City Engineer Gary Smith, J -U -B ENGINEERS, INC.;, "Today is August, 16th, 1982 and
the time is now 7:30 P.M. and I hereby declare the time for receiving bids for the
water project, residential water service rehabilitation,closed. We will open the bids
alphabetically and check each bid for completeness and compliance with the requirements."
City Engineer Smith called out the bids as follows:

Smith: "I don't think there is a question - the funds were appropriated."
The Motion was made by Rick Orton and seconded by Bill Brewer to take thel'J982 Water

Engineer Gary Smith's recommendation.

Conclusions of Law that is detrimental to the Annexation of Johnson Place?"

The Notion was made by Grant Kingsford and seconded by Ron Tolsma that the Council
approved the FINDINGS OF FACT AND CONCLUSIONS OF LAW on the JOHNSON PLACE ANNEXATION.

Mayor Glaisyer: "Catherine Park Final Plat was approved by the City Council last month,
apparently adjoining landowners and not pleased with the culdesac and went to Ada
County Highway District last week."
Tan Marks, developer of Catherine Park Subdivision: "Basically the culdesac has been
,planned from the very beginning, approved before this body after public hearings and
then we got into construction project in staking them out the neighbors felt that we
were taking too much of their property even though the property had been deeded over
to the county. We contacted the county and they agreed if it was alright with the
neighbors we could go with an "L" at that particular location, the end of State Street
on Cathy lane. This is fine with me and the neighbors thought that would be
acceptable. The ACHD brought this before this bodylast meeting, Aug. 2, and you
felt that the culdesac was necessary for the fire trucks, trash trucks and that sort
of thing. We had another ACHD meeting and they asked that we cane back before this
body again and allow the neighbors to tell their story as to why they feel we should
have the "L" instead of a culdesac. That is basically where we are tonight. Either
was is fine with me as long as we can get it done."
Councilman Orton: "As I remember we did a lot of investigation. First we investigated
a through street and it was not within the scope of our traffic plan, and then we
investigated different shapes of culdesacs."
Doris Oliason spoke in behalf of the neighboring property owners.
Oliason: "I have been asked to speak on their behalf. This all started out with the
irrigation pipe being put across Hzveda's lawn - without their permission, without
their knowledge - when they came hane,there it was. I didn't know that this is the
way different agencies ruled to be permitted or if this wasn't an illegal trespass.
Then we met with the Nampa Meridian Irrigation representative and he was most unhappy
with what he saw." Oliason explained that her irrigation means were disrupted and
most certainly a material changer a, --d should have gone back through the process again.
"It was my understanding that they (property owners) had signed an agreement with
Mr. Marks and Mr. Potter whereby they have given -:more property than they realized.
In other words, it would seem that the original plan that was presented - this is our
thinking - to the Planning & Zoning Ccnmssion has had substantial changes after the
people had signed the agreement - or if they ever saw one. At any rate their lawn
has been terribly damaged and the culdesac seems to be caning off of Hzveda's and
Mrs. Millers property more than off the other side.. We are here mainly because of
the culdesac encroachment to a greater degree on Hzveda and Miller property, Hzveda
has lost a lot of evergreens plus their lawn being torn up for several weeks now,
the irrigation has been straightened out I think, it seems half of the skimmer is on
ACID property and half is not. There has been so many discrepancies, so many things
done wrong, so many things done over that we are wondering what it is you people "O.K.".
This culdesac should not cane off samebodyIs private prg2erty for a new development.
We can understand where the ACHD has their right-of-way - all over everybody's
pro -
but in this case it is coming off just too much. Is this what you (Council) O,K dirty

Councilman Brewer: "Is it not true that the way the culdesac is laid out that it is
on deeded property?"
Keith Jacobs, ACID: "As near as we can determine it is on Ada County highway District
right-of-way, by deed and by plat." "We have checked as near as we can in the office."
Brewer pointed out that it is cannon for a propertyoVmer to use richt-of--way property
in lawn and shrubs for years thinking it was theirs.- when in fact it was deeded
property to Ada County for years.

