Transmitted herewith, are 27 copies of the Preliminary Plat, applica-
tion and supporting documents for the referenced project.
The proposed development lies within the "Old Towne" concept plan,
prepared.by us in 1980, and approved by both the council and Planning
and Zoning Commission. This proposal is in essential compliance with
that_plan, supporting the land use, transportation and green belt corridor
concepts thereof. It is the developer's pl.an to slope and landscape the
westerly bank of Five Mile Creek - as recommended in the 'Old Towne' plan -
to the limits allowed by the Nampa and Meridian Irrigation District.
City services are available to the site; water is available at the
southwesterly corner of the development and sewer to the north. An ease-
ment is presently being negotiated between the applicant and Mrs. Ruth
Crow the northerly land owner to allow extension of the system to the
site.
You.will Note, in your review, that the subject property is quite
narrow, and subject to a substantial easement for Five Mile Creek. The
presence of this easement results in a limited construction window. To
accommodate this, the applicant is hereby requesting a variance from the
normal setback requirements, and the establishment of special setback
requirements for this development. Setback requirements requested are as
follows: Front - 10'; side street - 10'; side yard (interior) - 5'; rear
yard 45'.
C. The on-site street is positionally East 6th. This designated
street is not continuous and full width right -of -way -and improvement
would negate all development potential .of the subject property. The
applicant, therefore, requests approval of a private lane to be
designated as Catherine Lane.
D. It is further requested, that the southerly 266 feet of Catherine
Lambe approved for private lane construction.standards; and that
the remaining portion to the north be constructed as a half street
allowing for future development of the west half across the existing
roadway easement on that property.

SITE CHARACTERISTICS
GEOGRAPHIC FEATURES.
Located at the easterly edge of the present city limits of Meridian, the
site is'part of that mixed-use review area identified in the Meridian
Comprehensive Plan'as "Old Town". The proposed project contains approx-
imately 2 acres and is defined as that block of land bounded on the north
by E. Washington Avenue; on the south E. State Avenue; on the east by 5 Mile
Creek; and on the west by the protracted alinement of E. 6th Street.
The tract has adequate topographic relief to insure good drainage and
sewerage gradients., It is primarily valley lands which have been leveled
for agricultural purposes. Abuting the property is Five Mile Creek. This
waterway will provide a natural break for screening from adjacent uses.
GEOLOGICAL FEATURES
The structural foundation oft this land area is generally silty loam running
to a depth of 40 60 inches' with minor inclusions of weakly cemented hard-
pan. This material has a relatively slow permeability rate permitting only
shallow rooting penetration. Due to these factors, agricultural use is
limited. As a development site, however, the materials are very acceptable.
There is sufficent loam to ensure good vegative growth, and the site drain-
age -way located in.the sub -surface gravely sands will provide excellent
drainage for development purposes. The soils classifications and descriptions

RESTRICTIVE COVENANTS`.
FIVE MILE CREEK SUBDIVISION

The undersigned, being the owners of the property hereinafter described,
hereby adopt the following protective covenants in their entirety to apply
to real: property to be subdivided and contained in a subdivision to be*known
as CATHERINE PARK SUBDIVISION, Meridian, Ada County, Idaho.
CATHERINE PARK SUBDIVISION is divided into single Family residential
lots in compliance with the local and state regulations and laws.
The following coven: nt,$; 'shall run with the land and be in force and
effect for thirty (30).years hereafter unless sooner terminated by agreement
of the owners of seventy-five.percent (75%) of the land in the subdivision
and are as follows, to -wit:
(1) No building, fence, wall, structure, improvement or obstruction
shall be placed or permitted to remain upon any part of said property unless
a writtenrequestfor approval thereof containing the plans and specifications
therefore, including exterior color scheme, has been approved in writing by a
majority -of the Architectural'Committee or by its representative designated
by a majority of the Committee: The approval of the Committee shall not
be unreasonably withheld if the said plans and specifications are for improve-
ments which are similar in general. design and quality, and generally in
harmony with the dwellings then located on said property.
Variances in building set -back requirements shown on plat may be given
by the architectural committee upon proper showing and so long as the city
ordinances and special setback requirements on setbacks are met.
The ground floor living area of a one story house in this subdivision
shall not be less than 1200 square feet. All area requirements shall be
exclusive of the garage area and shall be well constructed of good quality
material and workmanship. For the purpose of covenant, -eaves, steps, and
open porches shall not be construed to permit any portion of a building, on
a lotto encroach upon any other lot. No residence shall be in excess of two
stories. Structures may be conventional, on-site construction or manufactured
housing.
The value of any residence in.the.subdivision shall exceed $50,000.00
in value including the valueof the land and improvements thereon, based
on January 1982 costs.
Fences shall not extend closer to any street than 20 feet without
express approval of the Architectural Committee, and shall be of good -
quality and workmanship and shall be properly finished and maintained. The
location of fences, hedges, high plantings, obstructions or barriers.,shall
be so situated as not to unreasonable interfere with the enjoyment and use
of neighboring properties and streets, and shall not be allowed to constitute
an undesirable, noxious or nuisance use. The determination' of the Architectural
Committee shat-1'be binding ori all parties as to whether an undesirable, noxious
or nuisance use exists.

