Stokes, Ph.D., Administrator Division of Environment SUBJECT: Cross Connection Control For Fire Sprinkler Systems Due to passage of House Bill 166 by the 1981 Legislature, Mr. Milton Klein, Director, Department of Health and Welfare, has rescinded his decision•of November 28, 1980 to require cross connection control for fire sprinkler systems (see memo enclosed). Therefore, the minimum backflow prevention requirements for fire sprinkler systems transmitted by Al Murrey's memo of December 18, 1980 are no longer in effect. The Department does not have any requirements. If you have any questions, please call Al E. Klein Director SUBJECT: Cross Connection Control - Fire Sprinkler Systems Statehouse Boise, Idaho 83720 The authority granted to the Director in Section 1-8306.03(1) of the Idaho Regulations For Public Drinking Water Systems as it per- tains to fire sprinkler systems has been voided by passage of House Bill 166 by the 1981 Legislature. The new law provides that "no state agency nor any district health department shall mandate requirements over and above those required in the uniform building code, 1979 edition with the 1980 supplement and the national fire protection association pamphlet number 13-1928, or later editions as they shall be adopted by the department, whichever is the most stringent for fire sprinkler systems". AGENCY NOR ANY DISTRICT HEALTH DEPARTMENT SHALL MANDATE 5 REQUI REMENTS OVER AND ABOVE CERTAIN CODE REQUIREMENT'S l~'OR FIRE SPRIN- G KLER SYSTEMS; AND DECLARING AN EMERGENCY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 41, Title 39, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and 10 designated as Section 39-4116A, Idaho Code, and to read as follows: 11 39-4116A. FTRE SPRINKLER SYSTEMS. Notwithstanding any other provisions 12 of law, no state agency nor any district health department shall mandate 13 requirements over and above those required in the uniform building code, 14 1979 edition with the 1980 supplement and the national fire protection 15 association pamphlet number 13-1978, or later editions as they shall be 16 adopted by the department, whichever is the most stringent f.or fire sprin- 17 kler systems. 18 SECTION 2. An emergency existing therefor, ti~hich emergency is hereby 19 declared to exist, this act shall be in full farce and c}ffect on and after 20 its passage and approval. f~eridian City Hall .8. July 6, 1981 agenda 9 (Cony ) talked to ACRD and they had no objection or problem with doing that. Our original approval of this was to bring a 10 inch line up, through and continue it on up. So, we would make provisions for that to be continued of course. The intent on this is economic I would suspect." There was review discussion concerning f~leridian Business Industrical Park. (Tape on file). Fire Chief Welker cautioned location of fire hydrants. Smith stated there appeared to be 3 hydrants on King and 2 hydrants on E. 5th There was no objection voiced from the Council concerning the proposed phase of development in Meridian Business and Industrial Park. The establishment of limiting four (4) children for child care in a "Neighborhood Child care"situation was discussed. It was the feeling of the Council that four ch ildren were a reasonable number. The Attorney was given the go ahead with civil action against Green Acres Properties, Inc, (Smith's Food King) because of their failure to install a backflow prevention ,device on its fire prevention sprinkling system. Attorney Crookston reported that the City is still going to arbitration with DVY Construction Co. There being no other business to come before the Council the meeting was adjourned. Mayor Joseph L.