FINDINGS OF FACT and CONCLUSIONS OF LAW
The above entitled annexation having come on for hearing on
July 6, 1982, at the hour of 730 o'clock p.m., the Petitioner
appearing through Russell Johnson, the City Council.of the City of
Meridian makes the following Findings of Fact and Conclusions of
Law
FINDINGS OF FACT
1. That all notices have been given as required by law and
all approvals and procedures before the Planning and Zoning
Commission have been given and followed;
2. That the property is adjacent and abutting to the present
City Limits;
3. That the proposed zoning of the property as "C" Commercial
is in accord with the Meridian Comprehensive Plan and the proposed
zoning ordinance and present zoning laws;
4. That the existing use of the property is pursuant to
grandfather rights in the County and the land use will not be
changed;
5. That no persons appeared at the public hearing objecting
to the annexation or the zoning;
6. That the annexation of the property is reasonable, that
it is not a shoestring annexation, that the addition of the propert
will aid in the symmetry of the City's boundaries;
7. That the owners have requested annexation and that this
annexation has been instituted by them and not the City;
8. That the annexation of this property will aid in the
orderly development of the City;
9. That the City Council .finds the annexation and proposed
use to be in harmony with the general purposes and uses of the

CONCLUSION'S OF LAW
1. That the City of Meridian has authority to annex property
pursuant to 50-2221, Idaho 'Code;
2. That the annexation of the proposed property is in the
best interest of the City and has been performed in compliance
with the Local Land Use Planning Act and the Ordinances of the City
of Meridian;
3. That an Ordinance shall be prepared annexing the parcel of
property to the City of Meridian.

PUBLIC HEARING: Revenue Sharing
Mayor Glaisyer explained that the City of Meridian will receive approximately
$45,000.00 in Federal Revenue Sharing.
Glaisyer: "I would open the public hearing for any comments as to how the City
would spend. these funds." "Is there any one from the public that wishes to make
comments on the revenue sharing?"
There was no response.
Glaisyer: "Public hearing closed."
Glaisyer: "Is there any comment from the Council on the'revenue sharing at this
time?" There was no response.
PUBLIC BARING: Johnson Place Annexation, "C" Commercial
513 So. Meridian Road
Russell Johnson was present representing his request for annexation for 9.9 acres
to be zoned "C" Commercial. This property is presently being used as Meridian
Rental Center and will be continued to be used as such.
Johnson explained that the North side of the property was "Grandaddy Rights."
This is zoned Agricultural at the present time. Since the property does fall under
the Comprehensive Plan under Commercial Mr. Johnson expressed his desire to go into
the City rather than to obtain County Zoning. (Tape on File)
Johnson proposed to put a high board fence from the road to the back of the property
or. the residential side to obscure any vision on the residential side.
Johnson explained that it is 700 feet to City Sewer from his property. The ordinance
states that he must only connect to City Sewer & Water if the property is within
300 feet.
Tolsma: "Are you planning on using the whole 10 acres?"
Johnson explained that he uses part of the property to demonstrate the rental equipment.
Johnson stated that the majority of his rental equipment is farm equipment.
Roger Welker, Fire Chief: "This creates an enclave for fire purposes." There were
no other Department Head comments concerning this annexation request.
Mayor Glaisyer: "I will now open the Public Hearincr g

