2. Councilman Grant Kingsford: "It bothers me that because there is HUD
money available we are allowing the low end sq. -ft. -wise of every
subdivision to be built on - next, the developers will want to
change the per centages on the low end! Once those houses are
built we will have then for a hundred years - vacant lots can still
have good houses built on then next year or the year after..."
10.18.82 Council: The Motion Carried that "the Council instruct City
Attorney Wayne Crookston to draw up Findings of Fact, Conclusion
of Law regarding the request of MERIDIAN PARK SUB. minimum square
footage requirement reduction.

That prior to the enactment of Ordinance 383 on January 5, 1981
most residential developments and plats were approved by the City of
Meridian with a minimum housing size of 1,350 square feet being
contained in the restrictive covenants of the subdivision. This
section shall not have the effect of removing that 1,350 square foot
restriction. If an owner or owners of a subdivision desire to have
the capability to construct some houses of less than 1,300 square
feet, they shall come before the Cit
showing each lot and the minimum size house that c nh be ban uiltdthereon
clearly shown. Said change in the plat shall not be considered a
new platting for purposes of platting procedures, and only the City
Council need act on such request, but one hearing must be held on
such request with fifteen (15) days prior notice being Polished in
the official City newspaper and with notice being
certified mail, return receipt requested, to all property owners in
the subdivision and to all property owners within three hundred
(300) feet of the external boundaries of the subdivision. After
approval by the City Council, the amended plat shall be recorded
clearly showing the minimum house size that can be constructed on
each lot.

That the requirements of 2-411 D shall not apply to any residential
housing development that was not initially restricted to a minimum
house size.
2-412 FLOODPLAIN OVERLAY DISTRICT (FP)
2-412 A PURPOSE
The purpose of the FP District is to
guide t in the floodway
and floodway fringe areas of any watercourse elt atnflood flows, and
to minimize the expense and inconveniences to the individual property
owners and the general public through flooding. Uses permitted and
conditional uses that are authorized in this district are generally
associated with open space, recreational and agricultural land uses
and shall not hinder the movement of floodwaters_ The FP District
is superimposed over other districts.

carrying out those permitted activities must be approved by the
Commission and the Council under the Special Use Permit procedure

Re: Meridian Park No. 2 Subdivision
Final Development Plan Resubmittal
The contents of the subject plan resubmittal are in general conformance
with the City Department Heads and my comments that were made on your initial
submittal. There are, however, several items that remain to be addressed
and/or clarified. They are as follows:
A. Final Plat (Apparently this was not part of my original review_)
1. Dimension width of street right of way for all streets shown on the
plat.
2. Status of Lot 1, Block 4 with regard to Ada County Highway District
requirement of access restriction to Linder Road. (Is this an
existing residence?)
3. Status of APA comment that the street name "Rochelle Drive" as shown
on the plat is. unnacceptable. (The street plan -profile shows this
street as "Salinas Drive.")
4. Numerous comments on the plant print.
B. Street Plan -Profile
1. What is the disposition of the street drainage leaving the curb and
gutter at Station 45+54.4 on Linder Road?
2. Please furnish letter from Nampa -Meridian Irrigation District that
they will accept direct discharge of runoff from catch basins on
Salinas Drive & 13th Street.
3. Box Culvert Detail: The depth of concrete for the fence post anchor-
age is shown as 1'-0" instead of the 3'0" previously requested.

