We have reviewed the above-referenced submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council.' APPLICATION SUMMARY & BACKGROUND The applicant, Gerry Sweet, has requested approval of a one year time extension for recording of the final plat for Intermountain Outdoor Sports Subdivision (a four parcel, C-G zoned subdivision, located on the south side of E. Fairview Ave., approximately 1 /8 mi. west of N. Locust Grove Rd.). The Preliminary/Final Plat was approved by City Council on 6/4/02. There was also a variance to the landscape ordinance approved with this application (VAR-02-001). Intermountain Outdoor Sports retail store, located in one of the proposed lots, closed for business in July, 2002. Due to the closure of the store, the applicant has decided to sell the property and was unable to meet the conditions of approval for this project. The prospective buyers all wish to comply with the conditions and complete this application. The applicant submitted the request for the time extension within one year of the original approval, as required by Meridian City Code 12-3-8. RECOMMENDATION Planning and Zoning staff have no objection to the requested time extension, and recommend approval of the requested one year time extension for the Final Plat. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix III-A 2. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. UFC 901.4.2 & 901.3 3. The roadways shall be built to Ada County Highway Standards and have aback-to- back measurement of 36'. UFC 902.2.1 4. All radii shall be 28' inside and 48' outside radius. 5. All cul-de-sacs to be a 50' radius. 6. Insure that all yet undeveloped parcels are maintained free of combustible vegetation per section 1103.2.4 of the Uniform Fire Code. Provide an second emergency access point which is 20'.wide until the project is tied into another project or back into West McMillian. Susan S. Fairview Avenue Meridian, Idaho 83642 Re: Staff Level Approval Preliminary Plat: Intermountain Outdoor Subdivision 1375 East Fairview Avenue MPFP02-001 4-lot commercial subdivision Facts and Findings: A. The Ada County Highway District (ACRD) staff' has received the above referenced application requesting preliminary plat approval to plat a 4-lot commercial subdivision. The proposed subdivision has one existing commercial building (Intermountain Outdoor Sports) and will have three additional commercial lots. The 6-acre site is located on the southeast comer of Fairview Avenue and Stonehenge Way. This development is estimated to generate 830 additional vehicle trips per day (2,460 existing) based on the Institute of Transportation Engineers Trip Generation Manual. B. The application and site plan stamped and received by the City of Meridian on Mazch 11, 2002, and submitted to the District on Mazch 13, 2002, has been reviewed by the ACRD Planning and Development stall' and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. C. This is a staff level approval and will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform to District standards/policy or an appeal of the Planning and Development staff decision is submtted as described within the Standard Requirements outlined below. D. On March 18, 2002, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On March 22, 2002, the staffmet as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. S:~DSIBCHVSIJBS~Intermountain Chttdoor.sla.doc Page 1 E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed use of this development has been classified as Specialty Retail. (Per the ITE Manual) The impact fee rate from the fee tables for this use is $1,885 per thousand square feet of gross building area, based on the impact fee ordinance in effect at this time. Note: This rate is provided for informational purposes only and shall not be construed as an impact fee rate certification. The impact fee will be assessed at the time of plans acceptance by District staff, 'and shall be based on the fee tables and provisions of the District's Impact Fee Ordinance in effect at that time. F. Development patterns in the surrounding azea are commercial and residential. To the north of the site is the Idaho Athletic Club. To the south of the site are approximately 13+/-acres of non- developed parcels. To the west of the site is Danbury Subdivision. To the east of the site is an auto salvage yard. Based on development patterns in this azea and the resulting traffic generation, staff anticipates that the transportation system will be adequate to accommodate additional traffic generated by this proposed development at accepted levels of service. G. The existing commercial building (Intermountain Outdoor Sports) will remain and the proposed additional lots will be utilized for commercial use. No specific tenants or uses were included in the preliminary plat application. H. In the preliminary site plan, the applicant is not requesting additional access points to Fairview Avenue or Stonehenge Way. The three existing driveways were approved with the original application of Intermountain Outdoor Sports. - Previously approved Driveway # 1 is located on Fairview Avenue approximately 25- feet west of the east property line. - Previously approved Driveway # 2 is located on Fairview Avenue approximately 190- feet east of the west property line. - Previously approved Driveway # 3 is located on Stonehenge Way approximately 340- feet south of the north property line. The three additional proposed commercial lots will be utilizing the existing two driveways on Fairview Avenue and one existing driveway on Stonehenge Way. I. Fairview Avenue is classified as a principal arterial roadway with 114-feet ofright-of--way, and is improved with 5-travel lanes, with curb, gutter and sidewalk on the north side across from the proposed subdivision. No additional right-of--way is required finm this development at this time. J. Stonehenge Way is classified as a locaUlocal commercial roadway with 54-feet of right-of--way tapering to 50-feet abutting the site, and is improved with 2-travel lanes, curb, gutter, and sidewalk. No additional right-of--way is required from this development at this time. K. There are currently no improvements on Fairview Avenue abutting the proposed site. In accordance with District policy (7204.7.2) the applicant should be required to construct a 5-foot wide concrete sidewalk on Fairview Avenue located 2-feet within the right-of--way. S:~DSTECH~SUBSUntermountain Outdoor.sla.doc Page 2 Special Recommendations to the City of Meridian: The applicant should provide the District with a copy of a recorded access easement among the parcels for use of the previously approved driveways to the public streets prior to final plat approval. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACRD approval of the final plat: Site Specific Requirements: 1. No additional access points to Fairview Avenue or Stonehenge Way have been proposed and none are approved with this application. 2. .Pave the existing driveway on Stonehenge Way that is located approximately 340-feet south of the north property line to its full-required width of 24 to 30-feet and to a point 30-feet beyond the edge of pavement of Stonehenge Way with 15-foot curb radii tapers abutting the existing roadway edge. 3. Construct a 5-foot wide concrete sidewalk on Fairview Avenue located 2-feet within the right- of-way. Coordinate the location and elevation of the sidewalk with District staff. 4. Replace any existing damaged curb, gutter and sidewalk and any that maybe damaged during the construction of the proposed development. Contact Construction Services at 387-6280 (with file number) for details. 5. Utility street cuts in pavement less than five years old aze not allowed unless approved in writing by the District. Contact ACIiD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. 6. Meet District drainage requirements per section 8000 of the ACRD Development Policy Manual. Contact District staff at 387-6170 for details. 7. If utility relocation is necessary to construct improvements required with this development, then all utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 8. Any existing irrigation facilities shall be relocated outside of the right-of--way. 9. Other than the access points specifically approve access to Fairview Avenue is prohibited. The Commission shall heaz and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted azbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address, and telephone number, and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written azgument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regulaz meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing. 2. Payment of applicable road impact fees aze required prior to building constmction in accordance with Ordinance #195, also known as Ada County Highway District Road hnpact Fee Ordinance. 3. Al] design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standazds and approved supplements, Construction Services procedures S:~DSTECFi1SUBSUntermountain Outdoor.sia.doc Page 4 and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 4. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 5. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject properly unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. No change in the terms and conditions of this approval shall be valid unless they aze in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development.
