Stuart,Superintendent Meridian Public Works Dept. 11 West Bower Street Meridian, Idaho 83642 Honorable Mayor & Council City of Meridian 728 Meridian Street Meridian, Idaho 83642 Dear Mayor and Council: Re: Meridian Place Subdivision Phase Development of Unit I Recently, Mr. Earl Harmon contacted LaWana about the possibility of developing only a portion of the approved Unit I of the subject subdivision. Because the sewer and water lines had been installed for the whole of Unit I, the question arose as to whether or not the City could accept only those parts of the sewer and water system within the proposed phase development. I have discussed the question with Bruce and Earl, and we make the follow- ing recommendation to you: 1. Sanitary Sewer. The top of the manhole closest to the northerly boundary of the phase development must be brought to gravel road grade. The sewer lines coming into the manhole must be physically sealed to prevent entrance of debris and inflow. The outflow sewer line from this manhole will be used for access to clean the sewer line. Earl Ward informs me that the total system of Unit I had been inspected for leakage and alignment and had passed the tests. 2. Domestic Water. Our suggestion is to break the water main in Jericho Way just beyond the northerly boundary of the proposed develop- ment and install a blow -off assembly on the pressure side of the main line and a sanitary cap on the non -pressured side of the main line. Bruce informs me that the developer is correcting a leak in the water main line today and that after it is complete the system beneath the proposed paved areas would be acceptable. Bruce and Earl and I feel that it would be quite difficult to maintain and be responsible for sewer and water lines outside the boundaries of the improved areas. The physical separation of these lines should also provide the maintenance separation. Sec. 6; T3N; RIE; B.M., Ada County, Idaho Surety Extension Dear Mr. Harmon: 318 E. 37TH STREET BOISE, IDAHO 83704 PHONE: 344-6111 The Ada County Highway District's Commissioners, in meeting on September 23, 1982, reviewed your request for the surety extension and partial paving as concerned with the subject subdivision. The Commis- sioners made the following decisions regarding your request: 1. Extended the expiration date of the surety agreement to May 29, 1983. 2. Approved the partial paving of the development with the re- striction that the following must first be accomplished: a. Remove and replace the contaminated gravel base. b. Provide a copy of the acceptance letter from the City of Meridian for the sewer and water service lines. c. Compact all gravel base to 95 percent. 3. On October 7, 1982, Meridian City Engeneer, Mr. Gary Smith, submitted to the Mayor and City Council some conditions that he recommended before acceptance of the reduced area. These conditions have all been met and all development is completed, except for the laying of the asphalt mat, which should be completed within the next two days. In light of the completion of all work requested I here -by petition the Mayor and City Council to accept the reduced portion of Phase I, Meridian Place Subdivision, subject to the paving being completed satisfactorily and meeting all elevation requirements. Further I here -by WARRANT AND GUARRANTEE all work in the accepted portion of Phase I, Meridian Place Subdivision, for a period of one year from the date of acceptance by Meridian City. Said reduced area is comprised of; Jericho Way from the North boundary of Lot 6, Block 5, South on Jericho Way to where Meridian Place intersects with Settlers Village Subdivision, and on Willow Brook Drive from the West boundary of Lot 8, Block 5, Easterly to include the Culdesac. Much discussion followed what would be required by the City to re -zone the area for a parking lot. It was suggested that the parking be removed a certain distance from the intersection, but Mr. Patton stated that the parking is critical there also. Commissioner Winder stated that the staff would like to get the parking removed but want to give Mr. Patton and his people a chance to establish an acceptable approach. Commissioner Winder suggested that this problem be resolved by next week at the noon meeting, and instructed staff to go out and look at the area to see where the parking can be removed. Mr. Patton asked if the grassy area between the sidewalk and gutter could be used. ACTION: TRAFFIC ENGR. John Galvin asked that the Commission not allow the study to be dropped, that the Highway District look into the possibility of incorporating the island idea or some other way of slowing down the traffic. Further discussion followed. Mr. Galvin noted that those traffic islands have been incorporated successfully in other towns. Staff to look into the possibility of using the island concept. One of the citizens, unidentified, reported a sight obstruction to the stop sign on Nez Perce at Owyhee. Staff to notify Boise City Forestry to have the tree trimmed. Discussion held. ACTION: TRAFFIC ENGINEERING Jon Robertson further explained the islands that are installed in the intersection and the towns where they do work. He requested that a study be initiated for possible solutions to the problems they are having with speeding and non -local traffic. Much discussion followed. Staff directed to look into what can be done. ACTION: TRAFFIC ENGINEERING SUBDIVISIONS - Keith Jacobs presented the Technical Review Committee Agenda of September 20, 1982, and asked the Commission for comments. The Commissioners agreed with staff requirements, statements as presented. 