4. What length of fence will be installed across the culvert?
C. Sanitary Sewer - Domestic Water Plan & Profile
1. Show gate valve symbol on all water line stubs to fire hydrants.
2. On Sheet 8 call out Manhole MP -22 as a drop manhole for Lateral 11011.
3. Water and Sewer Crossing Five Mile Drain -
a. Delete requirement of steel casing for the six inch diameter
water line as long as the line will be installed via open
trenching. If boring or jacking of either sewer or water pipe
is required then casing will be required.
b. Since the sewer pipe is placed through the culvert footing it
will be necessary to also extend the concrete cover slab through
the footing so that the footing bridges over the pipe. Show
this in the crossing plan view.
C. Show thrust blocks at the 45° bends on the "Water line Crossing
Elevation." These shall be built in accordance with the City
of Meridian Standard Specifications.
D. Settler's Canal Relocation
1. Plans should be submitted to Settlers Canal Company for their review
and approval.
2. Spacing of manholes may exceed the cleaning abilities of the Canal
Company. This should also be confirmed through the Canal Company.
3. I assume your hydraulic calculations have set the elevation of the
top of the pipe manholes.
one set of the resubmitted plans accompanies this letter to visually show
all of my comments. Please call if you have any questions. Please return
this red -line set to me with your revised plans.

that the installation of this subdivision's sanitary sewer and domestic water
system has been satisfactorily completed.
I understand that Earl Ward has advised you of the conditional acceptance
of the sanitary sewer system. This concerns the locating of the sanitary
sewer service connection for each of five (5) lots as listed in Earl's letter
to me dated December 31, 1980. A copy of this letter is attached for your
information. Please note that building permits for these lots will not be
issued until these services are located and marked.
In accordance with City of Meridian Policy the installation and materials
of the sanitary sewer and domestic 'water system are to be warranted by your
contractor against defect for a period of one (1) year from the date of this
letter.
I would appreciate it if you could forward a copy of this letter to this
subdivision's owner for their information.

maintenance.

Co. has agreed to guarantee any repairs to the syst r;,1 for a period of
one (1) year.

City of Meridian Wastewater Department, and is constructed accord-
ing to the City of Meridian Standard Sewer Specifications. The
system can be accepted for maintenance by the City of Meridian.
Service connections for five of the lots have not been located
at this time and the developer and design engineer have indicated
by letter that they.will locate these connections before a build-
ing permit will be issued on these lots. They are as follows:
Block 3, Lot 4, Block 4, Lot 18, Block 9, Lots 1, 2, and 5.

Water Line Crossing - Five Mile Creek
Dear Mr. Johnson:
It will be necessary for you to revise the detail of the subject
water line crossing to include the following:
1. Install a 2 -inch wall thickness of pipe insulation (Fiberglass
25 ASJ/SSL).
2. Maintain a 3 -inch sand bed below the pipe.
3. Cover the top half of pipe, not in sand bed, with a layer of
15 lb. felt building paper.
4. Construct a six (6) inch thick ring of "lightweight" concrete
over the pipe and extend the ring down to the bridge deck.
5. A sketch of the requested detail is attached hereto.
Please have your contractor notify Mr. Bruce Stuart, Meridian
Waterworks Superintendent, when he starts the construction so that the
work can be inspected as it is done.
The City of Meridian requires that all construction details for
subdivision improvements be submitted to them for approval prior to
construction. The City will work with you in any way it can to meet
your deadlines, etc., but you need to also work with the City in conform-
ing to their requirements. I am sure a certain amount of time and money
could have been saved if this process had been followed on this project.

We hereby request permission to begin construction of three model homes
on Lots 15, 16 & 17, Block 4, Meridian Park Subdivision, prior to final ap-
proval of subdivision improvements.

Last month construction drawings for water and sewer systems in the
Meridian Place Subdivision, Unit 1 were submitted to the Meridian City
Engineer, Water Superintendent, and Sewer Superintendent for comment.
Comments from these departments have been received, and the suggested
revisions, to the construction drawings have been made.
Six copies of the revised construction drawings are submitted herewith
for distribution to City departments, and for final review and approval.
Our final submittal to the Idaho State Department of Health & Welfare will
be made after approval from the City of Meridian has been received. I might
remind you that we will need a letter from the City of Meridian saying water
and sewer service for this subdivision will be provided by the City of
Meridian. We will greatly appreciate favorable comments from the City at the
earliest possible date.
I understand from a recent conversation with Verl King that the final
plat for,this subdivision has been submitted to the City of Meridian.

