Franklin,.was discussed and is 1,000 feet.from sewer service There was discussion concerning minimum sewer charge.}' a d T(ie Motion was made by Orton and seconded by Brewer to waive the minimum hookup and Meridian City Hall .2. May 5, 1980 Willard Rowley, representing Sanitary Service, Inc., spoke concerning his ability to generate enough income from this new system to take care of the depreciations. Rowley stated he felt it was well worth trying this system. Mayor Glaisyer asked Rowley if he had reviewed the committee's figures. Rowley stated, "yes, I have reviewed their numbers." Rowley felt the Sanitary Service should be able to come back for a review if needed. Rowley had reservations concerning how much more trash will generate and taking over the landfill costs, but will cut down on bookkeeping. He thanked the committee for the work they have done in evaluating trash service. The Motion was made by Kingsford and seconded by Orton that the council accept Sanitary Service outline of once a week unlimited use pick up on principal_ residence, the fee structure of $3.75 residential, senior citizens 65 and over, with verification of age, $2.95, commercial rates on a per yard basis on file with these minutes, carry out service fees to be set by the Board of Equalization on an individual basis. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Williams requested that the committee be left intact to review the statements periodically. Agenda 2 Franklin Square Jim Stubblefield was present to request an amendment to the covenants for Franklin Square which had been taken under advisement at previous meeting. His request was to build townhouses on 14 additional lots. This would increase the density to 7.4 units per acre. Williams displayed final plat which had been recorded restricting only one block with townhouses and certain lots for duplexes. This would be a matter of changing the plat and there is a moratorium for 120 days restricting such actions There was discussion concerning a petition submitted by residents of Franklin Square in opposition. Stubblefield presented a later petition which he stated was signed by the majority of residents, but had not contemplated replatting. He felt the townhouses were in demand and a better utility of the ground. Attorney Crookston explained that request would require a plat amendment. Mayor Glaisyer called for public comment, as there were several residents from Franklin Square present. Tim Burgess stated that he had not been notified that Stubblefield had circulated the second petition. Burgess stated that everyone in the subdivision should be recognized and opposed any change of the covenants. Mayor Glaisyer stated that there is a 120 day emergency moratorium which denies any replatting until the city ordinances are complete and after that time Stubblefield may come back and make the request and Mr. Burgess will be notified. The council cannot take any action at this time. Crookston stated that there would be a public hearing requirement and certified notification to residents for the hearing. Agenda 3 Addendum #3 - J -U -B Engineering Attorney Crookston explained the language of the contract. There was discussion concerning the increase negotiations and the adjustment affect with DVY Construction. Smith stated that the adjustment concerns 2E, during construction, 2F operational, 2G, warranty. The mayor called for the Council's decision on the input from the public hearing held April 17, '980. There were no additional comments received since the closing of the hearing. Mayor Glaisyer stated that in lieu of all the problems and the input, he could see no reason why the 120 day moritorium for platting of additional residential subdivisions would out any additional burden on anybody, and will give the city time to complete the Zoninq and Development Ordinance in compliance with the Comprehensive.Plan and Housing Statue Plan of 1978. (Ordinance #367 on file with these minutes.) enda 7 Mayor Glaisyer presented a request by Stubblefield for an amendment to protective covenants to increase the number of townhouses in Franklin Square. There was discussion concerning Franklin Square - was platted and approved stipulating certain types of homes on certain lots. Building Inspector Schoen stated that Stubblefield's Franklin Square plot plan, or subdivision approved, states on the plan the specified use for each lot. City Engineer Smith stated that the approved density now is 6.8 units per acre. If Stubblefield increased by 14 townhouse lots, or 28 units, would increase to 7.4 units per acre. Smith thought the Comprehensive Plan allowed 8.0 units per acre in this area. Fairview, may be processing meat. They are remodeling for freezers and smokers. Schoen had informed Ross two weeks previously that they were in need of a building permit. There was discussion concerning the requirement of hooking to the water. Water line is located directly in from: of this building. Agenda J Franklin Square 2 rii Jim Stubblefield was present And requested permission for a conditional use permit to place a formica shop in -their warehouse complex at the North 40 feet of building one. He presented a plat for Council review on the proposal. He had discussed the proposal with two of the Council members. They own the property on all sides. It is a clean business which involves laminating formica in the building. There will be no trash accumulated inside or outside and no noxious vapors or anything of that nature. It will use little water or sewer. Egress and ingress will be through Franklin Road only. Stubblefield stated that they are going to landscape all they own along Franklin Road. The Mo -t -i -on -was, -made by Joseph Glaisyer and seconded by Grant Kingsford to allow the Formica shop under a conditionalusd"permit in Franklin Square. Motion passed: Kingsford, yea; Bodin.e, yea; Glaisyer, yea. Agenda 3 Meridian Manor #2 Vacation