A G R E E M E N T THIS AGREEMENT, made and entered into this ~~ day of April, 1976, by and between PAUL H(yRTING, herein called First Party, and ALOYS C. SCHLEKEWAY, herein called Second Party, W I T N E S S E T H:- WHEREAS, First party is the owner of a parcel of land lying and being within the City of Meridian, Ada County, Idaho, situated on the corner of 8th and Pine Streets, and WHEREAS, Second party desires to construct a pipe line for conveying sewage across First Party's property. NOW THEREFORE, in consideration of the sum of $1.00 and other good and valuable consideration, the receipt for which is hereby acknowledged, First party does hereby give and grant to Second Party, his successors and assigns forever, the right to lay, maintain, operk~te, use, repair and remove a certain pipe line for conveying sewage through and across the North four feet of First Party's property, running from East to West. Said pipe and pipe line shall be laid under the surface of the ground and the soil around the same shall be packed reason- ably level with the surface of the ground and restored to its present condition. This agreement and the considerations paid thereunder are agreed by the First Party to be in full settlement of all damages which in any way or manner may be sustained by reason of the installation, construction, repair, use and occupancy of the said pipe line thru and across the within described lands of First Party.
