' Mayor Glaisyer:
As the potential design team for the developers who
desire to build a retirement complex within the Cherry
Lane Village development we-need a clarification (i.e. legal
opinion) as to the zoning status of such a complex.
The land is currently zoned "A" Residential and
our proposed use is not specifically listed.
The complex will have the following facilities:
Living Center Consisting of;
32 apartment units (2 bedroom)
60 person in-living center

The above units will be constructed to give a residential
appearance with shake roof and brick and cedar siding so as to
blend in with the final concept of the development.
It is our interpretation that such a development meets
the approved uses in an "A" Residential Zone. If you find that
this development is not in compliance, please forward to us ur
findings and action needed to be taken to come within you ~r~~
ordinances. I l

Dear Mayor Glaisyer:
You have delivered to me a letter dated .October 12, 1983,
from Keith A. Loveless and Robert Donovan requesting an
opinion as to the zoning status necessary for-the development
of Cherry Lane Village Retirement Estates® This opinion is
written solely in light of the representations made in the
letter.. If construction and use differs from those represen-
t tations made in the letter, my .opinion could be completely
different.

p p y p proposed development is to
~<~ be constructed is "A" Residential. In the City of Meridian
Ordinances, Section 2-405, the allowed uses in "A" Residential
are stated. While the proposed exact use, as represented in
the developer's letter, is not specifically included in
Section 2-405, that section does. reveal that the following
uses are allowed:
>~'` Dwellings
Lodging houses
~~~ Boarding houses
Hotels
Apartment houses
Hospitals
Sanitariums
The uses proposed in the letter present, basically, a combination
of the above allowed uses. That is, the development is going
to have apartment quarters, the boarding of people, and aspects
of a hospital or sanitarium. Combining the various uses into

one structure would not seem to create a violation of
~~ Ordinance 2-405.
It is, therefore, my opinion that the uses proposed
in the October 12, 1983, letter are allowable in the "A"
Residential zone.
It must be pointed out, however, that this opinion
is written in light of the representations made and the
existing ordinances. As you are well aware, new zoning
and development ordinances are in the process of being adopted
and the proposed use may be in violation of those ordinances.
Any application for development or a building permit would have
to be construed in light of the ordinances in effect at the
date of the application.
Also, in light of the fact that the area where. this
development is proposed to be constructed is being developed
predominatly with single family residences and the concept
plan for the entire area was for single family residential
development, it might be advisable for the Planning and
Zoning Commission to hold a hearing on the application for a
building permit or require the approval of 750 of the land
owners within a radius of 300 feet of the property before
issuance of the building permit as allowed in Section 2-413.
This procedure, of course, is at the discretion of the Planning
and Zoning Commission.

Councilman Kingsford: "With regard to the two parties that testified in favor of
reducing the sq. footage, I wouldn't have a particular objection to those lots
being switched -that would acc~odate your houses. -that's not our intent. My
concern is to allow those on the low end. Im personally against that."
The Motion was made by Brewer and seconded by Kingsford to deny the minimum sq.
footage requirements request for Meridian Park Subdivision.
There was discussion concerning the rule of Finding of Facts and Conclusion of Law.
City Attorney Crookston stated that everything has to be allowed under that act.
"They are asking for a variance in statute which is a zoning matter. This minimum
~• f~'~ge requirement ordinance would be a zoning ordinance. It is still an
action that falls within the procedures under the Local Land Use and Planning Act."
"Timether you deny it or not you still have to have Finding of Facts and Conclusion
of Law stating why you denied it - it does not only apply to approval."
Brewer withdrew the Motion, Kingsford withdrew the second to the Motion.
Motion withdrawn.
The Motion was made by Kingsford and seconded by Brewer to instruct the City Attorney
to draw up Findings of Fact and Conclusion of Law regarding the request of
MERIDIAN PARK SUBDIVISION mi.nimtun square footage requirement reduction.

Councilman Kingsford.

Kent Barney, Pat Quinney and Bruce Jeppsen were present for Council input on their
concept for construction of a retirement center in Cherry Lane Village.

Drawings were Presented. Barney stated a similar concept is being worked on in
Sandy City, Utah, and they felt it would be good for the area; Bruce Jeppsen stated
that this is a new idea; provides health care and social life for Senior Citizens;
their archi-test, Ken Stevenson and Associates, .has been involved in nursing homes
in 'the Utah area and surrounding states for 20 years and has developed a concept
for senior citizen needs; this is called a "Living Center" and not like a conval-
escent care center or nursing hcene; however, th:'re is a 25 bed facility nursing
center part of this-unit; there is an apartrnent concept, one and two bedroom;
garden! space; all conveniences for the people could be served right there; higher
security and access to medical care in a very short time from a full time staff;
the other projects they have taken 20 to 30 acres around the center for homes that
. would fit with senior citizen needs; their intent is not to isolate senior citizens
~~~ as there would be childrens' vlayground to accomodate adjoining neighborhoods; small
medical facility would service conarnuv.ty not limited to senior citizens; quality
construction; senior citizens can take part in all, any or none of the services
but if they new nursing service it is`'there, and connected by a breezeway.
Jeppsen: "Our first purpose is to, find out how you feel about this concept and
if you feel good about it we would like to go ahead and do a preliminary study on
it. The second is the possibility of Industrial Revenue Bonds."
Mayor Glaisyer: "In answer to the Industrial Revenue Bonds. - it will be on the
ballot in November and if it's passed -what, three-fourths of the population? -
it's going to take some time to get it within the realm of adoption."
Jeppsen stated that this is not dependent on IRB -this is of highest quality and
the thing that helps them out is the lower the interest rate,"the lower price they
can charge"
Barney stated that Jim Fuller, adjoining landowner, was excited about the concept
and has no problem making land available.

