Idaho 1 Kingsford: "Public Hearing is now open" Calhoun: "I am in fora Saw Shop and Fix-It Shop construction at 331 W. Idaho, when I thought I would go into a small engine tune up I was told I would have to have a fire safe building. I have brought up some sketches (distributed to Council) and to how a building would set on my property." There was discussion concerning property lines. Calhoun: "The building will be back in here (designating on sketch) five feet i~rom the property line on both sides, twenty-one feet to the north side of the building to the existing shed, sixty feet from the back fence to the outlined fence on 4th St., about forty-one feet from the west face of building to the gravel driveway." Kingsford: "Vern, would that require a setback variance?" Schoen: "No" Brewer: "Have you been around to all of your neighbors and obtained the necessary signatures?" Calhoun: "Yes" Signatures were displayed by City Clerk. Kingsford: "You didn't find anyone in oppostion?" It does pose some hazard for being tied onto your house and as close to the neighbors. It's ~' too bad you don't have a separate little shed back there." About a 10 x 12." ;i There was much discussion concerning the construction of a metal building, the setbacks, etc. Mr. Calhoun stated that he would prefer building a separate unit. `~ Tom Eddy studied diagram with Calhoun so as to check setbacks. The Commission '" felt there was sufficient space but cautioned Calhoun about keeping items stored >'~ and not laying around. Tt was the feeling of the Commission that there would be no problem as long as the shop was out and away from the house, trees and neighbors. The Ada County Highway District's recommendation was discussed and it was the unaminous feeling of the Commission that Calhoun not be required to do the road • improvement. Mayor Glaisyer: "Start to prepare your budget" Coundilman Orton: "The City currently insoects gas line installations in Meridian, it requires a great deal of training and expertise that Bruce has told me several I';' times that he doesn't feel comfortable with. He can't keep people trained in this regard although he has been doing a super job over the years. He has also been wprking with Intermountain Gas to .find a way to give the responsibility of those inspections to experts. As a result of his efforts he got this offer from Intermountain Gas: "In reference to our recent conversation concerni~",g natural gas inspections in Meridian, we would agree to perf~~rming the inspections in Meridian under '~ the following condi~:ions: 1. A permit from the City will still be required on natural gas installations, 2. The City wi1^: continue to charge and collect their present permit fee, 3. Any installation 6y hntermountain Gas Company installers will also pay permit fee as any other dealer, but license for Intermountain Gas Co!~pany installers will be waived. 4. To conform to other City licensing requirements, a Meridian homeowner will 6e allowed to purchase a permit and do gas fits-;b~~, in his own residence without being licensed. When this proposal is accented, Intermountain Gas Company agrees to do all inspection in accordance -!~° ~`~.''.P,A. 54 and Idaho Fue? Gas Code requirements." Orton: "This is the offer we have been looking for in some time, as you can see it leaves us financially harmless - we still get our permit fees." Attorney Crookston: "Don't you have ~:~:e robber watching the safe?" Orton: "When they are the installer and ts~~ `:,s:pector yG~_R do have the fpx guarding the chicken coop, but it is standard practice and they co these inspections in several cities. Furthermore, the responsibility w':~en they do both t~~e installation and the inspection is in the hands of experts.- I don't fear them making a bad inspection because one of their installers put 't in. Stuart: "Since I have been working for the City I have only had training once and that was about ten years ago. - They change their codes every years maybe three times a year - there is no way to keep up with them." He stated that they want to specify the uses so they are very clear for record, referring to the Recommended Conditions of Approval. ~~; He again stated that the Fire Department's request would be complied with by allowing Lot 12 connection to Bower St. Anticipated first phase project to be ~~ next Spring. ~~ ~' Winston f~loore stated that they would appreciate to be able to proceed this Fall ~`'~~`' if weather permits. They have created a high quality Business Industrial Park. They intend to sell parcels with reasonable, but strict covenants; outside storage will be screened, not visible from Franklin. Property in question is located at the Northeast corner of Pine and Locust Grove. Their intention was to build a church, access being from both ~r, Locust Grove and Pine. Since purchasing the land, the impact has changed. It was their feeling that this would be better suited for Industrial. Their question was to what use they could solicit this property for resale. It was pointed out by Orton that the Comprehensive Plan does commence that area to Industrial development. a~,~°~n:genc;a ~;, 7 John Ewing - 6-Plex Proposal Idaho and 2nd St. ., Design map was presented. Ewing felt that design-fit lot, trees would be maintained, parking off alley, retired homeowners, and condominium type. Density was discussed. It was the feeling of the Commission that a four-plex would be acceptable to meet °~ ~~ building codes and density requirements. ~y _ 1 It was Ewino's desire to submit his proposal October 9, 1979. ~< ~k~.< Keith Stanley entered the meeting to discuss the Annexation of his property next to B & B Business Park. Stanley stated that he was not in favor of Annexation. The Commission discussed the advantages of Fire and Police protection and the problem it presents in approving B ~ B Business Park. It was pointed out that creating an enclave was against City Ordinances. :a:„t~ Pipkin stated that hook-up fees would be required upon Annexation. Sharp suggested that this problem be worked out between the property owners. ~,' Benda 8 Flannary, Oliver and Mrs. Lytle, owners of homes located on the P~ortheast corner of Cherry Lane and Linder. ~~ Flannary stated that the three homes are zoned Residential and this location has become very undesirable because of extreme traffic and noise. He stated that their ~Y~ concern was input for Commercial rezone. It was pointed out by the Commission that the Comprehensive Plan calls for Commercial ~kF` development on one of the four corners of an intersection. There is already one of those corners zoned Commercial. Ewing: "We have met all the setbacks and parking requirements and everything we need to do to meet the City Codes. 