The commissioners in the meeting revised the recommended requirements as follows: 1. Upheld the requirement for the dedication of 40 feet of right-of-way as measured from the centerline of Meridian Road to the parcel. 2. Agreed to the retention of the entry monuments in the right-of-way under a license agreement to be filed. 3. Approved the deletion of the requirement for deposit to the Public Road Trust Fund. My engineering firm currently has an application pending before the City of Meridian for annexation and zoning of an existing resi- ~~`~ deuce on North Meridian Road. The proposed use of the structure is for an office for my engineering firm. k. - Ina letter dated July 29, 1982, ACRD submitted recommendations to the City of Meridian regarding this application. A copy of the ACRD letter is attached. The purpose of this letter is to request an opportunity to f~° discuss these recommendations with the Commissioners at the next regularly scheduled meeting Thursday, September 2, 1982. r With regard.. to the recommendations, I would like to offer the following comments: ITEM NO. 1: I can agree to the dedication of additional property to provide '°' for a forty foot right-of-way. However, an existing thirty foot right-of-way now exists and it is my understanding that future ~:- ACRD planning anticipates the need for only thirty feet. They are located well off the edge `` of pavement and near the edge of the right-of-way. If possible, '~ I would like. to enter into a "license agreement" in order that the monuments can be preserved for the time being. ITEM NO. 3: ' This application involves no new construction, development ''' or subdividing. The application only seeks approval by the City ~,r of Meridian .to use the structure as an engineering office. The trust fund deposit recommendation presents an impossible and in my opinion an unfair burden upon my firm in going ahead with this application. For this reason, I would like to appeal this recommendation. ~~ I believe the trust fund policy has its place with regard to new subdivision development and construction or possibly with other types of major land use changes and construction. However, ~; in this case, the application will have no significant impact on traffic volume and specifically will not result in increased traffic volume on North Meridian Road... Additionally, there exist no plans in the next several. years for these improvements to be needed. The financial burden of this recommendation would make it impossible ~~ for me to continue with this application. I thought I would try to put in writing some of the thoughts I discussed with you on the telephone. Since receiving a copy of your letter dated July 16, 1982, I have gone completely through the Comprehensive Plan trying to find _~°~ where the proposed application might be in conflict with it. The result was tihat I found nothing whatever in the Comprehensive Plan that would indicate a conflict with the proposed application. As. I mentioned, I was somewhat involved with the preparation of the Comprehensive Plan document. The main theme I continually heard expressed by Meridian City officials was that they did riot want to tie themselves down to specifics in the Plan. They wanted to be left with total flexibility in making land use decisions based upon a multitude of factors which are in constant flux in a growing community. Making the Plan specific and rigid, they thought, might place them in a "Catch 22"`situation of having to approve something they did not want, while at the same-time having to deny something they did feel was beneficial to the City. The vagueness and non-specificity of the Plan, therefore, was very purposeful and was done solely so City officials could make individual decisions related to the benefits or non-benefits of each indivi- dual application. The above view is expressed•throughout the Comprehensive Plan document but is particularly addressed on Page 6 of the Plan under the title "Policy Diagram." One statement .was found .on Page 16, subparagraph 9, under the heading title "Economic Policies." Subparagraph 9 reads as follows: - ~S, - -' 9. Office use can be, but may. not necessarily be, V ~' integrated within neighborhood, community, re- gional shopping centers and Old Towri. . t.,. - _ This statement is specific on the point that, at the discretion { `,'.> of City officials,. office use of property within.a "neighborhood" '''"' can be approved without any conflict with the Plan itself. This '`' statement alone would seem to indic~.te an amendment would not be ~~~fl necessary for this application as the property in question is ~~.` specifically located in the North Corner neighborhood as shown ~~ on the Meridian Policy Diagram. ~ ; ,. Another statement in the Plan which I believe would support this application can be found. on Page 51, subparagraph 2, under ,' `4` i the title "Special Areas Policies." The statement reads as ,, , follows: ~~ 2. Another statement similar to the above can be found on Page 28, subparagraph 2, under the title "Policies." It reads as follows: 2. Every effort shall be made by the City of Meridian to encourage commercial and industrial growth and development, which furthers employment and economic- self-sufficiency and reduces Meridian's present reliance on Boise's Metropolitan economic and employment center. In summary, there are several statements in the existing Comprehensive Plan which would indicate that this application is in conformance with the Plan., Additionally, I could find no statements which would indicate a potential conflict with the Plan. ~ - .In your letter, Wayne, you have indicated that you have only briefly reviewed the conformity of the application with the Comprehensive Plan and that amore detailed review would be necessary at the request of the City. If amore detailed review is undertaken, it is hoped this letter might be of some help in completing that review. It is also-my hope that a more detailed • ,review would indicate that th,e application is in conformance with the objectives contained in the Plan and that we could therefore 'move ahead with the schedule we had originally envisioned. Ted Gwin, State of Idaho Transportation CITY OF MERIDIAN TRANSPORTATION PLAN MAP Ted Gwin, from the State of Idaho Transporation, was present to answer questions that the Council might have concerning the Meridian Transporation Plan Map. Mayor Glaisyer: In view of the year 2000 Transportation Plan Map that we are currently trying to adopt „ we are concerned about funding for the Eagle Road Interchange, and also for-the Meridian-Kung proposed changes, if they are inside the rural area or outside. How would that effect funding for the City of Meridian?" Gwin: "State Highway 69 from Kuna to the ~~leridian City limits is on Federal Aid Secondary Funding System. Accord~:ng to Federal regulations secondary funds can not be used for constuction within the Urban area. State Highway 69 within the Urban area would have to be funded with Urban funds. Eagle Interchange, as far as the Interstate system, can either be funded with private donation, should the Quong development go through, or it could be funded with Interstate funds." ACI~1J was concerned about t?