Franklin Road Meridian, ID 83642 Re: Arnie Subdivision Section 7; T3N; R1E; B.M., Ada County, Idaho Dear Mr. & Mrs. Stutzman: On May 13, 1982, the Commissioners of the Ada County Highway District (here- after called "District") approved the Preliminary Plat subject to the following conditions: 1. Provide by dedication 30' of right-of-way from centerline of East Pine to the parcel. 2. Provide full improvement to the north half of East Pine Street abutting. 3. Relocate all irrigation/drainage ditches and fire hydrant out of the Pine Street right-of-way. 4. Provide for the vacation of East State Avenue east of the cul-de-sac or provide for a suitable right-of-way exchange. 5. Cul-de-sac radius on East State Avenue to be 45' back of curb and 50' to property line. 6. Provide for the additional right-of-way required from the property owner on the west for the cul-de-sac at the East State Avenue termina- tion. 7. Individual lot access to the collector, East Pine Street, is prohibited. Recommend a frontage road with a single entry to Pine be employed. 8. All dedicated streets to be improved to Ada County Highway District Standards and Specifications. Drainage plans shall be submitted and subject to review and approval by the District. 2. If Public Street Improvements Are Required: Prior to any construction within the existing or proposed public right-of-way, the following shall be submitted and subject to review and approval by the District: a) One complete set of detailed street construction drawings prepared by an Idaho Registered Professional Engineer together with payment of plan review fee. b) Execute.an inspection agreement between the Developer and the District together with initial payment deposit for inspection/ testing services. c) Complete all street improvements to the'satisfaction of the District, OR execute surety agreement between the Developer and the District to guarantee the completion of construction of all street improve- ments. 3. Furnish copy of final plat showing street names as approved by the Local Government Agency having such authority together with payment of fee charged for the manufacturing and installation of all street signs as required. 4. If Public Road Trust Fund deposit is required, make deposit to the District in the form of cash or cashier's check for the amount specified by the District. 5. Furnish easements, agreements: and all other datum or documents as re- quired by the District. 6. Furnish Final Plat drawings for District acceptance certification and endorsement. City Hall Meridian, ID 83642 Mr. Mayor and members of the Council: With respect to my current agreement to purchase lot 7 of the proposed Arnie Subdivision located at the east end of State St. and within the Meridian city limits, I would at this time like to request special permission from the council to begin construction on my principal residence to be located on said lot. It is my understanding that special permission from the Council is necessary to begin construction before the completion of utilities services and the approval of the final plat. I would like to call attention to the following factors: the preliminary plat has been approved, Utility construction has begun, and Mr. Tom Marks has obtained special permission recently to move a modular home into Catherine Park Subdivision immediately to the north of Arnie Subdivision prior to utitity construction. Within these easements no structure, planting or other material shall be placed or permitted to remain which may damage.. or interfere with the installment and maintenance of the utilities, or which may=:change. the direction of flow of water through drainage channels in the ;easements. Located-at the easterly edge of the present city limits of Meridian, the site is part of that mixed-use review area identified in the Meridian Comprehensive Plan as "Old Town". The proposed project contains approx- :;,; imately 2 acres and is defined as that block of -land bounded on the north by E. Washington Avenue; on the south E. State Avenue; on the east by 5 Mile Creek;'and on the west by the protracted alinement of E. 6th Street. The tract has adequate topographic relief `to :insure good drainage and sewerage gradients. It is primarily valley lands which have been leveled for agricultural purposes. Abating the property is Five Mile Creek. This waterway .will provide a natural break for screening from adjacent uses. This material has a relatively slow permeability rate permitting only shallow rooting penetration. Due to these factors, agricultural use is limited. There is sufficent loam to ensure good vegative growth, and the site drain- age-way located. in .the sub-surface gravely sands will provide excellent drainage for development purposes. This piece of property is a very real problem and believe this would compliment it's use. 3) B1 dg. Inspector, Vern Schoen: The best design I have seen on this property. Woodward; Earl Ward; Gary Smith; Gene Kindred, Wayne Crookston; Penny Webb Minutes of any prior meetings were dispensed with at this time. ^• ~ .Item 1 John O'Connor; American Legion Baseball at Storey Park - Concession Stand Request Mr. O'Connor stated that he is involved with Legion Baseball and that the club is looking for ways to generate revenue. An obvious way would be with concessions. These concession sales would be limited to Legion activities during the baseball season. _ There would be no sale of beer. Any revenues from the concessions would go to the ~`" ball club, and hopefully start a funding source fora perment stand at the park. Rick Orton stated that with .the work completed last year at the park, the City is open to allow the temporary concession stand. Mayor Glaisyer questioned any problems on clean up. O'Conner stated that clean up was no problem. Bruce Stuart gave a positive report on the past clean up. He stated the only problem was • in the dug-outs themselves. He displayed maps of Arnie Subdivision to the Council. He stated that they have received approval on the preliminary plat, and that y~: the construction of the utilities has been started. Gary Smith, City Engineer questioned