ID 83642 C2083 BBB -5491 Transmitted herewith are twenty -Seven (27) copies of the revised pre- liminary plat of Brooklawn Farm Estates. This revision is made pursuant to the comments received from the Planning and Zoning Commission on October 12, 1982; comments from council and city staff received on September 24, 1982; the comments of the Ada County Highway District received September 9, 1982; and the comments of City Engineer, Gary Smith, presented at the council hearing of November 1, 1982. In view of the late receipt of the engineer's comments, we appreciate the necessity of your action to table the matter until the questions raised could be adequately addressed. We have carefully addressed each comment in our re -design and the assoc- iated variances requested herein. Pursuant to your review, we are hereby requesting that this matter be removed from the table and considered at the regular council meeting of November 15, 1982• Ada County Highway District comments of September 9, 1982 Comment 1. "Provide by dedication, 33 feet of right-of-way from center line of Linder to the parcel". Action: This right-of-way has been provided for in the pro- posed plan. Comment 2. "Relocate all irrigation ditches out of the rights- of-way. Prior to relocation, obtain written approval of the applicable jurisdiction". Action: Nine Mile Creek traversing the northeasterly corner of the property in a northwesterly -southeasterly direction will be piped to the most easterly boundary of'the development. The irrigation lateral running parallel to Linder Road will be abandoned as this ditch serves only the subject property. District comments of Sept. 9, 1982(continued) Action:(continued) South of the development will be fenced on the northerly side. Pursuant to approval of the pre- liminary plat, an application will be processed with the Nampa -Meridian Irrigation District. Comment 3. "Provide for the installation of a five (5) foot wide sidewalk on the Dine Avenue frontage". Action: This has been incorporated in the proposed plan. Comment 4. "Provide full improvement to the East half of Linder Road abutting." Action: This has been incorporated in the proposed plan. Comment 5. "The access to Pine Avenue is approved. Direct lot access to either Pine Avenue or Linder Road is pro- hibited. Delineate the restriction on the final.plat". Action: The proposed plan incorporates this restriction and said restriction will be noted on the face of the final plat. Comment 6. "Redesign the entry street (increase the 55 feet radius) to accomodate 25 mph traffic with consideration for on street parking". Action: The alinement has been revised retaining the 55 foot radius on the first curve as this curve is in the stop sign approach zone. The second(reverse) curve has been increased to a 155 foot radius consistent with the de- sign speed recommended. This change will also enhance vehicle entry and exit from lots 1 and 2, block 2. All lots have been designed to include off street parking - on street parkinn should be discouraged. COMMENTS: These comments pertain to the preparation of the final plat and improvement plans, and will be addressed in conjunction therewith. Council, city staff and agency comments received September 24, 1982 Comment 1. Central District Health Dept.: "�;te can approve this proposal for central sewage, central water,(improvement) plans for community sewage and central water. Street runoff is not to create a mosquito breeding problem". Action: Improvement plans will be prepared and submitted with final plat. Councilman Talsma: Only one entrance in and out and all dead end streets, extremely hazardous for fire protection and crowd control in case of fire. I would like to see the restrictive covenants before commenting further on this plat". Action: A second entrance to the development is planned to the East which will provide a loop road returning to Pine Avenue further East. (see attached concept plan). A temporary culdesac will be provided at the southerly terminus of West 15th Street until Phase 11 is developed. Draft restrictive covenants are attached for your con- sideration. Comment 3. Ada County Highway District letter - see separate dis- cussion above. Comment 4. Roger Welker, Fire Chief: "Too many Mobile Parks now. Loop water main, two (2) entrys, one off Linder. Fire hydrants shown. Size and placement of water mains. No parking in culdesacs and entrances. Street names for culdesacs. Action: Development is a Mobile Home Subdivision, as opposed to a space rental park. Lots will be sold. Demand is evident as client reports he has firm expressions of in- terest on 23 lots. Water main will be looped through Phase II back to existinn main in Pine avenue. Fire hydrant placement, size and location of proposed water mains indicated on plan. Recommend that all streets be re'tricted to no parking. Suggested culdesac street names on culdesacs are open for modification pending more specific in=put. Planning and Zoning Commission - action of October 12, 1932 The commission recommended