REQUEST FOR CONDITIONAL USE PERMIT

TIMETABLE FOR SUBMISSION:
1. See City Policy Statement, Submission Requirements, Appendix I.
2. A request for a conditional use permit must be in the City Clerks possession
no later than 12:00, Noon, Thursday, prior to the regular meeting of the
Planning and Zoning Commission.
3. The Planning and Zoning Commission will act on the request at the monthly
meeting following the month the request was made.
4. The City Council will hear the request at the first meeting of the month
following the month the request was passed on from the Planning and Zoning
Commission or when scheduled through the appeal process.

1. Application for Conditional Use Permit.
2. Petition from applicable property owners.
3. Legal Notice of Public Hearing.
4. Legal Description of Property.
ACTION TO BE TAKEN:
1. Planning and Zoning accepts or disapproves.
2. City Council accepts or disapproves.

DETERMINATION OF REVIEW:
1. The Planning and Zoning Commission and the City Council will evaluate the
effects of such elements as noise, glare, odor, fumes and vibrations on j
adjoining property; a discussion of the general compatibility with adjacent
and other properties in the district; and the relationship of the proposed
use to the Comprehensive Plan. ~
2. The Planning and Zoning Commission and the City Council shall review the
particular facts and circumstances of each proposed conditional use in terms
of the following standards and shall find adequate evidence showing that such
use at the proposed location:
a. Will, in fact, constitute a conditional use as determined by City policy.
b. Will u~ harmonious with and in accordancE with the general objectives
or with any specific objectives of the Comprehensive Plan and/or the
Zoning Ordinance.
c. Will be designed, constructed, operated and maintained to be harmonious
anti appropriate in appearance with the existing or intended character
of the general vicinity and that such use will not change the essential
character of the same area. _
d. Will not be hazardous or disturbing to existing or future neighboring .4 ~i

DETERMINATION OF REVIEW: Continued

e. Will be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage
structure, refuse disposal, water and sewer.
f. Will not create excessive additional requirements at public cost for
public facilities and services and will not be detrimental to the
economic welfare of the community.
g. Will not involve uses, activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons,
property or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors.
h. Will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding
public thoroughfares.
i. Will not result in the destruction, loss or damage of a natural, scenic
or historic feature of major importance.

s a special permit of the Zoning Commission after a public hearing, and
showing that such action will not cause damage and will be in accord with
the general purposes of this act, and provided further that before a permit
is issued by the Zoning Commission there shall be on file in the Office of
` the City Clerk the written consent of the owners of 75 per cent of the aree
~ of all the property within a radius of 300 feet of any port of the premises
whereupon such retail shop is to be erected or occupied.
3. PUBLIC GARAGES: A public garage for storage purposes
only where no repair facilities are maintained, when located in not less
than fifty feet from the front lines and not less than thirty feet from any
other street line on which the property faces; provided that before aper-
mit is issued by the Zoning Commission there shall be on file in the Office
of the City Clerk the written consent of the owners of 75 per cent of the
area of all the property within a radius of 300 feet of any part of the pre-
mises whereupon such public garage is to be established or maintained;
provided further that o public garage shall have no entrances or exits for
<' motor vehicles within 300 feet of an entrance or exit to a school, play-
; ground, public library, church, hospital, childrens' home or other similar

FACTS AND FINDINGS:
1. To convert an existing residence into a home owned hair style
salon located at 129 East Pine Avenue.
2. East Pine Avenue is fully improved with curb, gutter, and sidewalk
and has an 80' right-of-way which is adequate.
3. Alley is paved and has a 16' right-of-way which is adequate.
RECOMMENDATIONS:
1. Replace all damaged sidewalk sections and curb on East Pine Avenue
abutting parcel.

Council Member Kingsford questioned the comment made by ACRD concerning the repair
and replacement of all damaged sidewalks.
Council Member Brewer explained that this is a standard comment by ACRD, that the
sidewalks in this area were not a problem.
There was no public testimony.
Mayor Glaisyer closed the Public Hearing.
The Motion was made by Orton and seconded by Kingsford to approve of the Findings
of Fact and Conclusions of Law concerning the request for Conditional Use Permit
by Janet Deppe, 129 E. Pine, to operate a Beauty Salon.
Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea;
The Motion was made by Brewer and seconded by Kingsford to grant the request for
Conditional Use Permit to Janet Deppe, 129 E. Pine, to operate a Beauty Salon,
providing that all conditions set'by Planning & Zoning are met.