~ose because they would fa11 within this new dedicated rightrof-way 3) Approved the deletion of the requirement for deposit to the Public Road Trust Fund. City Clerk congirmed that Keith Jacobs, ACID, had reca?tunended item -~l and ~2 letter of request be upheld and tza.t the item #3, Road Trust Fund be deleted. Hosac stated that the ACT-ID has a "license agreement" that the monuments are not a traffic hazard and they can remain, ua place until such time they decide to widen the road, The two monuments-are a good 6 to 10 feet off the edge of the existing pavement. T'osac central District Health had indicated they could approve the project for individual water and commented that the existing septic tank should be inspected by them. I contacted Nancy Goodell (CDH) and in lieu of coming out and inspecting the septic tatak, Yf we could indicate to her that the size of the existing septic tank and also whether it had been serviced or pumped within the last couple of years, that would be adequate, Mr. Anderson, property owner, furnished a letter which I sent to Nancy.~x~.dicating the septic tank had been pumped within the last two years and the septic size being 1,000 gal. Road with zoning of "C" Commercial. Hosac: "I would like to utilize the house for an office for my Engineering Firm. ' `That i.s my main and only objectave.°° "I feel that it would be a benefit to the City. As pointed out, this has been a residence for many many years and I feel that it is a. landmark in the consnunity." "Annexing and zoning it for this use would be a means 'of Preserving the house.°' "As you ]aiow, Wayne Crookston, City Attorney, has submitted a letter raising some question as to possible conflict to the Comprehensive Plan." -I went through the Comprehensive Plan, through the whole document, and I failed to find any statement of any kind which would indicate that annexation and zoning of this .property for this use would conflict with it. In. fact, T found several statements that would actually support it.°' '°Office use can be, but may not necessarily be, intergrated wa.thin neighborhood, c:onarnu~ity, regional shopping centers and Old Town." °'I did find other statements in the Comprehensive Plan that limbed support but the most direct statement was the one I just quoted." ,."It states that office use can be approved within the neighborhoods, I think that is the strongest statement of all." "Z could not find any statements in t~~.e Comprehensive Plan •than even inferred that it would not be a proper use." Iiosac spoke to the comments that were received from ACRD. "I have talked to ACI-ID, and they basically said "come on down and let's talk it over°', what I would like to do in regard to the AC~iD comments is go to the Commissioners between now and the time . it comes before the City Council and work out scene kind of agreement with them." °'~ think that we can work something out.'° ~iosac stated that he would contact CDHD for an on-site inspection to verify current s"" workab~.lity of the sewage system. The agreements that are necess~~~-v 'ro provide for that. I certainly wouldn't want to do anything that would create any c.isagreements or legal problems for anyboeiy as far as the responsibility to hook to the City services. I am in favor of seeing that it is done at the time the property is annexed. Maybe that isn't possible here. Maybe we should leave that up to the City Council and let them negotiate that.": ~. ,. Hosac: "The current policy is within 300 feet. I certainly have no problem at all in ~~gning that agreement with the City that when those lines ire closer or available... one of the problems on that ism order to bring Sewer and Water down to that one house you can°t just bring a 4" service line for the 650-feet or a 1 1/2 or 1" water service line, in order to do°it we would have to extend the major - I think it's a 10" water main -all the way down 'there, and in addition I think it's proposed 12 or 16 inch sewer trunk line down through that. The cost would ~ absolutely prohibitive for this kind of a deal. I •think the real solution in it is to agree with the City in writing that when the services are available that they will be hooked on tq." Sharp: °'This request is in compliance with the Comprehensive Plan. Therefore, we recor~nend that the City Council approve this plan subject to: 1) Resolving concerns of ACRD 2) Dedicate 40' Right of Way 3) Provide adequate parking at South side or rear of house. ~). Design review for any new construction 5) Negotiate satisfactory agreement with City regarding"connection to City Sewer & Water The Motion was seconded. by Spencer. Motion Carried: A11 yea tem 2 Art Collins; APA -Transportation Planning Area Collins stated that there was a committe appointed by the Mayor and Council to work on the short term and long tezzn transportion planning. The project_is now conaning to a close. Collins: "The process of this is first the committee makes a recon~nendation to the P&2, then the P&Z makes a recommendation to the Council. The transportation plan of Meridian is then sent to Ada Planning Association Board. The transportation process i~ an inter-govertal thing." Collins did not thnk Federal regulations require a hearing. The recommendation >°would be whatever would best fit a public process and for Planning and Zoning to decide. He stated that t1•iis plan should be completed by mid September. Chairman Hinrichs stated -that -trhe committee has decided that halfway between Cloverdale and Eagle Roads, halfway between Ustick and McMillan Roads, halfway between Black Cat and McDermott Roads and halfway betvaeen Victory and Amity Roads would be designated as the Meridian Transportation Planning Area. Collins suggested that all these roads be called. within a "Resourse Area" and stated that it is important to designate these roads that effect Meridian so that Meridian will have access to Federal funding. The future proposed collector streets were discussed and designated by dotted lines on the T?~ansportation P~7ap di Jplayed. Making Locust Grove Road a through street through Bews and Smith Industrial Park was discussed. Other commercial busi- nesses do exist to the northeast and south of this property although I, realize that•they probably exist due to "grandfather" rights. However, I believe the close proximity :of this property to Cherry , Plaza and the probable significant future com,-nercial expansion of "~ the Cherry Plaza corner lends the area of this property to limited office type zoning as a buffer bet~aeen•hard retail commercial and residential environments. ~ ~ • •My specific•plans would include use of the property for my enginee"ring business.
