P9r. Rule is requesting approval of this plan, in order to meet his present construction loan committment, and anticipated occupancy date of those with deposits on lots. It is Mr. Rules intent, that as soon as Construction Phase 1 is complete, and approved for occupancy, he will be in a position to proceed immediately with phase 2. In other words, the committments he has on lot sales, that will close upon completion of the first phase, will enable Mr. Rule to proceed without necessitating an increase in his loan committment. This concept will decrease the amount of interim finance interest charges, and construction bonds to the Highway District; thus negating any increase in lot costs to the consumer. On behalf of f~1r. An application form may be obtained at the District office which will provide necessary preliminary information for District review. General Information A. DRAINAGE 1. The District will not accept any increased flow or drainage of decreased quality from a tract of land due to changed use. - 2. Any existing drainage facilities on the land must be maintalned, and arrangements made for continued opera- tion and maintenance of these-after the ownership of the tract is changed. 3. Neither are these always ~" the same on one tract of land. Often these can be 4 simplified without changing the Court confirmed status of~the rights, if arrangements are made with - the Secretary of the District in the advance plan- ~:x, Wing stages. ~~; 2. Any alteration from the original delivery point must • be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with - the Secretary of the District as part of the system ~~;' plan acceptance by the Board of Directors. 3. If irrigation service is not to be provided to the individual properties, all property owners must be ~~> notified that the District tax is an obligation of ' all -lands in the Irrigation District. If development plans include providing irrigation, operation and maintenance of the system may be under- ~= taken by a Lateral Ditch Water User's Association, in which case the District assumes no responsibility ~~;- ~~ beyond the original point of delivery for the tract. Inspection by representatives of the District or its engineers will not constitute approval of all or any part of the system and shall in no way relieve the developer or his contractor of the responsibility for providing a sound, workable system. 3. Within ten days after completion of construction the developer's engineer must certify to the District that the system was installed in accordance with plans and specifications, and furnish as-built drawings to the District. 4. The developer and/or his contractor shall be reT sponsible for the repair of all defects, leaks or failures occuring in the installation for a period of three years after completion of construction, A Maintenance and warranty bond in the amount of 10~ of the estimated or actual construction cost, whichever is greater, shall be furnished to the District within 30 days after completion of conT struction. If the owner or his contractor fails to make required repairs or replacements promptly, the District shall make them, and the cost therof shall be paid by the owner, his contractor or the surety. Item 1 John Williams - Construction of Building in City Limits John Williams, 1917 Leisure Lane, was present representing .his request for a variance of ~„s Building Codes in the construction of a wood frame, mete*1 skin garage type building. Williams explained that this building will not be used in commercial venture, but for his private use in building and working on race cars. Williams show the Council Members several pictures of similar metal buildings that have been contructed in other areas. Williams also stated that the building will be about 1,000 feet from the house, and that he had contacted all neighbors none which had objections to the building. The William's home is located on a 1.23 acre area which is more of a rural setting than residential. Vernon Schoen stated that this type of building was strictly against code, and a variance to UBC Chapter 25 would have to be granted. There was discussion concerning fire protection. (Tape on File - City Clerk's Office) Fire Chief Roger Welker explained that the building would be "marked" and that no firemen would be allowed on the roof. ~ The Motion was made by Kingsford and seconded by Brewer to grant a variance to John Willi to UBC Chapter 25, for the construction of a metal building. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer yea Item 2 Presentation of Certificates to Wastewater Employees Wastewater Commissioner Grant Kingsford presented two Class 1 Operator Certificates to two employees of the Meridian Wastewater Treatment Plant. The Certificates were presented to Judith Linder, and Richard "Todd" Godfrey. Kingsford commended the two on their hard work. (Applause) Item 3 final Plat Westlawn Estates #1 (Formerly Brooklawn Estates) V" im Potter, representing Westlawn Estates, stated that the comments by the Council, City W Staff, ACRD, and have revised the plans accordingly, and have resubmitted them for the 1 City Engineer's review. When my parents come from seven in the morning, with so few, like 15 to ~';; 20 parents, for an all day affair, they are stretched out to eleven hours so those that go to work at 3:00 A.M. - I do have one nurse who is due at work at 7:00 and I break my rule and take her son at 6:20 A.P?. - but most all of them ;E come beginning at 7:00 and then .they just kind of come stringing along. It's seldom that two come in the door the same minute so those parents that have to `' be at work from 7:00 to 8:00, then come those that have to be to work at 9:00 A.F1. On Monday, Wednesday, and Friday mornings, since I am a Pre-School teacher from ' California, I have class for those 3, 4, and 5 year olds that I graduate into : M Kindergarten with caps, gowns and diplomas.- quite an exciting thing - and this ~,':=~ is my pride and joy. Around 9:00 A.P-1. about 6 more children come - so it's a drawn out affair. Then beginning at 4:00 P.ffi. to 6:00 P.M. those children are ~ picked up - again it's not a congested thing. I forsee no problem for traffic. `_ ` hIy plans would be to fence in the back yard, my children would not be in the front yard. This is an ideal place to do business in the rear - to have my `~~''~ ,~ children and my office in the back. Annabelle Youmans: "I am proposing the acceptance of my application for the house at 129 E. Pine, for the use of a Pre-School Day Care Center. I have stated, and will repeat that I would like to use it for children from 2 1/2 years, through Kindergarten, First and Second grades - 5 days a week, seven in the moring until six in the evening. I have a nurse that belongs at work at 7:00 A.M., so I have an exception that she comes at 6:20 A.M., Monday through Friday. T_ would fence in the rear yard, the children would be in the rear, business would be conducted in the rear because there are four parking spaces back there. This house has been a business for years. ? can see no problem with the traffic flow because of the parking spaces and be~~ause there would only be drop-off - pick-up and when they pay their bill. You ~:ould probably average six minutes per person, and seldom do two parents come at tfie same minute. They would arrive and depart from the back, the children would come in the back - my office would be in the back, the ~-lay area in the back. I would handle the house of course. My sign would be on the front door stating to go to the rear door. "Entrance at rear'! would be printed, and any business would be conducted at the rear. By law the front door would be unlocked when the children are there."
