The Board of County Commissioners hearing will be held on Wednesday, June , 1984,~at 7:30 P.M. in the Les Bois Room, 3rd Floor of the Boise City Hall, to consider the following: 1. The Meridian Area of City Impact Map Ordinance An ordinance establishing the boundary of the Meridian Area of CPty Impact (attached), with provisions for treatment of property divided by the Area o.f City Impact boundary, for renegotiation of the ordinance and for a severance clause. 2. Additional purposes of said special meeting shall be to take testimony on and consider and take action on two resolutions dealing with (1) the referral process between the City of Meridian and Ada County for land use applications and (2) the adoption of two referral areas where land use applications to the County in those areas must be referred to the City of Meridian. The public is welcome to attend this special meeting and testimony, both written and oral, will be received and considered. If Meridian wishes to annex lands outside of its Area of City Impact, it shall renegotiate its Area of City Impact boundary with Ada County in accordance with Idaho Code 67-6526(d). 3.0 PLAN POLICIES AND ORDINANCES TO APPLY TO THE MERIDIAN AREA OF CITY IMPACT - 3.1 The Ada County Comprehensive Plan - Rural Area Section adopted by Ada County as of May 18, 1983, shall apply to the Rural Area as identified on the Area of City Impact boundary map in Cit Ordinance Number -t-`~--'-- and County Ordinance Number , which is the land area outside the Meridian City limits but within the Area of City Impact boundary. 3.2 Both Meridian and Ada County shall amend their Comprehesive Plans to be consistent with this ordinance. 3.3 The Ada County Zoning Ordinance shall be used to implement this ordinance. 4.0 COORDINATION OF PLAN AMENDMENTS, ORDINANCE AMENDMENTS, AND ZONING APPLICATIONS - 4.1 All applications for county and city amendments to their respective comprehensive plans and implementing ordi- nances which apply within the Meridian Area of City Impact shall be sent by the entity considering such amendment to the other entity. LAND SOLEY WITHIN OR TO BE INCLUDED IN THE CITY LI!V!ITS 1.1 Applications to amend the Meridian Comprehensive Plan or zoning ordinances, which application pertains to land already in the city limits or land which will be an- nexed into the City of 'Meridian coincident with adoption of the Comprehensive Plan Amendment, shall not be governed or controlled by this referral process or the Area of City Impact Ordinance. The City of P~ieridian shall, however, provide Ada County with copies of such applications 15 days prior to the initial public hearing on said applica- tion and the County, if it desires, may provide comment and input on the application. The Ada County Planning Commission shall determine whether or not such an amend- ment is in conflict with one or more of the goals., objec- tives or policies of the Ada County Comprehensive Plan. The Ada County Planning Commission shall notify the Me r= idian Planning and Zoning Commission of such determination in writing prior to or at such public hearing. Such input from the County shall not be binding or controlling on the City of Meridian but shall be treated as documentary evidence . 2.3 Once an amendment to the Meridian Comprehensive plan is adopted by the Meridian City Council, the Meridian City Council shall forward a copy of the final document to the Ada County Planning Commission within 15 days after its adoption, along with notice as to when the amendment will take effect. Any such amendment made by t_he Meridian City Council to the Meridian Comprehensive Plan, in accord with Idaho Code, shall not take effect in the unincorporated Meridian Area of City Impact unless and until such amend- ment is adopted by the Board of Ada County Commissioners as an amendment to the Ada County Comprehensive Plan. 2.4 All proposed amendments to the Ada County Comprehen- sive Flan Rural Area Section shall be forwarded by the Ada County Planning Commission to the Meridian City Plan- ning and Zoning Commission at least fifteen (15) days prior to any public hearing on such proposed amendment. All proposed amendments to the Ada County Zoning Ordin- ance which affect un~corporated areas of the Meridian Area of City Impact shall be forwarded by the Ada County Zon- ing Commission to the Meridian City Planning and Zoning Commission at least fifteen (15) days prior to any public hearing on such proposed amendment. SECTION 3.0 PROCESSING OF ZONING APPLICATIONS IN THE MERIDIAN AREA OF CITY IMPACT 3.1 The Ada County Zoning Commission shall send to the Meridian Planning and Zoning Commission all County ap- plications for Planned Developments, subdivisions, re- zones, conditional use permits and private roads, located witizin the Meridian Area of City Impact 30 days prior to any county public hearing on such applications. The Mer- idian Planning and Zoning Commission shall make recommend- ations to the Ada County Zoning Commission on such ap- plications in writing and shall cite the County Compre- hensive Plan Rural Area policies or other policies sup- porting such recommendation. Such recommendations shall be received by the Ada County Zoning Division no later than 24 days after Meridian has received such application. 