approval of a Mobile Home Park Permit and the tentative plat for Brooklawn Farm Estates Mobile Home Sub- division, subject to the following: Comment 1. "Connect to city water and sewer". Action: This has been provided for in the.plan. Comment 2. "That a solid fence be placed on Linder Road and Pine Street". Action: This has been provided for in the plan. Comment 3'. "Provision be made for street access to the property on the East. Action: This has been provided for in the revised plan. Councilman Talsma: "There almost has to be a loop or some way to get in and out of there". Action: Concept plan for Phase II wan displayed indicating that full development would provide for loop road back to line. Comment 2. Gary Smith, City Engineer: (1) "Direction of street drainage - How is runoff to be handled?". (2) "Right - of way requirement by Ordinance is 60 feet". Action: (1) Drainage plan depicted on revised preliminary plat. (2) A variance is hereby requested from this provision of the ordinance. Owner requests that rights-of-way be approved at 50 feet with the trade-off being a 5 foot exclusive easement to A.C.H.D. parallel to and contiguous with the right-of-way. We note that this consideration is common in the city in developments which are designed to provide off-street parking. (3) "Culdesac or dead end street shall be no longer than 400 feet". Action: (3) The concept plan for Phase I and II addresses this requirement. Until Phase II is opened there would be an effective culdesac in excess of this length, however, since this situation will be temporary, we request that a temporary culdesac be accepted on an interm basis. (4) "Direction of sanitary sewer and domestic water service and connection to city lines." Action: (4) These have been indicated on the revised preliminary plat. (5)"Ordinance also requires the tiling or fencing of irrigation ditches, laterals, or canals". Action: (5) a. Nine mile ditch will be tiled throught Phase I. b. Rutledge lateral will be fenced. c. irrigation ditch along Linder will be abandoned. d. Irrigation ditch along East boundary will be fenced. (6)"Front yard set back 25 feet". Action: (6) We hereby request a variance from the standard set- backs. We request the following: Front yard - 10 feet Side yard -- 5 feet Rear yard -- 5 feet The rationale behind this request is the configuration of mobile homes and the access thereto negate the utilization of front and.rear yards and -emphasize the use of the side yard nearest the main (front) door of the units. Gary Smith, City Engineer:(continued) (7)"Owner of land adjoining to the East". Action: (7) indicated on•revised'prel•imihary plat. (8)"Nampa-Meridian Land Use Change and Drainage Res - solution adopted, March 17, 1980, that should be gone over". Action: (8) in reference to comments received from District in September, 1982, a formal application and modification plans will be transmitted to the District pursuant to city approval of preliminary plat. Comment 3. Roger Welker, Fire Chief: reiteration of September comments. Action: Addressed earlier. Comment 4. Councilman Talsma: "questioned the possibility of a temporary turn -a -round at the end of the street until the loop could be completed". Owner, Dean Rule stated that it could be done that way. Action: Indicated on revised preliminary plat. Comment 5. Request for variance from 5 foot wide to 4 foot wide sidewalks denied. Action: 5 foot wide walks will be provided for in the preparation of the improvement plans. Additional items not addressed in the previous reviews and comments, are as follows: Item 1. Block length exceeds that specified in the ordinance. Action: This will be remidied when Phase II is constructed; and on an interim basis. We are providing a temporary culdesac as a trade-off. Item 2. Street light - placement Action: Street light location has not been indicated on the preliminary since placement will be contingent on the approved configuration of the plat. The owners, however, aware of the city's requirement, intends to provide "High Pressure Sodium Vapor Lights", so situated to- comply ocomply with the city lighting standards. SUMMARY: The primary intent of the proposed'develonment is to provide quality sites for mobile home living for adults. Since a significant percentage of the purchasers will be in the senior citizen catagory, design emphasis has been placed on low maintainance and high security. To effect these concepts; the lot size has been held to a nominal size of 4,500 sq. feet. SUMMARY:(continued) fence and the development will include "High Pressure Sodium Vapor" street lights; the streets, while public, will be a loop system with culdesacs, the reduced right-of-way widths incorporating a concrete valley gutter at the loop terminus will minimize unnecessary entry of the general public thereby enforcing the security of the neighborhood. There appears to be a significant demand in the marketplace for this type of residential lot. The owner indicates that, as of November 1, 1982, he has received 23 offers to commit to