Wallace Lovan, Cherry Lane Golf Course Manager, was not opposed to it but Barney had
not contacted Nu-Pacific or the H~neowners Association.
There was discussion concerning the concept.
Kingsford stated that he felt this was very expensive property with fairways around
it, etc., to place a facility such as this. The open space could be better used
and less expensive and not so far out.
Jeppsen stated a shuttle bus could be part of the plan for transporation.
Barney stated he thought they were not locked in on the placement of the Golf Course
Greens.
It was concluded that this would require a Conditional Use or Planned Unit Development
and that the Hceneowners Association should be contacted before proceeding with study.
Jeppsen thanked. the Council for their input and stated that he also appreciated the
negative thoughts as well so that they may use toward any study.

Mayor Glaisyer read Ordinance No. 416 entitled: AN ORDINANCE REPEALING SECTION
9-615, TITLE IX, CHAPTER 6, REVISID AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN,
ADA COUNTY, IDAHO, ENTITLED RESIDENTIAL DEVELOPMENT, E1~RGIIJCY INTERIM, MORATORIUM,
AND PROVIDING A NEW SECTION 9-615 TO BE ENTITLED RESIDENTIAL HOUSING STANDARDS.
Attorney Crookston explained the Ordinance purpose of clarifying the intention of
recording minimum square footage requirements on a plat.
Mayor: "Is there anyone in the audience that wishes Ordinance No. 416 read in it's
entirety?" There was no response.
The Motion was made by Brewer and seconded by Kingsford that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three
different days be dispensed with and that Ordinance Number 416 as read be passed
and approved.

ESTABLISrS OF THE REVISID AND COMPILID ORDINANCES OF THE CITY OF MERIDIAN,

Mayor: "This is turned back to the State of Idaho. The City no longer issues the
restaurant grading license."
Councilman Kingsford requested information regarding the actual physical inspection
of establishments.
Mayor: "Is there anyone iri the audience that wishes Ordinance No. 417 read in it's
entirety?" There ~nias no response.
The Motion was made by Kingsford and seconded by Orton that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three
different days be dispensed with and that Ordinance Ntmtber 417 as read be~,passed
and approved.

ENGINEERING REPORTS :
Wayne Forney, J-U-B ENGINEERS, INC., was present and stated that with regret he
reports that the Senior Citizen project was not funded by the State.
Forney: "The Govenor set this program up and it was his intent frcan the very
beginning to create projects that would generate jobs, econatoic development projects-~
more jobs the better. We knew this but did everything possible to assist the
Senior Citizen's put together an application. We met-the-deadline, 1~was accepted
and they ranked very high. Out of b2 applicants they were~in the top"tnird.
I talked to the State and they indicated there was quite a bit of debate concerning
the AMeridian project because it was the only application for a Senior Citizen Center--
and the Senior Citizens were able to secure almost $100,000 in private donation for
that center which, was about one-fourth to one-third of the total cost:-~~
