5.8.81 GRANT: 1. I have talked to Attorney Crookston about J.M.K. Properties The House that is having garage sales, etc. Crookston says they are zoned to legally do this. 2. Marty Igo & Jim (J.M.K. Properties) were not aware that their renters were doing this. They do not want to jepordize the good working relationship with the Mayor & Council (City). (City). They have just drawn up lease agreement with the(garage sale)people which stipulates the house being residential only. / 3. So this matter should be cleared up in a couple of months 4. This letter is intended to clarify the major uses that would be allowed by the City of Meridian for our property (2.3 Acres) located at the Northeast corner of Linder and Franklin Roads. To the best of our knowledge the City of Meridian has not completed their definitions of uses allowed in various zones. We would like to know, for our planning purposes, if the attached list of uses for a commercial zone would be considered acceptable uses in a commercial zone by the City of Meridian. Our list is a composite of uses as outlined in the Boise City and Ada County zoning ordinances. We would be happy to discuss this matter in depth at anytime with you. Chief Sherwin: No comments or objections at this time. 2. Joseph Glaisyer: I'm worried about the enclave this will create. Does our comprehensive plan allow two commercial shopping sites at intersections. 3. Richard Williams: 1) Not in compliance with comprehensive plan as it calls for one commercial (neighborhood) zone per corner. The SE corner meets that requirement (Crestwood). See comprehensive plan page 22 - Neighborhood Commercial Center Policy 2(c). 2) Prefer to see a specific plan and timetable for development not such generalities as mentioned. 3) Does not meet criteria size for commercial(neighborhood) See reference for Note #1 above. 4) Seems speculative not with any plans in mind. 4. Rick Orton: It is in conflict with Comprehensive Plan. 5. Bill Brewer: This intersection will prove to be one of the major intersections in Meridian. I recommend annexation and expect excellent planning for the location. 6. Ada County Highway District: If the rezone is apprved and the development proceeds, then the following requirements apply: 1. Franklin Rd. has a 50' right-of-way - 80' is required. Dedicate 40' of right-of-way from centerline of Franklin to the parcel for street portion fronting. 2. March 16, 1981 Agenda Larry Stoldt - Input on Rezone within City Impact Area 4 Larry Stoldt: "I would like your input on a rezone from a D-1, farmland, to a R-4 which would be a one family dwelling." Mr. Stoldt presented a map of the Heritage Subdivision No.l and No. 2 that designated the property he desired to rezone. "I bought the two acres that you will see that was left out of the Subdivision and it is zoned D-1. I built a home on one (1) acre and put a fence down the middle. I sold the one acre and home and got the other acre deeded to me so I own half of that (shown on map). All of those homes in that area are on acre lots." Stoldt displayed pictures of the surrounding homes. "Couple of years ago, when I went before Ada County Zoning, three (3) members voted for the rezone and thought it ridiculous that I try to farm one acre when all the rest of the lots in that Subdivision were one acre lots, on that same road. Three of the members voted not to, so that left a tie and I had to go before the Commissioners. And when I went before them Gary Bermeosolo and Linda Lund Davis said "No way; people were looking for a two acre and that it ought to stay the same", Vern Emery said "that's ridiculous,that should have been an R-4 when that Subdivision wds made" so he voted for and the other two voted against it. And yet, when I went to sell my home nobody could afford the two acres, all they could afford was the house and one acre. So now I am back with one acre that I am supposed to farm, and the way the zoning reads now I could raise hogs on it or anything - it's right in that Subdivision and on the road. Before, I think, when Ada County asked the City for input, the City said no because of the schools, the roads, sewer, etc. I don't think anybody really understood what the situation was. So, before I go before them (Ada County Zoning) I would like your input and make you aware of the situation." Williams: "I wonder why it wasn't R-4 when Heritage went in, and I guess my point is you knew what you were getting into when you bought it-' Stoldt: "Yes I did" Mayor Glaisyer: "Larry, what is directly South of your property?" Stoldt: "South, is a house" Mr. Stoldt again displayed pictures of homes surrounding, which are all one (1) acre lot homes. My acre is right on the street (Star Lane)" Orton: "So your choices are - a pig farm or build a house?" Williams: "You can't build a house in there - that's the whole point." Orton: "If you could get a rezone you could build a house?" Stoldt: "Right" Orton: "And if you did get a rezone