BY THE CITY COUNCIL: BIRD, HOAGLUN, ROUNTREE, ZAREMBA
A RESOLUTION VACATING A 12 -FOOT PUBLIC UTILITY EASEMENT
LYING IN LOTS 42 AND 43 OF BLOCK 1 OF SPURWING SUBIDIVISION, AS
FILED FOR RECORD IN THE OFFICE OF THE ADA COUNTY RECORDER,
BOISE, IDAHO IN THE BOOK OF PLATS AT PAGES 7104 THROUGH 7108
LYING IN THE SW 1/40F SECTION 23, TOWNSHIP 4 NORTH, RANGE 1 WEST,
BOISE MERIDIAN, CITY OF MERIDIAN, ADA COUNTY, IDAHO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on January 13, 2009 the City Council of Meridian, held a hearing on
the 12 -foot public utility easement vacation lying in Lots 42 and 43 of Block 1 of Spurwing
Subdivision, as filed for record in the office of the Ada County Recorder, Boise, Idaho in
Book of Plats at pages 7104 through 7108 lying in the SW '/4 of Section 23, Township 4
North, Range 1 West, Boise Meridian, City of Meridian, Ada County, State of Idaho, and
WHEREAS, after such hearing, the City Council, by formal motion, did approve
said described vacation; and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That the 12 -foot public utility easement lying in Lots 42 and 43 of Block
1 of Spurwing Subdivision, as filed for record in the office of the Ada County Recorder,
Boise, Idaho in Book of Plats at pages 7104 through 7108 lying in the SW '/4 of Section 23,
Township 4 North, Range 1 West, Boise Meridian, City of Meridian, Ada County, State of
Idaho, is hereby vacated. Copies of the necessary relinquishments are attached as Exhibit
FM

Section 2. That this Resolution shall be in full force and effect immediately upon
its adoption and approval.

A 12 -foot Public Utility easement lying in Lots 42 and 43 of Block 1 of Spurwing
Subdivision, as filed for record in the office of the Ada County Recorder, Boise, Idaho in
Book of Plats at pages 7104 through 7108 lying In the SW 1f4 of Section 23, TAN,
R. IW.. B.M., Meridian, Ada County, Idaho and more particularly described as follows:
BEGINNING at an iron pin marking the Southeast comer of said Lot 42; thence
along the South boundary of said Lot 42
South 89'°4628" Wast 6.00 feet to a point; thence leaving said South boundary
along a line 6.00 feet West of and parallel with the East boundary of said Lot 42
North 0011`32" West 31774 feet to a point on curve on the North boundary of
said Lot 42; thence along said North boundary of Lot 42 and the North boundary of said
Lot 43 along the arc of a curve to the lett 12.00 feet, said curve having a radius of 786.00
feet, a central angle of 00°52'33" and a long chord bearing
North 89°1554" East 12.00 feet to a point of ending of curve; thence leaving said