F.in_-'chs: "I now open the Public Hearing for the request by Dr. Sherry Rose for
a Conditional Use Permit for Office at 1323 E. First."
Steve Rose: "The proposal that we have for you tonight is to convert the 'top floor
Of the home into a Doctors I Office. We intend to have parking in%the rear. The
property is ideally suited for this type of operation. It has existing circle
driveway that circles behind the home with ample parking area on either side of the
existing garage. However, the lot being as large as it is, we really wouldn't need
more than the one side." "There is one thing. In the front of -the house between
the sidewalk and the street there are four low growing trees. They tend to form a
hedge." Mr. Rose presented pictures to the C o fission showing the view a driver
would have comping from the driveway. Fie pointed out how dangerous they were to a
driver that would be exiting, and how they would hamper the view. "I feel very
strongly that we do have a safety factor there." "If we were to be approved for
this type of useage, we would like additional permission to do something with the
trees, whether it be totally take them down and replace them with something that a
person could see through."
Hinrichs: "I can't see any problem with removing the trees."
Spencer: "Do you have any other plans for changes to the building or the property?"
Rose: "No planned changes." "There will be a railing on the front steps."
Hinrichs: "Is there anyone in the audience that would like to ccennent ons

Kenneth Gibson: "I am a neighbor to this property. Those trees need to go!"
"They are very hard to see around."
Humbert Valenti: "We have no object to these things, I am for it. I was one of the
first to start that. We hope that the Planning & Zoning will take into consideration
that whatever project at this time does maintain the architectural design of that area."
"If they could do it in such a manner as to not interfer with the overall appearance
of that street, I know that I as a property owner wouldn't object to it, and I'm sure
most of the property owners would not either. "
Hinrichs: "Are there any other ccnr nts from the audience concerning this matter?"
There was no response.
Hinrichs: "The Public Hearing is now closed."
The Motion was made by Spencer and seconded by Sharp that the Planning & Zoning
Commission reo mnend approval of the request for a Conditional Use Permit for a
Doctors' Office at 1323 E. First, with the condition that the architectural design
of the area is maintained, and that the Commission has no objection to the removal
of the trees in the Parkway in front of the residence.

want to agree with that."
Hinrichs: "We need to get this sewer straightened out.,.
Sharp: "Mr. Johnson, would that make a difference to you, in your request for annexation,
if you had to take sewer line 700 feet?"
Johnson: "I think that it would. I think that I would also have to discuss this with
the Sewer Department and find out."
Hinrichs: "I think that any motion should be conditional."
Mitchell: "Maybe we should just table it until he can find out."
Sharp: "I think that is best." "We could send it on to City Council & they could reject

Johnson: "I think a Motion with a condition would be more to my liking."

Chris Campbell, 601 S. Meridian Street: "I live at the property directly South of
Russ Johnson." "This has been a lesson for me. I have noticed people tonight talking
about the character of the neighborhood. Mr. Johnson's property as it sits has been
an eyesore to the neighborhood." "One thing that we have noticed it that the character
of the neighborhood has been shot," "Our property values have gone down, we can't get
as much now as we could have 4 or 5 years ago, and property has appreciated since then.
We have also noticed that there has been a lot of dirt from Mr. Johnson's property.
There is no way to stop it blowing across in the wind. The noise, there has been a lot
of noise over there. He constantly has been operating." "His buzzer for his telephone
goes off at some very odd times." "All in all it has been rather a pain in the neck
to us to have it beside us. Mr. Johnson was told by the court that he had to move
the equipment." "Mr. Johnson brought up the point that part of the property is zoned.
agricultural. I have photos at home of people plainly renting equipment from there.
I don't think that it is just agricultural, he is just carrying on business in all
Parts of the property."
Hinrichs: "What is it that you want on this? You want us to deny the annexation and
zoning of cmavarcial?"
Campbell: "Not necessarily. What we want more or less is to be carried into the
City too, so that maybe we can sell our property next to him, and move."
Hinrichs: "What would you like to see happen with this land?"
Campbell: "Well, I can't really say.
so that we could sell it.,, We would like our land also zoned Ccumercial
Hinrichs: "But your annexation request is not before us."
Campbell: "Not right now." "We could bring it before you."
Hinrichs: "We can not solve any of the Court concerns, We can annex the land, or
not annex the land, or annex the land zone it ccmuercial with conditions."
Campbell: "We understand that.
Hinrichs: "What I am asking you is, as a neighbor, what is it that you would like to see
done on this property?"
Campbell: "We would like to see it just stay in the County right now, or if you are
going to zone it commercial, we would like to see the whole thing zoned ccmrexcial so
that we could sell our property too."