Five Mile Creek has been presented to the Bureau of
Reclamation for their approval. In addition to their
required approval of these items, it will be necessary
for the developer to obtain an easement for the road
between Linder Street and the subdivision boundary at
Claire Street in the name of Ada County Highway Dis-
trict.
Five Mile Creek is presently owned by the U.S. Govern-
ment, however a. quit claim deed will be given to the
U.S. Government by the developer to establish the
exact boundaries of the Five Mile Creek drainage.
We would appreciate being placed on the agenda for
the planning and zoning commission scheduled to meet
on the 12th of March and the City Council meeting
immediately following so that we may proceed with
construction of Meridian Park Subdivision.
Plans and specification have been submitted to the
Department of Health, Division of Environment for their
approval.

I have reviewed the Preliminary Plat of the proposed subdivision.
This is not a letter of approval, but I do have some comments and
recommendations as follows:
1. Provide all street improvements to Ada County Highway District's
Standards, Specifications, and Policies.
2. Dedicate 40' right-of-way for Linder Road by plat.
3. Provide temporary cul-de-sac at east end of Darrah Drive.
4. Provide 300 Scale map.
I am unable, at this time, to proceed any further with the subdivision
Preliminary Plat Review. Before I may proceed you are required to comply
with the following;
1. As of August 18, 1978, all Preliminary Subdivision Plat Reviews
are subject to an Ada County Highway District Review Fee.

Minutes of the Regular Meeting held June 7, 1979 in the offices of the Ada County
Highway District, 318 East 37th Street, Boise, Idaho.
Commissioners Jeppesen, Fairbanks and Silva present.
Ada County Highway District staff present: Gary Funkhouser, John Joines, Chuck
Smith, Ron Cotterman, Les Niederklein, Mike Brokaw, Marcia True, Alice Sinsel.
Five citizens present.
EXECUTIVE SESSION - The Ada County Highway District Board of Commissioners declared
that they were in Executive Session at 11:45 a.m., under authorization of Chapter 23,
Section 67-2345, Idaho Code. Executive Session adjourned at 12:10 p.m.
Regular meeting convened at 12:15 p.m.
:MERIDIAN PARK SUBDIVISION N0. 1 - Joe Glaisyer attended to ask the Commission to
inform the City of Meridian when decisions are made and agreements approved on any
subdivision in the jurisdiction of City of Meridian. He informed the Commission that
subject subdivision will not be approved unless they develop streets to give access
to fire and emergency vehicles in the subdivision. The Highway District to inform
the City of Meridian of any further agreements with developers in the area.
MERIDIAN OFFICE COMPLEX
Discussion followed concerning the development proposed by Cherry and Son on Cherry
Lane. Commissioner Fairbanks explained that this is an opportunity to have 4th
Street extended south to Cherry Lane. Mayor Glaisyer said Meridian would back the
Highway District in requiring that the street be extended. Further discussion followed
concerning the delayed federally funded project for Cherry Lane. The need for this
improvement is very great and it was suggested that the Highway District write a letter
stating the serious need.
EXECUTIVE SESSION EXPLANATION - Commissioner Silva stated that during the Executive
Session the Commission discussed the Highway District job classification and compen-
sation schedule and requested that a study be done to determine what adjustments could
be made to alleviate possible inequities.
MERIDIAN OFFICE COMPLEX (Continued) -Mr. Cherry of Cherry and Sons, developers of the \
Phe ri ian Office Complex state that the land they are developing was purchased with
the understanding that the Highway District would put in the curb, gutter and side-
walk. Since the project as proposed did not go forward because of the change in
population of Meridian, the problem with funding has come up. It is now a completely
different project and the Highway District does not have funds to install the curb,
gutter and sidewalk and the developers of the area will be required to install them.
Discussion followed concerning the area between the existing pavement and the curb,
gutter and sidewalk to be installed at this time, which would leave a portion un-
improved until the federal project is built. Drainage was also discussed. Commissioner
Silva asked that the staff bring in a recommendation as to what should be done and
whose responsibilities each phase is and then the Commission will act on the question.
The developer to be notified when the decision is made as to what to do with the area
in front of the curb, gutter, and sidewalk.

