SUNIMARY DESCRII'TION OF APPLICANT'S REQUEST The applicants, Theresa and Lance Eckersell, request approval to vacate the 12-foot wide public utilities easement lying 6 feet on both sides of the common interior lot line of Lots 42 and 43, Block 1, Spurwing Subdivision. The owners of said lots wish to vacate this easement because there are no utilities in this area and the easement only creates an encumbrance on the lots, for building purposes. A legal description and exhibit map of the easement proposed to be vacated is included in Exhibit C of this staff report. The Meridian Public Works Department has no opposition to the proposed vacation of the subject easement as new easements will be dedicated with the Devon Park Subdivision No. 3 plat. The Applicant has provided proof of relinquishment of the easements by Cable One, Qwest Communications, Settlers Irrigation District, Intermountain Gas Company, and Idaho Power Company, included as Exhibit D. 2. RECOMMENDATION Staff recommends approval of the proposed vacation. 3. PROCESS FACTS a. The Unified Development Code, Section 11-SA-1, identifies the City Council as the decision making body on vacation applications within the City of Meridian. b. Newspaper notifications published on: December 29, 2008 and January 5, 2009 c. Radius notices mailed to properties within three-hundred feet (300') on: December 23, 2008 Idaho Code SO-1325 requires that all easements created with subdivision plats "shall be vacated in the same manner as streets "and must be approved by the local jurisdictions. State statute further requires an easement vacation be filed when a landscape or irrigation easement is involved. Note: This property is located in Ada County and has not been annexed. Idaho Code SO-1306A requires any person, persons, fzrm, association, corporation or other legally recognized form of business desiring to vacate a plat or any part thereof which is inside or within one (1) mile of the boundaries of any city must petition the city council to vacate. 6.
