ITEM:
1. Central District Health, Nancy Goodell: No objections to this annexation
2. Ada County Highway District: Parcel is located on West side of Locust Grove,
1/2 mile south of Franklin and 800' north of I-84. Property use, residential
and agriculture, to remain the same. Locust Grove fronting the parcel
has a 50' right-of-way. Locust Grove is a section line road and has
arterial status requiring a 66' right-of-way. Recommend that if the
annexation is approved by the City of Meridian, the applicant be required
to dedicate 33' of right-of-way from the centerline of Locust Grove to
the parcel.
3. Earl Ward, WasteWater Supt: City sewer not available at this time.
4. Councilman Grant Kingsford: "Would be interested in knowing future plans for
property. Few people want to farm in the City!
5. Mayor Joseph L. Glaisyer: "I do not recommend any more annexations - we are
stretched too thin now."
6. Nampa -Meridian Irrigation Dist.; The Irrigation District does have a recorded
right-of-way for the Hunter Lateral. If the City of Meridian required
fencing of water ways or ditches, please fence to the outside of our
right-of-way, which is 40 feet overall width - 20 feet from center line

3 Meiners Tract - Request for Council Endorsement on County Rezone

Bill Meiners was present representing his request of the Council for a letter of
endorsement concerning a County rezone to residential. He stated that he would like
the Council to endorse this concept.
All members of the Council agreed that this would be an ideal solution.
The Motion was made by Orton and seconded by Kingsford to authorize Mayor Glaisyer
to write a letter to Ada County Zoning endorsing the rezone on the Meiner's property.

4 Discussion: Model Ordinance Establishing and Fixing Rules of Procedure for Public
Hearings Before the Meridian City Council
Mayor Glaisyer presented his request that the Council adopt an Model Ordinance
Establishing and fixing rules of procedure for public hearings that come before the
City Council.
There was discussion concerning this Ordiance. (Tape on File)
Attorney Crookston explained that he felt this Ordinance would be very helpful in
hearing procedures and could be modified or enlarged to fit the procedure that the
Council would like to follow. (Tape on File)
Crookston: "I would like to have you adopt this as a procedural policy." "We follow
the procedure sometimes, but sometimes we don't." "This is mandated. We have to
adopt some type of procedure."
The Motion was made by Kingsford and seconded by Tolsma to authorize the City Attorney
to draft a Procedural Ordinance for the Council's review.

5 Department Reports
Vern Schoen questioned the Council on if they had a chance to inspect the wood
foundations going in at Meadow View #2.
Kingsford stated that he felt the Soil Conservation did not think the wood foundations
were a good idea.
Schoen agreed with Kingsfords observation.
There was discussion on the high ground water level. (Tape on File)
Orton stated that he did not see anything in the Uniform Building Code concerning
ground water. "They do not preclude building wood foundations on high ground water."
"So, if the soil is ok then it (wood foundations) would probably be under the code
right now."
Kingsford questioned where the approval to put the wood foundations in at Meadow
View #2 had come from.
Brewer explained that Mayor Glaisyer got ahold of the majority of the Council to see
if they would go along with the idea to put a couple of the wood foundations in and
make inspections on these two foundations. This was approved by a majority of the

Schoen stated that he felt that use of the wood foundations should be a Council
decision. Schoen explained that the inspections are done per the 1979 Book of

Re: Meiner's Tract
As you may recall, we recently approached the City Of Meridian for annexation
of our property to the city. It was found we could not achieve our purposes
by such annexation and we withdrew our application. Subsequently, we have
approached Ada County and have found it is possible to have our property
rezoned as residential by appropriate Ada County action. Our property lies
within the urban development area adjacent to the City of Meridian - our request
and question is, how would the City of Meridian regard our tract being rezoned
as residential? Any objections? If so, what are such objections?