Les Niederklein, Mike Brokaw, Paul Joos, Marcia True, Alice Sinsel.

MERIDIAN PARK SUBDIVISION - JOE OSIER - John Joines explained the problem with Mr.
Osier's proposed subdivision, which is in the final plat stage. They have run into
problems. For tax purposes the seller will only release a portion of the sub-
division and the developers can't get their financing to bond the whole subdivision
when they only own half. Developers are proposing to make an arrangement that they
will not sell any lots in the part of the development that is not released. It has
been discussed with Mr. Bud Hagan and me legal details will have to worked out.
fter further discussion, Commissioner ilva moved to have an agreement written for
the Commission to look at, in an attempt to solve the problem. Commissioner Fairbanks
seconded. Motion carried unanimously.
INTERIM FINANCING FOR L.I.D. 79-1, 79-2 - Mr. Bud Hagen was in attendance and
explained briefly how interim finan.cifng would work. He then introduced Rich
Michaels and Bud Way from the Idaho First National Bank. Mr. Michaels explained
the background for interim financing and that there will be a,need for issuance
of interim warrants under the L.I.D. statutes. The Highway District is allowed to
ask for interim financing on a private sale or a public sale. A public sale requires
a little more time in terms of advertising, etc. Mr. Michaels explained the differences
between tax anticipation notes and the warrants and how the bonds are sold and the
risks involved for purchasers. He said that he feels that according to the statute
the Highway District would be limited to 6% on tax notes. He further explained that
several entities are having to go to interim financing. Mr. Michaels stated that he
couldn't quote a rate but would be happy to work with the Highway District on the
L.I.D. packages. He said if the Highway District goes to a tax note sale, he would
recommend a public sale there. On L.I.D. warrants, there is no limitation in the
codes. He further stated that L.I.D. financing should be separate from tax antici-
pation note financing. Discussion followed. Mr. Michaels said there would be no
discount on the warrants to the contractor, effective interest rate would be as
stated. On the Milwaukee Emerald project, the length of time would be approximately
one year. Commissioner Silva moved to proceed with the warrant financing of the

Michaels offered to help the staff develop a statement so proper bids can be
entertained, etc.
Les Niederklein said he feels the Highway District should go ahead and set up a line
of credit now so if the interest rates go up we are still under the lower interest
rates. Commissioners felt the Highway District should proceed. Commissioner Fair-
banks asked if the Highway District is allowed to take advantage of the money
certificates which are paying in excess of 9l. Mr. Michaels explained that these
are not guaranteed by, the United States Treasury; they are a general lien of the
bank. They also require an investment of $100,000.or more.

Please consider this letter as a request for annexation to the City of
Meridian the following described property:
The SW 1/4 of the NW 1/4 of Section 1, T.311., R.1W., B.M., shown in cross-
hatching on the attached map. The property, presently owned by James J. and
Betty L. Tully, will be developed by Capital Development, Inc., into a residen-
tial subdivision following the applicable regulations and ordinances of the
City of Meridian. We request Residential Zone "A" be applied to the property.
We are anxious to proceed with the planning of our development and would
appreciate your prompt attention to our request. Construction of the Trunk
Sewer running through the subject property will be completed soon and we wish
to be able to market lots and dwellings on the first phase as soon as possible
after completion of the sewer system and plant improvements next winter. Since
it takes several months to prepare all the designs and obtain all the approvals
necessary, we need to begin our planning immediately.
Our property adjoins the existing sewage treatment plant which we under-
stand will be abandoned when connection is made to the new plant. We have
incurred a considerable investment based, in part, on the proximity of our
property to the treatment plant property and the liklihood that the City will
develop another fine City Park there. We believe that would be an excellent
use for the old treatment plant property and a needed facility for the north
side of the City.