Larry Sale was present representing the request for Smith/Bews. He stated that they are requesting vacation of Meridian Manor #2 and approval of Meridian Manor #3. He outlined a meeting he held with residents of Meridian Manor #1 and recommended to Smith/Bews they eliminate duplexes under consideration on lots located next to single family residence - in #1, and the Subdivision across 8th Street. Smith/Bows agreed to eliminate almost 20% of the duplexes. Sale refferenced a map showing where duplex lots can be located. He argued for the duplex lots backing up to the Mobile Home Park. They may not build duplexes on all the proposed lots. All duplexes will be built by Smith/Bews, no lots will be sold for construction of a duplex dwelling. Rental property upkeep was outlined. Sale outlined the status of unkept property. current residents. He explained the traffic system.Vale outlined the traffic problem for Sale requested approval of the vacation and approval of #3. Streets were discussed. Williams called for comment from the public. Eric Gabrielson was present representing the property owners on the question of Vacation of Meridian Manor #2 and acceptance of #3. In a prepared statement he stated; "On Friday night, January 26, 1979, twenty-four residents of Meridian Manor #1 and Cherry Manor met to discuss Vacation of Meridian Manor #2 and approval of Meridian Manor #3. All those people attending this meeting received a certified letter concerning this matter. The following points were agreed upon: Proposal: We will agree to Meridian Manor #2 providing the duplexes or multi- family dwellings are excluded. These dwellings have been proposed for Lots 9 & 10. Or: - We will agree to Vacation of Meridian Manor #2 and approve Meridian Manor #3, provided that there are no duplexes or Multi -Family Units." "The reasons for opposing duplexes or Multi -family units in Meridian Manor #2 and Meridian Manor #3: 1) There is a possibility of lack of upkeep on duplexes or mutli-family dwellings by renters or owners of rental units. 2) There will be a possible detrimental effect on the value of property adjacent ot, duplexes or mutli-family units. 3) People owning homes in the subdivision should have a choice in what type of E ■ • Meridian City Hall Agenda 3 Stubblefield (2) 15, 1979 Jim Stubblefield was recognized by the Mayor and stated that he was here for two reasons. First, they need to get some water meters. Galey Construction did the job but during the paving process there was damage to water valve housings. It will be taken care of by another firm but weather conditions slowed the process down. They need eleven water meters. He explained the economics of the system. Second, he would like to get some indication from the Council whether they will allow a Formica Shop in a building on their site. He explained the layout and type of building. Williams inquired from Ward if the sewer had passed inspection and has been approved. Ward stated that the surface inspection could be done at this time, the City needs "as built" plans. Williams inquired about the status of the lift station. Ward stated that he had letters from Ray Phillips and CDH approving the system. Stuart stated that there are a number of problems with the water system. The Mayor stated that if the Contractor agrees to repair any item necessary, he should be given water. Williams clarified a problem the City has not approved the distribution system, so if pipe breaks, ect., the City should not fix it. Stubblefield stated that if the City hasn't approved it they have no liability. It was discussed. Williams stated that he would like to see a letter that th(► developer will do the repairs and maintenance until the City goes through a final acceptance on those lines.` Stubblefield stated that was acceptable to•him. The Motion was made by Joseph Glaisyer and seconded by Grant -Kingsford to allow the eleven (11) water meters to be placed contengent on a letter from Stubblefield indicating they are responsible for operation and maintenance and that the City has not accepted the lines. Motion passed: Williams, yea; Kingsford, yea; Bodine, yea; Glaisyer, yea. The Mayor stated that he thought the request had been before the Council before. Stubblefield outlined the history of the development and explained the situation on the Formica shop. The Mayor stated that the requested use would be classified light industrial. Glaisyer stated that he didn't support the concept and requested a review of what happened to date.. Stubblefield stated that their building format included a concrete building. Glaisyer and the Mayor did not remember this type of building in the request. Stubblefield stated that it was included in the plans and they had been reviewed by the Building Inspector. He is requesting in one of those spaces a 40 by 40 shop for a Formica Shop. Williams stated that it should go before Planning and Zoning. It was discussed. Stubblefield stated that there is no one around him, it only effects his property. Zoning was discussed. Kingsford stated that he would like to review the plans, Bodine concurred. The Council decided to review the development and discuss it at the next meeting. Kingsford stated the $6,000 could be used in some way to reduce green fees for senior citizens or recreation programs, agreed with Williams that he would like to see the Council review green fees. Storey stated that it was not too much to ask that fee increases be discussed with whoever is appointed Golf Commissioner. Bodine questioned if we could tie up a lease for that many years and bind the next Council. Crookston Jr., Attorney, stated that you could bind future Councils but there are some gray areas. Glaisyer stated if you are concerned with more income,fix it at a 10 or 15 year period down the road and tie it to a consumer price index but now do not charge anything. Storey stated that after the five years there could