Gene Tipton, President of the Meridian Spokes Motorcycle Club, and Lee Young,
Vice President were present attempting to make the public aware that there is a
new motorcycle club in Meridian. Tipton explainedthe ideas of'their club.
Their goal is to involve the ccn mity with motorcycle safety, functions to be
held at the Meridian SpeeOway, working with Mr. Steve Garrett, Idaho Motorcycle
Safety Foundation of the State of Idaho, an attermt to change the motorcycle image
as there are over 60,000 motorcycles registered. in Idaho with a great need of
safety education. die stated that the rodeo function will be strictly skill and
the events will be educational.
Tipton: "We would like to ask for support from the comgmunity and see Meridian
being the "touching off point" for this function. We have been contacted by a
representative of the Idaho Motorcycle Club xffo has heard of our ideas and want to
consolidate some of their ideas with ours and through registration get an education
format for these young riders that are starting out. But we really need ccmmmity
involvement because everybody that rides a motorcycle anymore is part of a carnunity."
"We have a program that we can put on by going around to the different clubs and
by working with the canmunity we can possibly save a lot of young peoples limbs or
lives: Thank you for the opportunity to speak to you and present our function."

Keith G. Loveless, P.E./LS, Loveless Engineering, was present to represent
William and Marilyn Meiners, MEINERS TRACT ANNE-A'P+TION, containing 5.61 + acres
and located 885 South Locust Grove.
CounciL-mn Tolsma: "Why the "Grandfather Rights"?
Loveless: "Because of the one big open field or, the northerly side. A gentlemen
wants to buy that piece if it becomes aa-.nexed and we can split off that three (3)
acres. He owns the farm to the north and wants to maintain farming this. This
would have to transfer from Meiners to this other owner - if we became annexed and
can do the split. All we want to do is insure that we can transfer that grandfather
right for far-ing, he is renting this ground right now and farming it and has told
Meiners that he would buy the property but he wants to be guaranteed that he can
use it for farming."

Mayor Glaisyer: "Faye you taken this through the Ada County Commissioners?"
Loveless: "That's why we are down here for annexation instead of going back to
the Commissioner's. It is on a D-1 Zone and they won't rezone."
Councilman Kingsford: "Wouldn't it be smart to just annex that portion that you
want in and leave the farm cround out?"
Loveless: "I think that complicates the City's problem because we wouldn't be
annexing all of the Miener's property - we would be splitting it before the fact.
There is some complication according to the Meiners who researched this before
coming to me to prepare the documents."
Councilman Orton: "Is:i't the mobile hame on the grounds really the question?"
Loveless: "No, the mobile home exists behind the home and their son, who is a
landscape architect with a firth in Boise, is going to take the mobile home out and
put in a single family home. We are not asking for any grandfather right on the
mobile home other than the time it takes for us to process this and have to get a
loam. The mobile home already has a septic system and it's own well separate from
the home out front.. We would want some time because it is going to take time for
him to get a loan processed for him to build a hone there. That piece back there
with the mobile home will be transferred to the son. Basically we want to get rid
of that hayfield at the side of them - last year when Mfr. Meiners hayed he was
taken to the hospital as he is deathly alergic. They want to get rid of the farming
operation entirely."
Councilman Tolsma: "If this property is zoned "A" Residential and they sold it,
can they go ahead and farm it?"
City Clerk: "That is why the application for annexation was requested with a
"B" zone at the beginnina. "B" zone allows keeping some animals, etc."
Loveless: "They maintain a calf as beef.°'
Kingsford: "Where are.we as far as water and sewer services from this property?"
Earl Ward, Wastewater Supt.: "Sewer is about 3/4 of a mile away - Locust Grove
Industrial Park."
Bruce Stuart, 'Kater Sup It.. "14ater. runs up to 5th, on Franklin"
Loveless: "The property behind this property (h iners) and a 50 foot strip
to the South of it is in the.City limits now."(�fhis vras annexed approximately 1976.)
Loveless designated the boundary's on map and pointed out that the City limit that
fronts on Locust Grove amounts to only 50 feet.
Orton: "I would like to ask the owners - will the annexation really help jxou?
et :re go through some of the problems we have had in the past and scene of the
conditions that have gone on annexations sii:nalar to this, in regard to water and
sewer. if we do it this way, it may not help you at all. In the oast one of
the conditions was there v7ould not be any building until the water and sewer is
on. For example, across the Freewayr - the water and sewer extensions would have
to be :Wade, the plat co_•.vleted and i fled and certain elements of the site work
completed, and then we would issue you a building permit. Do you see what I'm
getting at?"
Meiners: "Our desire isn't to sobdivide. The land use will remain essentially
as it is. °'
Orton: "So your -intent is to get rid of that little piece of farmland and not
build on it?"
Meiners: "I have a health problem to the extent that I can't handle .the farm work.
The neighbor has to farm the area. We do not want to subdivide - someday we will
want to build to replace the 1Mobile Home, otherwise we have no intention to subdivide.
Orton: "There is another way to describe this - to make sure I am comunicating.
Let's say we did annex it and you did subdivide it, you did sell off the piece,
everything worked fine for a couple of years and you wanted to build a house - you
would have to come in then for a variance for an individual sewer or water system.
Like I say we haven't....'°
°miners: "Our inter.; is essentially for the land use to remain just as it now.
No change whatsoever."