3,2 The Peridian City Council shall make written recom- ~-:enc~ation to the Board of County Commissioners, and to the County Zoning Commission where appropriate, on any of the applications cited in Section 3.1 above. The region- mendation must be received by the County Zoning Division no later than 24 days after Meridian has received such application. The council shall cite the County Comprehen- sive Plan Rural Area policies that support their recom- mendation. That the adoption of Ordinance No. 324 was completed without the input of the County of Ada and was not adopted pursuant to the negotiation required by Section G5-6526, Idaho Code; that Ada County did not recognize the Area of Impact as adopted by Ordinance 324 ; that the City of P~Zeridian has used the Area of Impact as adopted in Ordinance 324 as a guideline for planning and development decisions even though not formally approved by Ada County pursuant to the procedure required by the Local Planning Act of 1975. 6. That Section 67-6526 (a) requires that the City and the County adopt by ordinance a map identifying an area of City impact within the unincorporated arFa,of the county at least by January 1, 1978; that Section 67-6526 (b) requires that if the Area of Impact is not mutually set by the City and the County by January 1, 1978, that within 3Q days thereafter, a com- mittee of nine persons should be agreed on; that said com- cittee is to meet and recommend to the City Council and the County Commissioners an Area of City Impact together with comprehensive plan and ordinance requirements. 7. The Meridian Area of Impact Negotiating Committee has recommended that the Meridian Area of Impact be defined as set forth on the attached map which by this referrence is in- corporated herein as if set forth in full hereat; the Committee has further recommended that Ada County's Comprehensive Plan Rural Area Policies, and Ada County's Zoning and Development Ordinances apply in the unincorporated areas of the Meridian Area of Impact; the committee has recommended two ordinances and two resolutions which by these references are incorporated herein as if set forth in full hereat even though not attached hereto. The first ordinance designates a :~eridian Area of City Impact boundary using the one-quarter mile section lines as the boundaries. A map is attached to this ordinance identifying the Area of City Impact. The map also shows related Referral Areas, which are discussed in the second resolution. Also con- tained within this ordinance are provisions for the treatment of property which is split by the Area of City Impact boundary and for a renegotiation process of the Area of City Impact and for a severance clause. The first resolution, which is called the Meridian Area of City Impact Referral Process, establishes the specific time periods and procedures for Meridian and Ada County to refer each other's plan and ordinance amendments to the other. Specifically covered are all amendments to comprehensive plans, the mooning Ordinance, and zoning applications. These items cannot ne considered at a public hearing unless and until the referral has been sent to the other jurisdiction within the specified time period. The contents of this resolution could have been put within the Area of City Impact Ordinances however, they were placed in the resolution so that they could be changed if the time periods or process proved to be unreasonable. Consequently, this resolution would require that Ada County notify Meridian of any County Comprehensive Plan amend- ment or any county negotiated Area of City Impact Ordinance affecting the Referral Areas. 12. Adjacent to and extending from this intersection are the Cherry Plaza Shopping Center, the Smith's Shopping Center, the Old Town Meridian area, and adjacent commercial sites to these three centers. Taken together, these commercial areas could be defined as a large community-sized shop- ping center. Normally a community-sized shopping center comprises between 100,000 to 300,000 square feet of floor area. Cherry Plaza includes approximately 135,000 square feet o f gross floor area and the Smith's Shopping Center includes approximately 64,000 square feet of floor area. At a density of three dwelling units per acre (DU/A), a community-sized shopping center can be expected to have a service radius of two to three miles (DeChiara, Joseph and Lee Koppelman, Urban Planning and Design Criteria (New York: Van Nos trader Reinhold Company, 1975;. p. 428.). The vast majority of the City of Meridian is zoned R-4 (8,000 square foot lots), which is equivalent to approximately three DU/A. From the intersection of Fairview Avenue, Cherry Lane, and East 1st Street to the proposed Meridian Area of City Impact boundaries, the distance in each direction is approximatley as follows: North--1 3/4 miles. East---2 3/4 miles (abuts the adopted Boise Area