Section 3. Dwelling Cost, Quality and Size..
(a) No single family dwelling at a cost of less than $48,000 including
lot cost based upon cost levels prevailing on the date this declaration is
recorded; --shall be erected -or placed on any building site and the floor
area of the main structure, exclusive of one-story open porches, terraces
and garages, shall not be less than 1350 square feet for a one-story
dwelling, nor less than 1700 square feet for a split entry or two-story
dewlling. Each dwelling shall have as a minimum a double car garage,which
may be attached or detached and of a construction similar to that of the house
it serves.
(b) ._It being the _intention. -and purpose of the covenant to assure that

Section 4. Building Location.
(a) No building shall be located on any lot nearer than 20 feet to the

Section 5. Building Materials. All buildings erected upon any lot
shall be of stone, brick, frame construction and if other than brick or
stone is used, such building shall be finished painted and maintained in
good repair so as to be inoffensive to any other property owners in said
subdivision.
Section 6. Work Prosecution. The construction of all dwellings and out-
buildings shall be prosecuted diligently and continuously from the time of com-
mencement thereof, and same shall be completed, including exterior painting with
in eight months after the date of commencement of construction unless such com-
pletion is prevented by causes beyond the control of the Grantee.

Section 7. Temporary Structures. No structure of a temporary character,
trailer, basement, tent, shack, garage, barn or other outbuildings shall be
used on any lot at any time as a residence either temporarily or permanently.
Section 8. Moved Buildings. No building shall be moved onto any
building site unless specific permission and approval of plans, specifications
and location is obtained in writing from the Architectural Control Committee.
Section 9. Nuisances. No nosious or offensive activity shall be carried
on upon -any lot, nor shall anything be done thereon which may be or may become
an -annoyance or nuisance to the neighborhood.
Section 10. Animals. No lot or portion thereof, shall be used for
the keeping or pasturing of goats, sheep, swine, horses, cows or other non -
household animals. Dogs, cats or other household pets may be kept, provided
that no animals -are kept, bred or maintained for any commercial purposes.
Section 11. Signs. No sign of any kind shall be displayed to the
public vaew on any lot except that the name of a resident of a dwelling upon
a lot may be displayed on a sign of not more than one square foot -in area.
The Grantor reserves the right to display signs.-upon.lots advertising the_
property for -sale -or rent, and signs used by builders to advertise _the property
during the construction and sales -period.
Section 12. Fences. No fence, hedge or boundary=wall situated -upon
a l=ot shall have a h iea ght greater -than six feet -above --the graded sufface of
the ground around which such fence, hedge or wall is situated. The construction
or maintenance of spite fences or spite trees or shrubs shall be prohibited
upon all lots in this subdivison. All wooden fences shall be constructed in -,.a
substantial manner, and shall be painted at attractive color and be maintained
in good repair so as to, be inoffensive to any ..other property owners -in said -
subdivision. No barbed -wire -fences shall be constructed -within this subdivi-
sion. Fences greater in height than three feet shall not be placed nearer
to a -front -street line than a dwelling -unless the -plans for said fence have
been approved. by the Architectural Control Committee as provided -An Section .:2,b. -
Section -13. Oil.and Mining Operations. -No oil drilling --oil development-
operations_, oil refining, quarrying or mining operations of any kind shall -be
permitted upon or in any lot, nor shall oil wells,--tanks,tunnels;-mineral
excavation or shafts be permitted upon or in any lot. No derrick or other
structure designed for use in boring for oil or natural gas shall be erected,
maintained or permitted upon any lot.
Section 14. Water. The Grantors will deliver domestic water to the
point where the water meter -is located at the property line. Each lot owner
shall connect to this water system at this point and use this water for their
domestic use. Grantors are under no obligation to deliver irrigation water to
any lot in this subdivision. However, each lot owner may avail himself of
the irrigation water for those lots that are within the existing irrigation
districts, subject to the payment of any and all dues and assessments for the
use of said irrigation water. Additional irrigation laterals may only be
constructed in the easement area that is provided along each lot line. Where
itis- necessary for a lot owner to obtain water over and across another lot
and maintain the necessary irrigation lateral through the easement area only,
as herein provided and as well as shown on the recorded plat across the lot
owner's property.

