Regular meeting of the Meridian City Council called to order by Mayor Joseph Glaisyer
at 7:30 p.m.

Minutes of the special meeting held August 25, 1983 regarding the Creamery Building
were approved as written. Counci]man Kingsford ccBmiented on the minutes of August
25, 1983, saying "In regard to the well, Mr. ~ttiyx at that time said that he was
going to route that water into the storm sewer. It has been called to my attention
again that the stone sewer dumps into the sewer system. I've aked Earl (Ward) to
meet with Mr. l~iyx and his representative and tell thin what storm sewer he will have
to go to.'-
Minutes of the previous meeting held Sept~nber 6, 1983 were approved as written.

i Dean Rule: Request for Phase Construction of Westlawn Subdivision #1
Mr. Dean Rule was present representing his request to be allowed a phase construction
plan for Westlawn Estates Sub. #1. Rule explained that in order to meet his present
construction loan conmittment he would like to have a phase construction for the
first 22 lots. Rule also said that about 2/3'rds of the lots in Phase 1 are sold,
and canted that "once we start, I doubt if we w111 ever stop."
Fire Chief Kenny Bowers said that that it will be "tight for afire truck, but there
are alot of other spots around that are slot tighter."
Kingsford pointed out that phase 1 allows for a cul-de-sac for turn-a-round.
Wastewater Supt' Earl Ward said that he would prefer that the length of sewer run
in the 1st phase would run to the next ccanplete manhole. Ward said that this would
enable him to facilitate the tests.
Works Supt' Bruce Stuart echoed Ward's request to take the water line to the 1st
inlay valve. (Broadway Court)
Rule said he had no problem with that.
The Motion was made by Kingsford and seconded by Tolsma to allow Dean Rule's request
for phase development in Westlawn Estates Subdivision No. 1, providing that the
sewer and water will go to West Broadway Court curie-sac.

2 Mr. Robertson: First Church of Christ, Request to Gravel Parking & Drivetivay Area
Mr. Robertson came before the Council requesting pP~---ission to gravel the parking
and driveway area of the First Church of Christ being built at 2511 W. Cherry Ln.
Robertson said that due to time limitations and costs they would like to gravel
terq~orarily, and plan to pave within one year.
Roberston said that they plan to gravel to meet ccenpactation required by ACID.
The Motion was made by Kingsford and seconded by Tolsma to allow the request by
1st Church of Christ, 1 year to pave parking lot and driveway, that it be graveled
to the compactation test and rules and regulatons of AC~-ID.

RIGHT-OF-WAY AGREEMENT
THIS AGREEMENT, made this 12th day of September ~ 1983 ',
pursuant to the Act of Congress June 17, 1902 (32 Stat. 388) and
acts amendatory thereof or supplementary thereto, all of which
acts are commonly known and referred to as the Federal Reclamation
Laws, between the UNITED STATES OF AMERICA, hereinafter called
the United States, represented by the officer executing this agree-
ment, hereinafter referred to as the Contracting Officer, and
THE FIRST CHURCH OF CHRIST, INC., an Idaho Corporation, acting by
and through a Board of Elders and Deacons hereinafter referred
to as the Church.