Sharp: "The only thing that we can act, on is what we have before tonight."

Campbell: "We do not like havina Mr. Johnsons' business carried on next door to us."
Hinrichs: "You are unfortunately living in an area that is transitioning to commercial,
and will continue to do so."
Mitchell: "This 8 foot fence he (Johnson) is talking about, would that help?" -
CamLobell: "Landscaping might help, but it would not remove the*site of the machinery
to us."
I�inrichs: "What about paving? Would paving help some of the concern that you have?"
Campbell: "Paving would help the dust conning over, but it would tend also to make
it unsightly unless there was a certain amount of landscaping in'there."
Hinrichs: "The problem is that a Service Commercial Area is an area that is heavy
commercial. It is not going to be truly beautiful, no matter what you do. You can
request certain buffers and landscaping, but we can't eliminate the business that is
happening on the land."
Hinrichs: "Any further comment from the audience?"
Mrs. Campbell: "I just want to ask the question, have you people (the Commission) looked
at Mr. Johnson's property?" "If you can tell that aledged Rental Equipment"

from a junk yard, which is what it closely resembles, I would like to know on what do
you base your opinion." "I have seen various other Rental Equipement businesses and
they don't look like that. They are maintained neatly, they are tidy and clean looking."
What we have are horrible old looking things, that just sit there with tumble weeds
growing around them year after year, and this is what we are protesting. We don't want
that to stay there, and if Mr. Johnson is allowed into the City on a commercial basis,
will the City of Meridian make him clean that up?"
Hinrichs: "All that we can do if we annex it and zone it commercial is to require
Paving, landscaping. We can not make decisions as to whether his property is an
eyesore or not. We can make decisions about what things we will require of the property
if it is used in this manner."
Hinrichs: "Any further testimony from the audience?"
There was no response.
Hinrichs: "Public Nearing now closed."
The Motion was made by Sharp and seconded by Mitchell to recommend to the City Council
the approval of the annexation request by Russell Johnson for 9.9 acres at 513
South Meridian Road, to be zoned "C" Commercial, subject to;must connect to City.Sewer
and Water, must be screened on all side, with a high solid fence next to the home,
and must abide by all City Ordinances.

4 Discussion &Decision on Time Tables and Procedure for Amendments to the Cor�prehensive
Plan
There was discussion among the Commission members concerning all of the material that
must be gone over concerning the Comprehensive Plan Amendments.
Mitchell: "I think that we should try to find a time that all members can be present."
Hinrichs: "This will probably require more than one study period." "We need to
read over everything that we have been given, and go over the testimony received."
Sharp: "Sometime next week."

the City of Meridian, Idaho. As part of your annexation, the
City required you to fence your property. You have received
extensions of time as to this requirement and you were to have
had the fencing done on June 15, 1983. This has not been
completed and, therefore, you are hereby notified and DEMAND
is hereby made that you fence your property as required within
thirty (30) days of the date of this letter or the City will
institute proceedings to deannex your property.

