Code 104(f) Historic Buildings: (f) Historic Buildings. Repairs, alterations and additions necessary for the preservation, restoration, rehabilitation or continued use of a building or structure may be made without conformance to all the require- ments of this code when authorized by the building official provided: 1. The building or structure has been designated by official action of the legally constituted authority of this jurisdiction as having special historical or architectural significance. 2. Any unsafe conditions as described in this code are corrected. 3. The restored building or structure will be no more hazardous based on life safety, fire safety and sanitation than the existing building. I feel under these conditions some breakaways from the U.B. Code should be allowed and this building permit is being issued under those conditions. The main item of concern being the outside walls of the structure are of solid brick construction without earthquake protection. This remodel is an improvement over the present structure but does not meet the earthquake requirements of-the 1979 U.B.C. One-way couplet on U.S. 30 and Meridian with six moving lanes and two parking lanes. 2. Two-way with two moving lanes and parking on both sides. 3. June 21, 1982 Item 7 Department Reports Mayor Glaisyer called on each department head for any report they may have for the Council. Bruce Stuart, Water Department stated that there is a water line going thiu a septic tank at 137 E. Pine. ~__ ~' Mayor Glaisyer instructed Stuart to contact the owner and make them aware of this problem. ;~ Mayor Glaisyer instructed all Department Heads that their department budgets for fiscal year 1982-1983 are due prior to July 14th, 1982. ~" Rick Orton stated that he would like to alert the Council on a problem steming from ' 1969 that has been discovered. This concerns the Zoning of the Ross property on East Fairview Avenue. It was zoned as "A" Residential and has never been rezoned. Both Ross parcels are commercial. One parcel is a furniture store, and the other parcel is a mobile home park. Orton stated that he felt it was the Owner's responsibility to request a rezone on this property, and that he wanted to alert the Council as to this problem. ~;' <~; w~ ~. . -; ~; Councilman Orton requested an Executive Session to discuss contractual obligations. The Motion was made by Orton and seconded by Brewer to go into an Executive Session to discuss a contractual matter. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea _~ Ray Sotero, Idaho Statesman,reque~ted that the Mayor explain"contractual matters" and cite the section from the Ida~io Code of the Meeting Law under which the Executive Session had been called. Mayor Glaisyer requested that Wayne Crookston, City Attorney, advise on this matter. Mayor Glaisyer cited section 67-2345 of the Idaho Code, Executive Sessions -When Authorized -Subsection (b) to consider the evaluation, dismissal or discipling of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student; The Council went into Executive Session. Mayor Glaisyer excused all Department Heads, and anyone else that wished to leave at that time. The Council returned to the Chamber at 10:07 with no action being taken in the Executive Session.