At least fifteen (15) days prior to any construction being commenced
one set of plans and specifications shall be submitted to the Committee.for
approval construction shall not commence prior to issuance of approval by
the committee.
(2)No building shall be located on any lot nearer to the front Tot.line
or nearer to the side and rear lot lines that the minimum building setback
distances as set forth by the City of Meridian for special setback requirements
for Catherine Park Subdivision, however, in any event no building shall be
located on any lot nearer than ten (10) feet from the front lot line, and
forty-five (45) feet from the ,rear line, five (5) feet to any interior side
line, and ten (10) feet from.the side street lot line.
(3) Construction of any residences on the subdivision shall be diligently
pursued after` commencement thereof, and shall be completed within one (1) year,
including landscaping..
Each house shall have at least one ornamental tree of at least 8 feet
in height in the front yard.
(4) No shack, tent, or basement only, shall -be used within this sub-
division for living quarters on either a permanent or temporary basis.
(5) Nothing of an offensive, dangerous, odorous, or -noisy kind shall
be�conducted or carried on nor shall anything be done or permitted in said
subdivision which may be or become an annoyance or nuisance to the other
property owners in said subdivision. Weeds shall be kept cut to less than
4 inches high.
(6) Keeping or raising of farm animals or poultry shall be prohibited..
All dogs and cats or household pets kept on these premises shall be properly
fed and cared for and shall be adequately, fenced so as not to annoy or trespass
upon the use of the property of others. Dogs shall not be allowed to run
at large.
No business shall be conducted on the above property that cannot be
conducted within the residence of the owner. No signs shall be installed
to advertise said business. No off or gas exploration or development of
any nature or any kind of mining exploration or development shall be per-
mitted_upon the -lots 'in this subdivision.•
(7) Only one outbuilding per lot will be allowed. All outbuildings
shall be constructed of good quality building material, completely finished
and painted on the outside and shall be of, good quality and character that
will be in harmony with the other building on said property and must be
approved by the`Architectural Committee.
(8) No building or structure shall be placed on said property so as to
obstruct the windows or light of any adjoining property owner in said sub-
division.

(9) Easements for installation and maintenance of utilities and drainage
facilities are reserved, as shown on the recorded plat of said subdivision
over the areas indicated on said plat. Within these easements no structure,
planting or other material shall be placed or permitted to remain which may
damage or interfere with the installment and maintenance of the utilities, or
which may change the direction of flow of water through drainage channels
in the easements. The easement area of each lot and all improvements in it
shall be maintained.continuously by the owner of the lot, except for those
improvements for which a public authority or utility is responsible.
(10) The grantors are under no obligation to deliver, irrigation water
or to furnish rights-of-way in connection with the delivery of irrigation
water to any lot or building site in this subdivision.
(11) All bathroom, sink and toilet facilities shall be located inside
the dwelling house or other suitable appurtenant building, and shall be
connected by undergroud pipe to the Meridian sewer and water systems. Con-
struction shall be of a type approved by the City, Ada County Central District
Health Department and the State of Idaho Health authorities.
(12) No sign of any kind, shall be displayed to public view on any
building or building site on said property, except on professional sign of
not more than five square feet, advertising the property for sale or rent,
or signs used by the developer to advertise the property during the construc-
tion and sales period. If a property is sold or rented, any sign relating
thereto shall be moved immediately, except that the Declarant or its agent
may post a "Sold" sign for a reasonable period following a sale.
(13) No lot or building site included within this subdivision shall
be used or maintained as a dumping ground for waste material. Incinerators
are not permitted. Reciptacles for storage of trash, garbage, etc., shall
be maintained in a sanitary and clean condition.
Parking of boats, trailers, motorcycles,- trucks, truck -campers and like
equipment, or junk cars or other unsightly vehicles, shall not be allowed on
any part of said property nor on public ways adjacent thereto excepting only
within the confines of an enclosed garage, or other approved enclosure,
and no portion of same may project beyond the enclosed area. Parking of
automobiles or other vehicles on any part of the property shall be prohibited
except within garages, carports, or other approved areas. The Architectural
Committee acting within the regulations of the City of Meridian,shall be the
sole and exclusive judges of approved parking areas. Their decision shall be
final and binding.
No machinery, building equipment or material shall be stored on site
prior to the time that the Grantee is ready and able to commence the construc-
tion. All such building materials shall be placed within the property lines
of said building site upon which , -the structure is to be erected.
(14) Installation of exterior radio and/or television antennae is
prohibited without written permission from the Architectural Committee.

