HomeMy WebLinkAboutBroadway Estates Westi 283 ORDINANCE NO. 404 AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: A PART OF THE NE 1/4 OF THE SW 1/4 OF SECTION 12., T.3N., R.1W., i B.M., ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. i WHEREAS, the City Council and the Mayor of the City of Meridian, have concluded that it is in the best interest of said City to annex to said City certain real property which is described as follows: BROADWAY ESTATES WEST ANNEXATION Parcel 1: A part of Lots 1 and 2 of Westlawn subdivision, according to the Plat thereof filed in Book 2 of Plats at page 94, records of Ada County, Idaho, more partic- ularly described as follows: Commencing at the Northeast corner of said Lot 1; thence West 126 feet along the South line of West Pine Avenue; thence South 125 feet to the real point of beginning; thence continue South 412.19 feet; thence West 528.40 feet; thence North 77.12 feet; thence East 130.0 feet; ` thence North 335.07 feet; thence East 398.40 feet to the point of beginning. Together with all water, water rights, ditches and ditch rights of way appurtenant thereto or connected therewith. Bruce McDonald stated that there were other interested parties that could not be at the Public Hearing. Mayor Glaisyer stated that the Public Hearing was closed, and there would be a decision by the council, but that anymore public input would not be accepted. (Tape on file.) The Motion was made by Kingsford and seconded by Tolsma to table the Conditional Use Permit request in the May 3rd meeting, or earlier, so long as all interested parties are notified. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, yea 4 Item 6 Hearing - Pretermination Water, Sewer, Trash Delinquencies Mayor Glaisyer read the TURN OFF NOTICE to the public: "This is to inform you in writing, if you choose to, you have the right to a pre -termination hearing, at 7:30 p.m. April 19, 1982, before the Mayor and Council, to appear in person to be judged on facts ani defend the claim made by the city that your water, sewer and trash bill is deliiquent. You may retain counsel. This service will be discontinued April 22 unless pa_,ment is received in FULL." Mayor Glaisyer: s the -e anyone here tonight that wishes to appear regarding your Water Sewer or Tragi bill?" There was no response from the public. Mayor Glaisyer: "If not, they are hereby informed that they may appeal or have the decision of th,. City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Ev,�n though they appeal, the water will be shut off." Fire Chief Welker questioned placement of fire hydrants, and stated that this is a dead.end water line — Washington should be loop water line. Marks stated he had talked to the Fire Marshall who suggested that this be .. brought down to one of the center lots this could be adequate. This would be d less than 300 feet on either side - the fire hydrant. Welker: "We need two fire hydrants - ne on East State and one on Washington." e wo g `Mayor questioned if this would be a public utility on a private drive. Kingsford: "I not sure I agree with that street being dedicated all the way down in light of it most likely will -not ever be developed - I not sure that I wouldn't rather it remain a private lane." Brewer: "I did not realize that the property was tied up to the West. This is the problem that has happened to this property all the way along. This concept is beautiful for this property." Dan Wycherly, American Realty,and Jim Howard of J.J. Howard Engineers was present { representing the Annexation request of Lorin Saunders Broadway Estates West. Wycherly: "We are proposing an annexation and rezone to "A" Residential of property located adjacent to 8th Street and Broadway." (Wycherly displayed map indicating the are) "Approximately ten (10) acres are involved in the project. Broadway Estates i West will consist of Townhouse units and be in the price range of $45,000 to'$50,000. Due to the economic times, we plan to do a very conservative phase development with the -first phase consisting of four to eight units. You have a conceptual plan and we would like to emphasize that this is a conceptual plan and we do have plans for professional landscaping making it a very pleasant, family oriented, type of Subdivision - to make it a type of property that would improve areas that are adjoin- ing it. We plan to have common careas for playground and recreational areas. The Property is contigious to the City of Meridian and there is City water and sewer at adjoining property. We would also like to emphasize that we are anxious to develop this property in such a way as to meet the desire of the City of Meridian for the, growth and development of the community and make it a place where people will be proud to. live as families." Councilman Tolsma: "I have property that borders on the north side and a lot of the property owners that live on both sides of me are already displeased with the kids cutting back and forth across their yards for a shortcut. All residents that I have contacted are totally against this unless there was a possibility of a six foot high fence, or some other means of deterrent, that would run the full length east and west,and also north and south on the west end." " Motion Carried: Kingsford, yea; Brewer, yea; Orton, yea Tolsma, nay Agenda 1 .4 HEARING - Wallace Lovan Conditional Use for Golf Course Club House 9 Mayor Glaisyer: "Public Hearing is open for a Conditional Use Permit.for Cherry 1 