the dwelling house and are required to be connected by underground pipe to
the wet line sewer -system in the -said subdivision. Trunk lines will be put
in by the subdivider but shall have no obligation to provide connection of
the wet lines to the household systems.
Section 16. Garbage and Refuse Disposal. No lot included within this
subdivision shall be used or maintained as a dumping ground for rubbish.
Trash, garbage or other waste material shall be deposited only in sanitary
containers meeting the requirements of the sanitation ordinances of the County
of Ada, State of Idaho, and the regulations of the ordinances of the State of
Idaho Health Authorities. No machinery, appliances or unsightly material shall
be stored upon a lot until a Grantee is ready and able to commence the construc-
tion with respect to which such building material shall be used, and then such
building material shall be placed within the property lines of the lot upon
which the structure is to be erected.
Section 17. Drivewas. Any driveway constructed on any of said lots shall
be of 4,000 psi 411 -Th -ick -air -entrained concrete and shall be connected to the
curb at the edge of the street in a manner:that it will not disturb the
drainage -pattern created by the street -and -curb section.
Section 18.Sidewalks,. To preserve -the aesthetic quality and living
style intended by the Grantor,_standard.five foot concrete -sidewalks shall
be constructed by the Grantor adjacent to the -back -of the curt for the full
width of each lot prior to the time the dwelling is occupied. In order to
avoid unnecessary, breakage, sidewalks, need not be constructed by the Grantor
until the dwelling is constructed. Sidewalks shall be of 4,000 psi; 4"
thick air -entrained concrete.
Section 19. Landsc� aping._ Landscaping shall be accomplished to provide
a reason a le and:leas�rng appearance, and must be completed within 90 days
after occupancy, _weather providing.- Grantor is under -no obligation to provide
landscaping on any -building lot.._
Section '20. Parking Res_ colons. Parking of boats, trailers, motor-
cycles; -trucks, truck,-campers-,----,motor-homes and -like equipment; or junk cars or
other -unsightly vehicles, shall not be allowed.on an

lation of radio and/or television antennae is prohibited outside and building
without written permission of the Architectural Control Committee. All build-
ings and surrounding areas are to be maintained in a reasonable and pleasing
appearance at all times.

Section 22. Damage to Improvements. It shall be the responsibility
of the builder of any residence in -this-subdivision to leave streets, curbs,
sidewalks, fences and tiled irrigation lines, if an

struction period. It will be conclusively presumed that all such improvements
are in good, sound condition at the time building is begun on each lot unless
the contrary is shown in writing at the date of conveyance or date of pos-
session, whichever date shall first occur, which notice is addressed to a
member of the Architectural Control Committee.
Section 23, Invalidation. Invalidation.of any of these covenants
shall in no wise affect any of the other provisions which shall remain in
full force and effect.
ARTICLE II
EASEMENTS
Easements -are reserved for installation and maintenance of utilities,
irrigation and drainage facilities five feet in width on side lot lines and
five feet in width on front and rear lot lines_. _Within the easements no
structure, -planting or other materials shal-i-be placed -or permitted to
remain which damage or interfere with the installation--and-maintenance of
utilities or which may change the-direction_A_f flow of water through drain-

ARTICLE III
GENERAL PROVISIONS
Section 1. Term. These Protective Covenants and Restrictions shall run
with the land desc it bed herein and shall be binding upon the parties hereto
and all -successors in title or interest to said real _property -or any -part _

Restrictions -shall -be automatically extended for successive periods of ten ---

NOTICE OF HEARING PROPOSED ANNEXATION AND ZONING
NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that a
hearing before the Planning and Zoning Commission will be held
at the City Hall in the City of Meridian, at the hour of 8:00
P.M., on August 14, 1978, and before the City Council in the
City Hall in the City of Meridian, at the hour of 7:30 P.M., on
September 5, 1978, for the purpose of annexing and zoning the
following described property. Any and all persons interested
shall be heard at said meeting.
The following described property to be known as CAPITOL
DEVELOPMENT ANNEXATION, and to be zoned "A" Residential:
