Dear Mayor Storey and City Council;
It appears that there will be some conflict over
the City's action pertaining to the above referenced
property in making a statement to the Ada County Highway'
District that the City does not want Williams Street
to be continued on through from East 1st Street to t"
Meridian Road. Therefore, I will not be handling this {
matter either for Mr. Lembke or Timber Supply, Inc.
I am sending copies, of this letter to Mr. Lembke
and to Russell D, Hunemiller of Timber Supply, Inc. so
that they will know of my position on this matter, which
position I have previously explained to them. If either
party: desires further action on this matter before the
City Councili I have informed.then to•be present in person
at the City Council meeting to be held'on November 6, 19789

SEWER EASE'ENT
THIS INDENTUU, made this day of , 19 , between
the part of the first part, and hereinafter called the
Grantor—, and the City of Meridian, State of Idaho, a municipal corpora-
tion, the party of the second part, and hereinafter called the Grantee;
WITINESSETH
WHEREAS, the Grantor desire to provide a sanitary sewer right-
of-way across the premises and property hereinafter particularly bounded
and described; and
IMEREAS, the saniL-ary sewer is to be provided for through an under-
ground pipeline to be constructed by the Grantee; and
WHEREAS, it will be necessary to maintain and service said pipeline
from time to time by the Grantee;
NOW, THEREFOF-P, in consideration of the benefits to be received by
the Grantor—, and for the sum of Ten Dollars ($10.00) and other good and
valuable consideration, the Grantor do hereby give, grant and convey
unto the Grantee the right-of-way for an easement for the construction,
operation and maintenance of a sanitary sewer line over and across the
following described property:
A parcel of land 25 feet wide, the easterly boundary of which is
described as follows:
Beginning at the intersection of the Westerly right-of-way line
of Linder Road and the northerly line of Lot 3 in Section 23., T. 4N
R. 1W., B.M., said Lot being the same as conveyed to Clyde E. Simpson
by Warranty Deed Record No. 309, Instrument numbered 261977, Official
Records of Ada County, Idaho; thence southerly along said right-of-
way line a distance of 180 feet more or less to an angle point in
said right-of-way line at which angle point said right-of-way line
bears westerly a distance of 25.00 feet, said angle point.being also
the terminus of the easterly boundary of said parcel.
V The easement hereby granted is for the purpose of construction and
operation of a sanitary sewer line and allied facilities, together with
their maintenance, repair, and replacement at the convenience of the Gran -
,tee, with the free right of access to such facilities at any and all times.
TO HAVE AND TO HOLD, the said easement and right-of-way unto the
said Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties
hereto that the Grantee will timely complete the work of laying the
sanitary sewer line and restore the premises used therefor to a condi-
tion comparable with that existing prior to exercising this easement; that
in making future repairs the Grantee will expediently replace and.restore
the premises to a condition comparable to that existent prior to under-
taking such repairs and replacements.
THE GRANTOR hereby covenant— and agree that he will not place
or allow to be placed any permanent structures on the area described for
this easement which would interfere with the use of said described ease-
ment for the purposes stated herein.
IT IS HEREBY FURTHER AGREED that the Grantor do hereby give and
grant to the Grantee the right to use during initial construction an
additional strip of land described as follows:
IT IS UNDERSTOOD that the strip of land described in the previous
paragraph is for the purpose of constructing said sanitary sewer line
herein described, the same to expire when the initial construction is
completed.
IT IS UNDERSTOOD and agreed that the Grantee will restore said strip
to a condition comparable to that existent prior to the undertaking of
the construction of such sanitary sewer line.
The Grantor do— hereby covenant with the Grantee that lie—
lawfully
inlawfully seized and possessed of the aforementioned and described tract
of land, and that he ha a good and lawful right to convey said ease-
ment, and that he will warrant and forever defend the title and quiet
possession thereof against the lawful claims of all persons whomsoever.

I have been requested by Timber Supply, Inc. and
Ernest Lembke to obtain a letter from you indicating that
the City of Meridian has no desire to see Williams Street
physically extended from East First Street to Meridian
Road. Enclosed in support of that request is a copy of
a letter directed to the Ada County Highway District from
Chicago Title Company of Idaho which is self-explanatory.
Also, enclosed is a copy of the Plat of Williams Addition
to Meridian, Idaho, showing that the road was never dedicated.
I realize that this request is made on behalf of one
client of another of my clients, the City of Meridian.
Therefore, if this request is at all controversial, please
let me know and I will of course bow out and have Timber
Supply obtain other counsel. However, if you choose to grant
this request, please inform me.

Kingsford stated that it runs close to the building if cars were parked in there they