and build a house, you would be another one (1) acre lot adjacent to a one acre Subdivision?" Stoldt: "That's correct." Kingsford: "I think we should write an endorsement to Ada County Planning and Zoning that we would favor this rezone." Mayor: "We would be writing our endorsement when we send back our input." Bill Brewer: "I agree with Vern Emery." Mayor: "I do too." Orton: "Would it be appropriate to put a Motion on the floor supporting Stoldt's request for rezone?" Mayor: "If you so wish." The Motion was made by Rick Orton and seconded by Brewer to approve the request of Larry Stoldt of City Council endorsement for a rezone from Agricultural to R-4, located Section 32, T3N,R1E, a one acre parcel. Motion Carried: Brewer, yea; Kingsford, yea; Orton, yea Williams, nay A Mayor Glaisyer read Ordinance Number 387.entitled: AN ORDINANCE ANNEXING.AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: A PORTION OF SECTION 12, TOWNSHIP 2 NORTH, RANGE 1 WEST, B.M., ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. Mayor: "This is the JMK Properties /Annexation, which is on the corner of West Franklin and Linder. Anybody from the public wish to have Ordinance Number 387 read in it's entirety?" There was no response. The I -lotion was made by Kingsford and seconded by Williams that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 387 as read be passed and approved. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea City Hall .5. March 2, 1981 would depend on borrowed from either a local or entities that are used to,borrowing and are prompt to finance these projects. With the interest and the trigger time you have to do things with it as opposed to somebody that can buy, lock it up and say don't worry about it - 10 years from now it's gone from 20 in the last five yrs it will go from 20 to 30. My motivation is to get it sold." The City Clerk was instructed to place Linder Industrial Park on the Agenda for April 6, 1981. Agenda 4 % J.M.K. Properties Annexation Hearing Martin Igo was present to request Annexation of 2.3 acres located on the NE corner of Franklin and Linder intersection. Igo: "The major reasons for our request are two. First of all the annexation and secondly we are requesting a Commercial zone with limitations. The annexation request seems logical to us as the property joins the City on the south, the City utilities will be required for any development or change in the use whether it is within the City or the County, as we understand it. Our effort would be to pay taxeg and use charges to those utilities to the City of Meridian rather to the County. The annexation seems to us as a process that will take place at some point of time and we would prefer that would take place now. The Commercial zone that we are asking for we fully realize that the land use in that area is moving toward an industrial use. We are also sensitive to the fact that uses in the industrial, or under the industrial use zone, may not be compatible with a shopping center which is zoned south of this property or the single family residences which join our property on the north and front Linder. However, there are many Commercial uses which would compliment both the shopping center as well as the residential uses. I think as far as competition, as you will, with respect to the shopping center there, there are many Commercial users that will not go into a neighborhood shopping center as such. Something along the line as a animal hospital, morturary, possibly a wholesale commercial business. Another thing under commercial use there is some flexibility with respect to having storage facilities if one were to contemplate a mixed use office and warehoused combination structure. Again would not compete with a neigh- borhood shopping center but would probably fit in with your Commercial zoning. Further, we understand that your Comprehensive Plan calls for a clustering of Commercial at a major intersection rather than of a strip nature. I want to speak to the matter of enclave because it has come up in the comments of the members of this Council and we have to take two positions. One, a matter of enclave with this particular piece of property would not be a concern to the people like the Fire and Police. The other point is that our 2.3 acres there really doesn't cause a enclave because there is a substantial amount of acres, I would guess would be 75 acres that would have to come into the City before our property would be considered as causing a enclave. Could I ask if the zoning ordinance has been achieved as of the date - as a matter of history this is where we came in. Jim and I purchased the property August of 79, we had informal meeting with Planning and Zoning and there was an effort going to establish the new zoning ordinance, we were asked to defer our application until such orddnance would be accomplished and I believe our application began again in August of 80. So we are before you here with a similar