WITNESSETH, THAT:
2. WHEREAS, in connection with the Arrowrock Division,
Boise Project, Idaho, the United States through the Bureau of
Reclamation, Department of the Interior, has ~ ursuant to Federal
Reclamation Laws, acquired certain lands upon which a drainage
facility known as the Nine Mile Drain has been constructed; and
3. WHEREAS, the Project facility known as the Nine Mile
Drain is being operated and maintained by the Nampa and Meridian
Irrigation District, hereinafter called the District, under a
repayment contract with the United States; and
4. WHEREAS, the Church desires to utilize a portion of such
lands to construct, operate and maintain a 4-inch sanitary sewer
line and appurtenant structures.
NOW, THEREFORE, in consideration of the mutual covenants
and stipulations hereinafter stated, the parties hereto do mutually
agree as follows:
5. The United States, in consideration of the sum of $100.00
to it paid by the Church, receipt of which is hereby acknowledged,
hereby grants to the Church, subject to the terms and conditions of
this agreement, the right to construct, operate, and maintain
a 4-inch sanitary sewerline over and across the Nine Mile Drain as
it is locatd in the NE~NW~d, NW ;NEB of Section 11, Township 3 North,
Range 1 West, Boise meridian, at the location shown on attached
Exhibit "A" and in the manner shown on the attach ed Exhibit "B",
both exhibits by this reference being made a part hereof, and
further described as follows:
A parcel of land 20 feet in width being 10
feet on each side of the following described
centerline:
Beginning at the N~ corner of Section 11,
Township 3 North, Range 1 West, Boise meridian,
then running along the North Section line,
N 89 03' 40" W a distance of 70 feet then
running S 0- 10' W a distance of 55 feet to the
Real Point of Beginning of the right-of-way
centerline, then running S 59 03' 40" E, a
distance of 110 feet, to an existing mainline
sewer.
6. The sanitary sewerline shall be constructed, operated, and
maintained by the Church without cost to the United States or its
assigns, and in such a manner as to cause no interference with the
normal operation of works of the United States. All construction,
reconstruction and maintenance work performed by the Church within
the right-of-way of the Onited States shall be undertaken only at
times, according to plans, and in a manner satisfactory to the
Contracting Officer.
7. The Church shall construct, operate, and maintain its
sanitary sewerline and appurtenances in a good, workmanlike manner
and shall insure compliance with the laws of the State of Idaho and
with all laws, regulations and orders of the United States and any
other publ~--authority affecting such works. The failure of the
Church after due notice to abide by any of the terms and conditions
of any applicable laws, rules or regulations, shall cause this
agreement to be subject to immediate termination at the option of
the Contracting Officer.
8. The Church shall adhere to the following special require-
ments in the construction, repair, operation, and maintenance of
the sanitary sewerline:
a. The Church upon completion of construction of
its facilities, shall install distinctively painted and identified
metal posts extending not less than four feet above ground surface
at the outside toe of each embankment or other physical extremity of
the Project facilities of the United States and five feet, measured
at right angles, to the right of the sewerline centerline when
looking in the direction in which the station increases.
b. Prior to actual construction or repair, the Church
shall notify the Contracting Officer or the District so that they or
their representative can inspect the work.
c. All backfill placed within the premises of the
United States shall be placed and compacted to the satisfaction of
the Contracting Officer. The Nine Mile Drain and appurtenant works
shall be restored by the Church to a condition at least as good as
before the crossing was accomplished.

d. The Church's sanitary sewerline will be a minimum
of 24 inches above the pipe enclosed Nine Mile Drain at the point of
crossing.
9. This agreement is granted subject to all rights pre-
viously acquired by third parties.
10. The Church agrees as follows:
a. There is reserved to the United States, its
successors and assigns, the prior right to use any of the right-
of-way herein described to construct, operate, and maintain all
structures and facilities, including, but not limited to canals,
wasteways, laterals, ditches, roadways, electrical transmission
lines, communication structures generally, substations, switchyards,
powerplants and other appurtenant irrigation and power structures
and facilities, without any payment made by the United States or
its successors for such right.
b. The Church further agrees that if the construction
of any or all of such structures and facilities, across, under or
upon said right-of-way should be made more expensive by reason of
the existence of improvements or works of the Church thereon,
such additional expense is to be estimated by the Secretary of the
interior, whose estimate is to be final and binding upon the
parties hereto. Within'. thirty days after demand is made upon the
Church for payment of any such sums, the Church will make payment
thereof to the United States or any of its successors or assigns
constructing such structures and facilities across, over, and under
said right-of-way of the United States. As an alternative to
payment, the Church, at its sole cost and expense and within the
time limits established by the United States, may remove or adapt
facilities constructed and operated by it on said right-of-way to
accommodate the aforementioned structures and facilities of the
United States. The Church shall bear the cost to the United States
of any costs occasioned by the failure of the Church to remove or
adapt its facilities within the time limits specified.
c. There is also reserved to the United States the
right of its officers, agents, employees, licensees and permittees,
at all proper times and places freely to have ingress to, passage
over, and egress from all of said right-of-way for the purpose of
exercising, enforcing and protecting the rights reserved herein.
d. The Church further agrees that the United States, its
officers, agents and employees and its successors and assigns shall
not be held liable for any damage to the Church's improvements or
works by reason of the exercise of the rights here reserved; nor
shall anything contained in this paragraph be construed as in any
manner limiting other reservations in favor of the United States
contained in this agreement.