Lane Rec.,i Golf Course Club House." Wallace Lovan: "I am representing the Cherry Lane Recreation Inc. which is known as the Golf,,Course. I am before you for a Conditional Use Permit to facilitate a club house for the golf course. This is coming about because the leaving of the neighborhood of the Real Estate Agency that had been leasing from the agency for '','-three years now - we will have a new agency and the agent wants to sell the clubhouse. The price for the existing clubhouse is just beyond what the golf course can afford - so therefor I am applying for a temporary clubhouse until such time a road and j utilities are driven back where the final clubhouse will be built." ICouncilman Brewer: "First, you are not going to make a Mobile Home Park out of this?" Lovan: "Absolutely not. Brewer: "Second, can you explain your procedure on setting the unit?" Lovan: "The procedure with the mobile home on the grounds would be properly planted so it would look nice. It would be fully landscaped and standards that I could live with in operation of the golf course. There will be asphalt and grass around part of the clubhouse." Brewer: "It's my personal opinion that it is the only alternative for Wally and the City. Mayor Glaisyer: Have you acquired the necessary signatures? Lovan: "I think I have acquired the necessary signatures." Councilman Kingsford: "Is there any problem with hooking up to the utilities?" Lovan: "There is no problem with the input., ,I have talked with Bruce and Earl, and, I have talkedwith'Idaho 'Power, 'etc:" Kingsford: "I certainly.don't,have any problem and I know Wally will do a good job with it. I was' pleased that the Homeowners Association has especially appeared for that." Don Sharp stated that the City as an "Old Towne" area designated in the Comprehensive Plan and that any reference to any other area as "Old Towne" as,shown on Catherine Park Subdivision development plan should be deleted. Potter stated that this reference was taken from a Chamber of Commerce map. Commissioner Bob Spencer questioned the 25foot width of Catherine Lane for emergency vehicles. Potter stated that at such time that the property (to the west) is developed,the remaining 25 foot easement, or dedicated right-of-way, and will allow for the full s development of the street. Hinrichs: "The Fire Department comments that Washington Street should be carried through - isn't it?" Potter: "Yes" "Washington Street, in the development plan of the northeast sector of Meridian, shows East Washington Street crossing Five Mile Creek." Mitchell: "Technically this (Catherine Lane) would be a "no -parking" street." We are saying that this should be built as 1/2 Street standard so if this other is improved the City can require that dedication." Wycherly stated the land is adjacent to 8th Street Broadway and that the proposed annexation to be zoned residential is to be called Broadway Estates'!West. 'The concept plan consists of townhouse units in the price range of $45,000.00 to $55,000.00. Wycherly stated that they plan to do the project in phases due to. economic times. Fire Chief Roger Welker: I have nothing against the Annexation - but cannot agree with the concept as presented. 2. Councilman Grant Kingsford: 1) I have no problem with this annexation. 2) In development plans - who will own sewer & water lines? 3) Who will own streets? 4) Does the density meet P&Z thinking with regard to Comp. Plan? 5) Would like to review restrictive covenants 6) Does development contain garages? 3. WasteWater Supt, Earl Ward: No recommendations at this time 4. Councilman Ron Tolsma: I have contacted most of the property owners bordering this property to be annexed and all I have contacted said no annexation at this time - partially due to the fact that kids going to and from school are now cutting across yards and other private property to get to school. Possibly some property owners would reconsider if a suitable vertical 6 ft. wood fence were built on two (2) sides of property - north & west, before andy housing or developing starts. 5. Ada County Highway District; Since the application is for annexation only and assuming the development will be platted in the future, our comments are very general in nature. The recommendations are as follows: 1. Broadway should be extended west through the parcel as a dedicated public right-of-way. Broadway is the only east -west connector between Pine and the railroad, a distance of almost a quarter of a mile. Currently, a strip of land 58' wide by approxi- mately 160' long has been dedicated for the extension of Broadway to the west from 8th Street. 2. Provide for the dedication and provide for the full improvement of Broadway through the parcel. 3. Provide a barricade at the Broadway termination and a barri- cade at the current north termination of 8th St. 4. Provide for the installation of a sidewalk on the west side of 8th St. for the street section abutting the parcel. 5. Relocate any irrigation/drainage systems out of the public right-of-way. 6. All dedicated streets to be installed to Ada County Highway District standards and specifications. 7. Submit street and drainage plans prepared by an Idaho Registered Professional Engineer. 8. Prior to the approval of street and drainage plans by the Highway District, the developer shall obtain written approval from the cognizant irrigation/drainage jurisdiction (District, Users Association, etc.) on relocation, design and installation of the system.