4Je have tried to make this a very presentable project using stucco, wood and stone and a lot of landscaping which will enhance the neighborhood." "Concerning the density problem, Mark has worked on that" Grindstaff: "We think the density isn't too great for the area, providing parking space, a large amount of landscaping There is a possibility that the Ada Cou~1ty Highway District may abandon a portion of West Idaho Street due to the fact that they only need a 60 foot right-of-way instead of an 80 foot right-of-way that is set forth now." Ewing: "It is quite important that with the money situation now that we go to a six plex to get the return on our money. As to our comments from the Meridian Fire Department, we have talked with the Fire Chief Roger Welker and we feel that we can solve all the problems with him - so I don't think we have any problem with them at all." When we contacted the Ada County Highway District on where they want the new sidewalks, they seemed to feel that this was a 60 foot right-of-way to contend ~,, with - so this would mean another 10 feet that could be abandoned." ,~Y` Ward: "One of the surface wells is located in the existing right-of-way"and if ~~ ~ the road right-of-way is cut down it would put that surface well inside the lot ~t by a considerable margin." ,_,. ~`` Brewer: "It look's by the way they landscaped it would be out near the tree." `}'- Grindstaff: "Our plans are to incorporate some of the mature trees into the ~~ landscape plan - it won't look all new" Ewing: "It will be sprinkled and I would like to also assure the City that on ~~` the landscaping we are willing to put up a Bond to do what we say we will do - ~ ~ we have full intentions with the landscaping and we will back this with a bond. w ~~ .. . ti We want it to look good and it will look good." ~: ~. Councilman Williams: "My concern is that which I have talked with Planning and ~,_ Zoning people, and that's the density. Our Comprehensive Plan calls high density s^' 8 to 15 dwelling units per dwelling acre - this figures 24. We had some reasons ~'; ~ for doing that, if we are going to go against our Comprehensive Plan I would like ~~ to know why and not just arbitrarily do it. It does look like a nice plan but I really have a problem with what our Comprehensive Plan says and what you are asking ~:,- to be done. " '~`~`" Ewing: "I think the economics of it should enter into it right now and how many "` four plexes are being built right now. We're hoping we can take a look at it as it is right now rather then a couple of years ago when building was good." ~-:' . Williams: "Why should the City take a more lenient position because of economic „_, °"'~" hard times. My business doesn't get any relief from any units of government ~,:~- because of the downtrend of the economy. I hate to see the fact that we spent a ~~w4 . lot of time and a lot of citizen effort to develop the Comprehensive Plan and then we say "the economy's down so let's just kind of throw it out the window for now" b:`;.., _ , I question the long term effect it will have on the City. The short terms aren't ~,, . just for a few." `~ Sara Ewing: "I felt like we should have higher density on that lot because it is ~` closer downtown and it is hard for people to drive cars and get around. We have to treat everybody equitably, if we've laid down some requirements and guidelines, then we're in the position ~* that we have to treat everybody equitably to find the reasons for the trade-off. My question is, what reasons do you have for the trade off.? Vern Schoen, Bldg. What prevents John from just getting a building permit?" `a1. Schoen: "Going back a year or two, we started to establish the plan we have, not ~~'- being adopted, then I started turning anything over duplexes to the Council - their ~. As far as the Ordinances you have now, I could Y; {: issue a permit tomorrow." ~~;- Brewer: "I've studied this pretty indepth - went all through the Planning & Zoning minutes and I have to agree with both sides. I have a very strong feeling ~~ for this gentlemen and I think in these times we do have to look at the time we're living in. I would like to see us consider granting a variance to the density and make it very clear in the minutes as to why it's done, it's not necessarily going to continue, but I think we should bend. I haven't seen anything like this for many, many months come before this Council. I admire these people's stamina '_`` for even setting down at the drawing board when times are like they are." ~~" Roger Welker, Fire Chief: "I have discussed the fences with John but I see Planning & Zoning want to keep the fences. I don't want them. That is a 16 foot :' alley and there wouldn't be room to fight fire. I have discussed this with John ~`` and there is no problem in taking the fence out. On the East side I want a cement deal instead of shrubbery for more area and more access in. They could see no problems with that." ~r ;s ~:-: y<' i ;. ,,- ` ~:: "~ ~:, Brewer: I have one more suggestion upon looking over your plans. For your fire safety, I"wonder if your roof line over your storage areas couldn't be extended over the patio areas, over the double doors, that would put a roof immediately under the upstairs bedroom where if a person come out that window could get onto the roof and drop to the ground." Ewing: "There's no problem with that. The reason the fence was put there was for privacy reasons for everyone. I will mention that the building is over a two-hour fire wall between the units and their designed just a~ if they were Condominiums, as such, so we feel we have a real fire safe building with the stone and stucco. As far as extending that storage, we have no problems doing that at all. We're open to suggestions to make the building better and we don't want the fire danger there either." ' Kingsford: "I agree on the density - we shouldn't set a precedent the same token on the width of that street and actually you should figure in from the center line when you are making a Subdivision, and also the alley - probab1y that density would come down very close to 15 dwelling units per acre, and the fact that our ordinances are not in place I would be willing to support it. with the amenities that we have outlined. I would like to see the bond. Hopefully the new ordinances will be completed soon and this will not set a precedent." The Motion was made by Brewer and seconded by Kingsford that the John Ewing and Mark Grindstaff Six-Plex (6-Plex) be approved and to be located at the NW corner of West 2nd Street and West Idaho, with a variance from the density requirement of the Comprehensive Plan; that they abide with the recommendations of the Fire Chief; that not in any way does this variance from the density requirements means there will be an onslaught of~~variances; and due to the closeness of the downtown area and for economic reasons this proposal be granted a variance from density; and that a Bond be provided to the City for landscaping and construction is completed as presented.