82 -24 -CU - Robert Christy - The Commission agreed with staff requirements. Meridian Place Subdivision No. 1 - Phase 1 - Mr. Earl Harmon was present and explained his request to pave a portion o his subdivision so he can sell ten lots. Much discussion followed. Keith Jacobs said he has no objections to the request, as long as the improvements are installed according to specifications. Commissioner Jeppesen moved to approve the request by Mr. Harmon to install improvements on Jerico where it intersects with Torrington Court at the end of Lot 6, Block 5. Commissioner Winder seconded. Motion carried. Office Building - Overland and Phillippi - Dr. Soo Lee - Dr. Lee's attorney explained the history of the problem and stated that Dr. Lee does need the entrance to the basement which will require the curb cut. Mayor Glaisyer: "The Hearing is now opened to the public for comment, pro or con, regarding the Conditional Use for a Beauty Salong, three licensed operators." There was M comment. "Public Hearing closed." The Motion was made by Brewer to approve the Conditional Use for a beauty salon with three (3) licensed operators, two (2) full time and one (1) part time operator; with the stipulation of the sewer and water departments attached. Kingsford: "Wayne,(City Attorney), does this require Findings of Fact when Ms. Larsen already has a Conditional Use?" Crookston: "It would, because there would be an increase of what she already has." Brewer: "I will withdraw my Notion." The Motion was made by Kingsford and seconded by Brewer to direct the City Attorney Wayne Crookston to draft the Findings of Fact and Conclusion of Law for the Conditional Use Permit request of Merle Larsen Beauty Salon, 1930 North Linder Road. City Clerk stated that Ms. Larsen had already paid hookup fees for Commercial and the 2.5 for water and sewer would be charged monthly. This was explained to Ms. Larsen. Agenda 3 EARL HArjKm - MERIDIAN PLACE SUBDIVISION, PHASE I Earl Hannon presented a letter of request for limited paving. Harmon: "The letter spells out in detail all of the request that I will briefly mention. Going back to the original letter where I requested developing a portion of Phase I and from that, your Engineer made some recommendations that ought to be done to make it acceptable. As of today all of those things have been accomplished except for the paving. My request tonight would be that you would vote in favor of the building permits being granted and the acceptance of this project subject to the paving being done in an acceptable manner, according to the elevations of water and sewer people need to have.—It also spells out in the letter my warranty and guarantee of the development project for the park will be accepted by the City. Mayor Glaisyer: "Where the pavement is going to end will there be sufficient turn- around for emergency vehicles?" Harmon: "It has been required by the ACHD that a barricade be put completely from curb to curb. They claim the reason is for liability - somebody at a fast speed coming off the paving into gravel could possibly cause an accident. I'm in the process of building a barricade to put across there. I inquired if it could be a partial one so the emergency vehicles could go around but as of Friday afternoon their (ACHD) deter- mination was that they wanted it curb to curb." Mayor Glaisyer: "Other than that, ACHD approved your proposal?" Hamm: jThey will,'subject to your letter of accepting water and sewer." Maps were displayed of meridian Place Phase I. There was much -discussion concerning methods for emergency vehicle turn -around. The lots to be sold are listed in the letter with these minutes. Earl Ward, WasteWater stated that they had plugged the line off satisfactorily. fibre discussion concerning a turn -around for emergency vehicles. The Notion was made by Orton and seconded by Brewer that the Council accept Mr.Harmon's request as stated in his letter dated October 18, 1982, with the request that the barrier be built at approximately the north side of the intersection of Torrington Court and Jericho Way; and that Mr. Harmon produce a smooth transition betweem the pavement and the gravel pad for emergency vehicle turn -around. President of the Council, Grant Kingsford welcomed Trent Bingham from Scout Troup # 81 who was in attendance for Merit Badge. Request by O.T.Davis Construction for use of Trailer for sales office in Meridian Place Subdivision. Rick Orton asked what action Council would take to allow this, Variance or Temporary Conditional Use Permit. Kingsford explained that Attorney suggested that the Council just allowed it with some time restraints, not having to go through the hearing procedure & etc. where it was a Sales Office and wouldn't be in the area that long. Frahm explained this would be an exception to the Mobile Home Ordinance where you allow a temporary use for this purpose and where you require the individual go thru the whole process would be an undue hardship. Orton stated that we had done this type of thing before for a construction type office. No objections to six months use, if that is adequate and we do not have to have a big argument getting it moved at end of six months. Since there appears to be some question as to our position on additional connections to the sewer system, we would like to clarify the matter at this time. Apparently, our department has no jurisdiction on subdivisions or land within the City which was platted prior, 9 Jerry Yoder's letter of May 2, 1973; consequently these sub divisions may be con- nected to the sanitary sewer if the City of Meridian has no objections. However, we would