Dear Ms. Goodell
Enclosed is lift station operation data for calendar year 1981
and January through April 1982. On February 7th, 1982 the
ScLun Baffle in one of the tanks became plugged and we had the
tanks pumped by a private septic tank service. The spillage
out of the unit was so minor it did not even require cleanup
and we have since treated the system with Hydrogen Peroxide to
help with the scum problem. We have started a program to pump
the tanks with our own equipment on a quarterly basis, or more
frequently if necessary.
If you have questions concerning the system please contact me
at 888-2191.

Dear Mr. Kane:
On June 11, 1981, The Commissioners of the Ada County Highway'District
(hereafter called "District") approved the preliminary Plat subject to the
following conditions:
The development is a resubdivision of Lot 11, Block 5, of Franklin Square
Subdivision which has been approved and was accepted -for maintenance by the
Ada County Highway District on 4/23`80.. Development fronts on S.W. 7th Ave.
which is fully improved.
1. Retain drainage on site. Provide site drainage plan confirming the
development will not adversly affect existing drainage conditions.
In order that the Final Plat may be considered by the District for acceptance,
the Developer shall cause the following applicable standard conditions to be
satisfied prior to District certification and endorsement:
1. Drainage plans shall be submitted and subject to review
and approval by the District.
2. Furnish Final Plat drawings for District acceptance certification
and endorsement. The final plat must contain the signed endorse-
ment of the Owner's and Land Surveyor's certification.

1. The location map attached to the applicant's application labels the site
as Lot 10. All other referrals call it Lot 11.
2. Since, by statute, the condominium law states that what is being purchased
is space (3 dimensional), I feel the ceiling elevations should also be
shown on the plat.
3. It appears to me that the parking area (Tract 5 - Common Area) should be
broken down into parking areas so that each living unit knows that it has
the right to one or whatever parking spaces. I assume this will be shown
in the Declaration.
4. I believe it is the intent of the State Code, Title 55 -Chapter 15 to
designate the stairways, balconies and patios as "Limited Common Area."
Reference is made to 55-1503(g) and the definition of a condominium in
55-1509(a), first sentence. Copies of these sections are attached for
your review.
5. I think it is prudent to have paragraph (a) of section 55-1509 included
as part of the plat front.

55-1502. Purpose --Public policy. Whereas, the availability of more
adequate financing for construction, land development and improvement,
and business expansion is beneficial and advantageous to the develop-
ment of the state of Idaho and in the public interest, and, whereas, the
condominium estate is a concept of holding property, which concept
should be clarified in the state of Idaho to permit and facilitate the con-
struction and development of condominiums and condominium projects,
together with the financing of the same;
Now, therefore, the condominium estate in property is hereby declared
to be a lawful estate in property and consistent with the public policy
of the state of Idaho[1965, ch. 225, § 2, p. 515.]

55-1503. Definitions.—As used in this act unless the context other-
wise requires:
(a) "Condominium" means an estate in property as defined in section
55-101B, Idaho Code, as amended.
(b) "Project" means the entirety of the property divided or to be
divided into condominiums.
(c) "Property" means the land described in the declaration recorded
pursuant to section 55-1505, together with every building, improvement
or structure thereon, and every easement or right appurtenant thereto,
and all personal property intended for use in connection therewith or
for the use, benefit or enjoyment of the condominium owners.
(d) "Unit" means the separate interest in a condominium.
(e) "Common area" means the entire project excepting all units.
(f) "Management body" means any person or persons managing a
project, and includes the condominium owners acting themselves, a
corporation or association of which the owners are members or stock-
holders, a board of governors or directors elected by the owners, or a
management agent selected by the owners, by the corporation or
association, or by the board, or named in the declaration.
(g) "Limited common areas" mean those common areas and facilities
designated in the declaration for use of a certain condominium owner or
owners to the exclusion, limitation or restriction of others.