of City Impact boundary) . South--3 1/4 miles. West---3 3/4 miles. This Intersection may not be the exact center of the described three major shopping areas, but it is necessary to pick a specific location for analysis purposes. Also, these shopping center standards are general and must be applied and balanced against other factors such as existing land use, public service capabilities, geographic factors, and ability to annex. Additionally, there is a fairly large shopping center at the intersection of Fairview Avenue and Five Mile road and another fairly substantial shopping center at Overland Road and Five Mile Road; these two shopping centers appear to be visited more by City of Boise and Urban Boise residents, at least more so than by Meridian residents. GEOGRAPHIC FACTORS The Meridian. area has a generally flat to rolling terrain which is devoid of major geographic factors which would divide or unite the City of Meridian. There are no major rivers except for the Boise River, which is to the north of the proposed Area of City Impact. There are no major elevation changes, with the possible exception of the benches or rims which do not seem to pose any major barrier to city development or expansion. Roads are a major man-made feature of the geography of the Meridian Area of City Impact. However, only Interstate 84 could be considered as a barrier. This 2-84 barrier will become less of a factor in the future as the Eagle Road interchange is developed. In addition, transportation plans (Ada Planning Association, Transportation Plan for Northern Ada County, (October, 19 2 p. 3 Aeridian Comprehensive Plan, p. 18.), call for the construction of a Locust Grove Road Overpass in the long-term future. This will also lessen the barrier of I-84. The Southwest Community Wastewater D~anagement Study (1980) indicates that the general flow of ground water from South- west Boise/Southeast Meridian is toward the City of Meridian. This northwest flow of the groundwater applies to all the land which is generally north of Amity Road. At Amity Road the ground water flows directly. west, ante south of Amity Road the ground water floes in a south to south- westerly direction. &REAS '.THciT',CAP1' REASONABLY BE~ EXPEC'1'E_') TO BE ANNEXED TO THE CITY IN TFiE FUTURE The Meridian Comprehensive Plan, adopted in 1978 and as amended in 1984, indentifies an Urban Service Planning Area (USPA) for the City of Meridian. Peridian is expected to grow to approximatley 20,500 people by the year 2000 (Ada Planning Association, Demographic Report Ada Count , Idaho, (July, 1984) p. 3.). In fact, an accident which occured on Cloverdale Road might actually occur in both cities and involve responses from two police departments, fire departments and ambulance services. Consequently, quarter-mile section lines would be used as boundaries rather than roads . An additional factor considered in this category of Area that could reasonably be expected to be annexed is that the City already has great amounts of land zoned for residential, com- merical and industrial uses but have yet to be developed; addition- ally the rieridian Comprehensive Plan encourages infilling rather than sprawl and has a policy that development locate adjacent to existing similar development and uses. 13. That since the City already has large amounts of annexed but undeveloped land within type Citi limits, considering many of the policies of the Peridian Comprehensive Plan dictate infilling and the locating of new uses adjacent to existing uses and considering that all new development is required to endeavor to connect to municipal water and sewer, the City concludes that development outside the City limits but within the Area of Impact should not be encouraged. The Motion was made by Jim Kling and seconded by Burl Pipkin that the Planning and Zoning Commission accept the Settlers Village for the concept of zero lot line Condominiums provided that prior to the time the Preliminary Plat is submitted the City of Meridian has in effect an ordinance providing for the condominium concept and that the preliminary plat conform to this ordinance. Idaho in the Meridian Original Townsite for office space for an attorney. Mr. Glaisyer stated that parking will be provided on a lot to the East which is now a vacant lot. This will be prepared in the near future by black topping. }: ~; „. /~„ The Motion was made by Annette Hinrichs and seconded by Jim Kling that the Conditional Use Permit be granted to Joseph Glaisyer at the premises of 35 E. Idaho for use as an Attorney Offices contingent to acceptance by the Nampa-Meridian Irrigation District and the paving of the parking lot. Motion passed: All, yea. Mr. Edmon Jones was present to discuss the request for Conditional Use for the premises of 14 E. Carlton in the Nourses 3rd Addition. He presented a parking proposal for the use of the land. The Motion was made by Don Sharp and seconded by Lee Mitchell that the Commission recommend to the City Council that the Conditional Use Permit be granted to the premises of 14 E. Carlton located in the