Minutes of the previous meetings of January 28, 1980, special meeting and February 4, 1980 were approved as read. Agenda 1 Mayor Glaisyer announced that the City Council has come to the decision concerning the Cherry Lane Golf Course. Wallace Lovan has submitted the 1979 budget, proposed budget, lease agreements, letters of committment from Financial Institutions, and contracts for employment. Glaisyer stated that the City Council was ready to take the position of endorsing Wally Lovan to maintain and run the Golf Course for the upcoming season. The Motion was made by Orton Jr. and seconded by Williams to accept the material submitted to the City by Wally Lovan and along with the Mayor and Council's endorsement, submit to Mr. Leavitt and request his concurrance and if there are any other side issues that Mr. Leavitt contact Mr. Lovan directly. The Mayor read Ordinance #361, Rainey -Kuhl Annexation, entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: A TRACT OF LAND SITUATED IN NORTHEAST QUARTER, NORTHEAST QUARTER, SECTION 24, TOWNSHIP 1 NORTH, RANGE 1 WEST, ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. There was no public comment upon title reading. The Motion was made by Brewer and seconded by Orton Jr. that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days, be dispensed with and that Ordinance Number 361, as read be passed and approved. Mayor Glaisyer stated that with the power invested to him, he vetoed Ordinance #361 with the reason being that Rainey -Kuhl Annexation will be an undue burden upon the Police Department. He had.no qualms with the actual use of the property, proposed use of the property, but he felt the Police Department and the City does not need another bar that causes undue hardship. Until the property has availability for City wate and sewer facilities on site, the City should not extend its police powers. Meridian City Hall 2 - January 21, 1980 The Motion was made by Williams to allow a service line to the Church of God property across the Bodine property with an easement between Bodine Oil and the Church .of God be given to the City with the restriction that the use of this sewer line is personal to the Church. Stucker questioned if the Bodine property would be able to hook on the same service line in the future. The Engineer stated this could be a maintenance problem. Orton suggested that Bodine install a 4 inch line at the same time. The Motion was seconded by Kingsford. Motion Carried: Williams, yea, Kingsford, yea, Brewer yea, Orton, yea. Agenda Scout Annexation "C"- Located on East Overland, adjacent to LDS Deseret Industries. 3 .% Rex Black, Council Executive, was present to request that the one acre be annexed for the purpose.of Ore -Ida Council Administration. The building is 7100 square feet. The Mayor asked for public comment. Martin Igo spoke in support on behalf of Winston Moore, developer adjacent to proposal. The Motion was made by Orton and seconded by Williams to approve Scout Annexation "C" Commercial, subject to compliance of water and sewer requirements, design review, landscaping, construction of acceleration and deceleration lanes, fire and police approval, and subject to the proposed zoning ordinance. Motion Carried: Williams, yea, Kingsford, yea Brewer, yea, Orton, yea. Agenda 4 Meridian Glass Design Review-- 560 West Franklin Brent Barrus, owner, and James Gipson, architect, were present,representing Design Review. Gipson displayed drawing and stated that the existing house is structurally in good shape, the out buildings to be removed, the house to be remodeled into an office, the trees will remain, the new Meridian Glass building in the back to be used for light manufacturing and storage. The parking and drive will be by two curb cuts. There is a loading zone and a fire turn -around area, trash enclosure and fencing. landscaping will be preserved and added to. The fire turn- around was reviewed with Fire Chief Welker. Barrus stated that there would be'black top for access to the fire hydrant at the south end. Gipson stated that this pavement would sacrifice landscaping. Orton remarked that a steel grating could be used for fire equipment access across the lawn and a visual remedy for landscaping. Gipson stated that the curb cuts are existing now. Water and sewer lines were discussgd, Barrus stated that his Engineer is working on this and will go the best route. Williams requested that a landscape plan be placed on file. Barrus stated building should be started within the.next six months. Brewer requested that a sprinkler system be installed. Rex Black, Council Executive, was present and stated that there was a need for Council service more geographically centered. Cecil Thomas has given the land, 85 feet wide by 512 feet long, which is adjacent to the City, to the Scout Council for Annexation. Black stated this location is right off the Interstate and for example, the people of Mountain Home would be much happier coming there than going to the present location back of Fort Boise. Black stated thJs is an adult office, not a youth center, primarily for administration. Orton pointed out that the developments across the highway are all pulling together to'bring water and sewer :line across the Interstate. It would be quite awhile before the water and sewer is brought across the Interstate. Are they prepared for that wait. Black stated that they are,prepared.and it may be that one individual, who he did not wish to disclose the identity of, is interested in constructing the building. If the water and sewer is too long out of the way, they may come ' back and ask for a well and a septic tank. The use would be very light as for as sewer system. Mitchell questioned the adjoining access to the LDS Deseret Complex. Black stated that they have an agreement for a permanent easement to use the LDS Complex entrance. They are not using their own land for the entrance. Sharp expressed concern of putting more non-profit, non -tax paying entities clear out on the fringe where it will be difficult for the Police and Fire Department service.. Closer in would not be as costly. Black stated that he felt there was not better location as far as servicing the Scout Council. Mitchell asked if this was supported by United Fund. Black stated yes, that 20% of their operating budget from United Way, the rest is through substaining membership enrollment,a minor portion through campaign activity and fees. They are not a government agency. The Motion was made by Orton and seconded by Hinrichs that the Commission recommend approval of the Scout Annexation, subject to compliance of water and sewer requirements, design review, landscaping, construction of acceleration and deceleration lanes, subject to Fire and Police approval, and subject to the proposed zoning ordinance. Motion Carried: Orton, yea, Hinrichs, yea, Mitchell, nay, Pipkin, nay, Chairman Don Sharp broke the tie by voting yea. Agenda Home Federal Savings and Loan Ernest Lombard was present, representing_. Lombard displayed map of design . pointing out that the Highway Department has approved this plan. The building has been moved to the north, access points were pushed away from the intersection. The same type of building has won a design award. Trees have been saved and landscaping includes more trees. Lombard stated that a variance on alley side or dead end street side was needed. There is 5 feet from north property line to foundation. Pipkin stated that the F. First St. exit is a•concern. There would be the crossing two lanes plus a left turn lane besides this being a busy intersection. Lombard said there is very little business through the drive-in window. The Motion was made by Mitchell and seconded by Hinrichs that the Home Federal Savings and Loan be granted a one (1) foot variance on the north property line, but highly request a "right-turn,only" of the exit onto E. First St. Motion Carried: All yea.
