Fairview Avenue Boise, Idaho 83712 In regards to the above referenced Conditional Use Modification Fairview Lakes LLC is requesting an appeal on the following items : 1.1 a. A planter island is required to be constructed at the north end of the row of parking on the west side of the building. 1.1b. Evergreen trees, minimum 6 -feet in height shall be installed within the street buffer along Teare Street. 1.1 c A trash enclosure shall be constructed on the site in the location depicted on the site plan in Exhibit A.2 1.3 a All wall surfaces, excluding the portion that will abut retail building 3 on the east elevation, consisting of painted block will be covered with texcoat. On December 15, 2008 a revised exhibit `B" for the approved conditional use modification was emailed to applicant. In response to the revised conditions I would like City Council to consider the following: 1.1 a The parking lot located on the west end of the building consist of seven parking spaces and have a landscape islands located on the north end and the south end of the parking lot.( see attached site plan) I believe the parking lot meets the requirements of the ordinance. l.lb. The street that runs parallel with the rear of the subject building is Carol Street. Teare Street is located perpendicular to the subject property and is located at the east end of the building. Our proposal addresses the addition of pine trees at the rear building elevation. Because of the amount of utilities that are placed in the rear of the building we are limited to the location and number of additional trees. Please note the original CZC that was approved did not designate any pine trees in the rear of the approved building. 1.1 c In the south west corner of the building I installed a trash enclosure ( see attached site plan for location ) Our building is currently vacant, I proposed that I would install additional trash enclosures in the future as needed. 1.3a The approved CZC that was attached to the approved building permit documents was substantially different from the building that was constructed. The building that was constructed was substantially upgraded in type of construction and use of materials. The original building was designed as a wood frame stucco building with minimal facade modulation to provide areas for limited signage. The approved building permit was concrete masonry construction with steel bar joist roof construction. The building was modulated by the addition of a full covered walk way of concrete roof tiles and stone column accents. The facade was designed to accommodate signage for future tenants. The concrete masonry was detailed in the front to replicate tile and the rear and sides were detailed that when painted would be a flat wall surface. I have taken a survey of the large commercial developments that have been constructed in the last three years. The commercial developments constructed of concrete masonry, the wall finishes of the rear building elevation were typically painted masonry. In summary I am requesting City Council to consider the following alternatives: 1. One additional concrete patio to be installed in front of the west sign panel to mirror the patio that was installed on the east end. 2. Phase II buildings to be modulated as submitted MCU -08-002 3. Phase II water feature court yard to be increased in size by a minimum of 3,000 additional square feet. 4. Three pine trees to be added to the streetscape along Carol Street in the rear of the building. 5. Approve the occupancy of the building with the existing trash enclosure. Require the addition of another trash enclosure as requested by Sanitary services. 6. Approve the existing painted wall surfaces. Thank you for your consideration on this matter.
