As a condition of the Variance application the applicant is required to provide several
statements for justifying any request for a variance of City Ordinance. The following is a list
of the statements required for the variance application:
A statement -what ordinance can you not comply with?
• The applicant cannot comply with the block length ordinance.
2. A statement -what prevents compliance with the ordinance?
• The applicant cannot comply with the Block Length Ordinance due to
existing conditions approved in previous phases of Bear Creek
Subdivision.
3. A statement -what are the minimum requirements of this ordinance that need to
be reduced to permit the proposed use?
• The interpretation of the 1,000-foot block length needs to be relaxed to
allow the proposed street configuration.
4. A statement -what is the difficulty or hardship that would result if requirements of
this ordinance were applied to the subject property?
The hardship would be creating stub streets to break up block length that
would not connect to anything in the future.
5. A statement -any unusual or peculiar circumstances that indicate regulations of
this ordinance that should not be strictly complied with.
• Existing stub streets within previously approved phases of Bear Creek will
not allow this site to comply with the Block Length Ordinance. Bear Creek
was previously granted a variance for Block Length.
6. A statement -that special conditions and circumstances exist.
Existing streets prevent compliance with the ordinance.
A statement -that interpretation of the ordinance shall deprive the applicant of
rights commonly enjoyed by other properties.
• The variance has been granted to this applicant for previous phases of
Bear Creek and other applicants in the past for similar situations. Strict
interpretation of the ordinance would limit the ability to develop this
property.
8. A statement -that special conditions or circumstances exist, that were not a result
of the applicant's action.
I requested a variance for Bear Creek Subdivision, which in turn caused
this property to require a variance. The Variance I requested and was
granted in a previous phases of Bear Creek did cause this property to
require a variance, however, as 1 have stated before the Ordinance needs
to be revised because there is no technical basis supporting it nor are
there sound planning principles in its foundation.
9. A statement -that granting the variance requested shall not confer on the
applicant any special privilege.
• Granting the variance will not confer on the applicant any special privilege.
The City Council has granted numerous variances for similar subdivisions.
10. A statement -how granting of the variance would convenience the applicant.
• Granting the variance will allow the applicant to develop the property with
the most efficient design without constructing stub street that will not be
utilized.
11. A statement -the relationship of the proposed variance to the Meridian
Comprehensive Plan (cite policy numbers).
By not extending a street out to State Highway 69 will limit the number of
access point onto a major arterial road, which is supported by the Meridian
Comprehensive Plan.
The above-mentioned list is intended to meet the requirements of the Variance
application. If there are any deficiencies or additional requirements of the Variance
applications required prior to its processing please call me at 344-9700.