(h) "Person" means any individual or any corporation, joint venture,
limited partnership, partnership, firm, association, trustee or other

55-1504. Requirements to qualify. The requirements of this act
shall apply to condominiums only (a) if there shall be recorded in the
county in which_ such condominiums are located or to be located a
declaration, as provided in this act, together with a plat or plats, and
(b) if said documents, or either of them, contain an expression of intent
to create a project which is subject to the provisions of this act, and (c)
if at least one (1) of such documents contains:
(i) a plat or survey map of the surface of the ground included within
the project,
(ii) diagrammatic floor plans of the building or buildings built or to
be built thereon in sufficient detail to identify each unit, its relative loca-
tion and approximate dimensions, showing elevations where multi-level
or multi -story structures are diagramed, and
(iii) a certificate consenting to the recordation of such documents
pursuant to this act, executed and acknowledged by the record owner
and the holder of any recorded security interest in such property. A
condominium project is created if there has been substantial compliance
in good faith with the provisions of this section.
The declaration and the plat or plats may, prior to the first sale of a
condominium, be amended or revoked by a subsequently recorded instru-
ment executed and acknowledged by the then record owner and the then
holder of any recorded security interest in such property. Until such
recordation of such a revocatiM, the provisions of this act shall continue
to apply to such property. The term "record owner" as used in this
section means the owner or owners of the property; or, in the case of
property held under a recorded lease, the lessee; or, in the case of prop-
erty held under a recorded sublease of such a lease, the sublessee; or, in
the case of property held under a recorded assignment of such a lease
or such a sublease, the assignee, but does not include holders or owners
of unrecorded interests, or mineral interests, of easements or of rights

55-1505. Contents of declaration.—(1) The declaration shall con-
tain the following:
(a) A legal description of the surface of the ground within the
project.
(b) A legal description of each unit in the project, which description
may consist of the identifying number, symbol or name of such unit as
shown on the plat.
(c) The percentage of ownership interest in the common area which
is to be allocated to each unit for purposes of tax assessment under
section 55-1514 and for purposes of liability as provided by section 55-
1515. Such percentage shall be fixed by taking as a basis the value of
each unit in relation to the value of the property as a whole. For said
purposes, the percentage so fixed shall be conclusive, subject only to clear
and convincing proof of bad faith at the time of and in the making of
such allocation or the last prior amendment thereof.

Common areas—Decorating. rights of owner.—Unless otherwise express-
ly provided in the declaration, deeds, plat or plats, the incidents of a

(b) The common areas are owned by the owners of the condomini-
ums as their interests appear and are set forth in the declaration pur-
suant to section 55-1505 (1) (c).
(c) A nonexclusive right of ingress, egress and support through
the common areas is appurtenant to each unit and the common areas are
subject to such rights.
(d) Each condominium owner shall have the exclusive right to paint,
repaint, tile, wax, paper or otherwise maintain, refinish, and decorate
the inner surfaces of the walls; ceilings, floors, windows and doors

55-1510. Removal of property from law—Common ownership—Re-
submission.—Unless otherwise provided in the declaration, a project may
be removed from the provisions of this -act by a vote or written consent
of the condominium owners owning at least a two-thirds (2/3) interest
in the common areas as percentages of interest are allocated pursuant
to section 55-1505 (1) (c), and by filing for record in the county where
the project is located a written instrument signed and acknowledged by
such owners wherein it is stated that such described project is so with-
drawn, provided, holders of all liens affecting any of the units or the
common must consent or agree thereto in writing by recorded written in-

land -use -change involved here and therefore the Dist. withholds

4. Richard Williams, Councilman: (1) The "Findings of Fact"
as so presented seem to be in error. The Company, Valley
Contractors, has completely ignored Meridian's Ordinance
pertaining to conversion of buildings to condominiums.
(2) The two hour fire wall is of paramount importance in
these conversions as noted in the Fire Codes. (3) The
developer has not mentioned the replumbing that must be done
for water and sewer. Each unit will have a separate meter
and separate tie in to the sewer. (4) This is Idaho not
New Jersey or Illinois. (5) Recommend denial unless developer
can meet all Fire and Safety Codes, especially as relates to
Two hour fire walls and that building be replumbed to meet
wate.r and sewer requirements.
5. Meridian Fire Department: The Meridian Fire Department does not
approve of this conversion of existing 4-P1ex due to. the fact
that the Fire Codes and Building Codes differ for 4-Plexes
than condominiums. At this time the 4 -flex cannot meet the
Condominiums' of the.Codes. These are National Codes .
6. Mayor Joseph Glaisyer: I do not recommend approval, and that does
not constitute arbitrary and capricious action.
7. Ada County Highway Dist.: 1. Retain drainage on site.Provide site
drainage plan confirming the development will not adversly affect
existing drainage conditions. In order that Final Plat may be
considered by Dist. for acceptance the following conditions to be