be negotiations one way or the. other. This would be for mutual protection. The Mayor recommended that the City accept the contract and would like it to be written up so the City could review it in it's final status. The Motion was made by Richard Williams and seconded by Grant Kingsford to accept the lease as rewritten and give the Mayor the authority to sign such lease. Agenda 4 The Mayor instructed Pat Joy to read Ordinances 327 and 328 (see evidence) Joy read Ordinance Number 327 entitled: AN ORDINANCE SETTING FORTH THE TOTAL AMOUNT OF MONEY NECESSARY TO BE RAISED FROM TAXES ASSESSED ON THE TAXABLE PROPERTY WITHIN THE CITY OF MERIDIAN FOR THE YEAR BEGINNING OCTOBER 1, 1978 AND ENDING SEPTEMBER 30, 1979. The Motion was made by Marvin Bodine and seconded by Grant Kingsford that the rules and provisions of 50-9002 and all rules requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 327 be passed and approved. Joy read Ordinance Number 328 entitled: AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR COMMENCING THE FIRST DAY OF OCTOBER, 1978, AND ENDING THE THIRTIETH DAY OF SEPTEMBER, 1979, THIS ORDINANCE BEING KNOWN AS THE ANNUAL APPROPRIATION BILL, AND DECLARING AN EMERGENCY. Benda 6 The request for setbacks in Franklin Square was reviewed. No action was taken. da 7 Police Chief Green reported that previous meetings on the budget that the Council indicated it felt one additional patrolman was acceptable and that two would require Council approval. Green presented a chart showing the patrol hours and explained the chart. He requested two people instead of one because of need. He proposed for two people that it would add 10 hours per day per shift plus one extra day shift that is currently worked by himself. He proposed to have two hour patrols from 11:00 A.M. until 3:00 A.M. the next morning. Green stated that they badly _Meridian City Council .6. Crookston stated he is trying to find out what the City is requiring. Crookston also brought up a problem with North West Steele Ellsworth stated that the City had nhtainrd an raw mont on flip 1ndn;fria1 Park, In the interim North West Steel obtained Che land, when we recorded °Pie easement document it was one week after the land was purchased from the Crestwood Industrial Park and the easement was not recorded on the deed. They will provide a 20 foot easement except it might hdnder their construction. They will let the City use what they want but want assurances that they can have their building in there. What it means to the City is so many feet of that area may be under a building by the time Galey Construction gets out there and they will have to work around it. If the building is there then we will have to get permission from the Railroad Company to use part of their land to allow Galey to construct the sewer line. They may ask for more money to construct. Crookston stated that their position is if they haven't constructed a building we can have as much land as we want. If they have built their building they want to build it up to the 20 foot easement linea Williams inquired if we had all the easements for Phase III. Ellsworth stated that we had and recorded the easement but the transaction took Place a week before the easement was recorded. Scheduling for Galey Construction was discussed. Ellsworth recommended we accept the easement the way North West Steel proposed it. The Motion was made by Richard Williams and seconded by Marvin Bodine to accept the easement as proposed by North West Steel, Motion passed: Williams, yea; Kingsford, yea; Bodine, yea; Glaisyer, abstained. Agenda 10Aodine reported that the Recreation District has the playground equipment in, placing the equipment was discussed, Bodine stated that the Kiwanis Club has offered to help put it in. Williams stated that the Optimist Club will have people available to help with the project. The location should be specified by Ellsworth and Bodine. Agenda 1� Stuart, Public Work's, reported there is a problem at the park with High School age people drinking and throwing away their bottles all over the park. The Mayor agreed there was a problem. Kingsford suggested some education on the problem, possibly signs. Bodine inquired as to what the ordinance covered and suggested the possibility of a stiff litter ordinance. Trash service at the park was discussed, Stuart inquired if school age people could be restricted from the park during the noon hour. Stuart reported he is having some problems with the Ada County Highway Department. They requested valve risers to be raised, when he arrived they were all ready covered with asphalt which now have to be dug out and raised. The problem was discussed. Glaisyer stated that he would get with Stuart and set up a meeting with the ACHD. Stuart reported that he has bids on two new pickups and inquired if he should get more estimates. The cost is around $6,000. Williams inquired if economy pickups will do the job. Stuart stated that he didn't know if they would hold up. Cont. 'd g: Agenda ' 3 Jim Stubblefield reported on their subdivision, Franklin Square. There is one , lift station, an absorbtion field and a battery of septic tanks. When the sewWr comes on line that is to be abandoned and they are to connect to the sewer: He stated that they maintain the system for a year and the City takes over m ena�ce after that. The City paid for the electrical charge for the first yea , however.! '. if something malfunctioned then it was their responsibility for the first year. On Northgate they were to do the maintenance for the first year and the City wouldN, after the first year. Pat Joy stated that the City Council has not set a policy or accepted maintenance, ,i;, for some of the interim systems;until the City does,this, it limits some financing ' Because the City hasn't accepted those systems they should be covered by this resolution. r The matter was discussed. Acceptance of interim facilities were discussed. The proposed resolution was discussed. Councilman Glaisyer stated that the City is becoming very cost cons sin thisr .budget cycle, we are locked into revenues.