CC: File, Gary Smith, PE, City Clerk, Planning & Zoning, City Attorney Date: 6/5/2003 Re: Proposed Agenda Item for June 10 Councl Meeting RECEIVED JUN - 51p03 City Of Meridian City Clerk Office I am requesting that the following item be placed on the June 10 City Council agenda, on the Regular Meeting Agenda for discussion and possible adoption: • Observation Point Subdivision -Exception to Final Plat Notes Reaardina Lot 2 Block 2. I have been contacted by Elliott Sheffield of RF Custom Homes, representing Victory 41, LLC, regarding construction of a new house on Lot 2, Block 2 of Observation Point Subdivision. This lot is approximately 1.9 acres in the southwest comer of the subdivision. They intend to demolish the existing house on this lot and replace it with one new 1,125 square foot house. The new house, as with the existing one, would be provided to the caretaker of the Cavens' property. Sewer service to this lot does not eadst. The Kennedy Lateral separates this lot from the rest of the subdivision. Accorcling to our sewer master plan, the property will be sewered to the west by a future thank. The final plat staff report included the following as Site Specific Comment #2: Plat the remainder of the property south of the Kennedy Lateral as a separafe lof, as well as the 20-foot-wide common lot adjacent to Victory Road. This area will maintain a sanitary restriction until such firne as the Black Cat Trunk is extended. The developer can enter into anon-development agreement with ACRD and the City of Meridian for this portion of the property. • Page 1 Staffs intent was to prevent subdivision of the property south of the Kennedy Lateral into commercial lots as was originally proposed due to lack of gravity sewer service. As a result of staff's comments and Council's approval, plat note #14 states: A sanitary n=striction exists on Lot 2, Block 2 and no building permit wi!! issued until a sewer line has been constructed and can service said Lot 2. Mr. Sheffield wishes to have the new house placed on the septic system that was replaced approximately a year ago and connect to City water. He informed me that he is willing to connect the house to City sewer when it is available across the front of the property. A second exception that must be made in order to issue a building permit on this lot pertains to house size. Plat note #8 requires that each dwelling be a minimum of 2,100 square feet excluding garages. This proposal reflects a new 1,125 square foot house. Public Works staff has no objection to this proposal but cannot issue a building permit for the new house. The City Attorney recommended that I bring this before City Council for specific approval of an exception to the Order of Conditional Approval, plat notes #8 and #14 and the Development Agreement if the Council chooses to make this modification.
