BOX 1552, TELEPHONE 208-344-8646 Re: IGA Remodel, Cherry Plaza - Water/Sewer Connection Fees Dear Mayor Glaisyer: We have been informed by the Building Department that a connec- tion fee of $1,880 for water service and a fee of $4,800 for sewer service will be charged on the above referenced project. We feel that this is an unfair assessment and that our client, Mr. Paul Zatica, is being grossly overcharged for the follow- ing reasons: 1. Our remodel project consists of a 3,120 -square foot addi- tion to the rear of the existing building. The existing water service and sewer will remain unchanged and so will the useage. 2. Our client installed the complete water and sewer system and provided the 20 -foot easement completely around the rear of the shopping center at no cost to the City of Meridian. This work was done in 1977 and 1978. He also provided the easement, at no cost to the City, for the City sewer interceptor line to run through the eastern edge of his property. 3. Approximately $40,000 in connection fees were assessed at that time. Since our client had installed the water and sewer and provided the easement at no cost to the City, Mayor Storey agreed that $40,000 was excessive; so a connection fee of approximately $20,000 was paid. We feel that a connection fee should only be paid on the square footage of this addition. No additional fees should be paid on the remainder of the store, unless connection fee increases are paid on an annual basis by all users. We request a meeting with you and a representative of the Public Works Department at your earliest convenience. I would like to suggest to you that what may have seemed to be the right thing to do at the time to alleviate a hazardous condition has now, in fact, created an even more serious problem with our customers making u -turns illegally to attempt to go into Boise and risking their safety while they do it., I recently have had a conversation with Mr. Frank Capshaw of the Highway Department in which he indicated that the responsibility for instigitating the construction of the traffic barrier belonged to the Meridian City Council. He also told me that the Highway Commission had suggested to your City Council that they hold a public hearing which, of course, was not done. Realizing that your Police Chief, Roger Sherwin, felt he had a traffic hazard on his hands, does not seem to me like a justifiable reason for overreacting to the situation. The merchants I represent are losing money and in some cases, their financial stability has been, and will continue to be, seriously restric- ted in part because of the lack of consideration given by their own city fathers. It escapes me why you would go behind these peoples' back and push forward with something that has as serious a consequence as this does. It is not too late to correct the problem. May I suggest that you consider organizing a public hearing on this matter. This is a serious matter to these merchants and also the patrons that are attemp- ting to exist the shopping center. I do feel that the City Council may have opened themselves up for a potential legal action. There is no one that wishes to pursue the courts in order to correct this injustice, however, if additional economic damage is done, I could see where hostilities Idaho First Plaza Suite 1701 101 S. Capitol Blvd. Boise, Idaho 83702 Phone (208) 345-1842 In addition to working out the mechanics of the Area of Impact agreement, { we will ask our staff to review the plan policies and ordinances that are proposed to be applied in the Area of Impact to determine their consistency with the goals and policies of the County Comprehensive Plan prior to finaling the agreement. The details of boundaries will of course have to be considered for each city individually also. The Area of Impact legislation within the State Code leaves a number of questions unanswered that can only be resolved through cooperation between the County and cities. We have been pleased with the manner in which these problems have been resolved in the negotiations thus far, although the actual implementation of the agreement over the next year will certainly point out shortcomings that will have to be adjusted through further County-City negotiation. The problems associated with leaving the sewer system as a private system and not meeting current Department of Health and Welfare standards was discussed in the Council Meeting. It is the opinion of the City of Meridian that if the sewer is not built in accordance with State standards that the City and the Cherry Plaza Development will inherit maintenance problems in the future, whether the system is private or public. You state the plans were submitted to the Meridian Fire Department, Public Works Department, and Building Department and were approved by them. Issuance of a building permit does not constitute approval of water and sewer line extensions. The Public Works Department stated they have repeatedly requested plans and specifications of sewer and water lines be prepared by a registered professional engineer and submitted to the City for review. The City of Meridian must accept only sewer systems which meet State standards and provide minimal maintenance. The City does not want to inherit a system which may cause problems to both the City and the development. Therefore, corrective action to overcome the apparent deficiency in the existing installation will be required before the City can.approve the facility. It was also determined that these systems must meet city requirements, be approved by the Idaho Department of Health and Welfare, and be located within easements. We employed J.U.B. Engineers to prepare plans and easements for the water system, which had not yet been installed, and prepare easement lines for the sewer system which was already in place. J.U.B. Engineers recently informed us that the sewer line was not installed in a manner that would make it acceptable as a public system. We feel that the sewer should remain a private system as it originally intended for the following reasons: 1. The sewer system was planned and engineered by our office to be a private system. 