Nourses 3rd Addition for the purpose of permitting office use. Motion passed: All yea. Impact Area matter was discussed. It had been agreed by the Commission to take action on this as a result of the Impact Area Hearing held before the Commission on March 27, 1978 at the American Legion Hall. All present at this hearing offered favorable comment for the acceptance of this impact area. There has been no negative response concerning this area. The Motion was made by Don Sharp and seconded by Burl Pipkin that the Commission recommend to the City Council that the Impact Area as defined in Ordinance #319 as described County line on the West, Highway 20-26 on the North, Cloverdale on the East as far South as the Freeway-Overland area, then including 5 Mile, 8 Mile and 10 Mile Creek drainage but extending no farther East than Cole Road or the New York Canal whichever comes first, then returning West to the County Line is the general vicinity of the Rawson canal be approved. There was an unanimous show of hands when Mr. Rowley asked of those that were in favor. The Question was asked as to a time table on developing the Impact Area. Mr. Rowley stated that they do not base a definite schedule but hope to have this proposal finished June or July,, Also the Comprehensive Plan. H. J. Cox, City Clerk, explained to the attendance that ordinances would have to be made that will encompass our needs. Mr. Cox noted that Boise will be involved and claim that some of the area that we are involved with has an impact on them. The whole County has a impact o:i Meridian and Meridian has an impact on the County. The reason for this hearing is to meet deadlines. Mr. Cox stated that we have met this particular deadline and we are keeping the ball in our hands and we are on top of the situation. Mr. Cox also explained that the County makes ordinances outside of the City of Meridian, they must make ordinances that we can live with -the City cannot make an ordiance in this impact area. We can only tell them of the ordinance we desire. Mr. Rowley stated that as the Impact Area is established, the ordinances will be negotiated between the City and the County and will be established at that time. The question was asked if the ordinances the City adopts in Meridian will govern the Impact Area. Mr. Rowley explained that not all of them because not all of them would deal with the outlying area. As Meridian expanded its quarters then those areas will come into the total, City ordinance, but the ordinances that are in the Impact Area is something that has to be negotiated between the County and the City. Question: Is it true that the ordinances in the Impact Area could end up to be the City of Meridian ordinances? Mr. Rowley answered that if the ordinances that were negotiated could use the Meridian Ordinances entirely if the County will agree. They can insist on negotiating a whole new set of ordinances. There will be ordinances of their own in Meridian Impact Area. These have to be negotiated between the City Council and the County Commissioners. H. J. Cox explained that the Comprehensive Plan is a plan that tells us how we want to get where we want to go. He stated that he didn't believe we would have the Ordinances done at the same moment that we have the Comprehensive Plans and yet they both might come together. Question: What happens if the City and the County cannot agree on Impact Area? Mr. Rowley stated that this could be taken to court in the end. The Commissioners have the last word until the Judge takes hold of it. He reported that there has been no objections anywhere to this Plan. Jim Kling, P&Z Commissioners, s~~~al that there very well may be some opposition to this Impact Area Plan and he cautioned that to make sure it goes we might have to get out and knock on some doors. Mr. Kling stated that he wants to see this Plan go but the people in that area have to want it to go. Bob Waitley stated that looking in the aspect of the underground water mod sewer systems and this right alone is the whole idea of accepting area into the Meridian Impact Area. Ebert' bit of water to the east of Meridian will be coming right through this area - This is a natural drainage of the water. This would be the strongest argument that we have to include this area to Meridian Impact Area. He suggested the we get on with ~". the plan, the quicker the better. Y "'' Bud Persons suggested that if the City of Meridian wants the area East of Cloverdale ' included in our Impact Area -lets go after it before Boise does it. `' Bob Waitley stated that there is a very high turnover in the Ada County Planning `~ Commission. He thinks that we should go after this area (east of Meridian) for all ~5, it's worth. The Members have changed and maybe they will have an entirely different look at it. ~", 6~= ~~ ~ ~ Willard Rowley announced that the Commission would be meeting on April 10th. ~•~'` Also he announced that by ordinance the Commission has changed their regular meeting ~,~.: ~„ . »~ night to the second (2nd) Monday of each month, starting the first of April. ~~.