- The only wa more revenues is, to cut some of these costs. We are facilit 'ng both the City and the developers by allowing these interim facilities and there is no great fee for the developers to cover the interim cost for a short time of period. The matter was discussed. Mayor Storey stated that if the City is going to spend time and have a'man goin g, ; around inspecting these facilities that the City should be compensated for Superintendent Shults stated a rough estimate of expenses for checking these d stations is between $60.00 and $100.00 a month. Charges were discussed. Gene Wright stated as a compromise that City delete (it absolves itself; see part; part 4 of RESOLUTION) Patrick Joy pointed out that this removes the responsibility from the City.' Mr. Wright inquired what would happen to permanent lift stations after one year.; The Mayor stated that he supposed that the City would have to maintain them. The Bond issue was discussed. The Mayor instructed that the resolution go to the Attorney to be put in Resolution form. Agenda 4 Jim Stubblefield, Variances on seven (7) corner lots for setbacks; Franklin Square Mr. Stubblefield stated that by City Ordinances there are 20 foot setbacks and it would be better for him as a developer and builder to have 15 foot setbacks from a side street. Canyon County has a 30 foot setback, Nampa, has a 10foot` setback. , The City setbacks were discussed and the Stubblefield proposal. The Motion was made by Grant Kingsford to allow 15 foot setbacks on side yards in Franklin Square. City Clerk, Herald Cox, reported on the existing ordinance. Vernon Schoen, Building Inspector, discussed the City Ordinances. The Proposal was discussed..t. Grant Kingsford withdrew his Motion. Councilman Glaisyer stated that he preferred a 20 foot setback. Councilmen present: Williams, Richard; Marvin Bodine;Grant Kingsford;Joseph Glaisyer �o Agenda 1 The Minutes of previous meeting were approved as read. Agenda The first item of business under old business was Franklin Square Subdivision. 2 Jim Stubblefield was present representing Franklin Square, Richard Williams stated that there was a reconsideration on the hook-up charge when Franklin Square comes upon City sewer. Stubblefield stated that there are three alternatives and he didn't see a problem, going down Franklin, going down Ten Mile or connecting to gravity flow. The planned interim system will carry the development until such time as one of the alternatives are available. If the lift station is in effect for more than one year the City can defray any cost on connections by recovering equipment out of the lift station. Mr. Williams'concern was who is going to pay for the ultimate hook-up and put the line in. Jim Stubblefield stated that at some point,.in time, other developments will bring a line to Franklin Square so there is not a problem. Mr. Stubblefield stated "if we can work out something with the people adjacent to us we would be more than happy to contribute the cost of the force main to their installation of the line or something like that, which would be mutually agreeable, but at this point in time I cannot say that that will happen but if it can that will eliminate the problem totally - if it doesn't we still have connected to the City sewer by virture of a Forced main to the Phase II connection where it intersects Franklin Road." Mayor Storey stated that what concerned the Council is that we have a resolution that all developers must come to City lines Jim Stubblefield stated that"we did address that, we would'go to the line with the force main like Franklin Square." "We would prefer not to do that, but if it comes on tap and is ready to go, we will do it." "We were trying to give you alternatives so you could tell us what to do - I don't think the third alternative will come up." "If you would want to give back the equipment I would be happy to make the crossing." Mr. Williams stated that the City is not in business to make money, we.just want to get the connection. Mayor Storey then read the portion of the previous minutes pertaining to Franklin Square. Mr. Stubblefield stated that they had asked that the City increase the fees for the temporary system development if the third alternative was used but the other two alternatives do not require anything by the City. Mayor Storey and Councilman Williams agreed that the first two alternatives would be better. The Council reaffirmed the acceptance of the Franklin Square interim sewer measure. Patrick Joy asked for a point of clarification, "then Mr. Stubblefield is going to connect to the City sewer at his own expense?" Mr. Stubblefield stated that this was already the case. Agenda The next item of business was the Conditional Use Permit at 14 & Carlton 3 The Mayor read the Conditional Use Comment sheet (evidence filed with these minutes) The Mayor pointed out the increasing number of Conditional Use Permits in residential areas and that they are a means of circumventing an ordinance or policy. It was zoned residential and if the City infiltrates these areas we are not going along with Planning and Zoning. There was further discussion concerning sewer connections: Mayor Storey stated that the City would not want to change Ordinance or policy and that Franklin Square must come to the City Sewer lines. Carl Ellsworth, J -U -B Enginner, stated that there is an ordinance drafted that addresses charges for those subdivisions with unique problems. There was general discussion as to what was resolved with the Franklin Square Sewer connection. Mr. Glaisyer stated that he was worried about the precedent being set for the City to connect to the sewer lines. Wayne Crookston, Attorney, stated that Jim Stubblefield should be notified