like to point out that Meridian could violate its NPDES discharge permit if it continues to allow additional connections to the sewer system, and that once such violations occur, bringing the sewage treatment plant effluent back into compliance with the permit might be difficult. We would also point out that your letter of January 9, 1975 concerning a certificate of adequacy for the Meridian sewage treatment system stated that additional connections to the sewer system would not be allowed. Based on this letter we concluded that the proposed improvements to the water system would have little impact on the Meridian sewage treatment system. If additional connections to the sewer system are allowed, we will have to reevaluate our statement concerning the certificate of adequacy. In summary, although our department appears to have no legal jurisdiction over subdivisions platted prior to May 2, 1973, the City of Meridian may not want to allow'additional connections to the sewer system because of possible violations to the NPDES discharge permit and possible effects on the certificate of adequacy. Merrimac Drive access from Locust Grove Road to subdivision on sheet 3 of 10 shows no provision for borrow ditch road side drainage nor is there a typical roadway section providing borrow ditch grading or roadway material and course depths. Pay the fee charged by the Ada County Highway District for the Quality Control Testing. 4. Provide 150% securities for the installation of improvements. If securities are not provided by cash or bond and are provided by a Letter of Credit, then the Letter of Credit must be on a format acceptable to the Ada County Highway District. Surety Agreement and Letter of Credit forms are available in my office upon request. 5. Subdivisions developed by a corporation must have the Surety Agreement endorsed by an authorized representative of the corporation and attested by the corporate secretary. "No thru Street" sign on Merrimac Drive just west of Jericho Street. Installation fee is $35.00 per stop sign; $35.00 per speed sign; $80.00 per intersection street name sign. John Joines, Ray Putman, Keith Jacobs, MOUNTAIN VIEW BIKE LANE DISCUSSION - Eric Guise explained that he has inspected the area for the bike lane and has talked with the property owners on Mountain View. He recommended that the bikeway designation be taken off Mountain View Drive from Plymouth Street to Curtis Road. Bond to Plymouth remains as it is. He said it will eventually be re -designated a bikeway but for the present feels that a bike route should be routed through the neighborhood and onto Northview. The No Parking designation will still be retained on the north side of Mountain View Drive. Bikeway signs will be removed between the two points. Area in front of the commercial property will still have No Parking signs because of the sight distance. Citizens in attendance agreed with the route as explained by Mr. Guise. Commissioner Fairbanks suggested the possibility of using Cruzen, Lynwood, Larch Streets instead of the connection at Plymouth. Mr. Guise to check out the area to see if this route could be used. LICENSE AGREEMENT - ALBANY STREET FENCE - Ray Putman explained that there is a property owner on Albany Street requesting permission to build a fence eleven inches into the right-of-way along Albany Street, south of McMillan, between Five Mile and Maple Grove. The fence will be eighteen inches behind the sidewalk. After discussion Commissioner Fairbanks moved to grant the license agreement to Frank W. Scroggs at 9237 Albany Avenue, to build a fence eleven inches into the public right-of-way. Commissioner Jeppesen seconded. Motion carried unanimously. LICENSE AGREEMENT - PAUL J. BUSER - 3112 GOOD STREET - Ray Putman explained that Mr. Buser wants to extend is fence and instaTl a gate across an alley between Anderson and Good Street. The alley has not been opened and Mr. Buser is the only one using the alley right-of-way. He said the other property owners affected have agreed to allow him to do this. After discussion, Commissioner Fairbanks moved to approve the License Agreement to extend the fence and install a gate but that the affected property owners who will be using the alley be required to sign the License Agreement also. Commissioner Jeppesen seconded. Motion carried unanimously. HOLLEY STREET VACATION - CORRECTION - Ray Putman said this vacation was approved June 15, 1978, but a section of the vacation was left out when the instrument was recorded. The ten foot portion of Holley Street was the portion left out. After discussion, the Commission authorized the correction to the vacation of alleys and streets in Wayne Addition to comply with the minutes of June 15, 1978. Because the sewer and water lines had been installed for the whole of Unit I, the question arose as to whether or not the City could accept only those parts of the sewer and water system within the proposed phase development. I have discussed the question with Bruce and Earl, and we make the follow- ing recommendation to you: 1. Sanitary Sewer. The top of the manhole closest to the northerly boundary of the phase development must be brought to gravel road grade. The sewer lines coming into the manhole must be physically sealed to prevent entrance of debris and inflow. The outflow sewer line from this manhole will be used for access to clean the sewer line. Earl Ward informs me that the total system of Unit I had been inspected for leakage and alignment and had passed the tests. 