situation. Probably the only other thing that seems to be consistent in comments is the matter of speculation.. Jim and I are not developers, we own the land and our objective is to bring the land to a higher and better use than it currently is. It is currently is R-4, County 1 acre residential lots. Certainly with that zoning we could qo through the County and have a subdivision of two residential lots. I would say that is not the best use of that particular piece of property, and also in light of the moritorium with the City of Meridian we couldn't get a subdivision of that nature approved. We recognize with the industrial activity there that the zoning would be keeping more with commercial is going to bring at some point of time the highest use of that prop- erty. In closing we would consider industrial for that property but some industrial uses might conflict with the neighboring residential." Orton: "You don't create an enclave - is that correct?" Igo: "Well, I guess I'm challenging the comments made on our comment sheet that it might cause an enclave and I have taken the position that it does not. The parcel to the east is approximately in excess of 30 acres. The City boundary as I know it is the westerly edge of Crestwood Park and then there is a sizeable parcel between . that and our property. In one conversation with the owners they indicated that they had no interest in annexation at any time. But there is also property lying north of the railroad track that would be between the City limits and Linder approximately another 30 acres, so as far as causing an enclave I have trouble with that part." Kingsford: "I feel it would cuase more of a infilling than an enclave. How do you propose to sewer?" ti ridian City Fall M� j7/_f//X_ March 2. 1981 Igo: "We understand from the comments the sewer is in Linder, at the Crestwood Industrial Park. Water is further east of us on Franklin. 15 inch sewer extends along the west boundary of this property and approximately 350' along south boundary (Franklin Rd.). City water does not presently exist in Franklin or Linder adjacent to this property. A 10" diameter line does exist in Crestwood #3 and is extended to Linder Road." Williams: "Does the plan call for the 10" line to go down Franklin then?" nary Smith: "The 10" line goes in the road just parallel to Franklin Road and then goes south to the Commercial corner, then it comes out onto Linder again. That was all part of Crestwood No. 3 development." Williams: "Flow does water get to the proposed Linder Park?" Smith: "It would either have to come up from Linder that point or from where the line enters into Crestwood on Franklin. I don't know how far that is from the property (J.M.K.)" Bruce Stuart: "From Southwest 12th" Kingsford: "Where is that set to loop into Pine? Again, we are not talking about this one (J.M.K.) but Linder Park, if that was developed you would have a loop to Pine wouldn't you?". Smith: "Well, it's not too far - I think the water is to the railroad tracks. It would have to be put under the railroad tracks and on down to Franklin." Kingsford: "In the past the developers have had to put the water and sewer past the property line, is the right?" Williams: "No, through their property." Williams: "I tend to agree with Planning and Zoning, I don't see what other use this land could be put to. I think they have come up with a reasonable solution for Marty." Roger Welker, Fire Chief: "On the enclave part of it, I don't think Marty understands that the Fire Department part of it operates under two separate entities and you get in trouble from the fact that the use of the City truck in rural and not having.the address that's dispatched by Boise - this could cause problems with our underwriters. You get a call to 6540 Franklin with strictly volunteers you have a little difficulty knowing whether you are taking the City truck or whether you are taking the rural truck - that's the problem. Another comment that I can make along with that, the more development such as Linder Industrial Park - the more fire fighting equipment and manpower." Williams: "Do what Whitney did." Welker: "You mean make the developer pay it?" Williams: "Somebody.has to pay it." Welker.: "There is a law that they have passed now on waterflow usuage which I think will help the Fire Departments. The City can assess buildings according to the water - flow requirement, sprinkling them,etc." The Motion was made by Williams and seconded by Orton that the Council approve the Annexation of J.M.K. Properties Zoned "C" Commercial with the conditions of Design Review and with the understanding that common retail commercial be precluded. Map was displayed. Bryce: "This has already been through the highway, traffic, design approval, landscaping approval for Ada County - that has been approved." Orton: "There was some conditions to that approval, you intend to comply to these?" (referring to the letter from Ada County dated, November 