt was the feeling of the Council that Trowbridge should contact the Senior Citizens

boundary should be shown on the plat, so it's located, and that it is dedicated.
The tie distance from the N.E. corner of the subdivision changed 36.42 feet from
the Preliminary Plat."
Potter: "That's correct - that's how much difference between possession owners and
record owners."

"No building shall be constructed on Lot 9, sn Block 1 of the amended plat of
Country Terrace Subdivision prior to approval of the Ada County Highway District,
pertaining to comb?etion of improvements of Country T-~rrace Way .lying southeasterly
of the cul-de-sac. The construction of Country Terrace VJay from the cul-de-sac to
the east boundry of this subdivision may be inappropriate at this time, since the
east .bordering land development is not certain. ?recently, the Country Terrace
Way cul-de-sac is fully improved, thus providing improved public access for all
lots, except Lot 12 and Lot 13 (the well lot) within the Subdivision. Since

companies such as Ryder but local basis. They rent, sale and lease trucks to local

Eley: "We feel we can be a good asset to the community, we feel our equipment is
front line, first class equipment and we always maintain to display that way. We
try to put on an excellent appearance and being at the entrance of town we intend
to make .a good presentation at all times." "We happen to have about a half a million .
worth of equipment out on that front line and it is all maintained, serviced and ready
to use at all times."

Dick Fischer and Dale Milton were present with Subdivision proposal located on
2 1/2 Street, directly behind 130, 1312 and 13.16 2 1/2 Street, Stoner Estate.
Fischer: "This piece of property was on the market, was not sold as one piece of
property. A developer would not want to develop Lot 2, for example, and have a
single family. residence on Lot 3. Mr. Milton and the Estate wants to divide the
parcel up into three different lots - Lot one being with the duplex, Lot 2 being
the back piece of property and Lot 3 being the single family residence. It is not
the intent of Mr. Milton to develop Lot 2 in any way. He just wants to plat this
into three different Lots and let somebody purchase Lot 2 and at that time if the
purchaser wants to Subdivide it or put a Planned Unit Development in, or recreation
center, it would be up to them to re-subdivide that plat."

Fischer: "To Lot 2?" Mitche'~1: "Yes" Fischer: "We are dedicating thirty (30)
feet of 4th Street. 4th Street deadends at the property line right now. We are
dedicating our half of 4th Street to the property. According to Ada County Highway
District we don't have to extend 4th .Street because of this type of a Plat. 2 1/2 St.
would be done under a LID at a later date. -Ada County Highway District wants a
dedicated 30 foot right~of-way from center line of 4th Street, which we're doing,
and they said"prior to the approval of Lot 2 the ACRD shall review and. approve Lot
access and development plan. This restriction to be delineated on the plat " which
we intend to do on the plat. Also, 3rd Street, which ends just north of the property
line can be extended if the property is developed, and can be developed into the
property. It abuts against the fence." "Rick Orton was wondering about the fences -
the reason that our property does not hit the existing fence line is because there was
some surv~ey_probl~eras out there and at the time that J-U-B Engineers did the
survey for Bates property the existing fences were out there and rather than try to

fight or get into a hassle with Mr. Stoner on this property, they elected to Plat®
the Subdivision for Bates' up to that existing fence. We have since surveyed this
property, we have contacted a lot of people out there - we show the boundary where
theoretical~ly,it'S supposed to be and Mr. Bates is going to work with Mr. Milton
and the property from our property line to that fence belongs to Mr. Bates - there
is no question about it." '
Pitchell: "How about these people bordering, like Ferguson?"
Fischer: "Actually what they are going to be doing is gaining property"
Mitchell: "And then the Corporation over here and Hawkins?"
Fischer: "The people on the other end - J-U-B Engineers did a survey for A&C Corp.
and the determined property line that they surveyed, the pins are about 12 feet to
the south of our property line. So the A&C Corp. would actually be gaining about
12 feet."
Mitchell: "Then there is no problem getting this corrected?"
Fischer: "No, as far as we are concerned, what we have out there, what we call the
deed line has pretty much been agreed. on by the property owners as this is where it is."
"The Fire Dept. has stated that they disapprove o-f the proposal. We are not changing,'
anything that is not already in existence, other than making it into three lots. The
access is not being changed. Like I say, if Lot 2 is developed in the future, then
4th Street will be extended and possibly 3rd Street be extended for the Fire District.
It would be for public access but for the Fire District also.:'
Mitchell: "It is possible to bring 3rd Street down and come over on 4th Street?"
Fischer': "It could do that or brought down a make a culdesac so it could be brought
into Hawkins property or the back of A&C Corp - or could be brought around into a 90°
back to 4th Street."
Mitchell: "Someday, Someway, Somebody is going to have to do something with that
lot too."
Fischer: "Whoever develops Lot 2 is going to have to come before the Planning and
Zoning and Plat the whole thing."
Chairman Hinrichs: "Anyone from the public wish to comment?"
Debbie Hawkins: "My concern is,`when they surveyed about a month ago, Mr, h1ilton
contacted my husband (Jack? and of course they went out and surveyed, remeasured -
and it sounds like everyone tends to gain but us, we are losing property. There is an
existing fence line that has been there for years and we are loping between four to six
feet of our property. At the time that Mr. Milton did the survey artd njy hu~b~nd ta~~ed
to him, we were not aware that an existing fence line after so many years, and if we
have maintained it, we have some right to it. lde are losing several feet of our
property. My husband. couldn`t be here because he is working and I don't know as much
as.he about this. We are not too happy about this situation as you can see everyone
is gaining but us and we have maintained this property for eight years in August.
At the time we were concerned about it but hadn't gotten to check into it, since then
we have talked to different people and an attorney, and found out where we stood on
this, which would mean the way the survey stands right now my husband would have to
do some changing around."
Sharp: "Which parcel is yours?" "This parcel marked as "Lands of Flawkins?"
Hawkins: "Right" i
Mitchell: "Doesn't Grandfather rights have something to do about those buildings?"
Fischer: "The only way I can answer that is that we will survey the deed lines for
the deeds that we get. We will also locate possession lines, which we have got -
and then it is up to th,e property owners involved to come, between them and get a
property line agreement or resolve the problem."
Ethel Hawkins: "When Dale Bates developed his property they surveyed it, on Badley Ave.
the street right-of-way was O.K. And when they started surveying I think it was about ',
a 30 foot strip and everybody was that much too far south. I couldn't go to the
Hearing at that time - about 1972 - but they went to court and they surveyed, and
surveyed that part of the street and finally got all of those boundaries. I thought
he bought a strip between the street and his pasture. It seems like that's where
everybody put their fences up. It started in Carlton and ~1rs. 6Jebbs property was out
in that half of Carlton and it was off that much. I know they went into Boise and
did a lot of work surveying - and I thought every boundary line was taken care of on
down to Carlton Street at that time. And there was a strip that Dale bought and he

