Ada County Trading Company Conditional Use - Chapin Subdivision, SE Corner of Fairview Ave, and E. 2 1/2 St. - Car sales lot. APPROVED with condition that the West Fairview access be eliminated and that there be Design for City Council. 3. B & B Business Park Annexation - Franklin Rd. next to Boise Cascade on West side. Agenda Rainey-Kuhl Annexation - Overland and Meridian-Kuna Road Parcel A 1 W. Overland South side Parcel B Howard Foley, Attorney, was present to represent request of annexation of the Time-for-Two Bar and Roho property. The Time-For-Two property is located on the Northeast corner of Overland and Meridian/Kuna Highway. The Roho property is located just South of the MarMon Annexation on West Overland. The Roho property, or Parcel B, will provide an impound facility for area need. Foley described the travel density of some 14,000 on the Meridian/Kuna Highway - 40,000 on the Interstate. Foley stated that since the City has annexed MarMon property which would require extension of Sewer/water, fire and police protection, that a greater tax base would be required to support what is now going to be an extended City service. The only way to extend that tax base is to bring in new commercial type of development, higher tax base. Foley stated that their most central point is that they are not asking the City to allow or convert property that is at present something other than commercial. The site is commercial. This is not a heavy residential area. They are asking annexation to expand and improve the services of the area. Steve Tede, Architect, displayed map sketch describing anticipated Supper Club area parking and landscaping to be located at the Time-For-Two intersection. Restaurant would be situated where the building is now and parking where the impound is now. 25% of the floor area would be bar, the rest restaurant and kitchen. Foley poihted out location of Parcel B, Roho property, to the West and uphill behind the present service station on Meridian/Kuna Highway. Extension of water and sewer services from the t4arMon Development were discussed. The Ten Mile route was most feasible. Orton commented that so far the City has approximately 160 acres annexed and so far no positive water and sewer plan to bring across the freeway. Sharp agreed to the fact that people are led to believe the services will be there and nothing is happening. Mitchell questioned if both property requests were contingent upon the other. Foley answerd yes. Foley explained that motivation for proposal is that the present location is not compatable to expansion for either business. One is going to have to move. The impounding lot would not be a wrecking yard, only storage for towing, insurance investigation, etc. Bruce Kuhl described the use of the impounding lot and would be landscaped so it would be compatible with any residential. Boise has only two such lots and the service would benefit and be convenient to this area. There was discussion concerning Comprehensive Plan, sewer/water facilities, access- ability to the Interstate, completion of the zoning ordinances and police service. The Motion was made by Orton and seconded by Mitchell that the Commission approve the Rainey-Kuhl Annexation with the condition that before Preliminary Plat there is positive committment for water and sewer across the Interstate, by a certain date; adequate buffering; detailed landscaping with design review, and meet all City requirements. Se Agenda 2 Ada County Trading Company - S/E Corner of Fairview Avenue and 2 1/2 Street Jim Potter, Edward Brooks proprietor and Harry liazen, owner, were present representing requested for Conditional Use for a car sales lot. Design plan was presented. Potter outlined compatable use, curb cut and access. The Highway Department has not called for sidewalks. Potter explained the Highway Departments plan for curb cuts. The Commission requested that they negotiate with the Highway Department to eliminate the access near the corner of Fairview and 2 1/2 Street, leaving the access onto Fairview at the East end and on 2 1/2 Street. The Motion was made by Mitchell and seconded by Tewksbury that Ada County Trading Company Conditional Use Permit fora Car Sales Lot be allowed with the condition that the West Fairview access be eliminated and that there be Design Review fdr City Council. Motion Carried: All yea Agenda B & B Business Park Annexation - West Franklin 3 Brent Barrus and Harold Briscoe were present representing request. • Barrus displayed map and explained the first 150 feet off of Franklin would be Commercial the rest, extending to the Railroad, Industrial Sewer available off of Boise Cascade property, water available off of Franklin. Sharp pointed out that the small piece of Stanley property would create an enclave and the City's policy is to not create such an enclave. Barrus stated that the property owner, Keith Stanley, was contacted and his opinion was that when the City wants them in, they will be taken in. Barrus felt that Stanley had no objection to "be taken in". Barrus stated that they need their annexation request approved so that they could better develop and convenience to the City of fire and police protection. There was discussion concerning enclaves. The Motion was made by Orton and seconded by Hinrichs that the B & 6 Business Park Annexation be approved based on the condition that the Stanley property (created enclave) be produced also for annexation by written committment. Motion Carried: All yea I Agenda 4 Paul Keene Conditional Use -located at 1123 E. 1st St. Paul Keene was present, requesting a Conditional Use Permit for an Art shop. Keene presented signatures of consent of neighbors, and stated there will not be many patrons at anyone time, some parking off of alley, his living quarters in the back and compatible location. Sign will be unlighted and approximately three feet of driftwood design. The Motion was made by Orton and seconded by Tewksbury that they approve Paul Keene Conditional Use for an Art shop, located at 1123 E. 1st St. Motion Carried: All yea. I Agenda 5 Meridian Business and Industrial Park Preliminary Plat - located 516 E. Franklin. Al Marsden representing and Win$~tbn Moore, Industrial Park owner, were present. Marsden displayed Preliminary Plat combination development which includes a Warehouse development, Industrial development, and a Business Park with a bank and restaurant corner. The project is 46 acres, small business in front, large buildings in back, not retail and semi warehouse functions. East Bower access was discussed. Lot 12 shows an easement. Marsden stated that this easement parking area could serve as access for fire protection from E. Bower. ~ • Meridian Planning and Zoning .3. Septemberl""A, 1:9,79 Marsden reviewed Recommended Conditions of Aporoval {on file with these minutes.) Access on Franklin was discussed. Marsden stated they have complied with Ada County Highway District requirements of an access every 300 feet. Distance of frontage is 2000 feet long. He stated that they want to specify the uses so they are very clear for record, referring to the Recommended Conditions of Approval. He again stated that the Fire Department's request would be complied with by allowing Lot 12 connection to Bower St. Anticipated first phase project to be next Spring. Winston Moore stated that they would appreciate to be able to proceed this Fall if weather permits. They have created a high quality Business Industrial Park. They intend to sell parcels with reasonable, but strict covenants; outside storage will be screened, not visible from Franklin. The Motion was made by Orton and seconded by Tewksbury that Meridian Business and Industrial Park Preliminary Plat be approved contingent upon the agreement that they comply with the new ordinances, review of variances of lot lines, access on Franklin be limited, the access paved easement be put through to E. Agenda 6 Mike Anderson and Steve Moore were present, representing First Church of Christ, seeking advisory. Property in question is located at the Northeast corner of Pine and Locust Grove. Their intention was to build a church, access being from both Locust Grove and Pine. Since purchasing the land, the impact has changed. It was their feeling that this would be better suited for Industrial. Their question was to what use they could solicit this property for resale. It was pointed out by Orton that the Comprehensive Rlan does commence that area to Industrial development. 7 John Ewing - 6-Plex Proposal Idaho and 2nd St. Design map was presented. Ewing felt that design fit lot, trees would be maintained, parking off alley, retired homeowners, and condominium type. Density was discussed. It was the feeling of the Commission that a four-plex would be acceptable to meet building codes and density requirements. It was Ewing's desire to submit his proposal October 9, 1979. Keith Stanley entered the meeting to discuss the Annexation of his property next to B & B Business Park. Stanley stated that he was not in favor of Annexation. The Commission discussed the advantages of Fire and Police protection and the problem it presents in approving B & 6 Business Park. It was pointed out that creating an enclave was against City Ordinances. Pipkin stated that hook-up fees would be required upon Annexation. Sharp suggested that this problem be worked out between the property owners. 8 Flannary, Oliver and Mrs. Lytle, owners of homes located on the Northeast corner of Cherry Lane and Linder. Flannary stated that the three homes are zoned Residential and this location has become very undesirable because of extreme traffic and noise. He stated that their concern was input for Commercial rezone. It was pointed out by the Commission that the Comprehensive Plan calls for Commercial development on one of the four corners of an intersection. There is already one of those corners zoned Commercial. Limited Office would be the only alternative, when the new Ordinances are adopted. hieridian Planning and Zoning .4. September 10, 1979 Agenda 9 Lee Stucker, Shelter Home in Bethaven Subdivision. Stucker requested input from the Commission, stating that this would involve an ambulatory shelter for less than 100, 7.5 acres. He questioned if the new ordinances would accomodate this type of use. Hinrichs stated that in the new ordinances, this would be listed as a Conditional Use in a Residential area R-II medium density. The Plotion was made by Orton and seconded by Tewksbury that the meeting be adjourned at 11:00. Motion Carried: All yea. APPROVED: Chairman r ~ • MERIDIAN BUSINESS AND INDUSTRIAL PARK Recommended Conditions of Approval Hearing Date: September 10, 1979 RECOMMENDATIONS 1. Streets: a. Curb, gutter, and paving are required throughout the sub- division or as specified by the Ada County Highway District. Detailed construction plans and specifications must be approved by the Ada County Highway District prior to con- struction. b. Provide and dedicate 50 feet of right-of-way for loop road and cul-de-sac with 5 feet road easement on both sides. c. Provide 41 feet of pavement and curb, back to back, for loop road and cul-de-sac or 30 feet of pavement without curb with borrow pit on both sides of road. ~- d. Submit street names for public dedicated streets. e. Place street name signs at all intersections. f. Stop signs are required at all street intersections with Franklin Road. g. Eliminate acceleration and deceleration lanes on Franklin Road. h. Maintain a minimum of 300 feet between access points on Franklin Road for access to development. 2. Utilities: a. Submit a letter of acceptance for water service from the City Engineer prior to recording the final plat. b. Submit a letter of approval of sewer and water facilities by the Regional Health and Welfare Environmental Services Office prior to recording the final plat. c. Installation of service utilities to comply with requirements determined by the public utilities providing service. d. Submit a letter of approval of the drainage plan by the Ada County Highway District and the City Engineer prior to recording the final plat. e. Existing sewer line shall have a 20 foot easement and shall be shown on the plat. f. Modifications made in alignment to the Hunter Lateral shall be approved by the Nampa-Meridian Irrigation District. g. Approved fire protection facilities to be provided to comply with the requirements of the Meridian Fire Department. r Page Two MERIDIAN BUSINESS AND INDUSTRIAL PARK 3. Development Plan: a. Industrial, warehousing, restaurant, bank and business park uses as delineated on the development plan are allowed as part of the preliminary plat approval. b. The size of parcels for the industrial and warehousing uses can be modified to reflect site size needed to accommodate the proposed uses. The final plat need not be submitted until all parcel sizes have been ,G'~etermined either through sales or two years from October'l1, 1979, which ever occurs first. Building permits will be issued for individual lots so long as a metes and bounds descrip- tion and map is submitted to the Building Department des- cribing the parcel and its location in relationship to the approved preliminary plat and street system. 4. Amenities and Restrictions: a. The on-site and street landscaping as shown on the preliminary plat design plan is approved in concept and detailed land- scaping plans must be submitted for each parcel when re- questing a building permit.