8, 1979,to Gerald Cope) "The letter listing thirteen conditions for approval?" Bryce: "Yes, right. We had a permit from them and it was signed off." Orton: "Building permit?" Bryce: "No, zoning certificate." Orton: "These conditions are attached to the zoning certificate - if I read some of the conditions, maybe you can indicate whether you have complied. For an example, 'Handi- capped space to be 12 foot width'?" Bryce: "Yes - I think it is on there, if not - yes." Orton: "Sidewalk ramps shall be provided for the handicapped per U.B.C.? Properties Annexation Proposal had been tabled August 19, 1980. Marty Igo was present, representing the 2 acre proposal on the NE corner of Linder and Franklin. Igo stated that he had taken the.position of commercial - limited retail zoning. The Commission had previously explained limiting any retail because of the neighborhood shopping center approved on opposite corner and had discussed commerical limited office with Igo. Igo: "I referenced for consideration on this piece of property,an office complex and light industrial, a manufacturer's representative might have 500 to 800 sq. ft. office, but he needs storage in the back. That would be the kind of thing that would normally be restricted in the light office, because it comes under that storage definition, which 3 falls into your light industrial. I was looking for a zone that would be compatible with what would be on both sides of me." h: Hinrichs: "Do you want a light industrial zone?" Igo: "If I have a light industrial zone, which I would be in favor of, I would still have,: all of the rights under commercial. I was considering the residents on the north.": Sharp: "We could bring it in commercial, but then attach conditions - certain types of offices or combination office warehouse and design review. If it were a good looking office warehouse combination. I don't have any problem with it." Hinrichs: "I don't want another neighborhood shopping center across the street (from Crestwood)." Igo: "Obviously the light industrial zoning would be the product available to me and I assume I would have to come in for a conditional use or design review anyway, but don't want to come in for down zoning. I only have 300 some feet of frontage on either street and I don't see big trucks rolling in and out of there, that's going to be more compatial with an industrial park - they will have more room to swing in there, plenty of entrance. Commercial with limitations as to what can go in there, gives me a broad range." There was discussion concerning commercial compatibility with property either side, Hinrichs, referring to proposed zoning: "Professional offices are in industrial zoning, _ also outdoor storage and material." r Sharp: "I think the best bet would be commercial with restrictions." Hinrichs agreed. Hinrichs, referring to proposed ordinance: "The proposed General Retail and Service District is the one we want." Igo: "Then this zoning would be more compatible. We would have to come in for a condi- tional use giving you more control." Sharp called for comments from the public. There were none. The Motion was made by Hinrichs and seconded by Spencer to recommend to the City Council approval of J.M.K. Properties Annexation zoned "C" Commercial with conditions; with design review and with the understanding that common retail commercial be precluded. Motion Carried: All yea. Matlock Day Care Conditional Use Thea Matlock was present to request the use of her home for a Day Care,located at 805 W. 4th. Matlock had obtained necessary signatures of approval. Agenda 1 Norus Rezone Hearing Agenda 2 ^ff . Bill Blankinship, Boise PAC, was present, representing the rezone from "C" Commercial to "A" Residential of a portion of Settlers Village. Blankinship reviewed history of Settlers Village by displaying maps and stating that in 1974 the section was zoned commercial (previous hospital planned), in 1978 was platted in this manner. The new owners, Dimeo-Gordon Enterprises are requesting the portion designed for residential rezoned, but leaving the front Fairview section asi commercial. They have obtained 100% approval of property owners within 300 feet. A mixed development is planned. The plat was previously approved for 4-plexes, but Blankinship stated realistically they would not fit on those lots. The density would also be too great. They are spreading the density, on the west side some 0' lot lines, split some lots which would not require a variance, the lots around the cul-de-sac will require a replat for townhouse clustering, streets are in so they have to work with what is there, the subdivision at this point is just about 95% approved. There is an architecture theme being set developing the commercial front off Fairview, in keeping with spirit, color, harmony, unity and scale to the whole project. At the division of the commercial and residential, there would be a physical barrier keeping with the architecture