purchase a lot, subject to the approval thereof. We also note that the owner has received unanimous consent from the adjoining.property owners, indicating a strong public acceptance. Based upon the evidence of public acceptance and public need; and the recommendation approval from the Planning and Zoning Commission ; We hereby request your favorable consideration of the preliminary plat for Brooklawn Farms Estates,Phase I. No tent or other make shift dwelling may be maintained or used on any lot prior to the location of a mobile unit on said lot, except that a garage or other small building permanent construction not intended for habitation may be erected for the storing of tools or other personal property prior to the occupation of the lot by a mobile dwelling unit. 5. EXCAVATION AND DEFACING OF LANDSCAPE: No excavation shall be made on any building site except such as is necessary in the location of a mobile unit thereon and the soil of any lot shall not be left bare to erosion by wind or water. 6. Dogs must be kept in the house, on a leach or in a run no closer than five (5) feet of your lot line. 11. TERMS OF REGULATIONS: These building regulations and covenants shall run with the land and shall be binding upon all parties hereto and all person claiming under them until , at which time said regulations shall be automatically terminated unless the owner or owners of legal title to not less than two-thirds of the building sites, by an instrument or instruments in writing, duly signed and acknowledge by them amend or extend said build- ing regulations, and such amendment or extension, if any, shall become effective upon the filing of any such instrument or instruments for record in the office of the Recorder of Ada County, Idaho; such instrument or instruments shall contain a proper reference to the plat of BROOKLAWN ESTATES SUBDIVISION as recorded in the records of Ada County, Idaho. 12. ENFORCEMENT PROVISION: If any person shall, at any time, violate or attempt to violate any provision of these protective covenants and regulations, every other person owning any real property within the subdivision shall have the right to prosecute any proceedings at law or in equity against the alleged violator either to enjoin him from further violation or to recover damages for past violations. These protective covenants and regulations are hereby declared severable, and any invalidation of any provisions, sentence or paragraph contained in these protective regulations and covenants by any court shall not in any way affect or invalidate any of the other provision, sentences or paragraph hereof. 13. EXCEPTIONS: The foregoing Code of Restrictive Covenants shall apply to all properties within BROOKLAWN ESTATES SUBDIVISION excepting that lots usedtemporarily by the developers during the construction and sale shall be excluded from said provisions. 14. ARCHITECTURAL CONTROL COMMITTEE: There is hereby created an Architectural Control Committee composed of three members, which are Dorothy Rule, Dean Rule and Betty Biddick. '•!hereupon an election shall be held to elect the Architectural Control Committee. One member shall be elected for a three year term, one member shall be elected for a two year term, and one member shall be elected for a one year term. Thereafter an annual election shall be held to elect or re-elect one member. Should a vacancy occur the two remaining members shall by appointment fill said vacancy. 15. WAIVERS: Specifications of each mobile dwelling proposed to be placed within BROOKLAWN ESTATES SUBDIVISION shall be filed with the Architectural Committee, and its placement therein shall be approved by that committee'before said mobile home may be placed on a location within said subdivision. The plans and specifications for any other building to be constructed within said sub- division shall be first submitted to said Architectural Committee and the actual construction thereof deferred until approval of that committee has been given; provided, however, that should said committee express neither approval nor rejection, its failure to pass upon said application for a continuous period of ten days shall be construed as consent to the proposed dwelling or construction of other buildings. The Architectural Committee shall have and hereby is granted the right to refuse to approve any design, plan, color or type of construction which it deems unsuitable or undesirable for any reason, aesthetic or otherwise. In passing upon such design, said committee shall exercise reasonable judg- ment, shall have the right to take into consideration the suitability, type of st=ructure, material of which it is to be constructed, as well as the exterior color and the harmony thereof with the immediate surroundings. The Architectural Committee shall also have right to waive minor in- fractions of these regulations if in the particular circumstances where the waiver is sought the same may be granted without discrimination and without adversely affecting the aesthetic appeal of the subdivision.