2 JUB - Sewer Rate Increase Information
Gary Smith, JUB, City Engineer, explained that he had been asked to investigate the
Possibility of an increase in the sewer user rate to off -set the deficit that is
occuring in that fund. Smith explained that he had contacted Sanitary Engineer that
is in JUB, Kirby Vickers. Vickers put together a brief letter,, 6Ut1inj.ng'h=is philosophy

Smith: "Theuser rate for both of these services (Sewer & Water) must be set so that
the service is supported." "The utility does not make a profit, but it does pay it's
way." "There has been very little planning for replacement on these facilities. They
do wear out." "What we have discussed is a rate study that would be based on a 5 year
plan. The 5 years is used because it is a time period that you can somewhat predict."
"What it is comming back to is the user. The user,.more and more, has to pay for the
facilities that they use."
Smith explained that basically the research has shown that the sewer rate could be
increased $2.50 with out any further investigation, based on the figures that were
researched at the time the proposal was written. This would be to make up the deficit
that the City is facing this year.and fiscal year 82/83.

rate increase across the board for sewer use and to instruct the Water Superintendent
and the Sewer Superintendent to make a feasiblity study on the 5 year study plan on

3 Sanitary Service Inc. - Request for Increase in Collection Fees FROM TABLE
The Motion was made by Kingsford and seconded by Brewer to bring from the table
the request by Sanitary Service Inc.; Mo Alidjani, for an increase in collection fees.

Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea
Mo Alidjani was present to represent his request for a 10.8% increase in collection
fees. This would bring the fee to $4.15 per month residential for unlimited collection.
Aliajani cited the increasing costs of gas, oil and labor as a few reasons for
seeking an increase. Aliajani also stated that even with an increase, he will still
be the lowest for service in the Treasure Valley.
The Motion was made by Brewer and seconded by Tolsma to approve the rate increase
of 10.8% to Sanitary Service Inc., Garbage Collection, rates as outlined in letter dated

4 Russ Johnson - Request for Variance to Build Fence in Spring
Russ Johnson, Johnson Place Annexation, was present to represent his request for a
variance to allow him to build his fence in the Spring. Johnson was to build a fence
as a condition to annexation. (Annexed to City on 8-16-82)
Mayor Glaisyer explained to Johnson that he had received 2 complaints concerning the
fencing of the property.
Johnson explained that he had all the lumber and poles, and was waiting for a break in
the weather so that he could treat the poles. Johnson stated that he felt this would
not be possible now until late Spring.
The Motion was made by Brewer and seconded by Orton to grant Russ Johnson a
variance until June 15, 1982, to"have his fence built.

MAYOR GLAISYER - COMPLAINT RUSSELL JOHNSON; MERIDIAN RENTALS
Mayor Glaisyer explained that he had received a complaint that Russell Johnson, Meridian
Rentals, had not started his fencing yet, which was part of the conditions under which
he was annexed to the City of Meridian
Councilman Orton stated that he had spoken with Johnson about a month ago, and at that ti
he had bought the poles for the fencing and treated them. Orton: "I can't understand
what had stopped him. I know that he has proceeded up to that point."
Johnson, and convey the wishes of the Council that the fence be completed immediately.
ACouncilman Brewer suggested that Vernon Schoen, City Building Inspector, talk to Russell
Schoen indicated that he would do this.

Kingsford stated that he has had several inquiries concerning the completi0n:,of,,the'11,
paving on the RR Tracks on lst Street.
Payor Glaisyer explained that he had contacted Bill Sacht, State Highways Department.
Sacht explained to Mayor Glaisyer that the weather had created i& -problem, and that the
paving would take place as soon as weather permitted.

9.9 Acres - Requested zoning is Cam<nercial "C".
Parcel is located on Meridian Street, 1600' south of Franklin
Road. meridian St. fronting has a 50' right-of-way - 80' is
required per the adopted thoroughfare right-of-way policy standard
for collectors and arterials. The City of Meridian, in the 1978
comprehensive plan, designated Meridian Street south of Franklin,
to have minor arterial status/66' to 80' of right-of-way. Meridian
Street in the particular area of interest, is improved only with
24' of BST hard surface road.
The applicant is requesting annexation to the City of Meridian
with Conmercial-"C" zoning. Under Meridian's zoning ordinance
Commercial "C" would permit a wide range of principle uses includ-
ing high traffic generators. Because of this potential, the
