Highway Access: The site is located approximately 1/4 mile from Franklin Road via Taylor Avenue, and is approx- imately 1 to 1.5 miles from the freeway interchange at I-84. Yard Area: The yard improvements include approximately 208,000 sq. ft. of asphalt surfacing and parking area, plus 2000 cubic yards of gravel surfacing. The Council approved the subdivision plat at that time. I have discussed our phone conversation with Mr. Fischer and he has directed me, to write this letter so that we might obtain more information regarding what Fischer-Marcola Company can do presently to further subdivide and develop the 10 acre parcel known as Lot 8. It was my understanding from our phone conversation that the final plat of the Crest Wood Industrial Subdivision has not yet been recorded due to the sole fact that one of the owners of real property located in the Subdivision has not yet executed his signature upon the plat. However, I further understand that the lack of recordation of this plat would not prohibit Mr. Fischer or a purchaser of Mr. Fischer's property from presently acquiring a building permit for an industrial use that would be otherwise compatible with the zoning designation applied to the property by the City of Meridian. I also understood that Mr. Fischer could, without waiting for recor- dation of that final plat, file his own plat (or replat) for just his ownership (Lot 8) and that such a plat would take precedence or priority for future development of lots designated in such a plat. In other words, Mr. Fischer could, assuming he complied with zoning and land use restrictions, including minimum parcel size requirements, subdivide (or plat) his land into smaller lots and sell those lots to individual users even 0 Jack Niemann July 23, 1985 Page - 2 0 though the overall plat of the Crest Wood Industrial Subdivision has not yet been recorded. I would appreciate confirmation of this understanding or, if I have misunderstood what you were saying, clarification of how Mr. Fischer might proceed to subdivide his property. His intent, of course, is to divide the 10 acre parcel into smaller lots and then to extend services and streets to those lots so that they might be sold to individual purchasers for industrial uses. He would like to proceed with that plan as soon as possible irrespective of whether the overall plat for the Subdivision has been filed. Therefore, in order to begin this development of Lot 8, I would request that you send to me copies of the applicable zon- ing and land division standards for the City of Meridian so that we can begin that subdivision process and hire a local engineer to do the necessary survey and design work. If there are spe- cial considerations or requirements that must be met regarding extension of services, street design, use of the adjacent rail line and any other factors, I would appreciate copies of those requirements so that we might review all of the City of Meridian's requirements at one time. Finally, I understand from you that Mr. Fischer could develop his property even without subdivision at this time and that the City of Meridian has no present enforcement proceedings or any other proceedings against the Crest Wood Industrial Subdivision other than waiting for the final signature in order to allow recordation of the final plat, Mr. Fischer was most pleased to learn that he could proceed with development, assum- ing that I understood you correctly, and it is his desire to be- gin that process as quickly as possible so that he might satisfy the City of Meridian's requirements in a timely and complete fashion. In our letter dated March 16, 1984, we indicated several conditions must be met prior to acceptance of the street for dedication and maintenance. These are reiterated below with our comments on that information which has been presented: 1. Plat review fee -of $100.00 has not been paid. 2. The right-of-way dedication of 40' from centerline of Franklin Road to the parcel is not defined/delineated on the plat. 3. The deposit to road trust in the amount of $27,023.00 has not been paid. 4. No test data to substantiate the street construction has been received nor have we received the engineer's written certification. 5. Submit sample data of soil conditions and the resulting "R" value and gravel -pavement required for comparison to that indicated as being currently installed. 6. The centerline radius at the right angle turn from NW 10th Street to Taylor is 80'. This should be 280' for a 25 mph speed limit. Since the street is already constructed, an alternative will require a sight triangle restriction in the plat at this location. 7. Full details of the box culvert are not shown, but are required to facilitate future inspection and repairs. 8. A barricade will be required at the east end of the cul-de-sac. 9. However, it was not platted pursuant to the Ordinances of the City of Meridian. Due to an over- sight of the City or special arrangements made, a plat was not required at the time the property was subdivided. The City of Meridian has taken the position that it would like to see the area platted as required by State law and Ordinance of the City of Meridian, and Crest Wood has consented to do the platting. In the past and at this time, the City has not taken the position that a building permit could not be issued due to the lack of platting but, if the plat is not finalized and recorded in the near future, the City could take the position that until it is platted building permits could not be issued. DRAINAGE 1. The District will not accept any increased flow or drainage of decreased quality from a tract of land due to changed use. 2. Drainage plans prepared by a registered engineer may be required where deemed necessary by the District even though on-site modifications to the District drainage system are not required in the development plans. B. C. IRRIGATION 1. The water rights of this District are not the same throughout the District. Neither are these always the same on one tract of land. Often these can be simplified without changing the Court confirmed status of the rights, if arrangements are made with the Secretary of the District in the advance plan- ning stages. 2. Any alteration from the original delivery point must be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan acceptance by the Board of Directors. 3. If irrigation service is not to be provided to the individual properties, all property owners must be notified that the District tax is an obligation of all lands in the Irrigation District. This notifi- cation is in compliance with Idaho law. 4. Smith: I knew of the project on Ten Mile Road from Franklin to Cherry Lane and understanding that we had a sewer line project for about a A of a mile south of Cherry Lane I called the Highway District and told them of our plans. We didn't want the overlay to extend to Cherry Lane Road, that if they could cut it off a quarter mile south of Cherry Lane Road that would be fine and would work with our sewer project and then they could come back and finish the overlay after we had the sewer line in. I was told by the Highway District that they could accomodate this. Not to long after I received a phone call stating they were laying asphalt down out there. I called ACRD, I was told they were putting down a coat that levels the asphalt and takes out the unevenness of the road and they had let that part of it get away and they had that done but they were going to hold the final overlay. Kingsford: It was my understading that that was as far as they had gone also. Eng. Smith: I will check in the morning. Kingsford: We have in the past used the Juvenile Court Services people in the park, public works and so forth, because of a change in the law that held us somewhat liable for workman's comp. we discontinued that policy. I think that we have an obligation to help employ and serve those juveniles. I basically need Council's approval to sign this agreement with Juvenile Court Services to use their juveniles in the park. The Motion was made by Tolsma and seconded by Yerrington to authorize the Mayor to sign that agreement. Explained more about water quality and specs for bids. The new Chairman for APA is Steve Gerber, and Vice Chairman is Mr. Dirk Kempthorne. APA asked that we all get behind the census project and support that, they will be giving us further information. There will be an inventory done on emissions. One item that we were asked to consider is Shekinah Industries, Inc. placed a mobile home temporarily at 1050 Franklin Road to be used as a temporary office for six (6) months, they've asked that they have an extension on that, that they are going to start construction in the spring. Morrow: I don't have any problem with extending it, but it looks to me that we need to do is basically say yes but this is the last extension. Tolsma: That porta pottie they have has to be gone in another 6 months per Central District Health.