11. The Church hereby agrees to indemnify and hold harmless
the United States, its officers, agents and employees, from any loss
or damage and from~any liability on account of personal injury,
death, or property damage, or claims for personal injury, death, or
property damage of any nature whatsoever and by whomsoever made
arising out of the Church's activities under this agreement.
12. Upon termination of this agreement for any reason,
the Church shall, at the option of the Contracting Officer, remove
all structures and facilities placed upon the premises by the Church
and shall restore the premises occupied by such structures and
facilities to a condition satisfactory to the Contracting Officer.
If the Church fails to remove its structures and facilities within
sixty •(60) days after the termination of the agreement, provided
such request has been made by the Contracting Officer, such struc-
tures and facilities, at the option of the Contracting Officer,
shall become the property of the United States.
13. The provisions of this agreement shall apply to and
bind the successors and assigns of the parties hereto, but no
assignment or transfer of this agreement or any part or interest
therein shall be valid until approved by the Contracting Officer.
14. This agreement shall terminate:
a. At the opt ion of the Contracting Officer i f the
Church fails to comply with any of the terms and conditions
thereof .
b. At the option of the Contracting Officer upon
discontinuance of the use of the facilities constructed by the
Church in accordance with the terms of this agreement for a period
of six (6) consecutive months.
c. At the request of the Church by giving written
notice to the Contracting Officer.
15. No Member of or Delegate to Congress or resident commis-
sioner shall be admitted to any share or part of this agreement or
to any benefit that may arise herefrom. This restriction shall not
be construed to extend to this agreement if made with a corporation
or company for its general benefit.

Dear Honorable Mayor Kingsford and Meridian City Counsel;
The Meridian School District in conjunction with the Meridian
First Church of Christ would like to seek permission from the
City Counsel to place two portables on the southwest corner of
the church property. The church is located at 2511 W. Cherry
Ln.
It is the intention of the Meridian School District to lease
building space from the First Church of Christ to house the
Meridian Academy, a dropout prevention alternative high
school. It would be necessary for us to use portables for
computer labs and to house our school equipment so the church
can continue to use the building on Sundays and scheduled times
during the week for other church activities and business.
Please advise us of your decision in regards to this request.

the architectural drawings for your new sanctuary under the direction
of Goodman Church Builders. We are attempting to determine all of
the guidelines and requirements established by the local planning
_ and building departments. It would be helpful if you could provide -
us with the addresses and telephone numbers of these departments
and~a personal contact inboth departments.
We have received from Wayne Goodman a copy of a topo map and legal
t :description for your site. There are a few minor variations in
-~ '` propertyline dimensions between the legal description and the topo
'-'map,' so we will follow. the legal description to layout the site plan.
More important than these minor variations, however are the required
easements, setbacks,. and right-of-ways we must follow. We need to
` establish the street right-of-way for Cherry Lane, the building
`~ setbacks, and any easements (especially along the Ruthledge .

~ ;,verify this information would be greatly appreciated.

Post 113.
Schweers was spokesman for the Veterans. He addressed the council and introduced
commanders present. Schweers read an impressive article "I am your Flag" to
commemorate Memorial Day, He extended an invitation to attend services at the
Meridian Cemetary for our fallen comrades.
Williams proclaimed May 26th, 11: 00 a.m. for Memorial Day services.

2 First Church of Christ Concept Plan
Mike Anderson presented the concept plan of the church to be adjacent to the
east of Stucker's Bethaven Subdivision, W. Cherry Lane.
There were no objections from department heads. Letter of fire chief an file
with these minutes.
Engineer Smith stated that there will be a street from Bethaven that could exit
out from church property, water is available from Cherry Lane, and sewer line
comes down and enters line coming out of Bethaven.
Drainage pond was discussed and Anderson stated the dry pond was to be moved
over to the west in Bethaven.
Councilman Orton abstained from any action.
The Motion was made by Kingsford and seconded by Brewer that the First Church
of Christ Concept Plan be approved on W. Cherry Lane, Stucker Annexation.
Motion Carried: Kingsford, yea, Brewer, yea, Orton, abstain.

President of council Richard Williams read Ordinance #370 entitled:
AN ORDINANCE AMENDIP~G TITLE 7, CHAPTER 3, ENTITLED SANITARY SERVICE SYSTEM! OF THE
REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY THE
DELETION THEREFROM OF TWICE PER WEEK COLLECTION DURING THE SUMMER MONTHS; BY
AMENDING SECTION 7-307 CHANGING THE MAXIMUM NUMBER DF POUNDS THAT MAY BE PUT IN
EACH CONTAINER FROM 100 POUNDS TO 80 POUNDS; BY ADDING A NEW SECTION GIVING THE
CITY COUNCIL OF THE CITY OF MERIDIAN THE POWER TO ADOPT RULES AND REGULATIONS BY
RESOLUTION PERTAINING TO SANITARY SERVICE INCLUDING BUT NOT LIMITED TO THE SETTING
OF FEES FOR COLLECTTON; AND PROVIDING FOR PENALTIES.
The Motion was made by Kingsford and seconded by Orton that the rules and provisions
of 50-9002 and all rules and provisions requiring that ordinances be read on three
different days, be dispensed with. and trhat Ordinance Number 370, as read, be passed
and approved. '

There was discussion concerning apartment dwellings, trailer courts and vacancies
during vacation.