of any changes from what was previously passed by the Council. Richard Williams made the Motion and Marvin Bodine seconded that discussion be A tabled until notice could be given to Mr. Stubblefield, Franklin Square. Agenda 2 Mayor Storey opened the Public Hearing on the City of Meridian Impact Area at 8:00 P.M. The Public Hearing Notice was read. Thera were no citizen agendas to testify. A Meridian City Hall .3. April 3, 1978. Agenda The next item of business was Franklin Square, presented for approval of the Final Plat. Jim Stubblefield was present representing the Franklin Square Subdivision. He stated that they have met all the criteria set forth on the Preliminary Plat, that the Preliminary Plat was approved by Planning and Zoning and Council, and that the final was approved by Planning and Zoning. Joseph Glaisyer questioned Mr. Stubblefield as to the value of the houses, how many lots will they sell to a builder; what about restrictive covenants; what is intended for the 5 acres in regard to commercial. Mr. Stubblefield explained that the values of the lots will start at $111000 and go up, that the development is open to everyone depending on financial ability; Minimum footage of the home is 1,050 feet; that in Planning and Zoning they requested Office space with storage space. They will build one office 300 feet long and 80 foot deep for lease on storage but won't know until market surveys. Mr. Glaisyer stated there was a high density of about 7.2 per acre and asked Mr. Stubblerield what he felt the density should be size Wise. Mr. Stubblefield stated that there would be adequate size to fit the building need. Mr. Glaisyer felt that a Four Plex on a lot 70 by 100 is too small for a 4-Plex. Stubblefield stated that the Preliminary Plat shows these as 4-Plex lots that would work as a buffer zone between Franklin Square and the Crestwood project and another six acre area. Too much yard on these would be a maintenance problem plus make the rentals tooexpensive. Mr. Glaisyer recommended to the Council that they take into consideration the 4-Plex lot sizes and the density. Mayor Storey polled the Council for their feeling of this project. Richard Williams stated that he is concerned with the density question. He felt that all developers should dedicate some land as an open space. Mr. Stubblefield replied that a park is the place for children and that a lot of open space, or area, in subdivisions creates something that homeowners or other. entity has to take care of. On a project of this size he felt it was unwarranted plus it was not set out that way in the preliminary plat. "The additional cost to 4. those renting in the 4-Plex would make it prohibitive. Mayor Storey remarked that the City needs to develop a firm policy.for the future developers, but in the absence of thin policy now it would be difficult to implement. Mr. Glaisyer stated that since the present Council took office in January, they have asked each developer to contribute something to the community this was a policy in the absence of a formal plan. J -U -B Engineer Mike Preston stated that these points are valid but are a little late. Those are zoning questions and Franklin Square has been zoned and is in conformance with Zoning Ordinances. This hasn't been changed since the preliminary approval by the City Council - the Council regardless of who is on it should live with the previous approvedq and stated that they would listen to the Council on open spaces on other tentative plats. Mr. Glaisyer felt that because of the proximity of completion of the Comprehensive Plan that the Council responsibility would not allow them to go blank to June. Grant Kingsford felt that there was a density problem but because of Planning and Zoning's approve) of the Final Plat that the Council should allow the Plat. Richard Williams agreed and stated that the Council is giving fair warning that the Council is going to take a look at densities, open space and the development of Subdivision as they relate to the community. Developers will be required to take these types of problems into consideration on future plats. Mayor Storey remarked that a new type of growth for Meridian is a new phenomenon and that the City is learning to take a closer look. He also stated that no one has been remiss. Richard Shults, Waste Treatment Sup't., pointed out that in Mr. Stubblefield's letter it stated that once the community field has been abandoned that the City would pay for the connection to the new sewer line. This would include about 150 feet and could cost the City three to five thousand dollars. Meridian City Hall 4. 0 April 3, 1978 Cont 'd Agenda Sumner Johnson, J -U -B, stated that they are suggesting to the City through the 4 City Engineers, that it is fair and realistic to put on a supplemental service charge for all Subdivisions that have special maintenance problems on a temprorary basis. The City needs revenue from hookups for the bond commitments, but other people should not be responsible for these special problems. J -U -B Engineers recommend, through the City Attorney for the City, to develop maintenance and operation charge different from the normal charge through a homeowners association. When the trunk line is extended, assuming St blefie d has sold all the lots, and is no longer involved, then the homeowners association is making payments to the City on a monthly basis as individuals. When the connection is to be made, the City could continue the added service charge to pay for the connection. In addition the City would have ownership of the abandoned lift station of considerable value which could -be sold to help recoups losses of two or three thousand to connect. Mayor Storey stated that other costs to the City for monitoring and maintaining the interim system should fall on those individuals living in the Subdivision. Mr. Stubblefield agreed. Greg Phillips, homeowner in Crestwood