the placement of the sewer. Allen stated the line is to come thru Catherine Park to State Street, and then South to the Centerline. ;' Smith pointed out that a5 of last Friday, there still is no easement for that sewer line. • , Wayne Crookston, City Attorney: "I don't recommend the variance. It is a premature approval." Allen stated that he hoped to have the final plat before the Council in July.. -~ Brewer: "You could build the most beautiful home in the world out there, but if you can't get water and sewer to it, it is going to be worthless. I wouldn't feel right _ letting Mr. Allen start building notknowing if he's going to get sewer and water out there:' °;> Allen stated that he is aware of the risks involved. Bates stated that he felt that this '~' ~ was not his expense. Kingsford explained to him the City Ordinance that requires the owner of record be - responsible for the water bill. Mr. Bates admitted that he was the owner of record at the time the bills were incurred. Mr. Bates stated that he felt the water bill due should have been taken out of the liquor license money that was refunded to Mr. Nelson and Mr. Denney. There was much discussion concerning the billing. (Tape on file) `:~; Bates stated that the money due the city had been taken out of the closing costs by Pioneer Title, and that they had mailed the check to the city. .` Mayor Glaisyer pointed out that as of now, no monies have been received by the city on this account, and he would call Pioneer Title and check on the funds. June 21, 1982, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made. by the City that your water, sewer and trash bill is delinquent. You may retain counsel. This service will be discontinued June 24, 1982, unless payment is received in FULL." Mayor Glaisyer: "Is there anyone here tonight that wishes to appear regarding your Water, Sewer or Trash bill?" '~' Terry Woodward, 1535 E. 1st, was present to contest his billing. There was much discussion concerning Mr. Woodward's billing. Councilman Kingsford: "Ulhat kind of a duplex is this that one side of it has '+:~ 34 feet and still has a sideyard setback?°' Allen displayed tentative plans and explained zero lot line and setbacks. There would be at least a single car garage, off-street parking for at least another car. Councilman Tolsma: "The P.GF-~ requirement for the frontage road would be for the off-street parking." h., Allen: "P_CI-iD did request a 30 foot right-of--way fran the centerline (Pine St.) and then. we P...xpect to be improving it with curb and gutter. Perhaps with the 30 feet there would be adequate parking space.'° Gary Smith, City ~gineer: "I think on collector streets ACf~ has in the past had a policy that they didn't want residential backing out onto that because of ~~~ the traffic volume through there. I am more familiar with arterials which are major thoroughfares ar_d are more rnstrictive access. Pine is a collector, on the right-of-way. situation, and the reason for my comment for 40 feet is that ~` on to the east, at the Bews Industrial Park, they have a 40 foot right-of~aay on ~'f the south side of the road. Pine existing up to this development, on the west of this development, was platted as 40 feet. This was the reason I continued on the 40 feet - I did not have ACM's comment at that time. . < Allen: "At this point the rightrof-orgy is only 25 feet so they (AC;~) did ask for sane extension of that." `-1. ~;;-. Smith: "Pine will eventually go through to Eagle ^toad - it will go through Upland Industries Annexation. The amount of traffic that it is going to carry ". from town to Eagle Road is, in my mind, questionable right now as far as volurve. ~`,' From Locust Grove F,oad to Eagle Road I can see there could be more traffic than from Locust Grove back to tovm." The improvement of ~r~est Pine was discussed under Councilman Tolsma's questioning and assumed to be what was wanted running straight through on East Pine. ~P11en stated there was no problem with a 40 foot right-of~vay as long as tY!ere ~~~'; was roan for the buildings. There was still the concern of the separate frontage T~ road. Earl Ward, Wastewater: "The all weather surface would be necessary" Gary Smith, City Engineer, stated that the sewer service for this property is contingent on sewer line being installed down Cathy Lane. Potter & Associates had informed him they would lower the grade of the manhole in East State so this could be extended to this property. Engineer ~::ary Smith, J-U-B tfiTGINEERS, INC., stated that Bob Sorcic, Ada County Highway Department, had contacted him and indicated that the concept plan that was submitted by Jim Potter shows a bike path on the west side of Five T~Lile Creek along Catherine Park Subdivision. Sorcic was wanting to ask for a seven (7) foot wide easement south side of that Subdivision which would be Lot one (1), and also a seven (7) foot wide easement along the north side of what would be Arnie Subdivision - for a total of 14 feet for bike pathway. There was discussion concerning the City's status on the bike pathways in this area, from Pine to Fairview. Smith stated that Sorcic indicated that all bike and pedestrian pathways would be maintained by the City Parks Departrnent. Councilman Orton stated that this reminded him of the issue that ACI'.~ raised seven years ago on drainage ponds -now they are going around trying to find someone to give the ponds to -they wont maintain them, they are eye sores, terrible wasteful ox~nnitr.~ent~ of ~~xx3 l~n~+. Smith: "When we first started the project the intent of the contract was to replace ~~~ the service line fr~n the service tap in the street to the residence at it's ~~~ foundation. As they began to open these things up we found several other problems existed with the Sewer lines, besides the residential service lines. In ~- many instances the length of pipe that was being replaced was different than the length of pipe we had shown on the plans -either the tap was not in the correct :. place in the street or it was not in the correct place at the house. The first item in the Change Order deals with the additional length.of pipe.