put his houses right at Badley Avenue. Our property line was right and I am on the
corner of Badley and 2 1/2 Street."

Hawkins: "No but we were involved and had to go to court at the time the 30 foot
street was put over,"

Hawkins: "Pdo, all our survey pipes were fine - but it was everything on south."
"I don`t know wFrat happened with Jack Hawkins', I thought everything was
settled. I can't remember how much they finally decided."
Fischer: "We have talked to Dale Bates and J-U-B Engineers, and we've compiled all'
the surveys that were done out there and there is unquestionably some problems out
there."
Hinrichs: "Planning and Zoning cannot resolve problems with property lines, anymore
than the surveyors can. .Our question will have to be simply do we approve this
Preliminary Plat?"
Sharp: ".I don't think we can approve anything until we have some property lines we
can approve. To me, this is something for the people to work out or go to court and
let the court decide. We can't change property lines - we have no jurisdiction in
that area. But frankly, the strips are quite narrow - a little shifting, a little
trading should be able to be worked out so that everybody could be happy."
"I think it would be improper for us to try and Subdivide a piece of property if we
don't have a legal description that at least everybody that attends the meeting
agrees to."
Dale Milton: "Mr. Hawkins, Jack, and I chained this all out and I don't understand -
when I left that day I thought he ,figured he was gaining about seven (7) feet."
Debbie Hawkins: "(do we didn't gain any - that day there was a verbal agreement and
then after talking to several people about the property lines and had talked to an
attorney about it „ we have an established fence line there - we tend to lose several
feet with this."
There was discussion between Debbie Hawkins and h9ilton which had no bearing on public
hearing.
The Motion was made by Sharp and seconded by Mitchell to table Preliminary Plat of
Milton Subdivision until requested to be removed from table and reconsideration.

Fischer: "When we came in tonight we thought the boundaries were resolved."
There was discussion stating that everyone else does not object. All property owners
within 300 feet have be mailed by certified mail notice of public hearing. There
were no objections.
Fischer: "The legal description that is on that map is the legal description that was
furnished to us and we surveyed it per that legal description. GJe surveyed these lines
which is on a legal description he has, and we just showed on here by lines - the
fence line."
Milton: "Mr. Aubrey Smith had stated back in the 40's somebody wanted to move these
(boundaries) and went out at night and moved the stakes and this was where they put
the fence in. He (Smith) said when they sold that property on the south end where
the apartments are (The Villa) he just went out and moved his fence over and let them
have it - he didn't even argue over it."
Milton: "You wont give us a decision for another months?"
Mitchell: "I requested that Sharp modify the Motion to say "when you guys are ready -
bring it in"

a landlocked piece of ground that somebody is going to be very upset about because we
wont let them develop. I would be hard pressed to vote against a development, but I
would not be hard pressed to put same very serious restrictions on what could happen
there - the type of development, the street configuration and so forth."
"There's going to have to have streets come in here - at least two different points"
"The only thing we've got to protect the City and the future owners against is that
they have a right to use that particular land, so I think we want to say there will be
no development including building one (1) house until such time that it comes back to
Planning ~ Zoning and City Council."
Fischer: "We have no objection for a stipulation like that - whoever buys it is going
to be made aware that they are going to have to come back in to get your approval."

to the City Council that they approve the Preliminary Plat of Milton Subdivision
subject to a property line agreement made between Jack Hawkins and Dale Milton and

Right, of way of 2 1/2 St. and in right of way of 4th St. The 4th St. line
ends at the S.E. corner of this property. Developer needs to extend this
8" line across the East boundary of Lot. 2 2. San.Sewer: An 8" dia.
line exists about 130' East of 2 1/2 St, and flows North. A 10" dia. line
exists in 4th St. and extends along the East boundary of Lot 2.

wince all of the property is in an estate, it was felt, by the Heirs, that the
property would sell faster if it were split into the following three lots:
Lot 1, An existing duplex is on this lot and is to remain.
Lot 2, Is an open 1.75 acre field,.This lot if sold separately from the
others can be developed into a nice planned unit development or a recreation center
without further dedication other than what we are dedicating on this subdivision.
The Heirs of this property do not ~,ntend to develQpe the property but to sell it.
Lot 3, This lot has a single family resident on it and it will remain;