Subdivision, stated',he and other home- owners in that Subdivision are concerned with the fact that there will be sixty (60) living units in a one block area, the density seems extreme and the area narrow for a 4-Plex lot. The numbers of cars and density without any open area seems poor. Mire Preston, J -U -B, on additional comment brought to the Council's attention to Stubblefield's letter stating that there will be a temporary open drain and also, they are requesting a variance for blocks four (4) and five (5) as they are in excess of the 1000 foot requirement. The Mayor called for a Motion for approval of this final Plat and suggested that Joesph Glaisyer abstain because of a conflict of interest. Mr. Glaisyer stated that he had no conflict of interest and is voting "No" for two reasons - the density is too high and the size of the 4-Plex lots. City Attorney, Wayne Crookston, did not state an opinion. k The Motion was made by Grant Kingsford and seconded by Marvin Bodine that the City Council accept the Final Plat of Franklin Square Subdivision. I Motion passed: Kingsford, yea; Bodine, yea;Williams, yea; Glaisyer, nay Agend Shelter and seeding at the City Park was discussed. 5 e�, Carl Ellsworth stated that he had met with Mike Baranco who gave recommendations for seeding the park and the specifications are now being developed so it can be bid. It will probably take two more weeks before it will be ready. Bruce Stuart stated that water would not be available until the middle of April. F Ellsworth also stated a Park plan has been submitted and on display from y Baranco and Associates. There was discussion on the trees for the Park and their planting. There was concern about the maintenance of trees. The Mayor informed the Council that Sup't. Shults was fertilizing the ground to be seeded at the new park site. Also, he brought up the subject of shelters for the Park and the need for authorization from the Council. Bodine stated that he would like to see two types of shelter -one being larger than the rest to accommodate larger groups but did not have a time table. Costs were discussed. The Mayor suggested possibly one (1) larger and three (3) smaller shelters. The Motion was made by Marvin Bodine and seconded by Richard Williams that the City purchase one (1) large shelter and the rest,up to $5,000, to be of the smaller type. March 20, 1978 Mr. Coleman pointed out that this line would benefit other people and suggested that the City develop a policy for reinbursement, also the number of valves could become a maintenance headache to keep operative. There was discussion as to the cost distribution on lines. The Mayor felt this should be between developers and thought the City would go along ulth reasonable proposals. Mr. Williams stated that if the City does get involved with this, because of Bond indenture any money collected would have to go to pay off bonds. The City gannet act as a collection agency. Agenda 7 John Eu -ring, representing Eving Company on a parcel of laud at 21h Street and Grruber, was present to request a variance of five (5) feet on 2%z Street. Discussion of variance request pointed out that sewer line repair would have to be dome six to seven feet from the house foundation at a depth of approximately 90. The Motion was made by Richard Williams and seconded by Marvin Bodine that the five (5) foot variance be granted to Ewing Company to build a house at 2'h Street and Gruber. Agenda 9 Carl Stoddard was present to request transfer of Beer License from Donald Bennett located at 229 West Franklin. The Mine License was not to be transferred. Mr. Kingsford stated that whoever 01 -ins that should be responsible, and when sewer and hater are available, they must hook-up to City services. Meridian City Hall .10. March 69 1978 Lift Stations are being installed. Three (3) in Cherry Lane Village and possibly one more. Mr. Ellsworth stated there is a major lift station required for the Cherry Lane Village that will be a long term to permanent installation as a 15" sewer line major lift station. The cost of maintaining permanent lift stations were discussed as the costs being borne by the user. The Mayor stated that it is not right for all the people to pay for this lift station. Mr. Shults stated that the new Sludge truck is needed at the sewer plant to haul the liquid sludge from the drying beds. It was noted that any damage to the truck must be repaired when the plant is completed before putting this truck into service at the new plant. Mr. Ellsworth, the Engineer, is waiting for a letter from EPA stating approval for the use of this truck at the present plant. This sludge can be used at the park if the sprinkler head can be svoided. Vernon Schoen, Building Inspector, reported only three to four Building Permits issued in 1978. This indicates a slow rate of growth and is a concern for the City because loss in hook-up and monthly payment monies into the water sewer enterprises funds to pay maintenance and operation and payment of bonds and interest. Franklin Square that has been approved in its final plat by the Meridian Zoning Commission was discussed as to whether it should be approved. There is also a problem concerning the sewer lines that ,will be necessary from this Subdivision which may require easements to reach trunk.,lines under the Project plans. Bruce Stuart asked the status of water specifications for developers. These could be rather detailed. Mr. Ellsworth replied that specifications should be as brief as possible but cover all aspects. There are minimum standards that must be maintained. It is hoped that procedural process proposals will come in the near future to inform developers of their requirements without the necessity of reading the codes to each one as they come. Ordinances -,could involve many booklets as hand outs. Mr. Stuart reported that Surface Well located on East 2nd Street, Well #2, is filled with