Applications: Final Plat Approval for four (4) lots.
Highlights of Proposed Development: The City Council approved the preliminary plat for
Sommersby Subdivision in January, 2005. The final plat for Sommersby Subdivision No.2 (FP-
06-024) was approved by Council in June, 2006. The entire preliminary plat consists of sixty-two
(62) buildable lots and six (6) common/other lots on 12.73 acres in an existing L-O and R-15
zones. The proposed phase includes 4multi-family lots to be developed with an 8-plex unit on
each lot.

Item 11. Fairview Lakes Retail
Location: 950 E. Fairview Avenue
Applications: Development Agreement Modification
History: The applicant, Doug Tamura applied for and received approval for a Conditional Use
Permit Modification. Aggrieved by the Commission's decision he sought Council review of the
decision. The request was heard by the City Council on January 6' 2009. After taking testimony,
the Council continued the hearing to give the applicant time to address their concerns regarding
the appearance of the rear wall of the building and submit a proposal for staff review and
recommendation.
The applicant submitted a proposal which was forwarded to Council packet. Based on review of
the proposal staff recommends the following:
• Paint a one or two color band that matches the bottom of the facade projecting over the arcade
on the south and west elevations should be added along the upper portion of the remaining
west elevation and along the length of the north elevation. This would be in addition to Mr.
Tamura's proposal of the painted doors and wainscot on the north and west elevations to break
up the lower portion of the facades.
• Plant two additional trees, the same species as the existing trees, within the street buffer along
Carol Street in the locations shown on the
• Construct 4 foot tree wells and install and maintain bark mulch around the trees for
protection.
• Plant blooming flowers like Floribunda roses or other blooming plants at the base of 3 of the
retainer walls to enhance the look of the landscape.

Outstanding Issue(s) for City Council:
1. Do the recommended landscaping improvements and proposed paint scheme address the
concerns regarding the rear wall of the building.
2. The trash enclosure that was constructed in the parking lot (off site) and the one
proposed in the rear property buffer do not comply with the UDC.
3. There are additional phases planned for this site which approved for building with stucco
finish. Is that still appropriate and should the applicant comply with the plans and
materials approved through a previous CUP modification?

Item 13. Silverstone Corporate Plaza
Location: Silverstone Corporate Plaza Condominiums is located south of E. Overland Rd. and east of S.
Eagle Road at 3421 E. Overland Rd.
Applications: Short plat approval to create 37 condominium units within a 116,000 square foot building
on 6.2 acres in a C-C zoning district.
History: A Certificate of Zoning Compliance was issued for the building on July 18, 2008.
Highlights of Proposed Development: The subject building is a principally permitted use in the a
C-C zone district. The proposed short plat would create 37 individual condominium units with
the shell of the building.
Elevations: No
Written testimony: None
The applicant has communicated their concurrence with the staff report and conditions.