AN ORDINANCE AMENDING SECTION 2-405 OF THE REVISED AND COMPLIED ORDINANCES OF
THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY ADDING THERETO SUBSECTION 12,
RELATING TO CONDO^.INIUMS.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA
COUNTY, IDAHO:
Section 1. That the following is added to Section 2-405:
12. CONDOMINIUMS:
(a) All residesitial condominiums or other condominium projects
within the City, or those over which the City may exercise control, shall
meet the requirements of Chapter 15, Title 55, Idaho Code, and the requirements
of this sub -section;
(b) No house, residence, apartment, structure, or any other building,
whether used previously as a dwelling or not, shall be converted to a
condominium without meeting the requirements of sub -section 12(a);
(c) All condominiums, whether they be newly constructed, or
structures converted to condominiums shall meet the requirements of the
Uniform Building Code, as adopted by the City as that Code applies to condominiums.
(d) All residential condominiums shall be built and placed only in
the Residential "A" Zone; Any other type of condominium development shall also
meet proper zoning requirements.
(e) Prior to the construction of any condominium project of the
conversion of any structure to condominiums the owner therccof shall submit his
application for a permit to the Planning and Zoning Commission as required
under 2-412; the Planning and Zoning Commission may take any action authorized
in said section or as otherwise authorized by the Ordinances of the City
of Meridian.
(f) Prior to the issuance of any permit the owner of said 'condominum
project shall furnish proof of meeting the requirement of Chapter 15, Title 55,
Idaho Code.
(g) Any land upon which a condominium project is to be constructed
_or land upon 'which rests a structure which is to be converted to condominiums
shall be subdivided and platted, the same as if the land were to be developed
for single family residential units if residential, and any other condominium
development shall also be properly platted so that property is conveyed by plat
description, and all requirements of the platting statutes and ordinances shall
be met prior to the issuance of permits or allowed in paragraph (e) above.
Section 2. WHEREAS, there is an emergency therefor, which emergency is
hereby declared to exist, this Ordinance shall take effect and be in force
and effect from and after its passage, approval and publication as required
by law.
PASSED by the City Council and approved by the Mayor of the City of
Meridian, Ada County, Idaho, this 16th day or October 1978.

CONDOMINIUM CONVERSION - APPLICANT'S COMMENTS
This proposal consists of converting -an existing four-plex apartment structure
into four condominium units for -sale. The-structure.was constructed in accord-
ance with all uniform building code and fire and safety code requirements in
effect at the time of construction. Current fire and safety codes require two
(2) hour fire separation between all units as well as separate public utility
entrances.
The existing structure meets.all current codes with the exception of the two
(2) hour fire rating requirement between the first and second floors. This re-
quirement was established after construction of said.units.
The City staff has indicated that the structure may be sold as a "cooperative"
ownership as is, with up*to four (4) parties owning an equal'shar"e of'said
cooperative; but indicates that the structure would have to be modified to meet
current fire and safety codes to allow the units to be sold as separate condo-
minium ownership.
This staff opinion appears to violate certain basic premises of real property
development and ownership. Since Idaho case law on this issue is minimal the
following citations are from other states with similar condominium law.
(1).. ."Condominiums' shall be deemed to be cooperative interests
in realty within the meaning of Section 352e of the general business
law....."
New York Statues 3394 and 339ee
Idaho condominium law and the Meridian Zoning Ordinance make no reference
t- subdivision approved requirements for the conversion of existing apartments
to condominiums.
The existing apartments conform to the City's zoning ordinace, and the proposed
conversion represents nothing more than a change in the form of ownership: The
use of the land will not be affected.
(2) In a similar case, the New Jersey Appellate Division pointed out
that ....... while NJSA 40:55-30 allows municipalities to regulate the
use or type of construction on real property, it does not grant power
to regulate the ownership or types of tenancies permitted. Further,
the court states t.hat "the word use," as contained in the statute above,
does not refer to ownership.but to physical use of lands and buildings.
A building is not (used) as a condominium for purposes of zoning."
New Jersey law provides further guidance.along these lines.
(3)....."It is the use rather than form of ownership that is the proper
concern and focus of zoning and planning regulation ..... Municipality may
impose subdivision controls upon condominium apartments only if it imposes
the same controls on conventional landlord -owned apartment buildings...."

It is clear from these citations that differing standards cannot be imposed
for multiple residence structures that are to be sold as condominiums vs those
that are to be rented.
It is also cl.ear from the city records, that this structure met all require-
ments at the time of construction.
The lack of a city ordinance to require all properties to be upgraded to
current UBC and fire and safety codes at each sale or change of ownership would
make it appear that the imposition of such a requirement on this proposed condo-
minium conversion would be an arbitrary and capricious action.
Based on these facts and citations the applicant hereby requests your favor-
able consideration of this application.