(15) These covenants shall run with the..land and shall be binding
on all persons owning a lot or lots within the subdivision for a period of
thirty (30) years from the date of the recording hereof, after which time such
covenants shall be automatically extended for successive periods of ten (10)
years, unless at any time after the initial recording of this instrument,
an instrument signed by the owners of not less than 75% of the lots within
the subdivision have been recorded agreeing to change or terminate said
covenants in whole, or in part.
(16) Enforcement against.any person or persons violating or attempting
to violate any covenant herein, shall be had by any property owners within
said subdivision either at lawor equity after:ten (10) days notice thereof
in writing served on the offending party. In the event of a judgement against
any person or persons for such violation, the Court may award an injunction
against any owner and/or the holder of any recorded mortgage upon any part
of said property, shall have the right to enforce, by any proceeding at law or
in equity, all restrictions, conditions, covenants, reservations, liens •and - -
charges now or hereafter imposed by the provisions of this Declaration. Failure
by any owner to enforce any covenant or restrictions herein contained shall
in no event be deemed a waiver!of the right to do so thereafter.

(17) A committee of not less than two persons shall act as an architectural
design committee and shall, prior to any new construction in said subdivision,
be furnished with detailed plans of any proposed building to be located in
said subdivision and shall be allowed fifteen days to review said plans,
drawings, or any modification or alteration thereof. Their written approval
shall be construed as full compliance with the provisions of paragraph (1) of
the original covenants. Said committee shall have sole discretion to determine
what shall be substantial compliance with said covenants. No buildings shall
occupy any portion of said subdivision without the prior approval of said
committee.

In the event any member of the committee is unable to act or fails or
desires not to act, the remaining committee member shall appoint an owner
of a lot in said subdivision to serve on said committee, all of whom will
serve without compensation.
(18) Additional Easements!: In addition to easements shown on the
recorded plat an easement is further reserved 5 feet each side of all lot
lines for instAl'l.ment and maintenance of utilities, irrigation and drainage.
Within all such easements no structures, other than fences, may be placed or
permitted to remain. The areas may be planted and landscaped but may not be
obstructed or altered to interrupt the flow of drainage water through the
easements. Said easements shall be maintained by the lot owner, except where
a public authority or utility company is responsible.
(19) Allowners hereby agree to pay the City of Meridian all applicable
connettion.fees and monthly service charges as prescribed by Meridian City Or-
dinances for water, sewer, and refuse pick-up.
(20) Invalidation of any single provision of these covenants shall in no
way affect any of the other provisions which shall remain in full force -and
effect.
(21) A homeowners Association shall be duly formed by the current
grantees. This association in the form of a Non -Profit Corporation, will
be for the purpose of owning and maintaining the private road, green belt
corridor improvements and on-site drainage or irrigation works which may be
necessary to convey drainage and/or irrigation waters through the subdivision
for the enjoyment of adjacent properties.

NOTICE OF PUBLIC HEARING
Notice is hereby given, pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that
a hearing will be held before the Planning and Zoning
Commission of the City of Meridian, at the.City Hall in
the City of Meridian at the hour of 8:00 P.M. on the 8th
day of March, 1982 and before the City Council of the City
of Meridian, at the City Hall in the City of Meridian at
the hour of 7:30 P.M. on the 15th day of March, 1982
for the purpose of approving the Preliminary Plat and
the Final Plat of CATHERINE PARK SUBDIVISION which would
be located, if approved, generally described as follows:
Lying in the NE 1/4 Section 7, T. 3N., R.1.E. STUTZMAN ANNEXATION.
The North boundary would be Washington Avenue Extension, State
Street to the South, the East' boundary is Five Mile Creek,
and COTTAGE HOME ADDITION to the West.
A more particular description of said real property is on file
at the office of the City Clerk, City of Meridian, City Hall,
Meridian, Idaho.
Any and all parties interested shall be heard at the above
scheduled hearings.