2. The plans showing this private system were submitted to the Meridian Fire Department, Public Works Department, and Building Department, were approved, and a Building Permit was issued which allowed us to construct the sewer system as shown._ 3. The sewer line was installed as shown on the approved plans and additional manholes were added as required by the Department of Public Works. The sewer passed the standard air and daylight test for sewer systems. Since the City of Meridian did not determine that the sewer system -would have to become a public system until after it had been installed it should be allowed to remain a private system. ZONING & PLANNING WILLARD ROWLEY CHAIRMAN ZONING & PLANNING During our meeting of March 16, 1977, we discussed the problems associated with the Cherry Plaza Development as located on the Northeast corner of Meridian Street and Cherry Land Road in Meridian, Idaho. Whether the water system is public or private is of great concern to the City. By the water system being private there will be limited or prohibited access to the City for fire protection, metering, and providing distribution or service lines to adjacent properties.For the water system to be public it must meet the minimum requirements of the Idaho Code. At this time the City is not prepared to accept the system as an extension of the public system but reserves the right to requi;e it to be dedicated public system at some future date. To accomplish this we recommend the following procedures to satisfy the needs and requirements of the City. 1. The water system must have plans and specifications prepared by a registered professional engineer as required by the Idaho Code, and to a standard that will permit them to ultimately be approved by the Division of Environment of the Idaho Health and Welfare Department. The plans and specifications must be submitted to the City of Meridian for our review. The installation of the water system must be certified by the registered engineer that it was installed in accordance with the said plans and specifications. 2. The City does not anticipate accepting the said water system as an extension of the public system until after 1979, due to the nature of con- struction of the area. The City wants to be assured, because of the construction being placed in a filled area, no settlements occur causing the water lines to leak or break due to settlement in the future. At the time the City accepts the water system the plans and specifications must then, as of that date in time, be approved by the Department of Health and Welfare for the State of Idaho. Also, CITY OF MERIDIAN - 728 Meridian Street, Meridian, Idaho 83642 Mr. Benning i Page 2 March 21, 1977 the water lines must pass the City's pressure test requirement just before acceptance by the City and the construction has to be certified by a.register- ed engineer at that time. The developer must be reminded that what can be approved by the Department of Health and Welfare today, may not be acceptable at a later date due to changes in regulations and it shall be the Developers responsibility to make the system comply as required by the City. 3. In the interim an ingress -egress easement must be provided for use in providing fire protection to the area and for the installation and servicing of water meters. The easement must be at least twenty (20) feet in width and provide a sufficient turning radius for large vehicles, in the Northeast corner of the development. All of the proposed public facilities shall be installed within the easement limits and the main water line shall be at least five (5) feet inside of the exterior boundary lines of the ease- ment. The said easement must be provided along the eastern and northern boundaries of the property. 4. The developer must submit his occupancy use per building unit to the City so a water user rate can be determined. As we discussed, a meter per major building or building unit is satisfactory with the City. For your information we are enclosing a copy of a letter from J -U -B ENGINEERS, Inc.,,dated November 5, 1977, concerning your development. The recommendations they made at that time are still pertinent to the pro- ject today. Be sure you are prepared to positively respond to each of those items when requesting final approval of your project by the City. We trust these requirements will be acceptable to you. Telephone: 467-5252-888-2321 November 5, 1976 Dear Mayor Storey: As authorized in the November 1, 1976 City Council meeting, we have reviewed the site plan addition for the Cherry Plaza Shopping Center. The site plan is very preliminary and more information is required for us to provide an adequate review. However, in the interim.: the following discussion and recommendations of the site plan is provided: O1. The site plan shows a storm sewer beneath several stores. We feel the storm sewer should not be beneath any buildings for many reasons such as maintenance and access problems. The drainage plan should also be submitted to the Ada County Highway District for their review and approval. 2. The Cherry Lane Road Improvements will affect this plan. The exact location of tree wells, parking spaces, etc. should be coordinated with the Ada County Highway District, and provisions provided so that the right of way and development adjacent to or on said right of way is done in accordance with the Ada County Highway District plans for the project. 3. The water and sewer lines must be determined by the City as to whether they will be private or public systems. If the water and sewer lines are to be public, then plans and specifications must be'submitted to the Idaho Department of Health and Welfare for their approval. If the system is to be private then we recommend the developer furnish the City with plans ands3.pacifications in order to assure quality workmanship and materials to be compatible with the City's water and sewer system. The plans and specifications for public systems must be prepared by a registered professional engineer. Observations of the site plan show an eight (8) inch sewer line is, approximately 490 feet long with no man- holes. There should be at least one manhole every 400 feet along the sewer line. No materials as to type of water and sewer lines are shown on the site plan. Therefore, to protect the City from future problems we recommend plans and specifications to be submitted for the water and sewer lines. 