sand. He will get a bid for repair and will present bid later. Mr. Green remarked about litter blowing from the school on to the Kiser property and other properties around the High School. He presented pictures to provide visual evidence concerning this. The Mayor will contact the School Sup't. to attempt to correct this matter. There should be a way to instill pride in the school to avoid this, the other schools in town do not look this way. The City Attorney brought up the matter of the easements for the project being allowed $10.00. It was thought that these people involved in these easements should be paid the $10.00 token fee. The Engineer stated that a list could be available at the next Council meeting. Mr. Crookston, Attorney, discussed an easement for West Steel through Capital Securities. These easements are involved in a construction easement on the property being acquired by Dale Fisher for West Steel. He will proceed with this easement. Mr. Crookston reported concerning the adoption of a Moratorium under the Planning Act There on two courses of action. 1. Short term is to issue notice based upon a finding of injurious to Health and Welfare - this is good for 120 days. OL 2. We have changed the pressure relief valves, some as many as four times, using different brands.Also,we have installed pressure regulators on some of the hones. The police chief's home is one of the homes having problems and, to date, it still discharges water after all the effort to correct this problem. It does not occur on every home. However, we are getting more occurances as time goes on. Is there anything the city can do to alleviate this situation? We would sincerely appreciate any effort you make to cure the problem. Mr. Don Hunter, property owner abutting a portion of the subdivisions East 0 and South boundary, has received drainage overflow from your storm drain system which was originally intended to discharge into Ten Mile Creek. Yesterday, May 24, 1979, the City Engineer and I visited the .site to examine the problem area. The following items were found to be deficient and not in accordance with the engineering plans on file in n this office. 1. Along the East side of Lot 18, Block 3, a note on the plans states "Construct 105 L.F. small ditch at 0.10%." This has not been done. The .ipparert reason,"for the ditch is to intercept irriga.:ion flow from a small ditch flowing Westerly that entered the subdivision boundary near the Northeast corner of Lot 18, Block 3. 2. Manhole No. 4, shown at the Southeast corner of the subdivi- sion and Lot 18, Block 3, has not been built in accordance with the plans. Note No. 3 of the Manhole No. 4 detail states that the top of the manhole shall be at the same elevation as the invert of the small ditch, previously mentioned. Also, the manhole cover was to be a grate that would allow inflow from the small ditch. This manhole needs to be reconstructed in accordance with the plans so the flow from the ditch can be received by the system. Waste Water Structure No. 1, located at the Southeast corner of Lot 48, Block 4 has not been completed. The weedrach of No. 4 bars at five inches, center to center, with angles top and bottom, has not been installed and back fill around the pipe and headwall has not been .completed. 2. Near the Southeast corner of Lot 7, Block 3, the plans re- quire that a bend be fabricated in the twelve inch line to direct the flow into Ten Mile Creek. This has not been done and an opening in the ground exists at this point exposing the two pieces of pipe and creating a place for debris to gather to possible plug the pipe. The above items need your immediate attention as they are creating problems for adjoining property owners. We have discussed this subject at length with Mr. Stubblefield, the Franklin Square Developer, in an effort to resolve the dilemma created by the conflicting storm water retention pond requirements of various government agencies. In capsule form, the following is our understanding of the various positions regarding storm.water retention ponds in Ada County, Idaho: (1) The Environmental Protection Agency has not solidified its position on what it may or may not require at some future date concerning storm water runoff; (2) The Nampa and Meridian Irrigation District is requiring all subdivisions to provide for storm water retention ponds for all street runoff water prior to discharge of the water into a receiving stream or natural drainage way and with the stipulation that the Nampa and Meridian Irrigation District shall not be responsible for the operation and maintenance of the said retention ponds; (3) Until recently the Ada County Highway District (ACRD) required storm water retention ponds for some subdivisions but not for others. If they did require a pond, they were agreeing to operate and maintain the pond. By recent action of the ACRD they have agreed to "permit" the installation of storm water retention ponds but with the provision that the ACHD will not operate or maintain facilities as constructed for the subdivision; (4) The City of Meridian will permit the installation of the said storm water retention ponds even though many City officials are of the opinion that they are undesirable. Under the current governmental organization in Ada County, the responsibility for streets, irrigation and drainage are assigned ENGINEERING—PLANNING—SURVEYING az 10th Ave.so. - Nampa, Idaho 83651 J -U -B ENGINEERS. INC* 0 Board of Directors 2 May 31, 1978 to other governmental entities, and, as such, the City does not have the organization or equipment to assume such a maintenance committment within the City, let alone for the entire County; (5) The Ada County -Commissioners apparently could legally accept county wide responsibility for such activities but this would undoubtedly create complications because the County Commissioners would be back into the "street and road" business and