2 PUBLIC HEARING: Sunnybrook Farms Phase #3
Variance, Final Plat & Square Footage Designation
Mayor Glaisyer opened the Public Hearing.
Mr. Max Boesiger, representing the request, told the Council that Phase #3 will
be much the same as the development has been in the past.
City Building Inspector Vernon Schoen said that the request meets all requirements.
City Engineer Gary Smith told the Council that all his comments had been outlined
in his letter of December 16, 1983. (On file with these minutes)
There were no other comments from the Department Heads.
Council Member Brewer said that he is glad to see Mr. Boesiger"back in action",
that he is a quality builder in the community.
There was no public comment.
Mayor Glaisyer closed the Public Hearing.

The Motion was made by Orton and seconded by Kingsford to approve of the Findings
of Fact and Conclusions of Law regarding the request by Sunnybrook Phase #3.

Minutes of the previous meeting held November 14, 1983 were approved as written.

1 Findings of Fact and Conclusions of Law -Janet Deppe Conditional Use Permit
~~-~ Chairman Spencer asked for comments regarding the Findings of Fact•and Conclusions.
Member Jim Johnson questioned the recommendation :made by ACRD that all damaged
sidewalk sections be replaced. Johnson said that he could not see bad sidewalks
in that area.
Spencer explained that this is a normad~ recommendation made by ACHD.
Spencer mentioned that there were two stipulations in the orginal motion that were
not included in the Findings of Fact and Conculsion. These were that the operation
be limited to one chair only and that the sign be left as it now exists.
The Motion was made by Morrow and seconded by Alidjani approval of the Findings
of Fact and Conclusions of Law.

The Motion was made by Morrow and seconded by Giesler that cdntiguent upon the
granting of the variance that the Commission recommend to the City Council that the
`~ final plat of Sunnybrook Subdivision #3 be approved, and that the change in the
minimum square footage requirements of houses that can be constructed on each lot
with lot designation be approved.

2 PUBLIC HEARING: Request for Conditional Use Permit to Operate Beauty Salon
`~ Janet Deppe was present. She explained to the Commission that she wishes to convert
'~~ an exisiting residence into ahome-awned hair style salon located at 129 East Pine.
'~/ Deppe said that there will be one chair only with herself as the operator.
When questioned on the response from neighbors, Deppe told the Commission that she
had gotten all-the required signature minus one.
Chairman Bob Spencer opened the Public Hearing.
There was no response.

Chairman Spencer closed the Public Hearing.
Chairman Bob Spencer mentioned to Deppe that if-the-Conditional Use Permit was to
be granted, there would be an additional hook-up fee-for sewer and water.
Deppe said that she was aware of this.
The Motion was made by Giesler and seconded by Morrow to instruct the City Attorney
to prepare the Findings of Fact and Conclusions of Law concerning the request by
Janet Deppe for a Conditional Use Permit to operate a one chair beauty salon at
'" 129 East Pine, with the stipulation-that the operation be limited to one cha~;r only
'( (if Deppe wishes to increase chairs she must come before the Commission again),
that the sign be limited to an attractive wood sign with no increase in light from
what is presently on the pale, and that Deppe meet all regulations and ordinances.

3 Annexation Request N&D Inc.
Mr. Norm Fuller, 1103 W. Camellia, was presented representing N&D Inc. Fuller
said that they are requesting annexation of an approximate 4 acre parcel located
on 417 S. Meridian Road to be zoned Industrial. Fuller's plan is to develop
an Industrial Planned Unit Development on the parcel.
It was determined that the property to the South of the proposed annexation is
zoned commercial, and the property to the, North is zoned residential.
Chairman Bob Spencer opened the Public Hearing for comments.
There was no response.
Spencer closed the Public Hearing.
Fuller told the Commission he felt the IUD would be harmonious with the surrounding
area.
There was much discussion. (Tape on File -City Clerk's Office -Meridian City Hall)
It was brought to the attention of the Commission that ACHD had not yet commented
on the proposed annexation request. Commission members concured that they would like
to have ACHD's comments available to them before making any kind of a recommendation.
The Motion was made by Morrow and seconded by Johnson that the annexation request by
N&D Inc. be tabled until the next regular meeting of the Meridian Planning & Zoning
W Commission to be held on December 12, 1983.