4. The building inspector and fire chief for the City should be consulted in regards to adequate fire protection and to make the building comply with the latest building codes. ZONING & PLANNING Proposed Cherry Lane Shopping Center Expansion This correspondence is to notify you of some basic decisions that have been made which will affect the above mentioned expansion. Both yourself and your architect, Trout Giles and Associates, have requested that the City find an alternate means of assessing water and sewer equivalents for the commercial expansion you intend to make. The Board of Appraisers for the City of Meridian has met, con- sidered the matter and have made recommendations to the City Council. The Council in turn has adopted those recommendations listed below. 1. The City ordinance requires that all commercial users be assigned one equivalent hookup for each 39000 square feet. It has been recommended and adopted that all stores with 3,000 square feet or less be rated at one equivalent water hookup and one equivalent sewer hookup. This will affect approximately 10 of the 16 stores in your proposed expansion. 2. All stores with more than 39000 square feet can be assigned a special hookup rating, possibly under a fixture basis system after the final building plans are submitted to the City. In no case would a store be allowed a less than one equivalent rating. 3. The City has undertaken an investigation to establish an alternate rating system, such as the fixture method, that will be fair to these special uses. 4. The City will continue to require that a separate water meter be installed at each store. 5. The City will continue to require separate fire lines into each store. It is normal proceedure to consider these matters after final building plans have been submitted. I The Bo rad of Appraisers shall be confirmed by the City Council and all Board of Appraiser's decisions shall be subject to approval of the City Council. 5-129 DUTIES OF THE BOARD OF APPRAISERS: The Board of Appraisers shall be delegated the duty of establishing the equivalent connection rating for a user and all City imposed charges in connection with the municipal water system including inspection fees, hookup fees, installation charges, monthly user charges, disconnection flees, and user deposits. The Board of Appraisers shall have the power to promulgate such rates, fees or charges or changes, in the said rates, fees and charges that are deemed necessary to adequately carry out the maintenance, operation and administration of the municipal water system under the authority of this Ordinance. 5-130: PURPOSE OF MONTHLY WATER USER CHARGE: The monthly water user charge is established to cover operation and maintenance costs of the system, and to provide a fund to pay for capital improvement costs, additions, oversized extensions to the system, or redemption of bonds that have been used to finance system improvements, all as a part of the City's responsibility to provide adequate domestic water service and facilities for the City. The monthly water user charge as described herein is to become effective immediately upon acceptance and passage of this Ordinance and monthly user charge billing under the rates described herein shall begin at the end of the first calendar month following acceptance of this Ordinance. For new connections, the water user charge is to begin when the connection to the City service line has been inspected and approved - or within sixty (60) days after the City service line has been installed, whichever is the earliest. 5-131: MONTHLY RATES: All owners who derive benefit from the City's municipal water system shall, in return for said benefit, pay monthly user charges as described below, The monthly user charge shall be based on the — amount of water used and the amount of fire and health protection provided by the municipal water supply system. All residents within the Corporate Limits, whose property is within one hundred feet (100') of the municipal water supply system, --- and all water users outside the Corporate Limits shall pay a minimum monthly user charge. The minimum monthly user charge for all users shall be based on one equivalent connection per single family resident. All other water service connections shall be prorated as to the number of equivalent service connections assigned to that water user by this Ordinance or as determined by the Board of Appraisers and will be computed on an individual basis. Any user having more than one classification of use shall be charged for the sum of the classifications. (This Section -- in no way effects or changes Section 14 hereinbefore set forth). The minimum monthly niter charge shall be three dollars ($3.00) per equivalent connection. Any user which has a total equivalent connection rating less than one shall pay a minimum monthly user charge for one full equivalent connection. Any user which has an equivalent connection rating greater than one shall pay a 275 5-131 0 5-131 minii-nurn monthly user charge that is the product 'of that user's equivalent connection rating multiplied by three dollars ($3.00). i.e., A laundry having twelve (12) machines would have an equivalent connection rating of: (4.00) + (2) (.25) = 4.50 and a subsequent minimum monthlyuser charge of: (4.50) ($3.00) = $13.50 All money extensions shall be totaled upward to the nearest figure divisible by five cents (.05�). Each user will pay a monthly user fee based on the quantity of water used and the Schedule of Water Use Fee in Table I I1. Each user shall pay, as full compensation for the benefits derived from the municipal water supply system, the minimum monthly user fee or the monthly user fee, whichever is greater. Should an owner, or his agent, request a City water service line to be disconnected, for any reason, there shall be paid to the City a disconnection fee of five dollars ($5.00). The owner, or his agent, must request the City to place the line back in service. There will be no turn -on charge associated with the reactivation of the existing service line. All monthly water rates will be charged against the property for which the City water service line is installed. The owner of record is liable for that amount, which must be paid before water service is resumed. In the event a depositor leaves an unclaimed balance in his account, that amount shall be Kept for six (6) months after which time it shall revert to the General Fund of the Citv. CHARGES FOR WATER AND INSTALLATION: The charges for water shall be as follows: In all cases, the minimum charge shall be two dollars and seventy five cents ($2.25) per month for Residential use and three dollars ($3.00) per month for business use.