would also be in the "drainage" business which has historically been the responsibility of the various irrigation and drainage districts or the Ada County Highway District. Even so, some Ada County officials are apparently investigating what action they should consider to resolve this problem. For that they are to be commended; (6) Mortgage guarantee agencies such as the Federal Housing Adminis- tration and the Veterans Administrations require that a governmental agency must accept the responsibility for maintaining drainage facilities before these financing agencies will approve loans for new homes in any subdivision that is required to install a storm water retention pond. This provision automatically rules out the maintenance of such facilities by a "lot owners corporation" even though there are many other reasons why a lot owners corporation would be unde- sirable for this purpose. The same reasoning applies as to why the developer is not acceptable as the entity to maintain the facility. I am sure there are many ways that this dilemma could be resolved if we all put our minds to finding a solution. The solution could run from the one extreme of leaving the situation status quo to the other extreme of going back to the old system of permitting open discharge into any natural drainage way or channel. I could not support either of these extremes. To remain status quo, in my opinion, would have the net effect of causing all single family subdivision lot development to be stopped as well as stopping many commercial and other residential types of development. I believe I could survive the "depression" that would be blanketed on our area by such action but I am sure the young adults, who are striving to make their place in this world, would be hard pressed to have to accept the decline in job opportunities and the associated extreme decline in family earnings that such an extreme position would cause. To the contrary, the permitting of continued open discharge, as was done historically, could create lasting environmental problems that we all wish to avoid and, above all, such a policy could make it that much easier for the federal government to take over control of one more local government responsi- bility. By this time anybody reading this letter should be able to .agree with my contention in the opening paragraph "that there is a dilemma". Therefore, I am taking the opportunity to circulate copies of this letter to a number of people and entities who should be vitally interested in working with you and other groups in finding a solution to the problem. To paraphrase President Dwight D. Eisenhower, he said, "The government should only do for the people what the people cannot do for themselves". It is a true "statesman" who will accept the challenge to give the leadership that is required to find a solution to this difficult problem. Above all, I do not want to see another governmental agency created just to address this matter if there is any possible way to do it within our present divisions of government. If I can be of any help in the formulating of an acceptable overall program to resolve this matter, please let me know. Your aggressive leadership in this endeavor will be appreciated. This system has been designed to include an open ditch along portions of the Easterly and Southerly boundaries of the development which will collect irrigation waste water from properties to the East. As development on these properties occurs, the irrigation waste water will be eliminated. Therefore, we are requesting approval of the open ditch as a temporary facility, to be abandoned when the irrigation waste water is eli- minated. The sanitary sewer system for the development has been designed to incor- porate a temporary central septic tank and absorption bed system. This Sys- tem is designed for a maximum flow of 14,500 gallons per day or app y 50 living units. Hook-ups exceeding these limits will not be allowed by the State of Idaho, Department of Health and Welfare, until such time the sewage system is connected to the City of Meridian Municipal sewer system. From this point the sanitary sewer will be extended Southerly across Tenmile Creek and Northwesterly along the Southerly side of said Teranile Creek to a point of connection to the sanitary sewer system planned for the area and shown on the plans for the "1977-78 Sewerage Project - City of Meridian Phase III - Interceptor Sewers." Detailed plans of this extension cannot be pro- vided until such time construction contracts have been awarded for said Phase III project. Also included in the development plans for the sewer collection system within the development is the use of sewer cleanouts at the ends of a portion of the collection lines. It is our understanding that the City of Meridian in the past, has not allowed the use of such facilities. However, since these cleanouts are located on lines which will be ultimately extended to serve future adjacent developments, it is our opinion that the construction of man- holes in these areas is a waste of resources and a costly maintenance factor for the City. At such time the sewer lines are extended, the cleanouts can be removed, or left in place to serve as additional cleaning ports, and man- holes installed at the proper locations on the extended facility. For these reasons we hereby request the City reconsider the use of cleanouts within the municipal sewer system. Enclosed for your use in evaluating this request, are copies of a standard sewer cleanout detail which is used in many cities surrounding the City of Meridian. We also request a variance be allowed for the 1,000 foot block length requirement as specified in the City of Meridian Subdivision Ordinance. This variance would apply to Block 3, 4 and 5 of the development. Adequate access has been provided to adjacent lands from the development thus eliminating the need for said requirement.
