Attached is a copy rezoning report for your review. The Board of County Commissioners respectfully requests that the City of Meridian indicate whether this rezone application is in compliance with the land use policies for the City of ;Meridian. The County does not wish to grant a•rezone request that would',be contrary to the adopted Meridian Comprehensive Plan. The Board of County Commissioners feels that commercial rezoning. should be scrutinized very closely in relationship to the Comprehensive Plans of the cities and the County. The rationale for the tabling action is as~follows; 1) The commercial use as proposed ~~ has more of an impact on, the City-of Meridian rather than the County.- 2) . In its present form, the Zoning and Development Ordinance of Meridian has a different emphasis and provisions when. compared. to the present Ada County Zoning and Subdivision Ordinance. ~3) Even though the present commercial proposal is not contiguous, i.e. city a'nnexation', the Zoning that is granted by the County should. be done in anticipation of annexation-when the proposed commercial is subject,to the jurisdictional interests vrhich are peculiar to the City of Meridian. 4) The proposed commercial-is within the scope of the Comprehensive P1an~and that Plan is adament regarding prohibiting strip ~~ Conmercial. Meridian Cit Council~~ This comment aras submitted to this office on ' ecember 7, 19 7. ,'During the Meridian City Council meeting of December 5, 1977, it was moved, seconded and passed to recommend to the County Commis- sioners~and the Ada County Zoning Commission to permit Carl Raasch of Idahp Motor Repair located at the southwest intersection of Locust Grove and Fairview Avenue to rezone from.R-4 to C-3 Service Commercial." At the time of the writing of the staff report we had not received comments from the Meridian Fire District, Meridian School District, Meridian Sewer, and an updated reconanendation from the Meridian Zoning~Commission or City Counc i 1•. ~ - STAFF ANALYSIS The parcel of land is located vrithin the Urban Service Planning Area of the City of .Meridian as designated on -the Ada County Comprehensive Land Ube Plan. As of this date the County and the City of Meridian have not adopted an Area of Impact statement and are still under negotiation. The City of Meridian has adopted a Comprehensive-Land Use Plan, and the County should look at that and analyze their plan in reviewing applications in their Impact Area, but the policies of the Ada County~Comprehensive Plan indi- cating development procedures in this area should be .followed. The Meridian Comprehensive Plan defines three major forms of commercial development. These being a regional shopping center, a community shopping center and a neighborhood shopping center. The Meridian.Comprehensive Plan does. not speak to a service commercial form of zoning as does the Ada County Zoning Ordinance. The form of use that the applicant currently has on the parcel would most closely be associated to the C-3 Service Cbmmer- i cial.Zone, if a commercial zone were to be approved.. This inequity between the Meridian Comprehensive Plan and the Ada County Zoning ,Ordinance may be a problem in granting a rezone on this parcel of land to a,C-3 zone. The existing use on the parcel has been in existence since 1963. In looking at the attached vicinity-map, it can be seen that only a small portion of the parcel of land was zoned commercial when the 1968 Zoning Ordinance was established. Staff does not know why the entire parcel was not zoned commercial,~if it was being put to a commercial use. Staff can`only assume that in~the adoption of the 1968 Zoning Ordinance, it was assumed that this particular use should have been a non-conforming use. The Zoning Commission and Board of County Commissioners are going to have to determine whether this parcel should be rezoned to a service commercial and~the use continued on the site or whether the use should be encouraged to locate in a more industrially developed area. Ada County Comprehensive Plan Section 5.2 of the Ada County Comprehensive Plan indicates the Facilities Plan .for the City of Meridian developed in 1976 will be used by the County as an interim guide to policies 'in the Meridian Urban Service Planning Area outside the Meridian City Limits. More definitive policies shall be adopted after Meridian has completed a comprehensive'•plan., As stated previously the Area of Impact agreement has not been established between the County and the City of Meridian concerning development within it's area. In looking at the Sewer Feasibility Study for the City of Meridian, this site would be located in the~1992 planning ]imits. The site would not be designate.d.as industrial or commercial in~the Land Use Plan that was developed for the Sewer and Water Plan. Section 8 of the Ada County Comprehensive Plan establishes the County's goals, objectives, and policies concerning commercial development. Generally these goals, policies and objectives encourage the consolidation of conuner- cial use and discourages further strip commercial development. The Meridian Plan also strongly discourages strip commercial development. Section 8.2-.6 of the Ada County Comprehensive Plan encourages the conversion of existing strip commercial development to a series of concentrated commercial areas. The main intent behind the plan is to encourage concentrated commercial areas to provide good access and preventing the proliferation of access points along a major arterial. This application. is a.t the intersection of one major arterial and one minor arterial and might be 'considered a concen- , traced node fora conunercial development. It is very h'~rd for Staff to make a recommendation concerning this application because a definitive statement has not been submitted by, the Meridian City Council since 1977 and Staff would like to know. if the City of Peridian feels this application is in general accordance with their Comprehensive Land Use Plan. '~~ It is difficult to tell whether a use of this nature is as large a traffic generater as other retail commercial uses are. It is Staff's opinion, though, a use of this nature would produce less impacts upon the arterial fr°om the standpoint of drawing commercial traffic. Staff also feels, though, that this use is of an industrial nature and should most likely be located in an industrial area. This puts Staff in a very difficult situation upon making a recommendation on this application, and Staff would like to wait until a definitive comment from Meridian is submitted concerning this ~.,; ~- application's relationship to' their Comprehensive Land Use Plan, being that the City of Meridian will be responsible for annexing and servicing this area in the future. Further, Staff does not want to make a decision that would. be .in conflict Frith the Meridian Comprehenisve Plan concerning their stance upon. strip commercial development along Fairview Avenue or other major arterials.