2. Domestic Water. Our suggestion is to break the water main in Jericho Way just beyond the northerly boundary of the proposed develop- ment and install a blow -off assembly on the pressure side of the main line and a sanitary cap on the non -pressured side of the main line. Bruce informs me that the developer is correcting a leak in the water main line today and that after it is complete the system beneath the proposed paved areas would be acceptable. Bruce and Earl and I feel that it would be quite difficult to maintain and be responsible for sewer and water lines outside the boundaries of the improved areas. The physical separation of these lines should also provide the maintenance separation. On October 7, 1982, Meridian City Engeneer, Mr. Gary Smith, submitted to the Mayor and City Council some conditions that he recommended before acceptance of the reduced area. These conditions have all been met and all development is completed, except for the laying of the asphalt mat, which should be completed within the next two days. In light of the completion of all work requested I here -by petition the Mayor and City Council to accept the reduced portion of Phase I, Meridian Place Subdivision, subject to the paving being completed satisfactorily and meeting all elevation requirements. Further I here -by WARRANT AND GUARRANTEE all work in the accepted portion of Phase I, Meridian Place Subdivision, for a period of one year from the date of acceptance by Meridian City. Much discussion followed what would be required by the City to re -zone the area for a parking lot. It was suggested that the parking be removed a certain distance from the intersection, but Mr. Patton stated that the parking is critical there also. Commissioner Winder stated that the staff would like to get the parking removed but want to give Mr. Patton and his people a chance to establish an acceptable approach. Commissioner Winder suggested that this problem be resolved by next week at the noon meeting, and instructed staff to go out and look at the area to see where the parking can be removed. Mr. Patton asked if the grassy area between the sidewalk and gutter could be used. ACTION: TRAFFIC ENGR. John Galvin asked that the Commission not allow the study to be dropped, that the Highway District look into the possibility of incorporating the island idea or some other way of slowing down the traffic. Further discussion followed. Mr. Galvin noted that those traffic islands have been incorporated successfully in other towns. Staff to look into the possibility of using the island concept. One of the citizens, unidentified, reported a sight obstruction to the stop sign on Nez Perce at Owyhee. Staff to notify Boise City Forestry to have the tree trimmed. Discussion held. ACTION: TRAFFIC ENGINEERING Jon Robertson further explained the islands that are installed in the intersection and the towns where they do work. He requested that a study be initiated for possible solutions to the problems they are having with speeding and non -local traffic. Much discussion followed. Staff directed to look into what can be done. ACTION: TRAFFIC ENGINEERING SUBDIVISIONS - Keith Jacobs presented the Technical Review Committee Agenda of September, 1982, and asked the Commission for comments. Commissioner Jeppesen moved to approve the request by Mr. Harmon to install improvements on Jerico where it intersects with Torrington Court at the end of Lot 6, Block 5. Please submit a letter from the City of Meridian saying that they will provide domestic water and sanitary sewer service for this subdivision. 2. We do not have a copy of Meridian's water and sewer standard specifications. Please submit a copy of these specifications. 3. The deadend water mains are not shown with the blow off devices. 4. The sanitary sewer notes should address the methods and limits for infiltration/exfiltration testing. 5. Please remember that when locating water and sewer mains the horizontal distance between these mains is 10 feet. Storm sewers are also included. 6. I have checked the calculations submitted for the 10 inch sanitary sewer and we can approve it at a 0.002 slope. If you have any questions, please feel free to give me a call. Since Chateau Drive is to be constructed as a 36 foot wide asphalt roadway it was felt that if possible these two utilities should be installed prior to improvement of the roadway. After additional consideration this morning it is our feeling, as City Engineer, that installation of the sanitary sewer and domestic water line would not be appropriate at this time. This conclusion is based on the following considerations. It has been the policy of the City to require on a fair and equitable basis, that subdivision developers extend utilities to and through their developments which this developer has done. Secondly, extension of these utilities at this time may possibly create a leap -frog development trend with the services being available at Locust Grove Road. Thirdly, installation of these utilities at this time will not allow installation of service connections for sewer or water service to adjacent lands because of unknown development configuration, densities, etc. These unknowns will create a need to cut the street at some future time for service installation resulting in numerous asphalt patches across traffic flow causing bumps and dips. It is our suggestion, based on the above considerations, that you create a resolution basically stating that if and when the property or properties adjacent to.Ch.ateau Drive develop, the developers be re- quired to install these utilities with services and completely rebuild the street, which will at that time include installation of curb, gutter and sidewalk.
