Agenda 1 Hearing - Conditional Use for Sales Office, 1332 Darrah Dr., Meridian Park Joe Osier addressed the Council to request the use of the garage as a sales office, located Lot 15, Block 4, of Peridian Park fora period of three years to market that property. Mayor: "Any questions from the Council of Joes?" There were no questions. The Motion was made by Orton and seconded by Kingsford to allow the sales office Conditional Use located at 1332 Darrah Dr. as recommended by Planning and 7_oninQ fora three year period. P1otion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Mayor: "Any public comment?" Engineer Smith: "Mr. Mayor, we have been having problems making connections with Roy Johnson to get a final inspection on sewer system." Waste Water Superintendent UJard: "The service connection markers have to be resolved." The system has not formally been accepted by the City .'J Osier: "This is what he (Johnson) is working on now." Orton: "No building permits should be issued until the system is formally accepted." Agenda 2 .BSU - James Felton James Felton, Boise State University School of Technology was present. Felton: "We have been using your old wastewater facility (N.4J. 8th St.) as a training site for our students in the wastewater program and you people have indicated to us an essential interest of furthering and upgrading the facility. ble are here to talk to you about the facility and expanded use of it - the possibility of building a state training center on the property. I'm here to entertain any questions. l+le have discussed this with Mr. 4Jard, Superintendent, and are currently using the facility now as part of our training." lpJilliams: "About a year and a half ago Joe, when we were finalizing the new sewage treatment facility the question was regarding the old treatment facility on N. W. 8th St. At that time we tentatively discussed tearing it down, what the cost would be, rehabili- tating in some fashion, as some of our alternatives. Earl at that point of time suggested we contact BSU because they do have an on going water and wastewater treatment school in the vo-tech program. At that time we talked with Jim regarding the oossiblity of rehabilitating so it could be used as a state training program facility. Recently, we did offer the use of the old facility to the school on a temporary basis. After further dicussion with them, (BSU), there may be an interest in mutual beneficial use of that old plant - one, we don`t have to spend money to tear it down, there is seven acres of land out there. And two, the University school could use that facility and do some rehabilitation to make it into a good training facility,~the minimum out lay cost to the taxpayers or the State of Idaho and the City of Peridian. Also with that, the school would have approximately 2O students that would in a sense bring a small business into the City; lunch, shopping, for the economic part. The way Earl and I, and some of the other Council members, have dicussed would be to deed a parcel of that land over to BSU so that they could rehabilitate the existing facility into a training facility and build a classroom on the land so they would have available to them, Federal Funds as the stipulation is that the land be deeded to them. In talking to the Attorney, Osier: "We have a subdivision that's currently partially completed, 59 lots (displaying , map) there is actually 88 lots shown, but 59 completed and ,you follow the loop around. three model homes on them. This house (indicating These three lots are improved with , -4 1332 Darrah Dr.) is being used as a sales office out of the garage and this is what I need, a conditional use permit for -- to be used as a sales office to market 145 lots that will subsequently be in the subdivision." Hinrichs: "This is to be used as a sales office only until the subdivision is completed?" Osier: "Yes." Sharp: "In this subdivision you are conforming with all of the items you agreed to in the preliminary -final plat process?" Osier indicates yes with a nod, and displayed brochures of homes that are being sold. He stated the minimum home is 1,350 sq. ft., ranging 1,353 to 1,376 sq. ft., all two car garage, different floor plans. All custom built would have to conform to covenant speci- fications. .: Hinrichs called for public comment. There was none. The Motion was made by Lee Mitchell and seconded by Don Sharp that the Commission recom- mend to the City Council approval of a conditional use permit to Joe Osier, 1332 Darrah Dr fora sales office, fora three year period. Agenda .~~~s 2 Settlers Village Final Plat ~'k Bill Blankinship and Norm Noonan were present with the final plat for Settlers Village. ~''~~ Blankinship, displaying maps: "There are a few differences that we have made on our final plat. We were having some boundary disputes, but we have resolved these disputes and resolved these different parcels of land -- we have an agreement to resolve with the City of Meridian on the well lot. What we have done, these lots were 102 feet deep, now about 93, as we gave~Bill Curtis (to the west) about 7 feet right along his old fence line. These dimensions will be slightly different than preliminary. We had to widen lots up to keep our square footage. On that side (east side) we added about 7 feet, all along the `-l~ east side to the beginning of commercial. The Michels own the three lots fronting Fairview ~`r- and they decided to keep the previous boundary. Isle have drafted legal agreements to all f,~~ the people. On the north side, we retained the very same as preliminary -- Earl Harmon owns part and the City owns part of north boundary. We have to draw up an agreement for the City of Meridian, wherein we will agree that the plat of record is the actual boundary instead of fence line." _ There was discussion concerning survey. The legal description was - actually over seven more feet -- the fence has been there for 50 or 80 ,years inside that property boundary, so the fence is there, nobody makes a chancre within 3 ,years, a fence becomes a legal .boundary. We had to change the legal boundary to meet the fence line.. The same thing happened over here -- the fence was not on the property boundary so we moved this boundary over to match the fence." Sharp: "How do we avoid this happening in the future?" Noonan: "Well, that boundary would be the legal property descriotion, unless someone say 'my fence is there' and takes it to court. }~' Blankinship: "Adverse possession is 3 years in the state of Idaho, and what it assumes is that ,you have paid taxes w7thit~. your fence lines and so you possess this land, paid taxes on it, regardless of whether the fence is in the proper place or not." "Anytime you survey and find old fence lines you should take these into consideration. Title Companys when inspecting will question fence lines." There were at least four different survey pins on one corner within a six foot range. Everyone offically signs and agrees to the correct boundary and then leaves the correct boundary pin. Blankinship states there was a meetina_ at that one corner with the other surveyors and an agreement made at that time. The accuracy of Dan Hubbies survey was also contributed to a laser type instrument which very few surveyors have acquired. Hinrichs: "Did you clear things up with the ACHD?" Blankinship: "Yes, we've even got the bond." Spencer: "Are there any boundary disputes?" Blankinship: "No, to the best of our kno+~rledge we're straight." The motion was made by Sharp and seconded by Spencer that the Commission recommend approval to the City Council of Settler Village Final Plat be approved as amended `~? provided that the agreements are furnished to the City that proves that the boundaries are legal.