theme, perhaps Spanish type, trees making a gentle division. The park is attached in the new covenants through a businessmen's association, to the commercial rather than residential. In the articles they allow for the park to be free and open to the public, allows for an opening so commercial areas can see easily, as well as residential. Their covenants have restricted any automotive fronting Fair- view, not meant to be heavy commercial, and have a planned community. The maps were concept to show theme. The density approved was approximately 15 upa. They are looking at an overall of 10 upa not including commercial. The planning procedure for splitting lots needs to be looked into. Chairman Sharp called for comments from the public. There were none. The Motion was made by Hinrichs and seconded by Spencer to recommend approval of the portion rezone request of Settlers Village as per the legal description of Norus Annex- ation #1, dated March 26, 1973. Motion Carried: All yea. JMK Properties Annexation Marty Igo was present to request annexation of 2.3 acres on the N/E corner of Linder and Franklin roads. Igo explained background of proposal. He and his partner, James R. Hollister, acquired property about a year ago, came before the Planning and Zoning for an informal meeting for what they might encourage in this location. The general thinking at that time was - thin�k in terms of Class A Industrial nature, office -.warehouse type of combination, they specifically told him that because of the neighborhood shopping center site on the south side of the intersection, that retail use would not be allowed, also that time the new zoning ordinance was being constructed so they were asked to defer this. They have approached the County, but Central District Health said they could not use their own sewer and water system because of the proximity of municipal --utility - they have since learned they could hook on to the utilities and stay in county and pay double fees. Also the County would not zone other than the city recommended. Because of the proximity, they have decided to work with the city and request under the present ordinance zoning "C". i ridian Citi Planning and Zonin .2. ust 19, 1980 Igo stated they felt with the industrial trend along the north side of Franklin Rd. and the railroad tracks within the one -mile of city center, the commercial zone would be more compatible with the homes to the north. They would be sensitive to those homes and suit commercial businesses that would be compatible to the neighborhood shopping center across Franklin, not necessarily the type of service that would go into that center. Igo explained the use of warehouse - office combination. A manufacturer representative might need 500 feet of office and 2 or 3 thousand feet of storage area. This would be compatible. Also, the Comprehensive Plan calls for clustering of any kind of commercial uses at the intersection. It certainly is not a single family or multi family location. Igo stated their interest is to get the process going, work towards the use of that land keeping with what the city is looking for. Commercial zoning with limited retail gives them, some flexibility. Light Office may be too restrictive a use of that corner, and too limiting for some users to locate there. There is a drain ditch that goes'through the property that gives them a usable 3/4 of and'acre front Linder - the balance would have access to Linder. Igo took the position that their 2 acres is not going to cause an enclave, it may con- tribute by starting growth on north side, but there is a good 75 acres of land that has to be dealt with before it becomes an enclave. Previous proposals around this area that were denied were discussed. There was considerable discussions concerning zoning this property "C" Commercial with an attachment, or design review, and the negative feeling for residential at this locatio It seems to be a matter of definition of zoning. Hinrichs still expressed concern of creating enclaves. mainly on the fringe (boundaries), the Sharp stated his fear of enclaves were creation of problems for the Fire and Police Departments. Spencer stated if all the property all the way up to City boundary would come in. he would have no problem with Annexation of JMK Properties. Igo pointed out the north side of tracks have no major arterial roads so better suited for residential. The south side has the major road system, better suited he felt he had to take the position for Industrial. As an individual property owner that he could only wait so long for the other 75 acres to do what they want to do with their own property. The reasons for this change of zone request as a part of the annexation process are as follows: 1) According to the Ada County Comprehensive Plan, this property is within the Urban Service Planning Area. 2) The property location and size meets.the goals outlined in Section 8 of the Ada County Comprehensive Plan.