Loveless: "This is what they told me when they first came in -they just want
the help on the paper work and legal work" "There is not very many people that
want to rent or lease 3 acres. The neighbor desires to own this piece and fits
his needs better if he can take down the fence and incorporate into the field
already around there. It is a separate piece now."
There was discussion concerning Ada County regulations of splitting. (Tape on File)
Kingsford: "In order for this to be sold off you would have to go through a regular
platting procedure."
Loveless: "we understand that."
The request from Ada County Highuray District was discussed. There is a request
from ACHD for a 33 foot right-of-way from the centerline of Locust Grove to the
parcel. If Meiners went to the platting procedure he would loose a eight (8)
foot frontage. They did not ask for improvement, just right-of-way.

Mayor Glaisyer: "This is a public hearing. Is there anyone in the audience
that wishes to comment concerning Meiners Tract annexation?"
Gene Kindred questioned if tie three acres were annexed into the City would it
make the three acres contiguous to the City. would it be acceptable to be taken
in if a purchaser or buyer would want to farm. Would the three acres throw any
bearing on a later desire to annex the rest.
Councilman Kingsford stated that the person who wishes to purchase the 3 acres is
already contiguous to the City boundary at the back of his property.
There was no other ccnmzents from the public and Mayor Glaisyer closed the public
hearing.
Attorney Crookston stated that if they change owners they loose their grandfather
rights. What they are asking for will have to be done by variance.
Councilman Orton stated that in the past the City has made annexations because
the oimers had specific proposals or ideas to somewhere in the future do urban
type development - residential, commercial or industrial. "I hope I am never
involved where an annexation was primarily instigated to get around an Ada County
rule - no matter how bad the rule was." "You are trying to get rid of a piece
of land. and the Ada County zoning laws won't let you do it."
There was discussion concerning variance, title transfer or other methods of
trans{erring use of land, grandfather rights, etc. (Tape on file)
Attorney Crookston stated he would review zoning district for "General Purpose"
which may allow farming.

parcel ARNIE SUBDIVISION. This parcel is located on the northerly side of
East Pine and Five Mile Creek City boundary.
Rick Orton: "I will be abstaining from this proposal."
Mark Allen: "We propose to subdivide this parcel which is approximately two (2)
acres, eight (8) lots, six (6) of which would be zero lot line duplexes - which
Ms. & Txrs. -Stutzman also plan to build. The one lot has an existing home on it
and the eight lot would be a single family dwelling. We have copies of the
correspondence from Ada County Highway District. We do agree to comply with their

.Notice is hereby given, pursuant to the Ordinances
of the City of Meridian and the laws of the State
of Idaho, that a hearing will be held before the
Planning and Zoning Commission of the City of
Meridian at the City Hall, at the hour of 8:00 P.M.
on the 10th day of May, 1982, and before the City
Council on the 17th day of May, 1982 at the City

We are requesting that our land, lying between the present boundary
of the City of Meridian and Locust Grove Road and north of Interstate
I-84, be annexed into the City of Meridian, with an "B Residential
with grandfather rights", zoning.
The property use will remain essentially the same. The Northerly 3
acres will remain agricultural and the Southerly portion will be the ex-
isting two (2) residences with trailer home being replaced by standard
residential construction. The parcels will be subject to connection to
the city utility services when available. The parcel is contigious to
the Meridian City Limits on its Westerly and Southerly boundaries. As
only two (2) residences are included or proposed in this annexation
there should be minimal impact on the essential services provided by the
